SUBJECT: Establishment and Appointment of Banning Ranch Development
Agreement Committee
1. Adopt the attached Resolution establishing the Banning Ranch Development Agreement
Committee.
2. Confirm the Mayor's appointment of Mayor Selich and Council member Rosansky.
DISCUSSION:
One of the City Council's priorities for 2008 is to conduct an appraisal of the Banning Ranch
property and assess funding availability for the purchase of the property for open space. The
Council has established a committee to oversee this effort, comprised of Mayor Selich and
Council members Rosansky and Gardner.
While the City is working on this priority, with the cooperation of the property owners, the owners
are also interested in pursuing plans and entitlement for development of the residential village
option in the General Plan. This development would require a development agreement. The City
and the property owners also are interested in a pre- annexation and development agreement,
which would outline not only vested development rights and public benefits, but also provide the
terms under which the property would be annexed to Newport Beach.
Recent development agreements have been negotiated by a committee of two Council members.
The attached Resolution establishes a committee of two Council members for the Banning Ranch
pre- annexation and development agreement.

RESOLUTION NO. 2008-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH
ESTABLISHING THE BANNING RANCH DEVELOPMENT AGREEMENT
COMMITTEE
WHEREAS, the General Plan provides that the Banning Ranch property
may be developed with a residential village, if not acquired for open space; and
WHEREAS, the Municipal Code provides that projects that require a Zoning
Code amendment and include the development of fifty or more residential units
require a development agreement; and
WHEREAS, Banning Ranch development requires a Zoning Code
amendment and could include up to 1,375 residential units; and
WHEREAS, the City and the owners of Banning Ranch desire an
agreement that outlines terms regarding annexation of the property to the City of
Newport Beach;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Newport Beach as follows:
Section 1. The City Council establishes the Banning Ranch Development
Agreement Committee, which shall be comprised of two (2) Council members,
appointed by the Mayor.
Section 2. The duties of the Committee shall be to negotiate the terms of a pre -
annexation and development agreement, which will describe development rights of
and public benefits to be provided by the developer and outline the terms for
annexation of the property to the City of Newport Beach.
Section 3. The Committee shall be an ad hoc committee, and shall sunset upon
City Council approval of the pre- annexation and development agreement, or

earlier if so decided by the City Council.
This Resolution was adopted at a regular meeting of the City Council of the City of
Newport Beach held on April 22, 2008, by the following vote, to wit:
