N2006 -0554 RECOMMENDATION: Conditionally approve the request of the Newport Beach Restaurant Association for the installation of 100 banners, from December 13, 2006 to January 26, 2007, for the inaugural Newport Beach Restaurant Week. Installation will be along Coast Highway between MacArthur Boulevard and Dover Drive, Newport Boulevard between Hospital Road and 32nd Street, Jamboree Road north of East Coast Highway, and MacArthur Boulevard north of East Coast Highway. DISCUSSION: The Newport Beach Restaurant Association (NBRA) has requested that 100 private banners be installed from December 13, 2006 through_ January 26, 2007 along major thoroughfares throughout the City for the inaugural Newport Beach Restaurant Week. The banners will be mounted on streetlight poles in the public right -of -way along Coast Highway between MacArthur Boulevard and Dover Drive, Newport Boulevard between Hospital Road and 32nd Street, Jamboree Road north of East Coast Highway, and MacArthur Boulevard north of East Coast Highway. The banners on Newport Boulevard and Coast Highway within Caltrans right -of -way will require a Caltrans Standard Encroachment Permit, which the applicant will obtain. Newport Beach Restaurant Week is a special five -day citywide culinary celebration, produced by NBRA and partnered with the City of Newport Beach, Newport Beach Conference ,& Visitors Bureau, and American Express, to attract local patrons and visitors to new and classic restaurants in Newport Beach. This event will take place on January 21 to January 25, 2007. During this period, patrons may sample prix -fixe menus at approximately 100 participating eateries. This event is open to the public and does not generate any ticket revenue; however, patrons are required to pay $12.95 for the three -course prix -fixe lunch and $26.95 for a three -course prix -fixe dinner with all Newport Beach Restaurant Week Banners — Approval of Encroachment Permit Number N2006-0554 December 12, 2006 Page 2 proceeds benefiting the First Battalion First Marines of Camp Pendleton and their families. The applicant's request to install the banners from December 13, 2006 to January 26, 2007 (45 days) will exceed the 30 days maximum installation period allowed per City Council Policy L -16. Although this time period exceeds the maximum allowed, it should be noted that the installation period will not conflict with any known upcoming banner installations. Should City Council elect to approve the installation of 100 private banners along the City's major thoroughfares for 45 days, staff recommends the following conditions of approval: 1. No banners shall be installed on traffic signal poles. 2. The applicant shall provide for on going maintenance of the banners and brackets associated with this event. 3. The applicant must sign a "Hold Harmless Statement" requiring maintenance of the banners /brackets and indemnification and hold harmless for any liability associated with the banners /brackets. 4. The applicant must maintain a minimum of $1,000,000 in liability insurance from a company with a Best's Key Rating Guide parameter of "A" or better, and a financial size category of "VIII" or higher. 5. Issuance of an Encroachment Permit by the Public Works Department and compliance to all conditions provided on the Encroachment Permit. 6. The banners shall conform to City Council Policy L -16 with the exception of the installation duration. 7. All banners and brackets shall be removed by the end of the approved time unless otherwise approved by the conditions stated in the Encroachment Permit. 8. All banners and brackets shall comply with the Encroachment Permit conditions. 9.. If needed, the City may require removal of some of the banners to allow other organizations to install banners at the same location and during the same time period. 10. A minimum of two 5 -inch wide half - circle wind slits per banner are required to minimize the wind load. 11. A Caltrans Standard Encroachment Permit shall be obtained by the applicant for banners within Caltrans right -of -way. Newport Beach Restaurant Week Banners — Approval of Encroachment Permit Number December 12.2006 Page 3 Environmental Review: Staff determined that the project is exempt from the California Environmental Quality Act (CEQA) pursuant to Section M78 of the Guidelines. This action is not considered to be a project as defined by CEQA. Funding Availability: No City funds will be required. The Newport Beach Restaurant Association will pay all costs associated with the installation and removal of the banners. Prepared by: ns ee, P.E.
