V .s WO Te INDEX Present Item #7 Tree Removal Request Ron Whitley stated that the request to remove the tree on 4th Street at 701 Carnation has been routinely denied by staff in accordance with Council Policy I -9, in the past. Policy I -9 states that unless a tree is unhealthy, staff cannot remove that tree. The policy was adopted to retain City trees. Mr. & Mrs. Longacre were present to speak to the Commission. Mr. Longacre stated that since he purchased the property nine years ago he has had nothing but problems with-the tree.. This tree is one of three on the parkway adjacent to his propoerty. He is the only one in his neighborhood to have three trees in such, a close proximity. Mr. Longacre would like to keep the other two trees, which are 90' apart, and just remove the one. The tree is scarred by cars 'parking, there even-though the curb is painted -red. Jack Brodks an& taff= became aware of the problem only three to four-- months ago and stated _it is a healthy tree. An x Motion was made that we sustain the staff decision to retain Second x the street tree on 4th Street in Corona del Mar,. Ayes x x x, x No's x Item48 Ford Aero- nutroni.c Park Ron Whitley stated that we have been discussing the proposed Site park at the Ford_Aeronutronic si.te for some time. We have reviewed several alternatives; one being, to eliminate the park site and accept in lieu fees. Motion x Motion was made to accept the J.M. Peters Company's Second x recommendation in concept for accepting in lieu fees for All ayes the park site. Motion carried. Motion x Motion was made that we recommend to the appropriate agency Second' x to consider the current appraised fair market value of the All ayes property with respect to the in lieu fee amount. 'Item49 Theatre Arts Study City Council formed an Ad Hoc Committee to address and answer some questions with regard to the development of the " Theatre Arts Center. The committee has met for the last two months and formulated a report which was presented to • the Council. The Council referred this back to the PB & R Commission for comments and discussion. Patti -Gene Sampson, President of the Friends of the Theatre Arts Center, took the podium and stated that they needed some breathing time to understand and become clear on what the Ad Hoc Committee is recom =•' mending to City Council.. Patti -Gene got her answers and supports the Ad Hoc Committee's recommendations to Council. A resident of Newport Beach, who lives in the vicinity of the Theatre Arts Center, took the podium and presented some problems. One probTem'i-s the parking in the area and the new sign being too bright. Motion x Motion was made that we authorize an architects study to be Second x completed that would provide the cost estimates for re_ All ayes, modeling the existing Theatre Arts builFdimg. They will not just go in and look at one degree of remodeling, but give us many cost estimates with perimeters showing various • degrees of rennovatibn, what we can get for our money. Motion x Motion was made to accept the proposed Council Policy I -18, Second x for community theatre. All ayes Motion was made to establish a City Council Ad Hoc Committee Motion x for the development of a City cultural element to be in- Second x cluded in-the City's General Plan. All ayes Item #10 Barbecues and Braziers Ron Whitley stated that over the years there have been designated area for barbecues and braziers on the beaches. Balboa Pier and Corona del Mar State Beach are the only two areas where the pits remain. Ken Jacobsen, Marine Chief stated that the number of barbecue pits have decreased significantly due to problems existing, such as: stealing fuel, fences, private wood piles, construction material, anything combustible. Motion x' Motion was made that we endorse the plan as suggested by the Second x Marine Department: Ayes x x x x No's x 1. Only charcoal fuel would be allowed (no open wood fire). • 2. Require that the barbecue /brazier be elevated from the.sand to keep the sand from becoming overheated, which would cause burns when the brazier is removed. 3. Require that the charcoal be thoroughly extinguished and the coals and ashes properly disposed of in a trash receptacle. Motion Second All ay • C, J �;� City Council Chambers 6&30P.M. r s Item #11 Jeff Kolin stated-that City Council received a request from the Women's Civic League,which was forwarded to the PB & R Commission, that we review the policy which states that we charge a fee for the use of Mariners Park multi - purpose room for the Women's Civic League. They have been using, the multi - purpose room for a number of years. They are requesting that the City .Council authorized reduced fee df $50 be waived entirely. The Women's Civic League is the only group that gets a reduced rate. x Motion was made that-we reject the facility fee request and that we not give any preferential fee reductions to any special interest groups or any other group. Item' 412 This item is deferred to August meeting. III.. 'ITEMS;FOR DISCUSSION: 'Item #13 This item will be.brought back i.n August for discussion with a member of the Planning Department present to up -date and revise the Open Space and Recreation Element of the General Plan. Sub - committee to guide consultant. Item' #14 New committee names and members are as follows: Parks Committee - Commissioner Cole Beaches Committee - Commissioner Morin Recreation Committee - Commissioner Stuart Item #15 Chairman Ammerman stated that what we want to do as a full commission is set some goals and objectives. Discuss where we are with our objectives on a quarterly basis. Division Friends of OASIS � • CITY OF NEWPORT BEACH PARKS, BEACHES AND RECREATION COMMISSION August 4, 1981 TO: PARKS, BEACHES AND RECREATION COMMISSION FROM: Parks, Beaches and Recreation Director SUBJECT: REVIEW OF COUNCIL POLICY I -12 - 'OCEAN FRONT "STREET END IMPROVEMENTS RECOMMENDATION: Recommend to the City Council that Council Policies I -1,- Bay Street End'Plantings; I -12, Ocean'Front "Street End Improvements;•and I- 15;'Ocean Front'Alley Improvements be combined into a new policy, - 10;'ImproVements'in'PUb fc Ways Ending at�Ocean:Front- or:BaV'Front. DISCUSSION: Staff of this Department and the Public Works Department have extensively . discussed the subject policies to provide a new policy that gives clarity and is consistent with current operational procedures. The original in- tent of the beautification concept is retained and the only changes being proposed are to have the new policy be administered by the Public Works Department and a section on enforcement when conditions of the approved development are not adhered to. Copies of the existing policies and the proposed new policy are attached for your-review. Whitley RAW:ma Attachments 0 4� b iA I -1 11/27/78 BAY STREET END PLANTING Bay front street ends may be improved for utility and aesthetic purposes under the following conditions: 1. Bay street ends at beach level: a. A two -foot wide planting area on each side of the beach will be bordered by a redwood or concrete strip to protect the sand against contamination. b. A two -foot high hedge will be planted in this area and will extend 10 or 15 feet out from each side of the beach at the end of the existing concrete pavement. A similar hedge should be planted across the end of the street, but should leave space fog City equipment to enter the beach area. 2. Street ends when tidal flow prevents standard installation: a. Landscaping on paved street ends must have approval by the City of specific plans. b. Reasonable access to the beach areas must be available. k 3. Installation costs are the responsibility of the adjacent property owners. 4. The City will recognize these areas as "Street End Beaches" under the control of the Parks, Beaches & Recreation Department. Adjacent property owners will provide maintenance of plantings. 5. Members of community associations should do all in their power to assist City Departments to maintain law, order, decorum and neat- ness of those street -end beaches. 6. Application for bay street -end improvement will be filed with the Parks, Beaches & Recreation Department. . Adopted - February 11, 1957 Reaffirmed - August 30, 1966 Reaffirmed - November 12, 1968 Amended - March 9, 1970 Reaffirmed - December 10 1973 Amended - November 27, 178 1 -12 2/9/81 OCEAN FRONT STREET -END IMPROVEMENTS Ocean front street ends may be improved for utility and aesthetic purposes under the following conditions: 1. All construction and landscaping will be installed at the expense of the adjacent property owners in accordance with specifications established by this Policy. 2. Landscape maintenance and watering will be provided by the adjacent property owners to the satisfaction of the City. A sprinkler system connected to the adjacent property must be installed in each planter. 3. All work will be installed to grades established by the Public Works Department to coincide with existing,facilities and to insure proper drainage. ' 4. A four -foot (4') wide sidewalk will be provided on both sides of the street right of way adjacent to the property line,' 5. A minimum of twelve feet (121) of'unobstructed access to the beach will be provided in the center of the right of way and will be sur- faced with brick, asphalt, concrete of artificial turf under the following specifications, or an equivalent surfacing subject to the approval of the City. A. Portland Cement Concrete. Six inches of concrete over compacted I ative. B. Asphalt Concrete. Two and one -half inches of asphalt concrete over a,six -inch thick aggregate base. C. Artificial Turf. Approved artificial turf to the properly glued -to surface of asphalt concrete or Portland Cement concrete installed in accordance with A. or B. above. D. Brick. Brick to be installed over a four-inch thick aggregate base. A dry mix of one -to -one cement and clean plaster sand to be swept into the 1/4" to 1/2" space between bricks. The dry mix will be moistened with a fine spray of water after it is in place. 6. Planters five feet (51) wide will be provided between the sidewalk and the center access along a portion of each side of the street with plant material being installed in accordance with City speci- fications. A six -inch to eighteen -inch high lip of concrete, brick or rock will be installed as part of the planter. 7. All improvements will extend from the nearest street or alley im- provement'to the ocean -front property line. 8. Applications for street -end improvement will be filed with the Parks, Beaches and Recreation Department. 10. Minor variations to the policy may be approved by the Parks, Beaches and Recreation Department. 11. Property owners who develop - street ends may also wish to participate in the City'.s program of placing palm trees on the ocean -front beach. Details of this program are available at the Parks, Beaches and Recreation headquarters building at 3300 Newport Boulevard. 12. All improvements will be installed at the expense of the adjacent property owners in accordance with specifications and plans approved by the City. 2. All work will be Installed to grades established by the Public Works Department. 3. All improvements will extend from the nearest street or alley improve- ment to the northerly line of the ocean front. 