The meeting of the Parks, Beaches and Recreation Commission
was called to order at 7:00 P.M.
Item #2
Roll call was taken. Commissioners Brenner, de.Boom,
Herberts, Konwiser, Springer, Taft and Wolfe were present.
Item #3
Chair Wolfe asked that Item #11, Commission Subcommittees
and Liaison Reports, paragraph 10, the second sentence
read as follows: "He also reported the Committee is still
active and that The Irvine Company will be contacted again
concerning a site." Commissioner de Boom moved the minutes
of the January 6, 1987 meeting be approved as corrected.

Item #4
The agenda was adopted as presented with the addition of
Update on Posting Agendas, Park Report, Teen Center and
Street Tree Committee Report.
II. JOINT MEETING WITH FRIENDS OF OASIS
Chair Wolfe reported the Friends of Oasis meet with this
Commission periodically to discuss issues of mutual concern.1
The Commission then met with Board members, the Recreation
Supervisor, and a few members of Oasis. i
Dr. Charles McCann, President of the Board, referred to the
Capital Improvements Review and reported they are disappoint c
their request for an arts and crafts room addition is not
higher on the priority list and, as such, would like the
Commission to reassess the matter.
Chair Wolfe informed Dr. McCann that the project was not
presented with enough data as to costs, design„ etc., and
that other projects have higher needs. Dr. McCann said he
fel't there was miscommunication on this matter since they ;

Chair, Wolfe explained that although their project is low on

not, there are other alternatives which can be pursued. '

Mark De'ven suggested the Friends improve 'communication with
the Department regarding their requests in order that staff
can supplement their efforts.
Commissioner Springer suggested the Friends communicate to
her since.she-is liaison- to Oasis so, that she, can transmit
inforipation to ,the. Comipiss'on,,,
Dr. McCann then addressed the Liability Insurance matter.
Their insurance costs have escalated 144% resulting in a
tremendous impact on their budget. The Friends' Board will
•
examine this matter and will report back concerning a joint
financial consideration or alternative.
•
Mark Deven reviewed the insurance requirements for use of
City facilities and reported staff will provide an analysis
of the City's insurance policy required of all community
organizations.
Dr. Jim DeLamater, Chair of the Long Range Planning Committee,
referred to the Master Plan of Oasis which is under their
jurisdiction. He reported the arts and crafts building has
been proposed for over a year and is not to be confused with
the area to the north which was deeded to the City by The
Irvine Company three months ago and allocated for use by
the Oasis Center. Any construction on the north side will b
an addition and will take some time to plan.
Dr. McCann then thanked the Commission for their help and
support and reported everything else was going smoothly. i
III. COMMISSION COMMUNITY SERVICE AWARDS I

Chair Wolfe reported that twice a year this Commission honors
Service
those individuals who have provided significant contributions
Awards
to the City of Newport Beach. Five volunteers are being
recognized at this meeting for their outstanding services to
the City.

Chair Wolfe then presented the plaques as Mark Deven intro-
duced the following individuals and gave a brief summary of
his /her activities: James DeLamater, George Goepper, Norma
Gilchrist, and Bill Hamilton. Joe Jorgenson was not present
to receive his award. !

advised that-the recreation needs of the whole City be kept
in mind during public testimony and discussion.
The Bicycle Trails Study has recommended three Alternatives:
(1) Upgrade and leave the existing combination sidewalk/
bicycle trail as is; (2) Upgrade and widen the existing
sidewalk /bicycle t'ra'il; and' (3) Upgrade the existing walkway;
and - construct a new 12' wide!- separate•- bi•cycl•e trail•:'
Chair Wolfe explained that this meeting is part of the
planning process and that there will be more public input
solicited, including meetings with the City Council.
Chair Wolfe then introduced John Wolter from the Public
•
Works -Department, who is the staff liaison to the Bicycle
Trails Committee.
John Wolter addressed the Commission and gave a brief
history of the walkway which was originally constructed
in the late 1930's. He explained the different class
designations and pointed out the trail is designated Class 1
on the City Master Plan, County Master Plan and Local
Coastal Plan. It would take approval by City Council and
an amendment by the Coastal Commission to change the Class 1
designation.
Chair Wolfe reported letters were received from John Heydorf
,
Joe Casala, Frank Spangler, William Ficker, Donald Regan,
Lavona McVicker, Marlene Poitevent, Henrietta Romolo, J.
William Miller, Jack and Betty McCarthy, and Mr. and Mrs.
K.D. Goen. With one exception, all were against a proposed i
bicycle trail on the ocean front.
Chair Wolfe opened the meeting to public testimony.
Mrs. Stanley Lowe, 3501 Seashore, addressed the Commission l
and stated she favors Alternate 1 which is to repair the
existing facility. Mrs. Lowe lives in a unique situation
•
whereby they are on a small beach and surrounded by bicycle
trails. It is difficult to get in and out due to ped-
estrians, skaters and cyclists, therefore, they would not
want another trail.

