The meeting of the Parks, Beaches and Recreation Commis-

II. RECOMMENDATIONS FOR ACTION: Item #.5
Mr. Whitley stated that there was a discrepancy in the
General Plan which states that the vacant parcel at the
Oceanfront end of 32nd Street had been mistakenly
identified as public property and shown as open space.
The site is also shown on the General Plan for "Two- Family
Residential ". The site is owned by Southern Pacific and
leased to Cagney. The City of Newport Beach does not own
this site. Commissioner Ross asked what this property
could be used for if it was City owned and some suggestions
made were that it could be used for a park or public rest -
rooms. Mr. Whitley stated that putting a small park at
this site would be high in maintenance. Therefore, it is
felt that this area should not be recommended for a park.
He stated that public res'trooms would be logical for the
area. Chairman Schwarz asked about the possibility of
using the site for storage. Mr. Whitley answered that
this area would be too far from the sailing bases.to store
equipment.

CdM Civic
Assoc.
The Corona del Mar Civic Association is requesting a re-
duction or waive in fees.for the use of the Multi- purpose
Room at the Oasis Center. Normally they use Room #1 when
available but if it is not they have to use the Multi-
purpose Room for a larger fee. They feel that since they
are getting the same service from the City the fees should
stay the same as they are for Room #1 or be waived
completely. The MP Room is much larger is size, therefore,
much higher in cost for energy and maintenance. Thus,
the higher fee is appropriate.
There are alternatives for other meeting rooms that the
•
Corona del Mar Civic'Association can consider but they
feel Oasis would be best. The other facility alternatives
are either too far for them or they feel are in unsatis-
factory condition. Also, if the CdM Civic Association
could 'project a firm annual calendar, the Oasis Room #1
could be scheduled for their purposes avoiding conflict
with other uses. The Association's past experience in
scheduling meetings even one quarter in advance is not
practical for them, they say.
Commissioner Ammerman stated that if we approve the re-
duction of the fee it would encourage them to use the
Multi- purpose Room and in turn, waste energy. It was
suggested that if there is an emergency or crisis a quick
drive to the Police Department fora meeting could work.
Commissioner Ross stated that they can't drive and that
Oasis is close by and handy for them. Commissioner Cole
stated that instead of the Association scheduling a meeting
and then seeing if Room #1 is available, to see if the
room is available first and then scheduling the meeting.

information should go back to City Council. Motion with-
drawn.

Since the passage of Proposition 13 the implementation of
user fees has become a common practice between the school
district and the City of Newport Beach. The above concept
allows for the exchange of facility use, maintenance
services, equipment and supplies; and as a result mutually
waive user fees for the use of respective facilities. By
using this concept we are holding back from an increase
in fees that the Newport -Mesa Unified School District
Board of Trustees approved. Commissioner Ammerman stated
that this item will have to be brought back to the
Commission.

formalized by agreement between the City of Newport Beach
and the Newport -Mesa Unified School District. Commissioner
Ross seconded the motion.
III. ITEMS FOR DISCUSSION: Item #8
Jeff Kolin reported on the summer beach volleyball tourna-
ment and stated that there Were two separate tournaments
two weekends' in a row. This year the location of the
tournament was at the Balboa Pier. In previous years -it
was held at Corona del Mar State Beach but due to various
problems - parking, poor condition of courts, etc. Balboa
Pier was chosen. Ten temporary volleyball nets and poles
were installed. The tournaments were very successful with
very few complaints and a few compliments. Commissioner
Schwarz asked if this was to be a permanent site would
the courts be permanent? Jeff stated that the courts
would remain temporary. He also stated that the tourna-
ment was self supporting. This item was brought to the
'Commission to make the Commission aware of the change in
location this year and that there were -no problems in
having the tournament at Balboa Pier. Student rep asked
If there were going to be 15 -16 year old tournaments next
year and Jeff replied that there was a possibility.

Mr. Whitley handed out a 'sheet for the Commissioners to
list in order what Committee they would prefer to be on.
Commissioner Green pointed out that the correct name for
the Recreation Program and Youth Involvement Committee is
Recreation Program and Citizen Involvement. The Committees
usually consist of three people.