4. Landscaping or potted plants will be,permitted in the portion of the alley right -of -way that terminates at the ocean front sidewalk in accordance with plans approved by the City. A six -foot wide, invit- ing passageway will be maintained for pedestrian access. All land- scaping will be maintained by the adjacent property owner to the satisfaction of the City. If 5. Where vehicles will travel, alleys may be surfaced with brick, asphalt, concrete or equivalent surfacing, subject to City approval. 6. Where pedestrians will travel, the six -foot passageway may be surfaced with sand, brick set in sand, asphalt or concrete, subject to City approval. 7. All improvements not meeting the requirements for Standard Public Works Construction will be maintained by the adjacent property owner to the satisfaction of the'City. S. Adopted - August 12, 1974 Reaffirmed — November 11, 1974 • M r / DRAFT n L -10 August 4, 1981 PRIVATE ENCROACHMENTS IN PUBLIC WAYS ENDING AT OCEAN FRONT OR AT NEWPORT BAY I. GENERAL It is the general policy of the City that streets, alleys and other public ways ending at Ocean Front or at Newport Bay are reserved for public use or open space; and that the - rights of the public, present and future, in said public ways are not to be diminished by the installation of private encroachments in said public ways. Private encroachments will not be permitted in said public ways unless in- dividual circumstances indicate that approval will be consistent with the public interest. Private encroachments may be permitted in said public ways for utility . and aesthetic purposes under the following conditions: 1. The improvements do.no.t create an impressions in the mind of the average member of the public that any portion of the public way is private property. 2. The improvements do not decrease the ease of access to the beach for utility vehicles or pedestrians. 3. The improvements do not result in the loss of legal parking spaces, except for driveway approaches conforming to Council Policy L -2, "Driveway Approaches." 4. The improvements do not eliminate.views of the beach from the nearest alley or cross - street that is parallel to Ocean Front. II. TYPES OF PRIVATE ENCROACHMENTS • A. Private encroachments requiring prior approval of the City Council and a permit from the Public Works Department: 7 1. Structural encroachments not otherwise listed, including, but • not limited to, fences, walls, patios, raised planters, etc., which encroach in excess of one foot into the public right -of- way, or exceed 3 feet in height. 2. Driveway approaches not conforming to Council Policy L -2. 3. Modifications to original design concepts ,approved by the City. 4. Signs. 5. Lighting. 6. Parkway surfacing other than standard portland cement concrete, textures concrete, or brick installed at grade. B. Private encroachments requiring prior written approval of the Parks, Beaches and Recreation Department: 1. Bay Front street ends. a. Bay street ends at beach level may contain two - foot -wide • planting areas bounded by redwood or concrete strips and and containing hedges no more than two feet in height. The planting areas may be installed: (1) At each side:of the prolongation of the street end extending no more than 15 feet from the end of the paved street. (2) At the end of the paved street, except that a 12 -foot- wide opening must be left for City equipment to enter the beach area. b. Bay Street ends where tidal flow prevents standard installa- tion may be landscaped, subject to the prior approval by the City of specific plans prepared by the applicant. • Access to beach areas must be provided for in any such specific plans. eA 1 y 8 I U r1 0 2. Unimproved Ocean Front street ends may be improved under the following conditions: a: Improvements will be installed at the expense of the adjacent property owners. b. Landscape maintenance and watering will be provided by the adjacent property owners to the satisfaction of the City. Approved artificial turf glued to surface of asphalt concrete or portland cement con- crete installed as described above. (4) Brick. Brick installed over 4 inches of imported aggregate base. A dry mix of one -to -one cement and clean plaster sand to be swept into the 1/4" to 1/2" space between bricks. If, in the opinion of the Parks, Beaches and Recreation Depart- ment; the location and nature of this type of encroachment is such that review by the Parks, Beaches and Recreation Commission is warranted, the Department may forward the application to the Commission for review. 'D. Private encroachments requiring,a permit from the Public Works Department: 1. Standard drive approaches. 2. Standard curbs, gutters, sidewalks, and street pavement. 3. Carriage walks and parkway surfacing of standard portland cement concrete, textured concrete, or brick. 4. Cable television and public utility facilities. 