meandering separate trail or use of the alley for cyclists.
Mr. James Quigg, 1924 W. Ocean Front, addressed the Commission.
He recommends the existing trail be repaired and extended to

Mrs. Lois Irwin, 1802 W. Ocean Front, addressed the Commissio

Mr. John Miller, 1232 W. Ocean Front, addressed the Commissio

Mr. Miller said he felt the main concern should be safety
on the bicycle trail and recommends resurfacing the present
boardwalk. He also feels enforcement of speed, etc. is a
very real problem.
Mr. Henry Swenerton, 1106 W. Ocean Front, addressed the Com-
mission and referred to Mr. William Ficker's letter. He
stated the Central Newport Beach Community Association
approves Mr. Ficker's plan wherein the present trail is re-
placed with a new walkway since the present trail is unsafe
and, in addition, eliminate the Class 1 designation. He is
against'a separate trail due to cost, noise, litter., etc.
Hillery Thamer, 1012 W. Ocean Front, addressed the Commission
and asked for clarification of the Class 1 designation which
John Wolter from Public Works explained. Ms. Thamer said she
favors improving the existing trail.
Albert Worley, 504 E. Ocean Front, addressed the Commission.
Mr. Worley recommended double lines be placed on the walkway
to separate pedestrians and cyclists. He also suggested
giving out tickets to enforce the law which would pay for the
police.
Ms. Gertrude Vorgang, 542 E. Ocean Front and owner of the
Pedal'Pusher Bicycle Shop,-addressed the Commission. Ms.
Vorgang pointed out she is opposed to the 3- wheeler bicycles

on the boardwalk and is in favor of repairing the existing
facility.

Pete Compton, 1 Canal Circle, addressed the Commission. Mr.
Compton said that for safety reasons, he favors two separate
trails from jetty to jetty.
Linda Slaughter, 900 W. Ocean Front, addressed the Commissio

She recommended shutting the -bicycle trail down during the
summer and enforcing the law that 3- wheelers are not allowed
on the trail. Ms. Slaughter said she favors putting funds
into improvement and enforcement.
Sgt. Joe Lambert of the Traffic Division addressed the
Commission. He reported enforcement is extremely difficult
since officers are busy elsewhere. The Traffic Division
recommends separated trails for safety purposes.
Mr. Gordon Barienbrock, 1124 E. Balboa Blvd., addressed the
Commission: Mr. Barienbrock's main concern is the speed
of cyclists and recommends 3 miles per hour signs be posted.
He recommends improving the existing walkway and considera-
tion of banning cyclists during certain hours.
Laurie Schnack, 211 E. Edgewater, addressed the Commission.
Ms. Schnack feels bicycles on the walkway are too dangerous
and would prefer the alley route idea.
Mr. Irving Waaland, 2804 W. Ocean Front, addressed the
Commission. Mr. Waaland asked that cycle limits at peak
hours be considered. In addition, he suggested a sign or
flag be posted when traffic is heavy and that this be
•
monitored.
Mr. Tomasek, 2213 Channel, addressed the Commission, Mr.
Tomasek believes visitors to the area should be provided
for and recommends a separate bicycle trail with speed
bumps. i

said she endorses a meandering bike trail from jetty to
jetty.

