A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH ESTABLISHING A FEE FOR THE USE OF CITY ELECTRIC
VEHICLE CHARGING STATIONS
WHEREAS, the City of Newport Beach ( "City ") currently has three (3) Level 1
and Level 2 Electric Vehicle ( "EV ") charging stations located at the Civic Center Parking
Garage and may install additional EV charging stations throughout the City in the future;
WHEREAS, EV drivers currently charge their vehicles at the City's charging
stations without payment;
WHEREAS, the City provides the electricity and ChargePoint, Inc.
( "ChargePoint ") provides the subscription plans and grid network management to the
EV charging stations; and
WHEREAS, the City desires to pass the cost of electricity and the ChargePoint
service plan to the EV charging station user.
NOW, THEREFORE, the City Council of the City of Newport Beach hereby
resolves as follows:
Section 1: The City Council finds and determines that the City's cost of providing
EV charging stations is currently $0.20 /kWh, which includes the cost of electricity and
ChargePoint's service fee.
Section 2: The City Council hereby sets the fee for charging at the City's EV
charging station at $0.20 /kWh, which fee shall be paid by the user of the EV charging
station.
Section 3: The City Council hereby authorizes staff to establish adjustments to
the fee for charging at the City's EV charging station based on actual fixed or variable
rate electricity supply costs or changes to any costs incurred from any vendor who
maintains the chargers in the future.
Section 4: The City Council finds the establishment of EV charging station
rates is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to
Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable
indirect physical change in the environment) and 15060(c)(3) (the activity is not a
project as defined in Section 15378) of the CEQA Guidelines, California Code of
Regulations, Title 14, Chapter 3. The resolution does not authorize development and
only establishes the charging fee for existing EV charging stations.
Section 5: The recitals provided in this resolution are true and correct and are
hereby incorporated into the substantive portion of this resolution.

Section 6: This Resolution shall take effect immediately upon its adoption by
the City Council and the City Clerk shall certify the vote adopting the resolution.
