Ron Whitley reported that this is the appropriate time for

Series which gives the Commission direction concerning actual
operations. The City Council will review this series in
October. Series I will be an action item on the Commission's

to the City Manager for his report to the City Council.
Ron Whitley reviewed each of the I Series. After discussion
and questions by the Commission, the following were
recommended:

Item (5) - Add: A sub drip system should be installed when
designing park and median landscaping.

will refer this policy to the Planning Center to determine
if there is a need for I -3.

Item #6 - Commission Subcommittees
Ron Whitley reviewed the role of the subcommittees listed.
He noted that Capretz is interested in serving on the Ocean-
front and Beach Committee. Rae Cohen asked to serve as the
liaison for the Friends of the Theatre Arts Center Committee.
We will need a liaison for the Friends of OASIS Committee
as soon as possible. It was suggested the Tree Committee
be eliminated.
Hopkins. recommended the Commissioners take this month to
think about the areas in which they may want to become
involved.
Item, #6.A. - Sandcastle Drive
Jack Brooks gave 'a brief history of the Sandcastle Drive
Eucalyptus Tree problem. He stated that ex- Commissioner
Cole and Paul Queryel of the Harbor View Hills Association
recommend allowing the removal of the trees by those who
want them removed, along with a gradual replacement schedule.
The cost will be borne by the Homeowners Association. Jack
Brooks, Rae Cohen and Mr.. Queryel will make specific recom-
mendations and Ron Whitley will give a complete history at
the next Commission meeting on September 6. This will be an
action item on the agenda. The homeowners will be so
notified and it was suggested that a,waiver or release form
be implemented for each address after the recommendations are
made. Removal and /or replacement will be done by independent
contractor(s).
III. INFORMATION - REPORTS
Item #7 - Recreation Division
Ron Whitley reported that Tom Line from the City of Carson
has been.appointed Recreation Superintendent and that we are
looking forward to his coming aboard on August 15.
Item #8 - Park'and Street Tree Division
No discussion.
Item #9 - Riverside Drive Scout House
Ron Whitley reviewed the Riverside Drive Scout House status
and noted that the volunteers are doing an outstanding job in
refurbishing it. Jack Brooks presented a preliminary schema=
tic of the area showing proposed landscape improvements and,
the addition of a basketball court and turf area at a future

date. Jack will present the plan to the volunteers for their
review and approval.
When the building•is completed, plaques will be presented at
a Commission meeting to Brian and Bonnie Jeannette and Gail
Demmer for their outstanding contribution in this endeavor.
Cohen•also suggested a ribbon cutting ceremony when the
Scout House is completed. Hopkins gave special thanks to
Jack Brooks for his time on the project.

Ron Whitley reported that after the City Council received the
Marinapark Study - Alternate Uses report, the City Manager and
Council had a number of questions which concerned them,
however, many-of these are the responsibility of other
departments. They are also requesting a graphic showing the
existing trailer park and an overlay of other alternatives
which keep approximately 75% of the trailer park in exist-
ence with less public use.
V. ADJOURNMENT

SUBJECT: BALBOA BOULEVARD IMPROVEMENT
The City Council recently authorized the preparation of an EIR to
evaluate widening Balboa Boulevard between 33rd and 44th Street.
The primary purpose.of the widening project is to improve safety and
reduce accidents by increasing, the sight distance and eliminating the existing
roadway obstructions. Overall improvements contemplated include wider park -.
ways, elimination of center divider parking, and the installation of median
landscaping in the middle of the block.
The proposed roadway improvement will' widen the street on the inland
side by 25 feet. Implementation of this project will require the acquisition
of six more parcels and the use of a 25 -foot strip of-the 38th Street Park.
The project is to be-constructed,using City ,Gas Tax Funds and the
County Arterial Highway Financing Program (AHFP). In order to apply for AHFP
funding,.it is necessary that the EIR be completed and certified by the City
Council by the end of this year.
• It is recommended'that the subject project be placed on the Parks,
Beaches & Recreation Commission agenda•for September 6, 1983, as an informa-
tional item. City staff and/or our consultant can make a presentation ,re-
garding the widening and its effect on the park. It is also hoped that the
Commission can provide staff with some input or a preliminary recommendation
regarding the park for inclusion in the Draft EIR. A Draft EIR is expected
to be completed by the October meeting and formal action by the Commission can
be taken at that time..