She would like to see the lane extend from Huntington Beach
to the jetty.
Mr. Todd Schooler, Member of the Bicycle Trails Citizens
Advisory Committee, reported he is in favor of a separate

trail due to safety and traffic concerns.
Mr. Rob Patterson, Chair of the Bicycle Advisory Committee,
reported they feel the safest program is to approve the
recommendation in the Ocean Front Boardwalk Plan which is
a separate 'bicycle 'trail. They would like the Commission
to approve Alternate 3 with certain conditions: (1) In-
corporate a speed' study and establish speed limits to be
supervised and patrolled; (2) Provide improvements to the
existing walkway; (3) Provide bicycle parking facilities
at street ends; (4) Provide a separate trail from 36th Streel
to the Pier (24th Street); (5) Make every effort to coordin-
ate Ocean Front and the McFadden Specific Area Plan; and
(6) Make every effort to work with those affected on the
project.
Marcia Nordland, 5710 Seashore, addressed the Commission.
Ms. Nordland voiced her concern over the liability issue and
suggested limiting times the sidewalk is used, repairing thel
sidewalk and use of signs.
Mr. Bob Caminiti, 112-36th Street, addressed the Commission
and said his main concern is safety and, therefore, he favor�
a separate trail.

David Alper, 310-1/2 Coronado, addressed the Commission. He
feels the safest solution would be a separate meandering
path which is patrolled.
Edward Line of Newport Heights addressed the Commission. Mr;
Line recommended bicycles be removed from the boardwalk and

favors keeping the boardwalk as it exists. He feels a
separate trail would also be used by pedestrians and he is
concerned about beach loss.

Commission. Mr.. Spangler said he -feels a separate trail

Marjorie Lindamood, 621 W. Bay, addressed the Commission.

She reported seeing dogs and people hit by cyclists. She
favors the existing walkway be repaired and enforcement
implemented,.
Maria Goen, 316 E. Ocean Front, addressed the Commission.

Ms. Goen referred to her letter and said she favors keeping
the existing walkway. She suggested more signs for both
pedestrians and cyclists and implementation of a bicycle
patrol which would cite unsafe and speedy cyclists.

the City will - represent the School District if the City is
deemed to be at fault. This has been reviewed and approved
by both the School District and the City Attorney.
Commissioner Taft motioned to, approve the Agreement as

VII. DISCUSSION ITEMS
Item #6 - Art in Public Places
Deborah Polonsky, Chai.r of the Arts Commission's Art in
Public Places Committee, addressed the Commission. Ms.
Polonsky gave a brief background of the Arts in Public
Places program. She then presented slides of certain areas
in Seattle where the architects and artists collaborated
on projects.
The Arts Commission will be working with this Commission,
and it is planned to use Parks, Beaches and Recreation
funds and Arts Commission funds for the design competition
at their first project at Inspiration Point. A Request for
Qualifications will be prepared and sent to landscape
architects who have worked with artists in the past.
Ron Whitley reported that refurbishment would be made with
this Department's Capital Improvement Projects fund and the
arts portion would be funded by Art in Public Places.
Ken Delino, Executive Assistant and staff liaison to the
Arts Commission, addressed the Commission and explained that
the six final landscape architects will be chosen jointly
by the Arts Commission and this Commission. The Arts
Commission will notify the artists and a design team will
be formed paid by the Arts Commission. The final decision
will be made by the City Council.
Chair Wolfe thanked Ms. Polonsky and Mr_. Delino for coming
to the meeting and providing this information. i

B. Budget
Commissioner Konwiser reported the increase in funds for
the 7700 Parks account is due to the request for three addi-
tional full time employees. There has been a substantial
increase in :acres added to the park system and additional
employees and equipment are needed to maintain the present
level of service.
Item All - Status of Capital Projects
Ron Whitley reported that before the bid process begins for
the Community Youth Center, plans and specifications will be
reviewed in depth by the homeowners associations. Mr. Deven
reported the plans are out of plan check and revisions and
corrections are being pursued,
Item #12 - Council Action on Commission Matters
Ron Whitley reported Commission matters receiving City
Council action are included in the agenda packet for their
information,.
Item #13 - Park and Street Tree Division
No discussion.
Item 1#14 - Recreation Division
In response to the Commission's concerns regarding day care,
Mark Deven reported that the School District is unable to
provide a facility, therefore, the need for extended day car
has been brought to this Department's attention and is being)
reviewed.
Item #15 —Update on Posting Agendas
Commissioner de Boom reported there have been no problems
with posting the February agenda except at the Riverside
Post Office which would not allow it.
Ron Whitley suggested this might be a staff function and the
Commission agreed staff will post the agendas and the
Commission will oversee the matter.
Item #16 - Park Report
Commissioner Konwiser reported the main items mentioned in
his January 5, 1987 report have been completed. There is,
however, no visible progress as to the Sign Project. Mr.

