County hereby grants to permittee the right to use and occupy a portion of those lands, commonly referred to as "Tidelands", conveyed to County of Orange on May 25, 1919, by Act of Legislature of the State of California. This permit is issued subject to applicable Ordinances of the County of Orange. Validation of permitted use may be subject to approval of the Coastal Commission, U.S. Army Corps of Engineers, City of Newport Beach and other regulatory entities. B. This permit maybe revoked by County and permittee agrees; upon notification from the Director of Orange County Community Resources, or his designated representative, to remove; relocate, reconstruct or modify subject pier; including floating dock and ramp, at no expense to County. If litigation is required by County to enforce the terms of this ,permit because of breach or default by permittee, County shall be entitled to recover from permittee administrative and legal costs. C. Permittee agrees to maintain the permitted facilities in good and substantial repair and condition. All improvements shall remain the property of permittee during the term's of this permit, County.shall have no obligation to permittee for the condition of the improvements. Permittee shall make all necessary repairs or improvements, including, but not limited to the maintenance of piers, moorings, buoys, walkways, plumbing and electrical installations (including lighting). By acceptance of this permit, it is understood and agreed that the term of this permit is for a maximum period of twelve. months and expires to coincide with liability insurance renewal of the year issued. October 29s, 2010 Field Survey 1.0 INTRODUCTION 1.1 PROJECT- BACKGROUND AND PURPOSE Coastal Resources Management (CRM) conducted an eelgrass (Zostera marina) habitat survey at 31 Harbor Island, Newport Beach, CA 92660 on October 29th, 2010. The purpose of the investigation was to determine the potential environmental effects resulting from the replacement of an existing gangway and dock at the project location. The project site is located along the southern perimeter of Harbor Island, in the mid-section of Newport Bay (Figure 1). The site coordinates are 33.60971 0.54' N, 117.90221 ° W. The proposed development includes removal of the existing dock, gangway, and eight support piles and replacing it with a dock of equal dimensions and the same number of piles within the same footprint as the dock to be removed. The purpose of these improvements is to provide a stable platform for passengers to access vessels and to improve the structural integrity of the dock. Site plans for the dock are provided in Appendix 1. 1.2 IMPORTANCE OF EELGRASS Eelgrass (Photograph 1) is a marine flowering plant that grows in soft sediments in coastal bays and estuaries, and occasionally offshore to depths of 50 ft. Eelgrass canopy (consisting of shoots and leaves approximately two -to -three feet long) attracts many marine invertebrates and fishes and the added vegetation and the vertical relief it provides enhances the abundance and the diversity of the marine life compared to areas where the sediments are barren. The vegetation also serves a nursery function for many juvenile fishes, including species of commercial and/or sports fish value (California halibut and barred sand bass). A diverse community of bottom -dwelling invertebrates such as clams, crabs, and worms live within the soft sediments that cover the root and rhizome mass system. In Newport Bay, eelgrass grows throughout the Entrance Channel and throughout many regions of the Lower Bay and the southern one-third of the Upper Bay at depths ranging between the low tide zone to -25 ft MLLW (Coastal Resources Management, Inc. 2005, 2010a). Eelgrass meadows are critical foraging centers for seabirds (such as the endangered California least tern) that seek out baitfish (i.e., juvenile topsmelt) attracted to the eelgrass cover. Lastly, eelgrass is an important contributor to the detrital (decaying organic) food web of bays as the decaying plant material is consumed by many benthic invertebrates (such as polychaete worms) and reduced to primary nutrients by bacteria. Because of the high ecological value of eelgrass meadows, it is important to document the location and amount of eelgrass in areas of proposed waterside developments and to mitigate any losses by avoiding or reducing, or compensating for any adverse effects on eelgrass habitats and communities. 