The 38th Street Park is a portion of a site that was originally
shown on the 1905 River Section Tract Map as "Bathing Pool ". No mention of
public dedication for the "Bathing Pool" was made on this map. The tract was
developed by the Orange County Improvement Association. In December of 1929
this association sold "That certain parcel marked ''Bathing Pool' on the map
of River Section" to the City of Newport Beach. 'Attached is a copy of a por-
tion of a 19.16 map which shows the "Bathing Pool ". The City owns the "Bathing
Pool" parcel in fee, with•no restrictions on its use.
The attached sketch also shows the portions of the bathing pool par-
cel that are currently being used for Balboa Boulevard and Park Lane (collec-
tively 45 feet). The 38th Street Park now uses the remaining 105 feet of the
original parcel. The proposed widening of Balboa Boulevard will reduce the
park width to 80 feet. It is felt that the existing uses in the park can be
accommodated after Balboa Boulevard is widened. A new restroom will be

constructed since the existing structure is not suitable to be relocated. The
other facilities can be relocated. It is anticipated that replacement trees
and shrubs can- also be planted.to take,the place of those that are removed.
I hope that'we can, through this project, not only improve the
appearance of the Park, but also improve its facilities and make it a better
place to go.

SUBJECT: Racquetball Tournament Request
In 1981 this Department co= sponsored a Racquetball Tournament with Mr. Joe
Padilla as our contract employee. This arrangement was unsatisfactory as
a number of problems occurred that caused the staff to determine that the
program would not be pursued on this basis in the future. Some of these
problems were caused by overcrowding of the area at West Newport Park during
a busy season and the fact that there was a bathing suit competition connected
w -ith the event.
In 1982 Mr. Padilla was told that the tournament would have to be conducted
as a special event coordinated through the License Division of oUr Finance
Department. Although the event obtained no approval from the License
Division, it was held illegally. The same problems occurred in 1982.
The promoters of the event have appeared before the City Council and the
. matter has been referred to the Commission for recommendation.

Staff is reluctant to be involved with a small program that allows our
Department to be criticized as a result of our co-sponsorship,. If a non -peak
time and controls and conditions can be established, the activity would be
most welcome.

We the resident voters and members of the community directly adjacent
to the racquetball courts on 56th and Seashore, support the Directors
of the Newport "Off the Wall" Classic. We feel that this racquetball
tournament promotes the full use of the facility and stimulate the
youth of the community in many positive ways, we see more area resi-
dents using the courts as a direct result of the tournament.
We also feel that the rental fees imposed on this community oriented
project, by the City Council, are excessive. We would like to see them
lifted or at least made cost permitting. Everyone profits from an event
such as this, from the local merchant to the juvenile under peer
pressure.
Please address this issue in your next City Council meeting.

OUTDOOR RAQUETBALL
TOURNAMENT PLANNED
City of Newport Beach, Parks, Beaches and Recreation Department is
sponsoring the Newport Beach "Off the Wall" classic. This outdoor
event is being planned for August 29 and 30, at 56th & Seashore St.,
(Pacific Coast Hwy). There will be three divisions represented,
men's singles, woman's singles, and mixed doubles. Hospitality
will be provided both days and an awards banquet Sunday afternoon.
Trophies and prizes will top off this weekend of fun in the sun.
Open to any "B" or "C" player; this tournament will provide
spectators with plenty of action. Anyone interested can call 640 -2271
or 979 -7436 for more details. Entry forms are available at the Parks,
Beaches and Recreation Department, 3300 Newport Blvd., Newport Beach,

This Department has a number of policies known as the I Series which are
closely related to the responsibilities • of our operation. Historically,
and by policy, the City'Council reviews these policies annually in
October. To prepare for this review, the policies are being provided
for our initial review. Staff will go through each policy verbally at
our meeting to assess their purpose and effectiveness.

