DISCUSSION This application is being brought to the Council for review and action because the proposed project is over County Tidelands. Mrs. Collier originally submitted an application in April of 1976 to construct the new bulkhead and revise the pier and float. The application was subsequently amended to eliminate the pier and float revision. At their April 28, 1976 meeting, the Joint Harbor Committee reviewed the application `i and. recommended approval subject to the conditions of approval. Condition #4 is the result of a condition placed on a permit obtained from Orange County Environmental Management Agency. The applicant desires approval of the new bulkhead because the existing seawall installed in the 1940's is a shallow depth wall and is in a deteriorated condition. The deteriorated condition is allowing the material behind the wall to leach through the wall into the bay. The proposed bulkhead will correct this situation as well as providing.longer panels. The applicant proposes to locate the bulkhead under consideration behind the U.S. Bulkhead Line which varies in distance from the existing wall. Existing groins are in place or will be in place on both side property lines of #24 Harbor Island � of 24 and 25). In as much as the area between the property line of Lots 24 and 25 and the U. S. ENVIRONMENTAL IMPACT: A`preliminary environmental assessment of the proposed seawall and fill has determined that few adverse impacts would result from the construction of the project. 'Durin'g construction, minor undesirable engine noise and fume impacts would occur. The navigation channel would suffer temporary partial obstructions by waterborne construction equipment. Placement of the bulkheads by jetting would temporarily increaseturbidity and sedimentation in adjacent areas. The benthic mollusc and polychaete community (bottom dwelling clams, snails,,and worms) in the project area would be permanently eliminated, as would small populations of attached animals and algae. The volume and surface area of the bay would be permanently but insignif- icantly reduced. An alternative of insertion of a new seawall in the place of the failed wall, which is collapsing bayward, would endanger the two large adjacent 'eucalyptus trees, and would accelerate the shoreline erosion during' construction." The proposed placement of the new seawall outside of the failed wall would be less costly than other alternatives and 'provide a void, into which backfill from the nearby swimming pool excavation could be placed. The two large trees would remain unaffected. The repair of the existing bulkhead would increase the property value of the involved lots. 'The new bulkhead would be stronger and higher to preclude further shoreline collapse and overtopping by high tides. No cumulative impacts would result since the proposed bulkhead will neither extend bayward'of'neighboring bulkheads nor extend to the U.S, bulkhead line. The preliminary assessment has concluded that no significant adverse impacts upon the human environment would result from this project. Therefore, atthis time, an Environmental Impact Statement does not appear to be required. The Permittee shall notify the. City Engineer at least three 3 days in advance of the date work is to begin and its completion. 5. Inspection: The work shall be subject to the supervision and approval of the City Engineer. On work which requires the presence of an employee of the City of Newport Beach as inspector, the salary and other incidental expense of such inspection during the work shall be paid by the Permittee upon presentation of a bill therefore. 6. Protection of Traffic: Adequate provisions shall be made for the protection of the travelling public. Barricades shall be placed on streets, with red lights at night, also flagmen employed, all as may be required by the particular work in progress. The Permittee shall not attempt to forbid the full and free use by the public of all navigable waters at or adjacent to the work or structure. If the display of lights and signals on any work hereby auth- orized is not otherwise provided by law, such lights and signals, as may be prescribed by Bureau of Light Houses, Department of Commerce, shall be installed and maintained at the expense of the Permittee. 7.
