Dear Mr. Josten:
As per your request we are sending you a pier transfer
card'and instructions for transferring the pier permit.
In checking through our files we find that the permit was
never transferred to Provident Credit Union of Burlingame
because they failed to make the necessary corrections to
the structure as noted in the enclosed copy of a letter
we sent to them.
If you believe these deficiencies have been corrected,
please call and inform us. We will make another inspection
and if City requirements are met we will transfer the
pier permit after we receive your check and the signed
transfer card.

Each year the City of Newport Beach sends statements to the holders
of pier permits in Newport Harbor notifying them that the annual
pier permit fee is due. Two statements have gone to this address
and have been returned. We conclude, therefore, that the permitee
is not the person or entity shown in our records.
The City Council Harbor Permit Policies state:
10. "Permits for harbor structures are issued subject to the
condition that any improvements constructed shall not be sold in
whole or part, leased, or transferred, without the written consent
of the City"., and
4.C. "The permit is not transferrable without the written consent
of the City of Newport Beach".
10.D. "At the time of transfer, all harbor structures shall be
inspected for compliance with the City's minimum plumbing,
electrical and structural requirements, and the conditions of the
existing permit. All structural deficiencies must be corrected
prior to transfer of the permit."
We enclose "Instructions for Pier Permit Transfer". Please contact
the Marine Department for further advice on transferring the permit
for a pier, if such be necessary. If we need only make an address
change, please inform us of the correct address to use.
We call attention to the enclosed statement from the Finance
Department of the City.

Dear Harbor Permittee at 115 North Bay Front:
The sidewalk adjacent to your residence. is subject to "water
ponding" at certain times. We believe that a contributing factor
to this ponding is that private pier utilities are routed through
the public bulhead.
To remedy this problem at your location in the vicinity of your
pier, you must remove a 4 inch drain and grout the void.
This work requires an encroachment permit from the Public Works
Department. This permit can be issued over the counter at City
Hall at a cost of $10.00. When you acquire the permit, the Public
Works Department can answr any questions you may have relative to
your particular situation.

Dear Sir:
The City of Newport Beach Marine Department has recived a request
to transfer pier permit # 150-115 for the property located at
115 North Bay Front, Newport Beach, CA.
We cannot transfer the pier permit until the following
deficiencies have been corrected and we have been notified:
1. A CITY -APPROVED anti -syphon device is required at the water
connection to the pier and float (see enclosure).
2.
Electrical wiring must be in conduit that is unbroken and
3. connected to the dock. At,this time an electrical extension
.cord.is running over the bayfront,public walk way from the -
4. residence. This is a serious violation and must be corrected.
'The structure was inspected; on 12/2/87 ` and in accordance
with Section 10-D of the Harbor Permit Policies it cannot be
transferred until it meets City requirements.
10.D."At the time of transfer, all harbor structures shall be
inspected for compliance with the City's minimum plumbing,
electrical and structural requirements, and the conditions of
the existing permit. All structural deficiencies must be
corrected prior to transfer of the permit."
A permit for'plumbing'or electrical work must be obtained from the
Building Department of the City.
PLEASE ADVISE THIS DEPARTMENT WHEN THE ABOVE DEFICIENCIES HAVE
BEEN CORRECTED.. When notified, .the structure will again be
inspected and when the requirements have been met the pier permit
will be transferred.

in this year.
At this time we have received no further informatFion
as to who should be the holder of the pier permit.
As you will note from our previous letter, the pL?er
permit must be transferred to the owner of the
abutting upland property.
Mr. Ferguson, whom our records show is the holder of
the pier permit indicated to us in March that you
are now the owner of the ,.property.
I enclose a copy of instructions for transferring the
pier permit and the transfer card which must be signed
by the seller and the buyer of the property.

Dear Sir:
A check of the City Harbor Permit files has shown that the permit
for the pier and float at 115 North Bay Front; Balboa Island,
- Newport Beach, is registered to G.W. Ferguson.
A transfer application must -be completed and a transfer fee paid
each time the permit has changed ownership.
Chapter 17.24.030 of the Municipal Code addresses the transfer of
a pier permit and reads as follows:
"No person shall transfer a permit for a pier, float or
similar structure granted under the provisions of this
chapter without prior written approval of the City."
Failure to pay the transfer fees can be grounds for revocation of. -
the Harbor Permit in accordance with Chapter 17.24.090 of the
Municipal Code.
Your cooperation in bringing this permit up to date will avoid
any action by.the City.

The.City of Newport Beach has received an application to'
transfer pier permit #150-115 for the property located
at 115 N. Bay Front.
The structure was inspected on 9-11-78 at which time it
was determined that the following deficiency exists.
A continuous pressure anti -siphon device must be attached
to the municipal water service, bayward of the bulkhead,
in compliance to title 17 of the California Administrative
Code.
In accordance with Section 10-D of the City Harbor Permit
Policies, "All structural deficiencies must be corrected..."
A permit for this work must be obtained from the Community
Development Department.
Would you please advise this department when this require-
ment has been met. If you have any questions, please con-