Recreation
Div. Report
The Parks, Beaches.and Recreation Department has increased
its revenue during the 1980 summer quarter. We hope to
grow even more next year. It has been a very good summer.
Some of the programs did better than others but overall
there was an increase in revenue. Approximately $5,000.
was spent on the Pic N Pop concert. The actual cost to
the City, not including staff time, was about $2,800. The
rest was secured through a grant through the Musicians
Fund and Friends of Arts Commission. Depending on the
financial support the Arts Commission can get next year
the Pic N Pop concert will be continued. Commissioner
Ammerman stated that in the future to try to know what the
number of paid registrees and drop outs are so we can
know that figure.
V. SPECIAL, URGENT, OR-LAST-MINUTE ITEMS:
Commissioner Schwarz thanked Jeff for the concert in East -
bluff Park. Attendance was about 2000 or 3000 people.

Jeff stated that we have a new staff supervisor from
Cypress, Dan iwata, a, graduate of Long Beach State, who
will be taking over contracts, classes, brochure pro-
duction, etc. We have been authorized to upgrade our
Recreation Coordinator position to Recreation Supervisor
in two or three weeks.
Commissioner Ammerman had a list of productions for the
1980 -81 season at the Theatre Arts Center and hopes they
will be supported. Lunch on September 17, and 21, to see
and talk to people behind the productions. .
Commissioner Ross stated that the County of Orange is
having a Conference•on Aging. This is being held on
Saturday, September 13 and Saturday, September 27, at Cal
State University Fullerton and Saddleback Community
College.
Commissioner Winburn reported on the Local Coastal Plan

PARK TOUR
Mr. Whitley stated that the response to the tour'was not
good. The purpose of the tour is being defeated if the
turn out is not good. Commissioner Winburn suggested
making the tour twice a year for a shorter length of time.
Mr. Whitley suggested an evening tour. 'Commissioner Ross
suggested a weekday afternoon tour. It was the concensus
of the Commissiom to cancel the tour and work toward'a
better time and day for participation purposes.
VI. ADJOURNMENT:

Commissioners;
At the request of my neighbors I have initiated the enclosed petition for
your consideration.
We are seeking relief from what we consider-as an intolerable condition
that is affecting the enjoyment of our properties and perhaps more impor-
tantly the values of our homes. When we purchased our homes we paid
amounts substantially in excess of current residential values for ocean
and harbor views and subsequently, over the years, these views have been
eroded by the City owned parkway trees. Therefore, we are requesting
that the City replace the trees or, if this is not feasible, that the
trees be pollarded to a height as to eliminate view interferance. Even
the most recent trimming which was done in the month of August has done
very little to alleviate the problem.
We, the signatories to the petition, hope and expect that you will look
favorably upon our request in as much as the City responded to a similar
request by the Homeowners.on Goldenrod Avenue two years ago, as well as
other individual requests by residents within our Homeowner Association.
If the format of your meeting allows, we would also request that we be
allowed to attend to further explain our problem.

and request that the City of Newport Beach remove the
existing Indian Laurel and Eucalyptus trees in the park-
ways adjacent to our properties and, once removed, that
the trees be replaced with trees selected by,the City
having lower mature heights and more compact root systems.
It is our belief that we are suffering a devaluation in
the value of our properties from view obstruction and
further that the City of Newport Beach is incurring an
excessive expense in the maintenance of the trees and
adjacent public walks due to their agressive growth