SUBJECT: Commission Recognition Program
The Parks, Beaches and Recreation Commission approximately two years ago
established a program whereby individuals and groups that have provided
extraordinary service or support to the objectives of the Commission
could be recognized. Not to be taken lightly, outstanding recognition
has been identified in the past. Staff would like to recommend that
four individuals be approved for presentation at the October meeting of
the Commission.

2. Bonnie Jeannette
3. Gail 'Demmer
For their active involvement in refurbishing the Riverside Drive Scout
House. Go by and take a look at the builing. It looks great!
4. Marilyn Cyprien
Has served as an office volunteer the entire summer and has done an outstanding
job with no fiscal remuneration.
There may be others that the Commission would like to consider. Please feel
free to recommend or suggest others.

SUBJECT: Marinapark Study - Additional Information Request
After the'initial review of the Marinapark•Study- Alternate Uses by the City
Council at their Study Session of June 27, T983, a number of questions and
additional information was requested for further deliberation on the concept
as proposed in the report. Listed below are answers as determined by the
committee and /or other City Departments. An alternate concept that signi-
ficantly reduces the impact of.vacating'the entire mobile home park is
provided for your review. By eliminating 5 trailer • spaces, some of the
proposed recreational and community uses can be accommodated. I will verbally
and graphically show you this plan at your convenience.
I. On Page 7 of the Study we referred to a November ballot measure on
coastal legislation. This was wording that was taken from the 1972
" Marinapark Planning Study -A Unique Opportunity for Public Shoreline."
It referred to the legislation that created the Coastal Commission.
We unfortunately used the historical information in the new report and
• failed to catch this inconsistency. To further answer the question,
there is no new initiative concerning coastal issues and the report has
been corrected to eliminate this statement.
A concession operation is discussed= Page 13 and further narrative
is �rovided to clarify this concept. 'A Community Multi- purpose Building
of -6,000 s.f., as indicated on Page 14 of proposed development costs,
would include on the ground floor a small ±500 s.f. concession operation
similar to what is found at the Corona del Mar City /State Beach. Not
envisioned to be a restaurant, but an operation that provides hamburgers,
hot dogs, soft drinks, beach supplies, etc. This recommendation combines
Community Center, public restrooms and concession building into one area
for cost efficiency.
3. The information regarding traffic generation has been supplied in a mgmo
from the Planning Department (attached).
4. A larger photo map has been mounted to show existing conditions for review
purposes. In addition, an alternate concept is shown on an overlay.
5. The question of responsibility of relocating existing tenants was reviewed
by the committee as indicated by the Planning Department dated April 4, 1983
(attached). Although discussed by the committee, they chose to not include
the information in their report as it was felt that the decision and /or
action was beyond the scope of the study. In summary, with a notification
• to tenants, of a maximum one year, prior to conversion of the mobile home
park there are no relocation cost requirements.
6. As determined by our Environmental Coordinator, Fred Talarico, the
implementation of the recommended proposal' would require an Environmental
• Impact Report (EIR) and the estimated cost of this report would be
$8,000 to $12,000.
The study committee has indicated a desire to transmit the original recommendations,
to the City Council as soon as possible. •If I can be of help to accommodate this

When we last discussed the potential Marinapark redevelopment, you requested
that we obtain some additional information for you. This is summarized as
follows:
Environmental Documentation
Fred Talarico, Environmental Coordinator, has indicated that an environmental
impact report (EIR) would be required for the plan earlier proposed to the
• City Council. The estimated cost of the EIR would be $8,000 to $12,000.
Traffic
Based on traffic generation rates for similar uses, provided by Traffic
Engineering, the proposed plan would result in the generation of approximately
1174 average daily trips ends (ADTE) on a weekday and 2120 average daily trip
ends on a Saturday, increases over existing levels of 170 ADTEs and 700 ADTEs,
respectively.