Whitley reported General Services told him a few will go out
per month and an acceptable cycle will be implemented.
Commissioner Konwiser recommended using the bid process or
getting a commitment from General Services to do one or two
signs per month.
Item #17 - Teen Center

flag and memorial plaque at the-Rhine Wharf location. An artist's rendering of
this concept is attached for illustrative purposes. Mr. Tozer envisions the
plaque portion of the structure as-being a memorial to Newport Beach and vicinity
• fishermen who have been lost at -sea.
As presented, the project would not cost the City for construction, installation
or maintenance. Mr.•Tozer woul•d'be responsible for generating the funds to
accomplish the objective,.

Recommendation:
Refer to the Recreation Programs Subcommittee a review of Liability Insurance
Requirements for regular use of,Ci-ty facilities by community organizations under
annual rental contracts and /or long term Lease Agreements. The review will be
conducted with the technical assistance of the City's Safety, and Insurance
Administrator and the City's- Insurance Consultant.
Background:
The lack of affordable general liability insurance coverage has affected many
community organizations as it has the-City of Newport Beach. At a time when
liability insurance coverage naming the City as additional insured i.s necessary
to providing specific activities and services, many community organizations are
• finding it difficult to obtain general liability in the aggregate limits required.
As discussed at the joint meeting with the Friends of Oasis Executive Board at
the Commission meeting of February 3, the Friends have witnessed a dramatic in-
crease in the cost of insurance premiums by 144 %. Despite a City Council policy
which authorizes a 50% assistance payment, the Friends are concerned that
anticipated additional increases may requ•`i,re them to raise membership fees. The
alternative, as far as the Friends are concerned, would be for the City to increase
its assistance payment percentage. The Commission requested staff to analyze
insurance requirements for-similar community organizations and report at the March
Commission meeting.
Presently, the Department requires general liability coverage in aggregate limits
of $1 million for organizations which extensively use City facilities for community
oriented programs. The use is governed by either an annual Facility Rental Agree-
ment, along term lease agreement, or a City Council Policy or Resolution. As a
result, insurance requirements differ based on the insurance market conditions
when the Leases were negotiated or inconsistent interpretation of insurance require-
ments. The proposed review will address these inconsistencies by applying a
consistent interpretation of insurance requirements based on the present condition
of the market. It will also analyze the relative exposure to risk of each activity.
To further illustrate the need for this review, the Department examined all existing
facility use agreements governed by annual contracts, long term lease or City
Council Resolutions /Policies.-Of the fourteen so identified, seven organizations
were currently providing the required insurance; three were under insured and four
were not providing any insurance due to the low risk nature of their use. Only
the Friends of Oasis was receiving an assistance payment from the City.. Attached
for the Commission's review is-an-analysis of the present insurance requirements.

SUBJECT: OPEN SPACE ON 15th STREET, PLACENTIA TO MONROVIA
At the City Council meeting of December 8, 1987, the question of park and open
space in the subject area was discussed. Upon reviewing this matter it has been
determined that the only vacant land that could be-used for small park tot lot
purposes is the 1/2 acre parcel identified as Lot 20 on the attached map. This
location is accessible to a�number-of new condominium developments in the area
and from the back side of'Newport Crest.
I have met with Mr. Jim White of the Mesa Development Company, who has developed
a number or residential-projects in the area. Mr. White was most helpful in
assisting in gathering information on this matter. The.1/2 acre site, as-identified,
is owned by Mr. Rawlins, who could be� approached with an offer for possible
acquisition.
Park requirements for this area, including Newport Crest, are anticipated to be
satisfied when the Banning /Mobil land is residentially developed. This is con-
sistent with our Recreation'and Open Space Element of the General Plan. However,
a smal'1 park in the subject area would also provide a service to the adjacent
high density developments. - •
The City Council at their meeting of February 9, 1987 asked the Department and the
Parks, Beaches and Recreation Commission to review this location and any possible
development of the Mobil /Banning property for a possible recommendation. Staff
is gathering additional information on this area for a detailed report for the
April meeting of the Commission.- If there are anv ouestions. please call.