31 Harbor Island, Newport Beach, CA 92660 Coastal Resources Management, Inc. October 29'h, 2010 Field Survey 2.0 SURVEY METHODS An eelgrass habitat survey was conducted by CRM biologists Rick Ware and Tom Gerlinger on October 29th, 2010 between 0900 and 1200 hrs. The survey was conducted using Wide Area Augmentation System (WAAS) GPS (Global Positioning System) technology and a Thales Mobile Mapper GPS/GIS Unit to map eelgrass areas and smaller eelgrass patches. Area reconnaissance transect surveys were first conducted to determine the location of eelgrass. A biologist in a kayak equipped with the GPS then followed a SCUBA -diving biologist who towed a surface buoy to mark the perimeter of identified eelgrass vegetation. The estimated GPS error of the Thales Mobile Mapper unit with post -processing differential GPS correction is less than one meter. GPS data were initially entered into the Mobile Mapper Software and then transferred into GPS TRACKER and ARCVIEW GIS software. The amount of eelgrass habitat in the project area was calculated using ArcView 10.0 and Mobile Mapper Software. Replicate 0.07 square meter (sq m) eelgrass shoot density counts were made by the field team at several locations in the shallow, mid, and deep sections of the survey area. These counts were then standardized to one square meter estimates. Depths were standardized to Mean Lower Low Water (MLLW) based on tidal predictions from the NOAA Newport Bay Entrance (Corona del Mar) tide station. 3.0 RESULTS 3.1 PHYSICAL CONDITIONS The survey was conducted under clear skies. Underwater visibility ranged between 2 and 5 feet (ft) and the water temperature was 64 degrees Fahrenheit. Sediments varied between fine sand and silts. Coarsest sediments were found at the shallowest depths proximal to the bulkhead. The dive survey extended between the bulkhead and 33 feet (10 meters) past the end of the existing dock, a distance 124 ft (37 meters). Survey area depths varied between 0.0 ft and -11.0 ft MLLW. rcii►� �►� ICel.7r.� � Eelgrass vegetation was located within the limits of the project area surrounding the existing dock structure at depths between -0.5 ft and -5.4 ft MLLW. This vegetation is a subset of eelgrass beds and patches that have historically extended along the south and west -facing bulkhead of Harbor Island (Coastal Resources Management, Inc. 2005, 2010a). The extent of eelgrass surrounding the project area dock is shown in Figure 3. The total amount of eelgrass mapped was 917.1 square feet (sq ft), or 85.2 square meters (sq m). October 29d% 2010 Field Survey Additional eelgrass was mapped on the west side of dock to the west of 31 Harbor Island along the dock's headwalk, but not included in the project area eelgrass area calculation. Eelgrass in the focused project area was located immediately west, north, and east of the existing 31 Harbor Island dock. Most of the eelgrass was found in small -to -medium sized patches although several very small patches (less than 4 square meters) were found scattered throughout the area and likely represent new growth centers along the inshore edge of the eelgrass zone. No eelgrass was located within the 31 Harbor Island boat slip. 3.3 EELGRASS TURION DENSITY An eelgrass turion is a unit consisting of a shoot and attached blades (Figure 2). Turion density provides a quantitative measure of the cover of eelgrass (low density, medium density, high density). Eelgrass turion density was moderate, and averaged 113.6 +/ 35.7 turions per/sq m (n=20 replicates). Individual turion density counts ranged between 57.1 and 171.4 turions/sq m. Comparatively, eelgrass shoot density on the west -facing bulkhead of Harbor Island averaged 253 turions/sq m in June 2004; 105 turions/sq m in July 2008; 59 turions/sq m in May 2009; and 90.2 turions/sq m in August 2010 (Coastal Resources Management, Inc. 2005, 2010a, and 2010b. 3.4 CAULERPA TAUFOLIA No invasive algae (Caulerpa taxifolia) was observed at the project site by Mr. Rick Ware (NMFS/DFG certified invasive algae surveyor). The agency -required invasive algae survey form is presented in Appendix 2. 3.5 OTHER MARINE LIFE Subtidal invertebrates identified during the survey included the burrowing anemone Pachycerianthus fimbriatus), the anemone Epiactis sp. (on eelgrass blades), bay scallops (Argopecten circularis), and sea pens (Stylatula elongatus). Fishes observed during the dives included round sting ray (Urolophus halleri), barred sand bass (Paralabrax nebulifer), kelp bass (P. clathratus), black surfperch (Embiotoca jacksoni), and topsmelt (Atherinops affnis). The piling fauna was dominated by the mussel Mytilus galloprovincialis, barnacles (Balanus glandula), encrusting sponge (Haliclona sp), solitary tunicates (Ciona intestinalis, Styela plicata), and colonial tunicates (Botryllus/Botrylloides complex). There were no State of California or Federal listed endangered, threatened, or rare species of plants, invertebrates, fishes, or marine mammals at the project site. 5 31 Harbor Island, Newport Beach, CA 92660 Coastal Resources Management, Inc. October 29w, 2010 Field Survey 4.0 IMPACT ASSESSMENT 4.1 PROPOSED CONSTRUCTION METHODS (SOURCE: MARK FALCONE) The construction period will be two -weeks (demolition through construction). No dredging will be required for the project. Waterside equipment will include a 40 ft by 20 ft boom barge. The barge will be on the site for 4 days. No other equipment will be used. Anchors will not be used to maintain the position of the boom barge. Project tasks include the removal of an existing two -finger, 88 foot -long "U-shaped" float, gangway, and eight, 16 -inch support piles. The new dock system will be composed of a new 88 foot -long "U" -shaped float with 6 ft -wide and 8 ft -wide fingers, a 4 ft wide x 26 ft long wood gangway, and eight, 16 -inch diameter cement piles (See Appendix 1). Hydraulic jetting methods will be used to place the 16 -inch support piles from the boom barge. 