SUBJECT: Conversion of Marinapark
State statutes for conversion of mobilehome parks exist in the Civil
Code, primarily addressing tenant /landlord relations, and in the
Government Code, primarily addressing the responsibilities of the
governing body to ensure that certain actions are taken. In this
case, the City fulfills both the role of the landlord and that of the
governing body. It must therefore meet the responsibilities of both.
Under Section 798.56 of the Civil Code a mobilehome park owner must
provide homeowners in the park with a notice of change of use as
follows:
• 1. The management gives the homeowners at least 15
days written notice that the management will be
appearing before a local governmental board,
commission or body to request permits for a change
of use of the mobilehome park.
2. After all required permits requesting a change of
use have been approved by the local 'governmental
board, commission, or body, the management shall
give the homeowners six months or more written
notice of termination of tenancy.
If the change of use requires no local
governmental permits, then notice shall be given
12 months or more prior to the managements
determination that a change of use will occur..
The management in the notice shall disclose and
describe in detail the nature of the change of
use.
3. The management gives each proposed homeowner

his tenancy that the management is requesting a
change of use before local governmental bodies or
• that a change of use request has been granted.

Although the City will not need a permit for a change of use, it would
be desirable to notice all homeowners before any public hearings
regarding park conversion.
Under Section 65863.7 of the Government Code, prior to, converting a
mobilehome parking to another use, the'project proponent must file a
report describing the impact conversion will have on the residents of
the park. The report is to address the availability of adequate
replacement space in mobilehome parks. In addition, as stated in the
statute:
The person proposing such change in use shall make
a copy of the report available to each resident of
the mobilehome park at least 15 days prior to the
hearing on the impact report by the advisory
agency, or if there is no advisory agency, by the
legislative body.
The legislative body, or its delegated advisory
agency, shall review such report, prior to any•
change of use, and may require, as a condition of
such change, the person or entity to take steps to
mitigate any adverse impact of the conversion on
the ability of displaced mobilehome park residents
to find adequate space in a mobilehome park.
. Thus, the City must prepare a "resident impact report ", circulate the
report to the park residents, and consider the report in reading its
ultimate decision regarding conversion.
Additional requirements pertain if the conversion involves the filing
of a tentative or parcel map. However, because the proposed
conversion of Marinapark would entail no subdivisions, these
conditions are not a factor.
Section 65590 of the Government Code regulates the removal of housing
units in the Coastal Zone. Marinapark is in the Coastal Zone, but,
because the proposed use is considered coastal dependent, portions of
the,Section regarding replacement housing would not apply.

PARK AND STREET TREE DIVISION,
AUGUST, 1983 PROGRESS REPORT
Our Park Crews performed the following tasks during the month of
August:
Trimmed shrubs and .trees on bike trail on West Pacific
Coast Highway.
Replaced bol'lards and chain at end of River Street and
West Newport Park.
Removed and trimmed shrubs on East Pacific Coast
Highway.
Removed cut brush from Spyglass Hills Nature Park.
Poured concrete pad for storage building at OASIS.
Replaced volleyball post at Colton Street end.
Built three park benches for replacements.
Our Street Tree Di- Vision performed the following:
Root pruned 35 trees.
• Trimmed 1593 trees.
Planted 1 tree.
Removed 4 trees.
Completed 8 work requests.
Areas being trimmed are Buffalo Hills, Buffalo Hills Park
and Ford Road median.