SUBJECT: SPYGLASS HILL PASEO - TREE PROBLEMS
BACKGROUND:
The Paseo in Spyglass Hill, specifically on both sides of
Spyglass Hill Road, has a large number of Eucalyptus
citriodora that are causing view problems to property
owners. The Eucalyptus trees are tall, stately trees that
will continue to grow to a height of 75 -100'. City Council
Policy I -9 which provides guidelines for our tree r-e-
tenion program does not address the issue of problem areas
where views are inhibited by City owned parkway trees. As
the Codes, Covenants and Restrictions (CC & Rs) for residents
in the Spyglass Hill Community Association area- :regiiire'.them
to maintain all private property trees to a level not ex-
ceeding the roof line of their houses, our City owned trees
are the only ones causing problems.
• I have been to several homes in the area and discussed the
matter with the Board of Directors of the Spyglass Hill Com-
munity Association. All agree, including this Department,
that the problem exists and should be eliminated. There are
13 trees on the bank side of Spyglass Hill Road and 41 trees
on the Paseo side that should be removed. It is estimated
that removal of the mentioned trees would cost $2,700.00.
Replacement, using a desirable 15 gallon tree would cost
approximately $2,.430.00 or a total of $5,130.00 to complete
the project.
The removal of these trees would benefit those that are ex-
periencing view problems and in addition would be a positive
step toward a low cost maintenance program for our street
tree operation. Replanting with a tree species that has a
lower maintenance requirement would aid the tree section in
their ever increasing responsibilities for tree trimming.
POSSIBLE FUNDING:
As a result of the Paseo deletion in the Spyglass Hill area
a reserve fund was established by the John D. Lusk Company
relieving them of future paseo development. This reserve
fund has a balance of $50,510.00 that is to be used on projects
• in Spyglass Hill that are approved by the City Council and the
Association. If the tree removal project has a high.priority

and could be approved by both parties the reserve fund could
supply sufficient fund's to accomplish the task.
RECOMMENDATION:
If desired, recommend to the City Council that the paseo, tree
removals be approved and funded from the Spyglass Hill Reserve
Fund.

I have, on numerous occasions, requested that the parkway trees along
both sides of Spyglass Hill Road be either trimmed or eliminated due
to their obstructing of views of homes on Bodega Bay Drive. I have
met with absolutely zero response. In fact, the comment made was
that nothing can be done and that one (1)'homeowner complaining will
not get the city to move on the problem.
I have contacted my attorney and he, in turn, has contacted Mr. Hugh
Coffin, city attorney. We find that an ordinance number 720.02.070
provides for the correction of this problem.

I am in receipt of your letter of July 14, 19.80 pertain-
ing' to parkway tree view obstruction.
I have discussed your particular problem with both
Mr. Burnham and.Mr. Coffin with the City Attorney's office,
and it is our opinion that the problem you cite cannot
be solved by the Zoning Ordinance which governs the loca-
tion of fences, walls, and plantings on private property.
The problem you cite is one of parkway trees located
within the public right -of -way. The retention or removal
of parkway trees is governed by Council Policy I -9 which
is administered by the Parks, Beaches and Recreation
Department. If you are having a problem with parkway
trees, I would suggest that you contact Mr- Ron Whitley
who is the Director of the Parks, Beaches and Recreation
'Department. Mr. Whitley's phone number is 640 -2270.
I have discussed this matter with trim and he will be
expecting your call.

If desired, recommend to the City Council that
fencing of Spyglass Hill Park be approved and
a $10,000. budget amendment be made from the
Spyglass Hill Reserve .Fund to accomodate the
project.
DISCUSSION:
The 'Spyglass Hill Community Association has requested that
some type of fencing be installed at Spyglass Hill Park
for safety purposes. The Department',s-ini.£ial reaction to
the request was negative as indicated'in my letter of July 31,
1980. However, after two meetings with the Board of Directors
. of the Association our concerns have been eliminated and, we
would recommend approval if the necessary arrangements can
be made to fund from the Spyglass Hill Reserve.

