3729 Ocean Boulevard, Corona del Mar, has been my residence since
1965. In December,of this year I initiated a landscaping improve-
ment at this address and at 3725, the adjacent property which I
own. As the brickwork was completed, I was advised that I was in
violation of the law because review and approval of the project
by the Building Department and the City Council was required.
By this letter, and the enclosed material, I request your con-
sideration and approval at the departmental level and the City
Council at its meeting January 7, 1980.
This property was built in 1947, the first home on the ocean side
of Ocean Boulevard. When I bought it in 1965, the city's property
at this site contained a wandering three foot asphalt path through a
veritable forest of five to six foot natal plum bushes and the
pathway terminated at the street at a point now occupied by a
barricade installed by the city. In the late 1970's, the street
light and power pole were removed and put underground. in 1971,
when I remodeled this house., City Council approval was granted
to remove this hazardous pathway with the provision that I put
in a six foot sidewalk at the curb at the 3725 and 3729 addresses.
Subsequently, I removed all of the tall natal plum and had a ,
sprinkler system and three foot wooden rail fence put in place.
I did not request a permit at that time simply because I assumed
that fixing it up should be my responsibility. I never assumed
it was my property, only my responsibility. As the beach traffic
increased, my fence, piece,by piece, was carried away by souls
unknown to provide small fires on the beach. After many repairs
and replacements, only an occasional wooden upright remained. The
increased cannine traffic*, combined with the human traffic, took
care of the sprinkler heads and all the plantings save the hardy
ice'plant and a few three foot junipers down the slope. Weeds grew

abundantly and nothing else. By June of this year, this end of
Ocean Boulevard looked very bad. My patient, long suffering,
neighbors across the street never complained to me about this
blight, but I know they suffered from it.. In June of this year,•I
-hired Mr. Herb Ramsier, a landscape architect who had worked
for Disneyland for many years in that capacity. We spent many
hours and he produced the plan which is included. The goals in
the production of this plan were to produce an area esthetically
pleasing and safe,. Honestly, at no time was there any effort
to expropriate the public land to my own use. My benefit was to
have a yard, pleasant and well kept.
The public property here presents some unique problems. The soil
is pure sand. As such, there is terrible erosion on the slope from
any water overflow. Shortly after the city completed the curb,
curve and storm drain project - in the process tearing out my
sewer line - the drain pipe in the gully broke during a heavy
rain and there was slippage of the slope and about 15% of the city's
• land ended up on the Little Corona beach 40 feet below. The slope
will not bear pedestrian traffic and the landscape design is offered
to discourage this and to hold the soil. Since 1964, beach traffic
has increased far beyond the capacity of the city to keep the street
and roadways clean. I, like my neighbors, have done our daily pick
up and cleanup of trash, papers and beer bottles. That goes with
the territory. The 12 inch brick curb along the sidewalk is there
to help in this regard and serve as a deterrent, or possibly a
convenience, to the many dogs who pass by. I can hose dawn the
wall but the poop scooping is a much more onerous task. Another
special problem here is safety which presents in two aspects.. The
first is the public safety. Because of the slope of my driveway and
the code requirements for its construction in 1971, it is absolutely
impossible for me to see pedestrians on the sidewalk when I back
out of my garage, unless they are fairly tall. There are many, many
small children coming to the beach. The design calls for an area
of brick flatwork to the North which will permit my sufficient
room to leave my driveway heading out with full vision. This area
is not sufficient for additional parking,except possibly for one
car. Our life style does not involve large parties nor would I
care to have a parked car dripping oil on the brick. The second
safety aspect is more personal. My front door is almost in a direct
line with Eastbound traffic on Poppy. On two occasions, drivers

have failed the stop sign at Poppy, proceeded across Ocean Boule-
vard, jumped that eight inch curb and come to a stop in the yard.
The halt has been more fortuitous than planned. This is the primary
reason for the fixed brick planter and, in.part, the reason that
the low stuccoed wall is returned across the front. The wall
also serves additionally to limit the erosion. Because the wall
is downslope from the sidewalk, it does not project above the top
of the'l2 =' brick curb at the sidewalk.
This, I hope, explains in a satisfactory manner the desigh as you
see it. -There is nothing sinister about the design or execution.
I now know the execution was illegal and I apologize and seek
your approval of what's been done. I will have spent over $17,000.
on this project, a project which I think benefits the city as well
as me. The sprinklers are hooked into my water line and the
maintenance of the area I• continue to accept as my responsibility.

