Escrow # 3379-AT Sirs: The City of Newport Beach Environmental Division has received a request to transfer pier permit 150-0109-1 for the above mentioned property. The facility was inspected on December 2, 1997. We cannot transfer the pier permit until the following deficiency has/have been corrected and WE HAVE BEEN NOTIFIED OF THE CORRECTION: 1. A City -approved anti -syphon device is required at the water connection for the water supply to the pier and float. A sketch showing the approved type of device and its installation is enclosed. The device presently on the water service is no longer an approved backflow prevention device. This requirement is in accordance with Title 17 of the California Administrative Code. 2. The electrical receptacles must be either GfI or twist lock for use in a water environment. 3. The gangway is unstable and the handrail has a broken sections. The Newport Beach City Council Harbor Permit Policies state: 10.D. "At the time of transfer, all harbor structures shall be inspected for compliance with the City`s minimum plumbing, electrical and structural requirements, and the conditions of the existing permit. All structural deficiencies must be corrected prior to transfer of the permit." PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE VEN RECTED. BOX 1768, NEWPORT BEACH, CA 92658-8915 January 24, 1989 Jeanne Pitman 109 North Bay Front Balboa Island,CA 92662 Dear Ms. Pitman: I have received your letter of January 10, 1989 and the attached petition requesting that the City dredge the channel between Balboa Island and Collins Island on the north side of the bridge between the two islands. Some time ago the City Council adopted Harbor Permit Policies requiring that all maintenance dredging bayward of residential and commercial properties shall be the responsibility of the upland harbor permittee, for those zones where private piers and floats extend over public waterways. The channel where you are requesting dredging is not a main navigational channel, and is used primarily for access to the various piers and floats in that vicinity, for berthing of vessels. I would be happy to meet with you on the site and discuss this letter in more detail, if you so desire. I can be reached at 644- 3-044. We believe that a contributing factor to this ponding is that private pier utilities are routed through the public bulhead. To remedy this problem at your location in the vicinity of your pier, you must remove one conduit and grout the void and re -grout voids at two other penetrations. This work requires an encroachment permit from the Public Works _ Department. This permit can be issued over the counter at City Hall at a cost of $10.00. When you acquire the permit, the Public. Due to Park Street sewer runoffs, channel dredging north of Balboa Island, upper bay dredging, seawall repairs on the west side of Harbor Island and west side of Balboa Island we feel the channel silted in quickly and now shoals have appeared in our channel. We request the public works department to dredge this channel to remove the built up sand and silt as they have in Grand Canal. It has become very difficult for boats in our area to go in and out regardless of the tide. Thank you for your consideration of this matter. Excessive displacement of sand and silt from Park Street sewer runoffs, chanel dredgings north of Balboa Island and the Upper Newport Bay, sea wall replacement on west side of Harbor Island and west side of Balboa Island have caused the channel to become a navigational nuisance with shoals and shallow water.
