CALL TO ORDER—The meeting was called to order at 3:30 p.m. Staff Present: Brenda Wisneski, Zoning Administrator Jaime Murillo, Senior Planner Benjamin Zdeba,Assistant Planner B. MINUTES of February 12, 2015 Action: Approved C. PUBLIC HEARING ITEMS ITEM NO. 1 Byers Residence Parking Modification (PA2014-219) 224 Coral Avenue CD 5 Benjamin Zdeba, Assistant Planner, provided a brief project description stating that the applicant is requesting a modification permit to exceed the maximum 10-percent addition allowed due to the existing nonconforming garage that does not meet the minimum dimensions required by the Zoning Code. He also described the property as "L"shaped and stated that it is comprised of a lot and a portion of two lots with the garage placed on the narrower 30-foot wide portion. He further indicated that expansion of the garage to comply with the current Zoning Code requirements would eliminate an unrequired third-car parking space and confirmed that the garage was built in conformance with the Zoning Code at the time it was constructed. Applicant John T. Morgan,Architect, on behalf of property owner Dan Byers, stated that he had reviewed the draft resolution and the required conditions. The Zoning Administrator opened the public hearing. One member of the public, Jim Mosher, expressed concern regarding the existing side yard parking and access to trash cans. There were no other public comments and the Zoning Administrator closed the public hearing. After expressing support that the existing two-car garage is large enough to accommodate two vehicles, the Zoning Administrator approved the Modification Permit request. Action: Approved ITEM NO.2 Shiloh LLC Lot Merger (PA2014-223) 4607 & 4615 Brighton Road CD 6 Jaime Murillo, Senior Planner, provided a brief project description stating that request is to merge two (2)lots on the bluff side of Brighton Road in Cameo Shores into one (1) parcel. The lots were previously merged through a lot line adjacent in June 2007; however, that permit has expired. The two (2) lots are currently developed with single-unit dwellings; pending approval of this lot merger, one (1) will be demolished and an addition will be constructed on the remaining single-unit dwelling. The merger will not consist of an excessively large lot in comparison to the existing lots in the area, particularly since the property to the south was previously merged and consists of three (3) legal lots. A member of the public, Mr. Jim Mosher, commented that the lot merger application should be submitted to the Coastal Commission for review and that lot mergers such as this reduce opportunities for the public to live adjacent to the coast. There were no other public comments. The Zoning Administrator commented that the applicant will be responsible for submitting the plans for the expansion of the existing dwelling to the Coastal Commission for review and approval. Seeing that no one else from the public wished to comment, the Zoning Administrator closed the public hearing and approved the lot merger request. Action: Approved ITEM NO. 3 Edson Residence Modification (PA2014-138) 2140 East Ocean Boulevard CD 1 Jaime Murillo, Senior Planner, provided a brief project description stating that the request was for a 43- percent addition to an existing single-unit dwelling with nonconforming parking. He stated that the Modification Permit was necessary for additions larger than 10-percent on properties with nonconforming parking. He indicated that the property's garage was constructed in 1987 with Code-compliant dimensions in effect at the time. Subsequent to the addition, the attic area was converted to living area without the benefit of permits. The primary purpose of this application request is to legally permit the conversion. In addition, the depth of the garage is being expanded to the current required depth of 20 feet; however, due to constraints associated with relocating a load bearing wall, a practical hardship exists with widening the garage. A member of the public, Mr. Jim Mosher, commented that there is an inconsistency with the addressing. The City utilizes Ocean Boulevard as the legal address; however, the County Tax Assessor and Post Office utilize East Ocean Boulevard. Mr. Mosher suggested that inconsistency be resolved. The Zoning Administrator approved the modification permit request based on the scope of work and the facts in support of the findings. Action: Approved D. PUBLIC COMMENTS ON NON-AGENDA ITEMS None. E.