Both parcels are owned by Dr. K. J. 'Smallwood.
On April 5, 1971 the City Clerk received a letter from Dr. Smallwood
requesting approval of his plans to landscape the parkway in front of his prop-
erty. The letter was accompanied by a sketch showing approximately 75% of the
parkway area covered by brick pavement.. The request was referred to staff for
a study and'report.
On,April 26, 1971 the City Council denied the request as submitted.
Dr. Smallwood was permitted one curb cut 20 feet wide and one straight con-
crete driveway 20 feet wide. As a condition of approval he was to restore the
meandering pedestrian walkway that had been removed, or he could construct a
• .6 -foot -wide concrete sidewalk behind the curb. The Council also required that
all landscaping be subject to the approval of the P':B.•& R. Department.
Dr. Smallwood had the sidewalk and driveway approach built. On
August 9, 1971 Public Works Department Inspector Russ Scott approved the'side-
walk and driveway. approach.
On June 8, 1971 the P.B. & R. Director sent a letter to the Public
Works Department in which he states that he had previously approved a retain-
ing wall at right angles to the street and a brick entry walk. The brick
walk was more extensive than approved by the P.B. & R. Director.
On June 17, 1971 the P.B. & R. Director sent a letter to Dr. Smallwood
discussing the project.
Several weeks ago (exact date unknown) it was observed that construc-
• tion bf brick planters was taking place in the public right -of -way in front of
3727 =29 Ocean Boulevard: Council Policy L -6, last amended on August 11, 1975,
"
now provides that private structural encroachments in the public right -of -way,
including raised planters, require the prior approval of the City Council. No
recent encroachment permit had been issued; therefore, the Public Works Depart-
ment red - tagged the work. Later, the work was again red - tagged because addi-
tional work was being done.
On December 12, 1979, the Building Director asked the Chief Building
Inspector to investigate the work. It was determined that the work was in the
public right -of -way and that under Council Policy L -6 the project should be
handled by the Public Works and P. B. & R. Departments.
Attached are copies of the correspondence referred to above.

ADJACENT TO 3729 OCEAN BOULEVARD
RECOMMENDATIONS:
1. That the request of Dr. Smallwood be denied.
2. That Dr. Smallwood be permitted one cues cut, 20 feet wide.
at the bottom; and one straight concrete driveway no more
than 20 feet in width.
3. That all landscaping be subject to the approval of the
P. B. & R. Department.
4. That the existing meandering pedestrian walkway along,
the southerly side of Ocean Boulevard be restored in
kind'by Dr. Smallwood or a standard 6 foot wide concrete
sidewalk be installed behind the curb.

•DISCUSSION:
Attached area sketch and a letter from Dr. K. J. Smallwood requesting per-
mission to construct landscaping, a planter,.a circular, driveway, and two curb cuts
in the 60 foot wide parkway in Ocean Boulevard adjacent to his house at 3729 Ocean
Boulevard, Corona del Mar.
The Driveway Approach Policy of the City Council requires the prior approval
of the City Council for any driveway on the southerly side of Ocean Boulevard. In
addition, the Municipal Code provides that no person shall plant trees or place solid
surfacing, material' in, any parkway or street right of way without a. written permit from
the City.
The southerly parkway on Ocean Boulevard should be retained as a pedestrian
walkway and greenbelt. Construction of off- street parking and planters in the park-
way would inhibit public use of the pedestrian walk and tend to create the impression
that the area was closed to public use.
In the past the City Council has denied aaplications for similar improvements
at 2711 Ocean Boulevard, 3301 Ocean Boulevard, and 3024 Breakers Drive (access from the
access road to the beach).