RECREATION DIVISION
0 AUGUST, 1983 PROGRESS REPORT
Youth and Adult Sports
Summer'basketball and softball leagues have just completed their successful season.
Both the programs were run extremely well by the Recreation Division and there were
only minor problems. To work out even the minor problems of the two programs will
depend greatly on an evaluation form sent out to the 181 coaches and managers.
An analysis of this evaluation will be mentioned in the next progress report.
The annual beach volleyball tournament at Corona del Mar State Beach had 101 teams
registered this year. There were three tournaments held for the Novice ''A' and
18 and under classifications. The tournament director said attendance was down
due to the bad weather.
The King of Newport Beach Softball Tournament was held at Corona del Mar High School
on August 13 and 14. There were 12 teams in the minor division.
The Girls Youth Softball teams competed in the Orange County Championships. Andersen
School sent teams from their 5th, 6th, 7th and 8th grades. Santa Ana won the
championship,..
Preparation is underway for the Boys Flag Football program. The season is due to
begin September 12 at six locations throughout the City.
• Aquatics and Sailing
The sailing program was successful this year but it is also becoming very competitive.
Revenue as compared to last year will fall several thousand dollars short this summer.
The drop is due partly to the Shields program. Next year's sailing program will be
improved due to a comprehensive evaluation. The lowering of class fees and the
dropping of certain staff members should increase attendance and save the City
money.
The swimming program was again excellent. The staff did an outstanding job and the
Belly Flop Contest on Saturday, August 27, was a great success. The City grossed
over $1000 more than last year.
The Body Surfing class was very successful. If there is any problem with this class,
it is the changing of the class location due to the wave configuration.
Facilities were very busy during the summer and they were kept clean by the maintenance
staff. An evaluation of our facility status for maintenance purposes will soon
take place and will be mentioned in subsequent progress reports.
Special Activity Classes
Summer activity classes showed an increase in profit for the '83 summer. Revenue
for 1982 was $48,407 as- compared to 1983 of $62,823. Because of the offering of many
new exciting classes and an annual adjustment fee, revenue was up 29 %.
Tennis class revenue for the summer was down slightly from last year.
The Fall Brochure has been mailed out as of August 22„ 1983. The brochure is very
comprehensive and lists all the classes and fall registration dates. Registration
�� should be heavy.

The Day Camp Program was very successful this summer. It ended with a spectacular
camp out at Grant Howald Park on August 19. A detailed camp evaluation is
• forthcoming.
The Corona del Mar. Fall Five Mile Run is being organized for October 23, 1983. Fliers
should be out soon.
Senior Citizens
August was a busy place for the OASIS Center. In addition to all the classes, trips
and games being offered, the OASIS held a very successful Luau on August 27 with
over 180 people in attendance.
There was a volunteer champagne party held on August 29 and several meetings for the
purpose of developing a croquet site at the OASIS facility.
Shuffleboard courts were finally accepted for use and a new Outreach Leader was
hired by the name of Pam McGovern. The Outreach Leader will also conduct training
sessions.
Meetings will be scheduled in September on the Health Fair to be conducted at OASIS
Center on October 1.

In reference to the decision by City Staff, we hereby appeal and
request that the commission afford us the opportunity to discusa
the proposed tree removal at my residence, 2126 Aralia.
The tree has created a nuisance and is a hazard due to the unusual
growth pattern of the roots.

of your next meeting, so that we may be put on the agenda.

SUBJECT: Roberti- Z'berg Urban Open Space and Recreation Program
Recommendation:
Request the City Council to adopt a resolution, identifying the project
of Irvine Terrace Park, utilizing the subject grant program allocating
$3,674 to be applied for and combined with the current Capital Improvement.
Discussion:
The Roberti- Z'berg Urban Open Space and Recreation Program was adopted by
the state legislature in February of 1977 and has annually provided funds
for park development. As all state budgets were reduced this year, our
allocation is $3,674 for F.Y. 1983 -84.
• As the amount is small compared to past years, the suggested action is
recommended' to take advantage of the program with an existing project.