5. Structural encroachments not otherwise listed, including, but not limited to, fences, walls, patios, raised planters, etc., which encroach one foot or less into the public right -of -way. If, in the opinion.of the Public Works Department, the nature or location of this type of encroachment is such that City Council review is warranted, the Department may forward the item on to the Council for action. E. Private encroachments not requiring a permit: None. III. APPLICATION PROCEDURE. All applications for permits to construct private encroachments under this policy shall be made to the Public Works Department. • 5 (I • IV. INSTALLATION All' improvements made under the provision of this policy shall be paid for by the owners of adjacent property. V: MAINTENANCE All improvements made under the provisions of this policy shall be main- tained by and at the expense of the owners of adjacent property. VI. ENFORCEMENT Enforcement of this policy shall be the responsibility of the Public Works Department. In the event that private encroachments constructed under the provi- sions of this policy are not maintained, the Public Works Department shall give written--notice to;the-permittees to restore said improvements to an acceptable condition, and further setting forth a specified date • by which time the improvements must be restored. Failure to restore • said improvements within the period of time specified shall be cause for the General Services Department to remove the improvements from the public way without further notice to the permittee. Nothing herein shall prevent any permittee from appealing any of the provisions of this policy to the City Council. A • CITY OF NEWPORT BEACH PARKS, BEACHES, AND RECREATION COMMISSION July 29, 1981 TO: PARKS, BEACHES, AND RECREATION COMMISSION FROM: Parks, Beaches, and Recreation Director SUBJECT. 1980 PARK BOND RECOMMENDATION: Recommend to the City Council that they adopt a resolution authorizing the application for funds, available through the 1980 State ParksBond program, for San Miguel Park. DISCUSSION: As you know, we are designing San Miguel this fiscal year, with plans for development during FY 1982 -83. To assist in this major capital improve= ment the use of the subject grant funds is desirable. It is estimated that the proposed park development will be arount $700,000. The Balboa Penninsula Point Association discussed the proposed location of a bicycle parking area at the West Jetty at our July meeting. Residents in the immediate area have observed that the major- ity of bikers ride to the street end, rest on the benches and enjoy the lovely view for a few minutes, then resume their ride. These people do not lock their bicycles but keep them with them instead. The few bikers who do use the beach wheel their bikes out to the trees nearest the water and lock them where they can keep watch on them. It is our feeling that a small bicycle parking area could be constructed in the area near the trees closest the water line. Recreation 1. Programming - To assist the PBR Department in program selection. 2. Facilities - To review the adequacy of existing facilities and community needs for additional facilities. • 3. Community participation - To be responsive to community recreational needs. Beaches Parks 1. Usage - To provide an optimum level of public usage. 2. Conservation - To assist in the preservation of our public beaches. 3. Liaison - To act as a liaison with the Marine Department and other agencies related to the beach usage. 1. Park and tree maintenance - To assist the PBR Commission in evaluating all aspects of park and tree maintenance (including street medians). 2. Acquisition and development - To assist the PBR Commission in all aspects regarding the acquisition and development of park areas. The above list is quite general. Ammerman, Manager DKA:pm t 10 RECREATION DIVISION • PROGRESS REPORT JULY 1981 Senior Citizens The program at Oasis Center continues to flourish under the cooperative leadership of the Friends of Oasis and City staff. A program of Saturday cultural events was kicked off with a performance by the "Showcase Singers" A regular schedule of these cultural events will be provided at a modest cost to the Seniors. The long awaited insurance program for Oasis activities will be in force very shortly. The City Council approved the Friends request for $2,400 to pay for half of the insurance premiums. The insurance program should provide adequate coverage for all Oasis activities. Special Activity,Classes Total revenue for activity classes so far this summer is $38,088 and an additional $15,323.50 for tennis classes. This compares with $36,316 and $17,028 for the entire summer last year. We hope to reach the level of last summer's tennis revenue as well with two sessions remaining. The fall brochure copy was turned over to Shorko Advertising for typesetting and layout. -The finished brochure should be in the mail on August 14, • with registration beginning on August 28. We are looking forward to an exciting new look brochure. The City Council voted to not approve the wine appreciation course. Staff will still have - plenty to do with the City's anniversary coming up in September•and a number of new classes added to our schedule. Sports Camps The sports camps at both high schools ran very smoothly this summer. There were some minor facility problems which were resolved during the first weeks= of the camps. In comparison to last year's figures more revenue was raised but participation decreased. This was due,`in. part, to a substantial fee increase and,`in part, to a decline in school enrollments. The Harbor High School 50 meter pool continues to be the most popular location for lessons. Corona del Mar High School and the 10th Street Bay location also offer summer swimming lessons. With four more weeks remaining for swimming lessons, it looks like we will easily pass last year's totals. The post season tournament for adult slo -pitch softball is scheduled for August 22 and 23, and August 29 and 30, at Coronartdel Mar High School. The men's "A" and men's "Novice" Beach Volleyball Tournaments are scheduled for August 8 and 9, and August 15-and 16, at the Balboa Pier Beach area. A first ever three wall racquetball tournament will beheld August 29 and 30, • at West Newport Park.