4.2 IMPACTS ON WATER QUALITY AND EELGRASS BED RESOURCES The location of eelgrass habitat relative to the proposed dock layout is shown in Figure 4. Small patches (0.1 square meter) and small eelgrass beds (up to 436 sq ft in size) are located at the inshore, head -walk portion of the dock to be removed or the dock to be constructed. Several of these are located within 10 to 15 ft of where proposed hydraulic jetting activity for placement of the guide piles will occur. Other larger patches of eelgrass on the south side of the existing pier are located greater than 25 ft away from proposed hydraulic jetting activity. 4.2.1 Construction Activities Potential Water Quality Impacts on Eelgrass Habitat. During the pile removal and emplacement process, jetting methods will result in the resuspension of fine sediments into the water column, and will create a turbidity plume in the local area. Turbidity may also increase if vessel propellers impact the bay floor or prop wash stirs up bottom sediments. To limit the dispersion of the turbidity plume, a silt curtain and boom system should be placed around the jetting operation to limit potential water quality impacts. An alternative, less -invasive method of placing the piles would be to drive the piles into the sediments rather than to use hydraulic jetting methods. Pile driving would lessen the potential loss of eelgrass in the immediate vicinity of the guide piles. Implementing other Best Management Practices (BUTS) that will eliminate any disposal of trash and debris at the project site will assist in preventing water quality and eelgrass habitat degradation. October 29`", 2010 Field Survey Potential Vessel -Related Impacts on Eelgrass Habitat. The shallow bay floor at the project site is vegetated with eelgrass (Figure 4). Consequently, the boom barge working near the dock has a potential to impact eelgrass through (1) the deployment of anchors and anchor chain within eelgrass habitat, (2) grounding of the barge over eelgrass habitat, and (3) propeller scarring and prop wash from the barge or support vessels for the barge. These events would create furrows and scars in the eelgrass bed and result in a significant and adverse loss of eelgrass. Such impacts would require the implementation of an eelgrass mitigation program to restore eelgrass to the project site, per requirements of the National Marine Fisheries Service (NMFS) Southern California Eelgrass Mitigation Policy (NMFS 1991, as amended). If the boom barge is positioned over eelgrass and left in place for several days, the barge will shade eelgrass vegetation that may result in a dieback of eelgrass. To prevent this from occurring, the boom barge should not be positioned over eelgrass patches or beds. Implementing Best Management Practices and adhering to the measures identified in the Eelgrass Protection Plan (Section 5) will reduce the potential loss of eelgrass related to vessel activities. 4.2.2 Direct (Construction) Impacts on Eelgrass Habitat Related to New Dock Structures Dock and Piling Removal and Installation. ler the dock or support piles will be directly placed within eelgrass vegetation. However, particular attention should be given to controlling turbidity and minimizing the spread of any tailings created during pile jetting operations to reduce the potential for burial of nearby eelgrass. No eelgrass is present within the footprint of the proposed dock or support piles, but small to medium sized patches of eelgrass are located nearby. These patches could be adversely affected through burial or physical disturbance. With the implementation of Best Management Practices (Section 5), eelgrass beds have a lower potential to be affected by the removal of the old dock and guide piles, and the installation of the new dock and guide piles. Post -construction eelgrass surveys, required under the Southern California Eelgrass Mitigation Policy (NMFS, 1991 as amended) will be conducted to determine any actual direct construction impacts. If impacts occur, then mitigation for eelgrass losses must be implemented (See Section 6). 4.2.3 Indirect, Long-term Impacts Related to Structure and Vessel Shading Effects Dock and Piling Installation. The proposed dock will be located within the footprint of the existing dock with the exception that the position of the dock fingers will be transposed compared to the existing condition (i.e., the existing six-foot wide finger will be replaced with an 8 -ft wide finger, and the existing 8 -ft wide finger will be replaced with a 6 -ft wide finger). This will not affect eelgrass habitat. Since the poson of the dock will not chane relative to the existing dock strut , there will be no additional shading impacts on eelgrass. 