Your communication regarding the Spyglass Hill Community Association's
desire to install a fence around Spyglass Hill Park has been received and
analyzed by this Department. Our initial reaction is not favaorable to
the concept of fencing a public park area.
The design of Spyglass Hill Park was accomplished with significant
involvement of the Spyglass Hill Community Association. Numerous planning
• meetings were held with the Association to determine the development criteria.
I realize that Board personnel turnover quite rapidly and a new set of
individuals are now involved. However, as the development of this park was
implemented and encouraged by the Association,their original concepts were
given high priority. The open, visible park area with appropriate safety berms
along E1 Capitan and Spyglass Hill Road was a recommendation of the Asso-
ciation. It was the feeling that supervision of the entire area and surveil-
lance from these roads was desirable to dliminate a closed in area where
young people .could possibly congregate.
It has been our experience while programming and maintaining a number of
parks within the City that closed in areas offer unique problems. As an
example, 38th St. Park located in Central Newport on Balboa Blvd. is completely
fenced and has been an expensive park to maintain and many social problems
have been encountered.
To assist in arriving at a decision, I would be willing to attend a
meeting of the Board of Directors of the Spyglass Hill Community Association.
All the alternatives could be addressed including a cost estimate for the
proposed fence. Please give me a call if you feel this would be helpful.

The Board of Directors of the Spyglass Hill Community
• Association would like to thank you for your attendance
at their meeting held on August 27, 1980. Per discussion
held at the August meeting you stated that you would
attend the September Board meeting and - present the
following information:
1) Proposal for some type of aesthetically pleasing
barrier, combining shrubbery (laedges) with decorative
fencing, to be placed around the park on the corner
of Spyglass Hill Road and E1 Capitan. The purpose
of this barrier is to prevent children and balls
from going in the street.
2) Proposal /estimate of removing the eucalyptus trees
on City property surrounding Spyglass Hill which
are blocking homeowners views and replacing the trees
with a more appropriate planting material.
The next Board of Directors' meeting is scheduled for
Wednesday, September 24, 1980 to be held at the office
of Ron Taylor, R.C. Taylor Company, 3 Corporate Plaza
Drive, Newport Beach, CA. Your attendance would be
greatly appreciated. This topic will be discussed at
8:00 P.M. Please confirm that funding for these
projects has-been approved by the City to be deducted
from the Paseo Deletion funds.

SUBJECT: FULL TIME HUMAN SERVICES COORDINATOR
At the request of Jim Felton, President of the Friends of OASIS, Staff
has prepared a report outlining the need for additional City Personnel
at the Center. The executive Board of the Friends has voted its approval
of the request for additional personnel and authorized Jim Felton and
Judy O'Shaughnessy to compile the report.
Present staff at the Center include 1 full'.time recreation Supervisor,
1 full time typist clerk, two full time maintenance workers, and one
z time social service coordinator. The existing staff of the Center are
managing the day to day operation of the Center and its existing programs.
The present 2 time social services coordinator manages a program of blood
pressure tests, hearing tests, glaucoma screening, legal aid, cardio
pulmonary resuscitation, peer counseling, job information, and lectures.
She also provides a drop -in social iworker s-ervice four morn_ings.._a Week:
The Board of the Friends of OASIS feels that with the expansion of the
Center and its membership there exists a need for additional human service
programs in the areas of:
1. Outreach
2. Information and Referral
3. Nutritional Programs (Meals on Wheels)
4. Adult Day Care
5. Senior Discount Program
A full time human services coordinator would be able to manage existing
programs as well as develop new ones. The Board feels that existing staff
will not be able to devote sufficient time to develop new programs and that
volunteers do not have the expertise needed to plan and develop these services.
The human services coordinator would also be avialable to serve as a liaison
to various OASIS committees as well as to senior citizen programs in the
county.
It is the Boards feeling that for a minimum additional expenditure, Newport
Beach can take a big step toward leading the way in programs and facilities
for its elderly.

SUBJECT: POSSIBLE NEW COUNCIL POLICY - DEDICATED TREES
BACKGROUND:
From time to time we get requests to have a tree and /or plaque
dedicated in our parksites. As we have no policy regarding,
prodedures on this matter, staff is recommending that a policy
be formulated and transmitted to the City Council that will
provide operational guidelines on this matter.
Items to be considered as the policy is developed should in-
clude:
1. Some type of control so that parks do not
become or give the appearance to be a cemetery
• as opposed to a recreational area.
2. Type and location approval to reduce or con -
trol maintenance factors.
3. Some criteria for eligibility to have a tree
dedicated, although a touchy subject, should
be established.
Hopefully, a Commission or City Council Policy can be produced
that will assist staff on this matter. The attached communi=
cation is an example of the subject.