Recommendation:
Authorize the Mayor and City Clerk to execute the Agreement as amended.
Discussion:
The Joint Powers Agreement has been a long standing document that has provided
a relationship with the School District that allows an exchange of facilities,
" equipment and services. This Agreement-has enabled the City to provide recrea-
tion programs utilizing school athletic facilities that has resulted in
savings to residents because expensive facilities have not been duplicated by
public agencies.
Specifically, the Agreement has been proposed' to be amended to include a state-
ment on liability responsibility as it relates to our use of school facilities
for community recreation programs. The amendment reads:
CITY agrees to protect, indemnify and hold harmless the DISTRICT,
its Board Members, officials and employees from any and all
claims, 4emands, liabilities and obligations of whatsoever
nature, including attorneys fees and court costs arising out of or
in connection with any negligent act or omission of CITY or the
occupancy or use of the leased'premises or any part thereof by
CITY or directly or indirectly from any state or condition of the
premises or any part thereof arising out of the operation and
maintenance of the leased premises.
CITY further agrees that DISTRICT shall not be liable at any time
for any loss, damage, or injury to the Teased premises or any
person whomsoever at any time occasioned by or arising out of
any negligent act or omission of the CITY, or directly or indirectly
from.any state or condition of the leased premises or any part
thereof caused by any negligent act or omission of the CITY.
Both the County counsel and our City Attorney "s office have reviewed the proposed
language and are satisfied with the amendment. In addition, the Parks, Beaches
and Recreation Commission at their meeting of February 3, 1987 recommended that
the City Council execute the amended Agreement.

WHEREAS, the Newport Beach Department of Parks, Beaches and
Recreation, hereinafter referred to as "CITY ", and the Newport -
Mesa Unified School District., hereinafter referred' to as
"DISTRICT" are both authorized to organize, promote anal conduct
programs for community recreation; and
WHEREAS,•the DISTRICT has facilities and grounds available
for community recreation on the campuses of the schools maintained
by said DISTRICT; -and
WHEREAS, it is desired that the CITY have priority to use
said'facilities when such facilities are not being used by the
DISTRICT for educational purposes, use of school facilities will
be permitted in the following order,of priority:
1. Regular school programs, including Summer School
activities.
2. CITY sponsored and or school connected youth programs,
e..g.,,Har'bor Area'Baseball Program.
3. Other youth activities

NOW, THEREFORE, IT IS AGREED that cooperative use shall be
made according to the following:
1. The DISTRICT will make a- vailable its facilities and
grounds, with the necessary equipment and appurtenances for

CITY agrees to grant to DISTRICT, upon application, the use
of any recreational facility, area, maintenance service, or
equipment owned by the City of Newport Beach which the DISTRICT
may require in connection with its public ,school program, provided
the use of such recreational facility, 'area, maintenance service,
or equipment for public school purposes shall not interfere with
its use by the 'CITY for community recreational purposes.,
2. Such DISTRICT facilities will be made available as long
as the use in no way conflicts with the use of the DISTRICT "S
buildings, grounds or equipment for school purposes or interferes
with the regular conduct of school work. The DISTRICT reserves
the right to cancel the use of its facilities upon seven (7)
working days notice when such planned use is considered to be in
conflict with the use of such facilities for school purposes.