SUBJECT: CONSTRUCTION ADJACENT TO 3729 OCEAN BOULEVARD
I have looked at the installations as outlined in your memo of June 8th
relative to.the development on public property at, the intersection of Ocean Blvd.
and Poppy Avenue. At the moment, there are three areas of construction that have
taken place: (1) the installation of a sidewalk adjacent to the curb; (2) a
bricked in area adjacent to the approved driveway; and (3) the retaining wall
separating this parcel from the one immediately to the West. As far as the side -
walk is 'concerned, it appears to•have gone in in.-.conjunction with City require-
ments.• I had previously approved the'installation of the retaining wall because
the elevation variations between•the'property there dictate that some type of
retainer is necessary. If you will notice, the adjacent three properties have a
similar retaining wall because the terrain slopes'from Orchid Avenue dorm to
Poppy quite severely. As far as the brick area is concerned'I did previously
approve an entrance brick walk coming from the driveway to their front door;
however, this is in far more extensive magnitude than was described to me in the
field.
I have not seen the plans for any further development or landscaping,
but in order to guarantee that installations will not be made that have not
previously been approved by the City, I will contact the property owner today
,- and indicate that no further installations can be *made on public property with-
-out their submission to the PB 4 R office.
Mr. Dick Beeson is also going to provide me with the landscape
installations showing watering systems, ground covers, shrubs, etc. It is
understood that I will approve these plans, prior to any horticultural installa-
tions.
Your memo indicated that his actions have successfully shut the public
off from the public property; however, upon inspection of the seven residences
that exist in that area, at least four of them totally shut the public off equally
as well.
Upon inspection, I do not disapprove with anything that has been done,
thus far; however, prior to any other construction, I will request some type of
construction plans, prior to installation.

Dear Mr. Stewart:
Thank you for your letter of June 17, 1971, and your continuing
interest in the project at 3729 Ocean Boulevard. I.regret that
the brick area going from the driveway to the front door is more
extensive than-you' had pictured it.
At this juncture, Mr. Beeson has not finished landscape and
sprinkler plans, nor have we discussed these plans in detail.
When they are available, and prior to any other development,*
we will submit to your office for approval and comment.
• Additionally, both Mr. Beeson and I are anxious to discuss the
City's plans for control of the erosion of this hillside. At the
time we had our discussions in the field with you, this problem
was mentioned and I believe was taken under advisement.
Additionally, when I appeared at the City Council hearing in
regard to the sidewalk width, this problem was mentioned.
Although this-hillside, of course, is city property, I am
interested in'how it will look from an aesthetic standpoint as
well as the very real problem of maintaining my retaining walls.
.The continued erosion, of course, will undermine and ultimately
destroy these retaining walls if it is not checked. Perhaps we
can discuss the whole matter when the landscape plans are sub 'teed.

On the south 31da of Ocean Boulevard a new sidewalk has
been constructed westerly of PoPpy Avenue. At the Poppy
Street end of the new sidewalk a potential hazard exists
for pedestrians'using the sidewalk.
It is requested that the General Services D partr,,ent place
a barricade at the east end of -the sidewalk until a plan
can be developed'to continue the sidewalk in an easterly
direction..

SUBJECT, EROSION "AT 3729 OCEAN BOULEVARD
Reference is made to the June 18, 1971 letter of K. J. Smallwood
-concerning hillside erosion at 3729 Ocean Boulevard.
It is suggested that if you consider erosion of the hillside the
responsibility of the.city,'that you propose a .Capital Improve-
ment Project to correct the situation. Ken Perry will be available
to work with you to develop a cost estimate and a basic engineering
and landscaping plan.
If the erosion is caused by the 'actions of Dr. Smallwood, he should
• be asked to contribute to the project.

