We respectfully request that the Harbor Commission re -think their decision to advise the Harbor Resources Manager to approve the Invictus request to moor in Newport Harbor from August 26- October 3. It is totally inappropriate to park a vessel 2/3 the length of a football field, wider than most lots on the bay and the equivalent height of a 5 story building in front of anyone's home or business on the bay. While we understand and encourage the Harbor Commission's goals to promote Newport Harbor as a preferred and welcoming destination for both large and small vessels, it is premature to promote Newport Harbor as a destination for mega - yachts until such time as they have a dock with shore power to put them on in an appropriate location that will not impede views of the bay, limit access to docks, and create a nuisance with the generator running 24/7 for an extended period of time. As we are sure that you are aware, vessels of that size require the continuous power of multiple generators to run all their systems when they are not connected to shore power. Now would be the time to explore the relocation of the docks in Lido Village as was recommended in the Lido Village Design Guidelines to accommodate not just the charter boats, but visiting mega - yachts as well. Until then, the City /Harbor Commission should not grant licenses or approve a mega -yacht to anchor in front of our home if that steps on our right to the quiet enjoyment of our property. It is of further concern that there may be a conflict of interest with one of the sub - committee members who we heard was acting as a paid agent for one or both of the vessels. We hope that this is not the case. Please share our comments with the appropriate members of the City Council and Harbor Commission. I have several questions that I hope will be addressed at your meeting tomorrow. I understand the Commission wants Newport Beach to be a destination for multi- millionaires' yachts and cruise ships, to stay months in front of homes, at the expense of the property owners as well as at the expense of the magical beauty of the open water of the bay. In my opinion, you short -change the visual impact of the open bay from the bridges, restaurants, wedding cruises, sailors, power boaters, kayakers, stand -up paddle boarders and others. It's beauty is what makes people want to come here to see it, to recreate, to spend money to eat and shop here, and to pay dearly to live here. Here are some specific questions related to the ships: 1. What is the "noise ordinance" you propose as a condition of allowing the ships in front of our homes? The wedding cruse ships and the bay front restaurants are not allowed to pipe music outside. The noise ordinance for Newport Beach parties prohibits music piped outside. Will the same ordinance hold true for the ships? What about the noise of generators running to operate the ships, systems? Will they be audible to the homeowners, and will there be a curfew for their operation? 2. What additional Harbor Patrol enforcement measures are proposed to timely respond to noise or other complaints? As it is, if the Harbor Patrol is called on issues it deems insignificant as compared to whatever else it prioritizes, it usually takes an hour or two for the Patrol to respond, if it responds at all. 3. The 120 -foot ship is three stories above the water line and the size of one of the cruise ships that travel through the harbor conducting weddings. Those boats seat 150 people for dinner. How many passengers will the 120 -foot ship have? How do you anticipate they will get to shore and back? Is this the "reason" for the proposed Lido Bridge public dock? 4. How high is the boat above the water line? The occupants of the boats will look right into the windows of the homes, even into the second stories. Have you considered the impact on the privacy of the residents, or the impact on the view of the bay the owners paid for when they purchased their homes? 5. You haven't provided a photo of the other ship you propose to anchor in the harbor, but I would have the same questions as for the 120 -foot ship. In addition, if you allow the ship to swing, it will take up a large and variable portion of the harbor and make it even more difficult for residents' and the sailing club's boats to exit and enter their slips. 6.. How far off the existing docks (plus the additional boat length allowed past the docks) is the proposed location of the visiting ships? As shown in the diagram, it appears boats entering or exiting their slips will have a difficult task, especially when backing into their slips. 7. Is either one of the ships a commercial boat, and if not, are there plans to allow commercial boats of similar size, wedding or otherwise, to park in front of our homes? 1 8. What is the Commission's analysis of the financial benefit to the City from allowing the ships to stay in the bay without obtaining slips as less wealthy boaters must? There will surely be a financial loss, both to the City and the owners of the homes, when property values decline on properties impacted by the huge vessels parked in front. 9. Do you propose to have such vessels in place during the Christmas Boat Parade blocking the views from the homes and from Lido Bridge, further eroding the property values of the surrounding properties? The biggest question I have is why the Commission is considering this idea? It seems the Commission keeps trying to "improve" the bay by taking away what makes the bay so beautiful and therefore so valuable. First came the ill- conceived visiting boat anchorage that imposed noise, drifting boats, and a three -ring circus that affected not only the residents but the boaters themselves. With the growing numbers of individuals on paddle boards and in kayaks in our part of the bay, it was a stroke of luck no one was hurt. Now, why turn the only truly open space in the bay into a parking lot for the wealthy? Frankly, for some time it seems the homeowners in this area have been continuously fighting the Harbor Commission's actions in our part of the bay. We have fought the Jet Lev's noise and the wakes that knocked our boats around, the ill- conceived parry-town boat anchorage last summer, and now I understand there are plans for a public dock off the Lido Bridge beach, right in the midst of this residential neighborhood. The homeowners should at least be made aware of the Commission's rationale for all the efforts that negatively affect our properties and whether there's some kind of master plan or purpose for this residential area that we're not aware of. I hope we can be enlightened at the meeting. I do thank you all for the work you do, as well as thank you for your consideration of my comments.