13. The CITY shall select and provide all paid or voluntary
personnel necessary to conduct CITY recreational activities upon
DISTRICT facilities.
14. If a charge is made in any form, even to cover expenses
for a recreation activity on a DISTRICT facility, advance approval
shall be secured from the DISTRICT. Such funds received shall
remain with the CITY to be us -ed to help defray the cost of•the
recreation activity. Such charges shall not preclude any boy or
girl from participation in the program strictly because of lack of
funds.
"No events for which an admission price is charged
shall be held pursuant to Chapter 10 of the
Education Code of the State of California (commencing
at Section 10900), except amateur athletic contests,
demonstrations or exhibits and other educational and
non- commergial events."
15. The DISTRICT shall provide the CITY with su.mmar
maintenance schedules well in advance. It is agreed that such
cooperation is for the purpose of alleviating any possible
conflicts in the use of the facilities and negating any incon-
venience to the citizens of the community.
16. The DISTRICT shall provide reasonable office space at
swimming pool locations to the CITY during summer months. It is
further agreed that the DISTRICT shall provide reasonable stora.g:e
facilities to the CITY on a year round basis.
17. The CITY shall be responsible for the installation and
operational charges assessed for additional telephones inst-alled
on a DISTRICT facility for use by the CITY.
18. All expendable supplies s,ha11 be provided by the
CITY.
19. The CITY shall be financially responsible for damages or
losses to DISTRICT facilities and equipment beyond fair wear and
tear during the. use by the CITY, and the DISTRICT shall be
financially responsible for damages or losses to CITY facilities
and equipment during use by the DISTRICT.
20. CITY agrees to protect, indemnify and hold harmless the
DISTRICT, its Board Members, officials and employees from any and
all claims., demands, liabilities and obligations of whatsoever

RECOMMENDATION:

BACKGROUND
, 1987.
In November 1984, a letter from a student at Newport Elementary School
was forwarded to the City's Bicycle Trails Citizens' Advisory Committee (BTCAC)
by the Mayor with a request to review bike safety on the Peninsula. The BTCAC
completed its review and forwarded a letter report to the Council recommending
that funds be'budgeted for construction of a separate bike trail adjacent to the
existing ocean front s.idewalk in order to separate the bicycle_ and pedestrian
traffic.
During the Council meeting of June 10, 1985, the City considered the
project and took two actions:
The Council approved an appropriation of $200,000, and combined
the description for both the proposed bicycle trail and for the
sidewalk repair.
2. The Council directed the BTCAC and the Parks, Beaches & Recreation
Commission to contact residents fronting the ocean front within
the perimeter of the proposed improvement and to conduct the
necessary public hearings to determine whether the improvements
should be constructed and, if so, suggested configurations of the
improvements.
Since that time an Ad Hoc Citizens' Committee for the project was
formed consisting of one member from each of the four community associations on.
the Peninsula, one member at large, two members from BTCAC, and the Chairman of
the BTCAC. The Ad Hoc Committee was formed to provide citizen input and discuss
alternatives with the consultant hired by the City to prepare the Ocean Front
Boardwalk Feasibil'ity Study (Study). In addition the Ad Hoc Committee members
were responsible for soliciting input and communicating comments from their
respective associations to the Ad Hoc Committee.
The Study was completed im August 1986 after a bicycle and pedestrian
use survey was completed which included both winter and summer counts on the
ocean front. After receiving comments on the report from the Ad Hoc Committee,
• the BTCAC forwarded the report with its recommendation to the Parks, Beaches &
Recreation Commission for review and public hearing.

FEASIBILITY STUDY AND PROJECT DESCRIPTION
The Study was prepared by the Civil Engineering firm of Austin -Foust
and Associates. The Study considered three separate alternates:
Alternate I Rehabilitate the existing 12- foot -wide ocean front
sidewalk.
Alternate II Rehabilitate and widen the existing ocean front sidewalk
to a width of 22 feet.
Alternate III Rehabilitate the existing ocean front sidewalk and
construct a new separate 12- foot -wide bike trail which
varies approximately 3 feet to 8 feet from the exi'sting
facility.
In addition to these alternates the Study divided the ocean front
sidewalk into seven segments as follows:

The Study prioritized both the recommended new construction and the
rehabilitation of the existing sidewalk by segments. The estimated cost for the
work is as follows:

PARKS, BEACHES AND RECREATION COMMISSION HEARINGS AND RECOMMENDATIONS
The first public hearing before the Parks, Beaches & Recreation
Commission was held on December 2, 1986. The Commission continued the hearing
to'February 3, 1987 in order to receive additional public input and ensure that
residents had the opportunity to provide input to the Commission.
While the first hearing before the Parks, Beaches & Recreation
Commission in December was lightly attended, the second hearing on February 3,
1987 was well attended, with those wishing to participate in the proceedings
exceeding the seating capacity of the'Council Chambers. The majority of the
testimony received was from ocean front homeowners who disagreed with the report
• and stated that their choice would be to• repair the existing sidewalk. Several•
residents and two members of the BTCAC spoke in favor of the separate bike trail
as recommended in the report. Several residents and the Central Newport
Community Association spoke in opposition to recommendations in the Study and,
recommended a dual boardwalk with a 6- foot -wide sidewalk and an 8- foot -wide bike
trail.
At the request of the Commission, City staff explained that the dif-
ference between the Central Newport Association's recommendation (noted above)
and the Study was primarily in the width of the proposed improvement [repair and
maintain existing 12- foot -wide sidewalk and construct a separate 12- foot -wide
bike trail (min. State design standard)].
After receiving all of the input, the Commission discussed concerns
for safety and the congestion that occurs now on the- ocean front, their concern
for the safety of bicycles if they are restricted from the ocean front and
forced to ride with, vehicle traffic in Balboa Boulevard, and concern for the
,ocean front residents who ex.perience•the brunt of the public use along the ocean
front.
The Commission then voted five to two to approve the Feasibility Study
with the separate trail (Alternate 3) and conditions as follows:
1'. If possible use the separate trail alternate for segment I (36th
Street to 24th Street).
• 2. Incorporate speed limits and signing in the final design of the
project.
3. Recommend greater enforcement to insure safer use of the proposed
2� facilities.

SUMMARY'AND OPTIONS:
1. Many of the homeowners along the ocean, front disagree with the
concept of the proposed separate 12- foot -wide bike trail, and wish
only to rehabilitate the existing sidewalk.
2. The Central Newport Community Association and the Feasibility
Study both recommend a separate sidewalk and bike trail. They
differ in proposed width with the 'Central'Newport Plan recom-
mending 6 -foot sidewalk and 8 -foot bike trail. The Feasibility
Study recommended patching the existing sidewalk (10 to 12 feet
wide) and constructing a 12- foot -wide bike trail. State law
requires that bicycle trail design conform to the minimum State
standard which is 8 7foot width, plus two 2- foot -wide shoulders
for a total of 12 feet.
3.. Several of the residents and proponents of the trail agree that
there is significant congestion on the existing sidewalk and that
something should be done.
a Restrict bike use to off -peak hours on the sidewalk.
b. Improve and increase enforcement of allowable use of the
sidewalk.
c. Construct the new facility to provide for both bikes and
pedestrians.
In the past the idea of eliminating bikes from the ocean front has
been rejected because forcing bicycles to ride with vehicle traffic on Balboa
Boulevard appeared more dangerous. If bike use is eliminated or restricted on
the ocean front, an amendment to the City Local Coastal' Plan will be required.
After considering the Feasibility Study and recommendations, the Coun-
cil has several choices for action.
1. Accept the Feasi'bili'ty Study, as recommended by the Parks, Beaches
and Recreation Commi,ss -ion and continue the Planning process, by
directing staff to:
• a. Prepare an EIR for the project.
b. Schedule a future public hearing for Council to (1) receive
additional public input, (2) review the EIR, and,(3) make a
�(�, final decision regarding the ocean front.

RECREATION DIVISION
• FEBRUARY, 1987 �PROGRESS'REPORT
SPECIAL INTEREST ACTIVITIES
Winter classes will continue through mid'March as "B" sessions began in February.
The Department's "Extra Time Classes" at Newport Heights continued to increase
enrollment; 106 students are registered for Computer, Arts and Science classes.
It should be noted that,the classes are filling a needed void; District curriculum
does not offer science and art programs, and' demand for computer programs is extremely
high. The success of the Newport'Heights program has resulted in inquiries from
parents at Harbor View and Mariners. The Department completed the draft on the
Spring brochure which was mailed to residents on February 27.
YOUTH ACTIVITIES
The new daily schedule approved'by the Recreation Program Subcommittee for the
Community Youth Center has been successful. Activities'continue to be well attended
and children are supervised -up to their pick up time. The youth basketball program
will schedule the season - ending tournament this month following a successful league
season. Daily practices and league games scheduled at the Lincoln gymnasium have
been very well attended. Tournament winners will be invited to the Orange County
finals. The Department also conducted meetings with representatives of Newport
National Little League,,Harbor Area Baseball and the American Youth Soccer Organization
regarding scheduling priorities for athletic fields.
SPORTS AND AQUATICS
Adult sports competition has continued to be well received. The winter basketball
season will be concluded this month after competition at Ensign and Lincoln gymnasiums.
The winter softball season began in February with classification games and will continue
i'n March. The expansion in adult sports has contributed to increased revenue to the
City; revenues generated from recreation service fees are up by $27,000 over this
period last year, while expenditures are up only $3,000. tailing classes scheduled
over the winter enrolled 48 participants'. No sailing classes were cancelled due to
lack of enrollment, unusual for the winter quarter.
SENIORS
The "S.S. Oasis Cruise Party" on January 31 was very successful as 250 people attended.
Oasis volunteers provided food', refreshments and entertainment. In addition to the
Special Event, the Center started a new class on weight control and nutrition and con-
ducted various lectures, including "Caring for Elderly Parents." Oasis staff, in
cooperation with the Friends of Oasis," is reviewing estimates prior to recommending
vinyl tile for replacement of the existing multi - purpose room floor. The Oasis schedule
for March is attached.

