HomeMy WebLinkAbout03 - Sunsetting Eight CommitteesCITY OF NEWPORT BEACH CITY COUNCIL STAFF REPORT Agenda Item No. 3_ December 9, 2008 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: City Manager's Office Dave Kiff, Assistant City Manager 949/644 -3002 or dkiff @city.newport- beach.ca.us SUBJECT: RESCIND RESOLUTION 2008 -93; ADOPT RESOLUTION 2008 -_ ELIMINATING AND SUNSETTING EIGHT PREVIOUSLY ESTABLISHED COMMITTEES ISSUE: The following committees' duties may have been completed: 1. Ad Hoc Committee to Promote the Revitalization of the Balboa Peninsula (PROP); 2. City - School Ad Hoc Committee; 3. Oil and Gas Field Operations Committee; 4. Neighborhood Traffic Calming Committee; 5. 1/1 Memorial Committee; 6. City Clerk Ad Hoc Recruitment Committee; 7. City Attorney Ad Hoc Recruitment Committee; and 8. Santa Ana River Crossing (SARX) Ad Hoc Committee. Does the Council want to sunset these committees? RECOMMENDED ACTIONS: 1. Rescind Resolution 2008 -93 which eliminated nine committees, including the Newport Coast Advisory Committee; 2. Adopt Resolution 2008 - eliminating eight committees. 3. Direct staff to return to the Council at a future date with suggestions to refocus the NCAC's role and meeting schedule. DISCUSSION: At its October 28th, meeting the City Council reviewed the list of approved boards, commissions and committees and discussed the City Managers recommendation to eliminate or sunset nine Council approved committees. The Council sunsetted these nine committees at its meeting on November 12, 2008 via the adoption of Resolution 2008 -93 (attached). City Committees December 9, 2008 Page 2 One of the nine committees was the Newport Coast Advisory Committee (NCAC). The NCAC is a seven - member body that the City created as the City was about to annex the Newport Coast. Newport Ridge, and Crystal Cove communities in January 2002. The NCAC initially met monthly, then bi- monthly, and now tends to meet as needed. Since the November 12 2008 meeting, a review of the Pre - Annexation Agreement (PAA) between the Newport Coast Committee of 2000 and the City reminded staff that the may not be sunsetted until such time as the City's obligation within the PAA are complete. The relevant section of the PAA is shown below: 2. NEWPORT COAST ADVISORY COMMITTEE, The City Council shall establish the Committee by Resolution ( "Committee Resolution ") adopted on or before October 23, 2001. The Committee shall consist of seven (7) members. Four (4) members of the Committee shall be appointed by NCC21K. The member or members of the City Council that are nominated from the district or districts in which any portion of the Property is located shall be members of the Committee. The City Council shall appoint any remaining member or members of the Committee who shall be residents of Newport Coast. The Committee Resolution shall specify that the initial terms of the Committee members appointed by NCC2K shall be three years with two of those members automatically serving additional three -year terms. All members of the Committee appointed by NCC2K shall reside within the Property at all times during their terms of office and NCC2K shall appoint a replacement at such time as any of the members they appoint no longer resides in the Newport Coast. The Committee shall terminate if, and at such time as, LAFCO terminates the annexation proceedings prior to certifying annexation of the Property or the City has fully performed its obligations pursuant to this Agreement (emphasis added). Several obligations of the City in regards to the PAA are complete, but some are not. For example: Council District Representation Complete Formation of the NCAC Complete Aviation Committee appointment Complete Fire and EMS Services Complete Police Services Complete Community Center Complete Assessment District Review Complete Ongoing Assessment District Relief (expires in 2017) Property Maintenance Ongoing -- Fuel Modification Zones Ongoing -- Slopes, parkways, medians Ongoing Refuse Collection N/A Utility Undergrounding (Edison) N/A City Committees December 9, 2008 Page 3 Therefore, at the Council's November 25, 2008 meeting, Council Member Gardner asked that the City Council reconsider its action on November 12, 2008 that adopted a resolution sunsetting nine committees and that an alternative item be placed on the Council's agenda on December 9, 2008 which would allow the Council to sunset eight committees (thereby leaving the Newport Coast Advisory Committee in place). Council approved this reconsideration. Assuming Council agrees to rescind the Resolution that eliminated the NCAC, Council Member Rosansky asked that the Council consider a modification in duties and meeting schedule of the NCAC at a future date. As he stated in his November 12, 2008 staff report, City Manager believes the elimination of these eight committees will not affect the way the City conducts its decision - making. Issues can still be brought to the City Council after being vetted through other Council committees or by having the Mayor appoint Council people to look into particular issues in order to bring recommendations to the City Council. Since the eight committees were created by resolution, elimination of the committees also needs to be by resolution. If the Council desires to take this action, the steps are as follows: 1. Vote to rescind Resolution 2008 -93, which eliminated nine committees. If this vote passes... 2. Vote to adopt Resolution 2008 -_ eliminating eight committees. If this vote passes, the NCAC will be restored. 3. Direct staff to return to the Council with suggestions to refocus the goals, duties, and meeting schedule of the NCAC at a future date. Environmental Review: The City Council's approval of this Agenda Item does not require environmental review. Public Notice: This agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the Council considers the item). NOW THEREFORE BE IT RESOLVED by the City Council of the City of Newport Beach that it hereby reaffirms its appreciation for the work done by the committees that are being eliminated or sunsetted, and BE IT FURTHER RESOLVED that the above named committees are hereby disbanded effective immediately and all resolutions and actions establishing the committees and extending the terms are hereby repealed.