RECREATION DIVISION
PROGRESS REPORT SEPTEMBER 1980

The Fall Session commenced September 8, and all classes are
progressing smoothly. Registration and revenue ar-e slightly
higher than last year at the same point in the session.--'
Although several classes have been cancelled or combined
because of low enrollment it looks as if it will be a suc-
cessful session.
Sunday lessons were added to the sailing program for the
first time this fall. The lessons have been extremely well
received by the public, with near capacity enrollments., Sabot
lessons have been about 90% enrolled and Gormet Canoeing wins
the inovative program of the session award.
The tennis program continues to operate at levels similar to
those of a year ago. The program is only 20 participants
short of last falls registration figures and should receive
additional sign -ups for second session five week classes and
a special two week holiday session in December.

Youth and A'dul't 'Sports
Registration for youth and adult sports programs began in
September. Staff anticipates that both the Adult Softball
and Basketball Leagues will fill. Games are scheduled to begin
in October. Youth sports continues to be a difficult area for
fall programming. Competition from a very large AYSO program
limits the participation in our youth sports programs, Regis-
tration for flag football will continue through this week and
should increase now that leaders are on the various areas.
Senior C'itiz'ens
P. B..& R. staff and'the Friends of Oasis are continuing to
expand and improve the scope'of the'center. A second mainte-
nance position has been filled by the City. This individual
will work during the evenings and on some weekends. The "Friends"
have hired their first van driver and obtained insurance for
their vehicles. The long anticipated transportation program
will soon be'operational.
Oasis special events continue to attract large numbers of
participants. The Luau served 392 people and the September
Tea Dance attracted 98 dancers. A special fund raising Grand-
parents Pancake Breakfast served 218 children and adults.

Installation of a, pay phone and improvements to the existing
telephone system are scheduled in October. These improve-
ments will be funded by the Friends and the City.
Special Programs
The Youth Center is preparing for a Halloween Spook House
and Costume Parade,. Local youth will.be invited to join in
the fun Friday, October 31st.
The Friends of the Newport Theatre Arts Center, in cooperation
with this Department, will be presenting a series of four
plays this season. The opening production will be "Fathers
Day" directed by Tom Titus and scheduled to open November 7.
The Friends of the Newport Theatre Arts Center have-developed
a strong organization for the ;production of community theatre.
This Department's relationship with the Friends of the Theatre
Arts Center has been very positive and staff looks to thh- future
growth of the organization.

SUBJECT: PARKS & STREET TREE ACTIVITY REPORT
In addition to our normal park activities the Parks Division performed
the following tasks:
1. Removed overgrown shrubbery on Ocean Blvd. that was
blocking the view of the ocean. Replaced a chain
link fence that was unsafe and planted vines on it.
2. Seeded an area of Las Arenas Park.
3. Removed the old wooden fence between our park and the
American Legion at 15th Street and had a new chain
link fence installed.
4. Installed a goal post at Newport Harbor High that
had been taken down by one of our softball teams.
• 5. Mowed four school fields for the School District.
6. Planted seven Oleanders adjacent to wall at Lido Sands
where shrubs had been remove d to install sidewalk and
curb.
7. Retrieved a park bench from the ocean that was dropped
off the end of the Balboa Pier.
8. Picked up and delivered furniture that was donated to
-the Oasis Center.
9. Installed sleeves under Oasis parking l.ot so that
planters can be irrigated.
10.• Had fill soil put in at the Oasis Center &long 5th Ave.
Our Street Tree Division performed the following this month:
1. Trimmed-404 trees
2. Planted 4 trees
3. Removed 15 trees

5. Completed the trimming of the Eucalyptus trees along
the bike trail at the Westcliff Goves.
6. Finished trimming the Broadmoor section of Harbor
View Hills.
Our crews are currently working in the Baycrest area of Westcliff, Orchid
Avenue and Poppy Street in Corona del Mar, and Fashion Island.