PARK AND STREET TREE DIVISION
• FEBRUARY, 1987 PROGRESS REPORT
Our Park Crews performed the following tasks in addition to normal
maintenance during the month of February:
Installed irrigation and R.R. Ties and graded parkway
at Lincoln School.
Installed R.R. Ties at Inspiration Point and vicinity
of Corona del Mar Bluffs.
Prepared for Japanese activities and installed signs
at Irvine Terrace Park.
Started retaining wall at City Yard.
Realigned infield and repaired fences at Community
Youth Center.
Prepared grade for new back stop at Eastbluff Park.
Re- stained and sealed benches at Ensign View Park
• and Main Street, Balboa.
Our Street Tree Division performed the following:
Trimmed 1,044 trees.
Planted 21 trees.
Removed 9 trees.
Root pruned 5 trees.
Completed 4 Work Requests.
Areas being trimmed this month are the Peninsula, the Ficus on Pacific
Coast Highway and Eastbluff.

It has always been my understanding that open, public hearings
are designed to get input from concerned, tax - paying citizens
about a particular subject, and then make intelligent decisions
based upon that input, and not from pre- conceived opinions already
established in the minds of the hearing body.
It should have been clearly evident to the commission, last evening,
that the preponderance of public sentiment favored re- furbishing the
. existing boardwalk, rather than creating a bicycle trail someithere
"out there" on the beach. These people did not just get off the
"turnip truck ". They are long time property owners, who live here
because they wish to enjoy the beauties of the beach and the ocean.
They are willing to put up with vandalism, cleaning up after the
visitors every day, and more than willing to share this paradise
with cyclists who wish to venture dorm the boardwalk at a leisurely
pace.

But not, repeat not, a meandering nightmare of a trail, which will start
to erode immediately, cost a fortune to build and maintain, create
untold problems in controlling, and cause no end of difficulties
for small children and just ordinary folks who wish to get down to
the water.

Dear Sir:
We have owned our home on the ocean front for thirty yeas .
For some time we hnd a pleasant walking path where families snd
their children had access to the beach.
Without notification, the path suddenly became a bi]e trail,
and we had speeding; bikes. Families were constantly warning
their children to "watch out for bikes." Rege.rdless of where
a bike path is put, the danger will still be there.
There are many miles of safe bike trails in the county
but beeches are limited. ^Lease leave the beaches for the
enjoyment of bathers, children and families. The bike trail
on the ocean front should be oliminpted!

I ain honored to have received the Community Survices Award
granted by the Ci•y1v PQ 6 R Commission. I am ombarransed,
however, to have missal the bestowal of the award. I must have
walked Into the Council Chambers as bit late last night. The
Commission moved to a roundtable discussion with samo group soon
after I arrived. I apologize to you, the other commissioners,
and to Dorothy Flohr U had told her only the day prior to the
Commission meeting that X Would be there to receive the award).
So, thank you.
I stayed at the meeting long enough to hear about one hour m•f
comments pertaining to the three boardwalk proposals. At your
•orebea•ance I chip in my two cents wbr•hi the current boardwalk
should be narrowed and restricted to podus••ian traffic. A
meandering bike trail should be extended from the Santa Anu River
Jetty to the wedge. I Suspect that you don't require the
justification for my opinion. you probably heard more than You
wanted to hear an the topic last night.