8 31 Harbor Island, Newport Beach, CA 92660 Coastal Resources Management, Inc. A 4 -ft wide by 24 ft -long gangway will be placed at the west end of the dock and will replace a similar gangway that was located at the east end of the dock. This structure may.shade small, 0.1 square meter eelgrass patch. This is recommended as an alternative to a solid gangway decking (See Section 5). A two-year monitoring program will be implemented per requirements of the Southern California Eelgrass Mitigation Policy (NMFS, 1991 as amended) to determine shading impacts from the gangway, and other potential shading sources (vessels and structures) as discussed in Section 6.0. 5.0 BEST MANAGEMENT PRACTICES AND MITIGATION MEASURES 5.1 WATER QUALITY BEST MANAGEMENT PRACTICES During construction, the following Best Management Practices (BMPs) are recommended to reduce water quality degradation in Newport Bay and to reduce potential adverse impacts on marine resources. Removal and emplacement of the piles will be conducted using Best Available Te,,,a,�� AT) that limits the re -suspension of sediments and the creatlo oT turbidity plumes. Consider pile driving methods to place the guide piles rather than using hydraulic dredging which results in a higher probability of damage to eelgrass bed resources; 5.2 WATER QUALITY MITIGATION MEASURES Discharge of any hazardous materials into Newport Bay will be prohibited; • a silt curtain will be placed around all water -side construction activity during the construction of the dock system to limit the spread of turbidity. If prolonged turbidity is observed outside the silt curtain then the silt curtain shall be re- deployed an�ositioned in a manner to correct the problem. • debris bins will be placed at the project site. Material collected will be removed on a�aily b'asis. The amount, type, and location of any large debris (piles, dock parts, concrete, etc) that is deposited on the seafloor will be documented and removed prior to the completion of the project. Acceptable material is Globalgrid fiberglass mini -mesh grating, 1-1/4" thick, fire retardant, light gray, extra fine grit top, UV retardant. It is manufactured by: FRP Resource LLC, 119 A El Dorado St., Arcadia, CA 91006, T: 626-698-6151, F: 626-445-2198 5.4 MARINE RESOURCES PROTECTION PLAN MITIGATION MEASURES FOR CONSTRUCTION IMPACTS The following mitigation measures will be implemented during construction to avoid adverse impacts to eelgrass and other marine resources. • The project marine biologist shall mark the positions of eelgrass beds in the vicinity of the dock and gangway construction area with buoys prior to the initiation of any � e project marine biologist shall meet with the construction crew prior to construction to orient them to specific areas w ccurs; • the project marine biologist will perform weekly on-site inspections to ensure that BMPs and mitigation measures are being implemented during construction; • support vessels and the boom barge should maneuver and work over eelgrass beds only during tides of +2 feet MLLW or higher to prevent grounding within eelgrass beds, damage to eelgrass from propellers, and to limit water turbidity. The report will be presented to e resource agencies and the Executive Director of the California Coastal Commission within 30 days after the completion of the survey. Once the reconnaissance survey was completed, GPS (Global Positioning System) technology and a Thales Mobile Mapper GPS/GIS Unit were used to map eelgrass areas. A biologist in a kayak equipped with the GPS followed a SCUBA-diving biologist who towed a surface buoy to mark the perimeter of the eelgrass vegetation. Small patches that were too small for mapping were recorded as point values and an estimated size of the patch was determined by the diver. The estimated GPS error of the Thales Mobile Mapper unit with post-processing correction was approximately 1 meter. GPS data were initially entered into the Mobile Mapper Software and then transferred into GPS TRACKER and ARCVIEW GIS software. The amount of eelgrass habitat in the survey area was calculated using ARVIEW 9.3 and Mobile Mapper Software, and distances from the eel rass ve etation to the existing docks and the bulkhead was were calculated to assist in determining potential project impacts on eelgrass bed resources. An interpretation by the Harbor Resources Manager may be appealed to the Harbor Commission, as provided in Chapter 17.65." DETERMINATION: When two bay front, pier permitted properties are combined into one lot, that larger lot shall be permitted to keep both piers without penalty. In essence, the property owner is following the Zoning Code by combining both lots into one. But, under strict interpretation of the Municipal Code 17.35.020 (A)(7), the property owner would have to remove one of the two piers to satisfy the "one pier per lot" rule. This penalizes the property owner for following the Zoning Code, and it is not fair. Staff will make efforts to revise the Municipal Code to this effect in the near future.
