In addition, the proposed beach disposal has been reviewed and found by the Executive Director to be consistent with Special Conditions 1, 2, and 3 of Coastal Development Permit 5-99-282. No further review is necessary from the Commission for the beach disposal components of the project. Please be advised that only the project described in the materials submitted for the sites listed above have been found to conform with Consistency Certification CC-078-99 and/or conform with the terms and conditions of Coastal Development Permit 5-99-282. Any change in the project may cause it to lose its status as consistent with CC-078-99 and/or CDP 5-99-282. This certification is based on information provided by the recipient of this letter. The facility was inspected on October 18, 1995. We cannot transfer the pier permit until the following deficiency has/have been corrected and WE HAVE BEEN NOTIFIED OF THE CORRECTION: 1. A City -approved anti -syphon device is required at the water connection for the water supply to the pier and float. A sketch showing the approved type of device and its installation is enclosed. The device presently on the water service is no longer an approved backflow prevention device. This requirement is in accordance with Title 17 of the California Administrative Code. 2. The electrical receptacles must be either GfI or twist lock for use in a water environment. The Newport Beach City Council Harbor Permit Policies state: 10.D. "At the time of transfer, all harbor structures shall be inspected for compliance with the City's minimum plumbing, electrical and structural requirements, and the conditions of the existing permit. Discussion_ This application is before the City Council as required by Section 23.V. of the Harbor Permit Policies, which states: 23.V. "All new piers shall be subject to special permits approved by the City Council. Revisions to existing piers will be permitted providing they do not lessen the use of either the immediate water or land areas." The applicant is proposing a revision to an existing float that reduces its width but makes it longer. The.square footage of the old float is approximately 160 sq. ft.; the new square footage, will be 195 sq. ft. The present location of the float is in an area where there is no beach and the revision is not likely to lessen the use of the immediate water areas or land areas. Bay Front, Balboa Island, Newport Beach is registered to Willis I. Sutcliff. A transfer application must be completed and a transfer fee paid each time the permit has changed ownership. Chapter 17.24.030 of the Municipal Code addresses the transfer of a permit and reads as follows: "No person shall transfer a permit for a pier, float or similar structure granted under the provisions of this chapter without prior written approval of the City". Failure to pay the transfer fees can be grounds for revocation of the Harbor Permit in accordance with Chapter 17.24.090 of the Municipal Code.
