In addition, the proposed beach disposal events have been reviewed and found by the Executive Director to be consistent with Special Conditions 1-3 and 9-12 of Coastal Development Permit 5-99-282, as amended. No further review is necessary from the Commission for the beach disposal components of the projects. Please be advised that only the projects described in the materials submitted for the sites listed above have been found to conform with Consistency Certification CC -078-99 and CC -077-01 and/or conform with the terms and conditions of Coastal Development Permit 5-99-282, as amended. Furthermore, you must comply with the following non -discretionary Special Condition: -2- 1. The permittee shall ensure that there are no direct impacts to onsite eelgrass beds and/or patches to be avoided. Prior to the commencement of construction activities, the permittee shall flag with surface buoy(s) the limits of the dredging footprint, as shown on the approved dredge application, to delineate areas of impact permitted within waters of the U.S. Any additional acreage impacted outside of the approved dredge footprint resulting in a direct impact to eelgrass would require mitigation at a 1.2:1 ratio, per the Southern California Eelgrass Mitigation Policy. As long as you comply with the general permit conditions of RGP No. 54 and the Special Condition, an individual permit is not required. This letter of verification is valid until July 24, 2005, when RGP No. 54 will expire. A general permit does not grant any property rights exclusive privileges. Also, it does not authorize any injury to the property or rights of others or authorize interference with any existing or proposed Federal project. We also noted extensive amounts of trash dumped on the bottom between 27 and 28 Harbor Island, on the inside edges of the docks. We did not find eelgrass directly underneath the dock, but within 15 feet of the dock. Also, small patches of eelgrass within the 27 HI slip. Hope this helps. (I used California Grid Coordinates on the City site to check our positions on the eelgrass maps.) RATIONALE: The subject site is a lot located between the first public road and the sea and is a bayfront lot. The subject site is also located in the locked gate community of Harbor Island in the City of Newport Beach. No public access currently exists through the site. However, the project will have no impacts on existing coastal access. Public access to the harbor exists in the area across the channel from the Harbor Island community along the public walkways on Lido Island and Balboa Island. An inspection by the City of Newport Beach Fire and Marine Dep artment states that no del grass is present within 15' of the project area, thus no eel grass will be impacted by the proposed project. In addition, the Regional Water Quality Control Board has determined that the pr o0osed project will not adve rsely impact w . ater quality if standard construction methods and materials are used. The proposed project design is compatible with the character of surrounding development and does not have any negative affects on visual or coastal resources, public recreation or coastal access. Also, the proposed development will not prejudice the City's ability to prepare a Certified Local Coastal Program and is consistent with the land use designation in the City's certified Land Use Plan, past Commission actions in the area and Chapter Three policies of the Coastal Act. This waiver will not become effective until reported to the Commission at their february 13-16, 2001 meeting and the site of the proposed development has been appropriately noticed, pursuant to 1 3054(b) of the California Code of Regulations. The Permittee shall not attempt to forbid the full and free.use by the public of all navigable waters at or adjacent to the work or structure. If the display of lights and signals on any work hereby authorized is not otherwise provided by law, such lights and signals, as may be prescribed by Bureau of Light Houses, Department of Commerce, shall be installed and maintained at the expense of the Permittee. Structures shall be so constructed as not to obstruct, interfere with or prevent the free use or passage of any sidewalks, street, alley, public way or navigable channel. F . Liability for Damages: The Permittee is responsible for all liability for personal injury or property damage which may arise out of work herein permitted, or which may arise out of the use or possession of said works, and in the event any claim is made against the City of Newport Beach or any department, officer, or employee thereof, though, by reasons of, or in connection with such work, permittee shall defend, indemnify and hold them and each of them, harmless from such claim. G. Revocation of Permit: The rights given under this permit are permissive only and the City of Newport Beach reserves full right, power and authority to revoke this permit at any time. In the event the Permittee fails to remove said works within the time specified, then the Marine Safety Depart- ment shall have the right to immediately remove same at the cost and expense of the Permittee. H. Repairs: The Permittee shall keep the structures in good repair at all times. Failure to repair, when written notice has been given by the Marine Department, shall be cause for the revocation of the permit. *Amended - October 26, 1976 Ila H-1 HARBOR PERMIT POLICIES - I. Pollution Control: The Permittee shall maintain the area delineated on the harbor permit free and clear from beached or floating rubbish, debris or litter at all times. Adequate safeguards shall be maintained by the Permittee to avert any other type of pollution of Newport Harbor from recreational and/or commercial use of the tidelands. Failure to comply with the provisions of this section shall be cause, after written notice has been given to the Permittee by the City, for the revocation of the permit. When unusual circumstances arise with respect to the collection of debris or litter, the City Manager may authorize by the use of City forces or by contract the' removal of said debris. J. Rights to impose rental or other charges: The approval of the foregoing permit by the City of Newport Beach shall not constitute a waiver of any rights which it may now have or hereafter have to impose rental or other charges in conjunction with the maintenance of the proposed facility and user of the same. The imposing of tidelands rental, or use, fees shall not be extended to include private residential piers and slips, constructed and used solely by the abutting uplands owner for recreational purposes, unless otherwise directed by State Mandate. *K. In those areas of the harbor where the piers and floats are bayward of residential zoned areas and are reserved for the occupants of the abutting upland property, liveaboards shall not be permitted. SAFETY REQUIREMENTS A. All commercially operated boat docking facilities shall be equipped with fire fighting facilities as specified by the Fire Chief of the City of Newport Beach. B. Any electrical service upon any pier, dock, or float shall be installed under a permit obtained from the City of Newport Beach Community Development Department. C. Any domestic water service upon any pier, dock or float shall be installed under a permit obtained from the City of Newport Beach Community Development Department.
