SUBJECT: BACK BAY SCIENCE CENTER- AWARD OF CONTRACT NO. 3460
RECOMMENDATIONS:
1. Approve the plans and specifications.
2. Award the bid packages for Contract No. 3460 as shown below for the Total Bid
Price of $266,676.00, and authorize the Mayor and the City Clerk to execute the
contracts.

BACKGROUND:
The Back Bay Science Center (BBSC) on Shellmaker Island in the Upper Newport Bay
Ecological Reserve is a multi -party project with the City of Newport Beach as the lead
agency for design and construction. A multi -prime delivery method is being used for
project construction.
On February 28, 2006, the City Council awarded 12 of 16 proposed trade contracts to
the lowest responsible bidders and rejected the bids for four trade contracts because of
irregularities or non - responsiveness. A budget amount of $260,000 was established for
the four trade contracts to be re -bid. Three bid packages were re- advertised and bids
were opened and publicly read aloud by the City Clerk at 2:00 p.m. on June 29, 2006.

DISCUSSION:
Only one bid was received for each bid package. A summary of the construction
contractors who obtained plans and those who submitted bids is attached as Exhibit A.
The one remaining trade contractor bid package (No. 9) is for flooring work which is
estimated to cost less than $10,000. An informal construction contract or a change
order to one of the other trade contracts will be used to cover this portion of the project
work. This procedure is not expected to require City Council action.
The project construction manager, Douglas E. Barnhart, Inc., has reviewed the
experience and qualifications of the trade contractors which submitted bids and
analyzed the schedule of values of the work to be performed. Barnhart is satisfied that
the bid amounts are appropriate and that the contractors have previously performed
similar work successfully. Therefore, staff recommends award of the contracts for Bid
Packages 6, 10, and 16 to Dow Diversified, Inland Building Companies, and
Metropolitan Floor Coverings.
Pursuant to the Contract Specifications, the contractors will perform the work in
accordance with the time frames provided in the overall project schedule prepared by
and implemented by the construction manager.
Environmental Review:
A mitigated Negative Declaration was prepared and processed to assess the
environmental impact associated with constructing the Back Bay Science Center.
Identified mitigation measures have been included in the project design. The California
Department of Fish and Game was the lead agency for the environmental review and
the documentation was completed in September 2003.
Public Notice:
The Notice Inviting Bids was advertised in the City's official publication and in
construction industry publications.
Geotechnical, Material Testing, and Survey Services:
Geotechnical, material testing, and survey services for these three trade contracts are
covered by separate professional services contracts that have already been established
for the overall project requirements.
Funding Availability:
There are sufficient funds available in the following account for the project:

A 5% contingency is included in each of the trade contracts. In addition, a $245,000
contingency was approved for the entire project as part of the City Council's actions on
February 28, 2006. The difference of $6,676 between the budget amount of $260,000 and
the award amount of $266,676 for these three trade contracts will be allocated from the
$245,000 project contingency. The flooring cost still to be determined by Bid Package No.
16 will also be taken from the overall project contingency.
