Regional General Permit (RGP -54)
Permit Expired in October 2011
However, eelgrass surveys are prohibited between November —
February. Therefore, March 1 is when the permit effectively ended.
Sediment Chemistry Report completed March 5th.
Applications to the agencies are last hurdle
Coastal Commission has stated it would be relatively simple, and could
get approved by June (assuming application submitted by April 20)
Corps requires 120 days, but that could be shorter, maybe
Water Board — unknown at this time.

RGP -54 — Historical Use
For Dredging
2007 = 16
2008 = 16
2009 = 9
2010 = 7
2011 = 5
(Eelgrass is a factor in these low numbers.)
For Dock Construction
2007 -08 = 38
2009 = 3
2010 = 5
2011 = 0
(The Permit only allows for like- for -like reconstruction — most folks want to
change configuration. Permit does not help dock projects.)
RGP -54 (cont.)
Sediment testing for previous 5 year permit: $300,000
Sediment testing for current, proposed 2 year extension:
$125,000
Permit fee for the City: $1,640

Updated California Eelgrass Management Plan
(NMFS sponsored)
ii Update to the current plan
L If Newport specific plan is adopted, then this won't have a
drastic effect
Several important proposed changes:
- Increased extent of eelgrass beds
Includes all eelgrass plus a 30' buffer area (even if there is no
eelgrass in that buffer area!)
Expanded definition of eelgrass bed
A single plant equals a bed
Bathymetric surveys required
Hydrodynamic surveys required for projects that may affect currents
. Increased complexity of mitigation determinations

This stale's more than 3 million boafnv enlhui asLL must have a department with a Director ashow
Versus" focus u boating. Cal Boating has a compact organizational structure and administers boating
programs in a thnely end non- bumucmtic manner. Its smtmnry chamr is directly boating- related.
While 1 understand the importance of finding savings during these difficult times, eliminating Cal Boating
would not help resolve the state's fiscal problems, and would jeopardize programs ead services which the
boating community has determined to be essential and is willing to finance.
1 urge you to withdraw your proposal to eliminate the Depermem of Boating and Waterways (Cal
