Dredging —Upper Bay
RDA Contracting has moved from Unit 1 /III to Unit II (near Irvine Blvd.)
They'll be here for a couple months then move back near Jamboree Bridge area.
Project will be complete after that.
The City and Corps have
been fielding noise
complaints while working
24 hours a day.
Contractor will monitor
noise and make
adjustments).

Corps Change of Command Ceremony

Pedro.
We wish Colonel Thomas Magness well as he spends the next year in
Afghanistan.
The City looks forward to working closely with Colonel Mark Toy for the
next 3 years.
Will arrange a Newport tour of the Upper and Lower Bay project in the coming
months.

The Mitigated Negative Declaration (MND) 30 day public review
period ended on July 13.
5 Comments received from various agencies
Council will review the MND on July 27
Applications for sediment disposal at the POLB were submitted
on June 30. We now wait...

No time wasted...
Permit applications will be submitted next week.
Pre - application meetings with Coastal Commission, Corps, Water Board,
State Lands were very positive and productive — no red flags.
Requesting a November (or earlier) Coastal hearing.

Some minor last minute submittal issues - currently being resolved.
Project is expected to be construction in - mid September.
This will not affect our Rhine Wharf dredging project.
Public Access Docks
Very well received in the harbor -

Rules and Time Limits
Li Some complaints about the lack of rules.
❑ Plan is see how the docks work this summer,
then develop rules that reflect needs of the users.
Outreach at 15th St. on July 7 at 5:00 pm to listen
boater's opinions.
15th Street needs some minor cleat adjustment.
Discussed rules at MMPSC on July 8.
Intend to bring a final plan to the HC in August or
September 2010 .

Improved public dodo are a welcomed relief to harbor users. The City's Public',Vorks and Harbor Resources by Gt;
have been working on providing increased capacity for temporary dinghy 5e -ups in the Newport Harbor.
Three public docks have been improved to more than double the capacity at 15th Street, 19th Street, and

Sea Lions
Some sea lion activity in May /June. South Mooring was called
to resume his nightly patrols for a while. Relatively quiet now...
Patrols will resume later this summer.
Sea Lion stickers will be reprinted and sent to fishing, charter,
rental industries.
Relying on the Harbor Patrol to help identify problem areas and
to help contact mooring permittees.
It is a violation to feed
wildlife in Newport Bay
N.B.M.C. 7.30.010
Other Issues
Mooring Administration
Contract with the Harbor Patrol approved by Council on June 22, then by
the County Board on June 29
Major highlights
County will remit all mooring rental fees (over City Tidelands) back to the City.
County is installing a credit card reader at the front desk for
convenience to boaters. Operational within —1 month.
County will perform a "head check" (dye tablets & Y- valve) for every
rental (with another check if rental is >30 days.)
Enforcement of NBMC including issuing Notices of Violation and
Administrative Citations on behalf of the City.
More active involvement in mooring revocation process.
Assist the City in identifying live aboard violations.
Cooperative approach to sea lion control.
County will adopt guest mooring fees, then the City will adopt those
fees in the Fee Schedule.
Other Issues
Harbor Commission and Planning Commission joint
meeting date TBD (-September).
Harbor -wide Eelgrass Survey (every 2 years)
Currently underway since late 2009.
Entire perimeter of the harbor is physically mapped for eelgrass by
divers (generally from Bulkhead to Project Line). About 60% complete.
Helpful to gain an understanding of eelgrass trends.
Currently, it appears that eelgrass has been receding since the last 2007
survey.
Marina Park
Working with consultants (Moffatt and Nichol) to submit permit
applications soon.

RE: PROPOSED COASTAL MARINA PERMIT
Currently, the Stale Water Board is temporarily suspending its work and the release of
a draft Coastal Marinas Permit in order to further its work with stakeholders on marina
and coastal waters issues. The State Water Board with the cooperation of stakeholders
and other agencies is gathering additional fads and information on these issue, and is
exploring both regulatory and non - regulatory solutions along with stakeholders on how
to preserve the beneficial uses of our coastal waters. Ongoing developments will
continue to be communicated to key stakeholders and the public as they become
available. A few of the ongoing activities at this time are discussed below.
In terms of information gathering, the Stale Water Board is anticipating the findings of a
$727,000 federal grant funded study conducted by the Unified Port of San Diego to test
safe alternatives to copper -based antifouling paints. The State Water Board expects
findings from this study to be released in December 2010. The Stale Water Board is
also working closely with the Department of Pesticide Regulation (DPR) in its
reevaluation of copper -based antifouling paints. Further information on this subject is

As a non - regulatory course of action, the State Water Board is evaluating recognition
of the California Clean Marinas Program (CMP). This program consists of a voluntary,
self- implemented set of best management practices (BMPs) aimed at maintaining water
quality. CMP is in the process of strengthening its program in response to a review
conducted by the Marina and Recreational Boating Interagency Coordinating
Committee.
The State Water Board plans on revisiting the decision of what the most appropriate
course of actions are in safeguarding water quality at coastal marinas by March of
2011. Any ultimate decision will be based in large part upon additional information
provided by ongoing studies and informational efforts, as well as the feasibility of
alternative, voluntary compliance efforts, such as CMP.

Other Issues
D Boats Blocking Channels During Events
At a recent HC meeting, the Harbor Patrol requested that the City look
for ways to prohibit vessels from blocking channels during events like
the Christmas Boat Parade.
Municipal Code 17.20.20.13.3
"Restriction of Water Traffic. For such time as necessary
preceding, during and after any race, regatta, parade or other event
held on the waters of Newport Harbor, or at any other time when
the City Manager deems it necessary for the safety of persons,
vessels or other property, he shall have authority to restrict or
prohibit waterborne traffic in the harbor, and it shall be unlawful to
willfully fail or refuse to comply with any order, signal or direction of
the City Manager, his deputies or agents. For purposes of this
section, waterborne traffic shall mean any object, structure or
vessel in contact with the water. "