PROGRESS REPORT: DECEMBER, 1979
SENIOR CITIZENS,
The Christmas dinner, held December 8 at the Center, was a very festive occasion;
160 people enjoyed the fellowship, food, entertainment, and dancing. The Travel
Group organized a special Acapulco Cruise December 15 to 22. A New Year's Dance
Was held December 31; it was a successful, gala event. Matt Hall has resigned
as President of Friends of OASIS, due to health considerations. Jim Felton has
taken over as interim President.
SPECIAL CLASSES-
Intensive trainings were held for all special instructors in December. A broad over-,
view of the program was presented to assist instructors in understanding their place
in the organization. Department policies, accident procedures, registration, con-
tracts, and a variety of other topics were covered. Instructors were pleased with
the training, and felt this effort to delineate responsibility was worthwhile.
Press relations have been improving -- slowly but surely. Both 'The Pilot' and 'The
Ensign' have printed good articles about our winter registration.
In order to obtain artwork for upcoming brochure covers, staff has instituted'a
• brochure cover contest. Winners will of course receive exposure by having their
work on the cover, and will also be highlighted in a short biographical sketch in=
side the booklet. The Department receives artwork at no cost.
Winter classes began January 7. Registration continues through the first week of
classes; as is usual for the winter, registration is slow.
YOUTH AND ADULT SPORTS
Registration for boys and girls basketball continues through January 11. Practice
began on the areas December 3, and the first games are scheduled for January 12.
Adult Softball and Basketball continue through the end of January.
SPECIAL PROGRAMS
The Sunshine Club has been enjoying a.wide variety of activities, highlighted by a
Christmas party December 21.
Recreation programs at the Community Youth Center in December included Christmas
window painting, movies, paper airplane contest, skateboard contest, mural painting,
frisbee contest, and a picnic.
The first production of Friends of Newport Theatre Arts Center, "Summertree ", will
open January 10 at the Center. Commissioners are invited, to attend and, support thi's
• worthwhile community theatre.

SENIOR CITIZENS
An extremely successful Monte Carlo Night was held Saturday, November 10. This event
raised additional monies for the OASIS Fundraising Campaign. On Sunday, November 18,
more than 225 senior citizens enjoyed a special Thanksgiving Dinner at the Center.
The annual flu clinic was held November 28, and a trip to Las Vegas departed last week.
The group plans an exciting holiday season, kicked off by a special Christmas Dinner
at the Center December 8.
SPECIAL CLASSES
Fall- session classes were completed the week prior to Thanksgiving. Several "inter -
session" courses in tennis and various exercise disciplines are being held during the
month of December. Winter classes will begin January 7,•with mail -in registration
commencing December 14.
The winter brochure will have a significantly different " look' than the last several
issues. This book will serve as, an example of our product when local businesses are
approached regarding the purchase of advertising. This program will commence with the
spring issue, and staff anticipates that the partnership between the local business
community and the Department will be beneficial to both parties:
• An additional cost savings will be incurred with the formation of a non - profit corpora-
tion, Newport Beach Public Information, Incorporated, which will enable the mailing of
the quarterly brochure at 3.1t,per piece. Currently, the cost to the Department is
8.4¢ per piece; the cost savings per year could amount to $7,800. Council approved
this non - profit corporation at its meeting of November 26; staff will implement in time
to, obtain the low rate for the spring issue mailing.
YOUTH AND ADULT SPORTS
Flag football completed its season mid - November, with a special City Tournament
November 17 and 18. The City Champs will participate in the Orange County Municipal
Athletic Association Tournament November 30- December 2 in Buena Park.
Girls volleyball was extremely small this year, but those girls who participated
enjoyed a positive experience. The volleyball season finished November 26.
Registration for Youth Basketball began in November. Practice will start in December,
with games scheduled to start January 12. Staff anticipates a large turnout for this
program.
Adult Basketball and Softball are close to midway through their respective seasons, and
will be finished the end of January.
•Special Recognition Award honorees will be acknowledged at the special Commission
meeting December 18, 7:00 p.m. in the Council Chambers.
SPECIAL PROGRAMS
The Newport Beach Sunshine Club has been operating the entire month of November. Staff
is extremely pleased to be offering this program once again; attendance has averaged,
_ nine per week. —The -young man responsible for -this program has-been doing a fine job of
meeting the needs of this group.
A children's play, "The Nightingale ", was presented Saturday, November 10, at the Theatre
Arts Center. The show was sold out, and people had to be turned away. Staff was very
excited about the popularity of this event and plans to do more in the future. The
Arts Commission cosponsored the program, which was a Yellow Brick Road Show production.
Future plans include a second Y.B.R.S. presentation, as well as a puppet show geared
especially to children.
