Approval of the Army Corps of Engineers 2. Approval of the California Coastal Commission 3. That all plumbing and electrical work be done under a permit from the City Building Department _4. That the plans and specifications for the dock must be approved by the Public Works Department 5. The fire prevention equipment on the docks must be approved by the City Fire Department 6. The sunken dry dock in the water at the eastern side of the property must be removed prior to construction 7. The revised slips can be made available only to boat brokers and the only vessels berthed at the marina will be vessels for sale. The marina will not be used as a private berthing marina for private vessels. Discussion• This application is before the City Council as required by Section 5.C.3 of the Harbor Permit Policies, which state: 5.C.3. "Prior approval of the City Council will also be required before issuing a permit for shore -connected structures when (3) the upland abutting property is zoned commercial". The applicant wishes to rebuild an existing marina that is in need of extensive repair. As part of that rebuilding, applicant wishes to reconfigure the docks as indicated on the attached diagram. F-17 (2) In its new configuration the marina wouild provide berthing for at least 18 vessels. Based on Sections 17 and 19 of the Harbor Permit Policies the applicant, should be required to provide thirteen and one half,parking spaces and one men s and one women's restrooms. The applicant has indicated that the slips will be used only for vessels for sale by yacht brokers and will not be available for berthing of private vessels. In this case, the applicant has agreed to allow that the marina be so conditioned, and has asked that they be exempted from the parking and sanitary requirements. In the past, where applicants of commercial marinas have so conditioned their permit, the Council has allowed these sections (Sections 17 and 19) to be waived. He summarized areas of concern to him, as enumerated in his letter and stated that the only real issue is, "Do the Lido Shop owners have a parking agreement granting parking rights?" If so, he felt the staff should honor it. Mr. Willford stated that if the City Attorney and staff have evidence which shows that they do not have the parking rights set forth in the parking agreement, it should be presented now. Otherwise, he felt the Council should instruct the staff to honor the agreement. In conclusion, he requested that: 1) Staff specifically list what. they feel the disputes are between the owners of the parking structure and the Lido Shop owners; 2) City Council obtain its own independent legal counsel on this issue; and 3) Rather than litigate the issue in Executive Session, this matter be discussed openly in a regular City Council meeting. The City Attorney stated that he would like longer than two weeks before bringing this item back to the Council, in order that he and the staff can review the issue and make recommendations to the Council.
