PROCEDURAL MATTERS Item #1 - Call to Order Call to Order The meeting of the Parks, Beaches and Recreation Commission was called to order at 7:05 P.M. Item #2 - Roll Call Roll Call Roll call was taken. Commissioners Brenner, Grant Herberts, Konwiser,•Springer, Taft and Wolfe, Jr. were present. Item #3 - Approval of Minutes Approval of Minutes x Commissioner Taft moved the minutes of the April 5, 1988 x x x x x meeting be approved. Unanimous. Item #4 - Adoption of Agenda Adoption of Agenda The agenda was adopted as presented with the addition of Avon Street Wetlands, Bonita Creek Park, Big Canyon and PCH Boat Ramp. II. ACTION ITEMS Item #5 - Volleyball Court - China Cove Volleyball Court - Mark Deven referred to the.subject report and reviewed China Cove staff's recommendations to either retain the court in its present location or remove the court. He pointed out that the existing court is in the best location from the stand- point of safety, high tides, etc. Following posting for removal on April 6, 11988, an equal number of letters and petitions were received supporting retention and removal. As a result, the matter is now being presented to this Commission for their consideration. Chair Brenner opened the meeting to Public Testimony. David Beauchamp, 2605 Way Lane, addressed the Commission. He stated his home directly faces the court and feels the problems such as traffic, noise and parking in China Cove are not related'to the volleyball court. He added that CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission Page 2 City Council Chambers 7 p.m. INDEX volleyball is a great beach amenity and that those who do play there pick up fitter on the whole beach area and are courteous and respectful of the beach and the property owners. He added that if the poles were removed, there would be more beach chairs, games, etc., resulting in even more problems. Debbie Douglass Ogorek, 2609 Cove Street, addressed the Commission. She stated their home is at the street end, 10 steps away from the court, and too close to their home since tt is very noisy and they can easily hear profanity. She added that the parking problems are�bad since the players either block or park in their driveway. She would like the court removed and suggested players go to the main beach. Jack Hall, 2619 Cove Street, addressed the Commission and referred to a letter'addressed to Council from Ben Douglass. Chair Brenner pointed out that each of the Commissioners • has received and read the letter. Mr. Hall stated he feels the court causes illegal parking problems and cited instances where the players were very offensive. He added that if the court were to remain, parking, restrooms and a turn around area should be provided. Commissioner Springer arrived at 7:25 P.M. David Beauchamp, 2605 Way Lane, again addressed the Commission and pointed out the.court services a variety of people, including residents. Since the court has a permanent net and line, he suggested pulling the net might help the situation. Jack Hall, 2619 Cove Street, addressed the Commission 'again and stated establishirfg hours would not work unless supervised. He was under the impression that originally no play was allowed from June to September, on Holidays and from 12 Noon - 4 P.M. during peak periods. Julia Gold, 2601 Way Lane, addressed the Commission. Ms. Gold 'referred to Resolution No. 88 -14 to which this Commission is being -asked to make an exception for the court's location. She stated she is appearing on behalf of beach goers and sun bathers who are being pushed into the ocean. This is the last swimable beach in the area which is used by an elite group of volleyball players. She feels that since this is a small beach it should be designa- ted a passive swimmers beach. Three blocks away is a main,' L large beach with amenities such as lifeguards, restrooms, parking, etc. for the players. Ms. Gold also referred to CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission Page 3 City Council Chambers 7 p.m. INDEX the liability of emergency access, reckless driving on alley -like streets, cars blocking fire hydrants, and use of ne'ighbors''homes since there are no bathroom facilities. She feels that if the court is to remain, there be per- manent hours posted, lifeguards, a restroom installed and maintained, and a method of control for illegally parked ---f cars. In summation, she asked that the beachbe preserved as a swimming cove and passive area. Bruce Kahl, 715J Narcissus, addressed the•,Commission. As . a volleyball player and frequent user of the beach, he stated the players are sensitive to the neighbors, do not park in their driveways, do not use profanity or litter the beach. He referred'to a petition with 25 signatures in favor of retaining the court. Rob Walker, 2575 Elden Avenue, Costa Mesa,.addressed the 'Commission. He stated many professional people from,-:other • -areas go to this site and he feels there is plenty of beach for-the swimmers. He feels the players do not cause the parking problems, but that the jet skiers-and swimmers do. 'There is.only one small dumpster at the Cove which is overflowing by the end-of the weekend. Debbie Douglass Ogorek, 2609 Cove Street, again addressed the Commission. She reported the cars that-block her driveway are the volleyball players': Richard Larson, 23 Canyon Ridge, Irvine, addressed the Commission. He stated he felt that the court is used as a scapegoat for China Cove's problems; that the problems would exist if there is or is not a court. 'Tom Moore, 1219 Blue Gum, addressed' the •Commission. He said that although he is a volleyball' player, he also sunbaths at the Gove since it is a less crowded beach. He feels the players get blamed for the problems and he has never seen a time when there was not enough room for sunbathers. He suggested adding more trash cans'since one is not sufficient -and-feels a restroom would only make the situation worse. He stated the positives of a volleyball court outweigh the negatives. • Tony-Ferguson, 2.15A-Carnation, addressed the Commission. He reported that since the area is shielded, players favor this site since it protects them from the wind. CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission Page 4 City Council Chambers 7 p.m. INDEX Tom Miller, 6308 W. Pacific Coast Highway, addressed the Commission. He referred to Corona del Mar State Beach where the prevailing wind blows smoke from the fire pits onto the volleyball courts. Mrs. Cleo Jones, 2608 Cove Street, addressed the Commission. She said she lives 40' away from the court and, although not against the sport, feels it takes away 'too much of the beach. She also cited instances where windows have been broken and children hit by the ball. Richard Lewis, 2600 Cove Street, addressed the Commission. He suggested making the 'court conform to the 50' minimum from every property line. He stated there are two beaches here and feels there is a reasonable amount of beach; that the situation has worked for years. He objects to the launching of jet ski's at the site and feels many problems center around those who do not play volleyball. He recommended a one year trial period during which the • permanent net would be removed. This would free up the beach area when volleyball is not in use and would dis- courage some who just park and play. He also suggested posting reasonable hours and shifting the court slightly away from the homes so they are a minimum of 50' away. Tracy Riddle, 615J Orchid, addressed the Commission. Tracy stated players would lose quality of play and a well protected area should the court be removed. Chair Brenner closed Public Testimony and discussion by the Commission ensued. Commissioner Wolfe, Jr.. stated he felt the site is a great place to play volleyball but feels the rights of the home- owners should be respected. He suggested a compromise be sought such as removing the net and posting hours which the players could enforce themselves for a trial period. Motion x Commissioner Taft motione6 the net be removed and reasonable hours-be posted. Commissioner Grant stated'he felt the court is unauthorized under the new guidelines and-there needs to be a balance of needs between'the homeowners and the public. He suggested slightly relocating the court. He felt removing • it would cause more parking and traffic problems. Commissioner Konwiser stated he felt this public beach should be used by as many as possible. He felt that since CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission Page 5 City Council Chambers 7 p.m. INDEX posting of hours cannot be enforced, this be eliminated from the motion. Commissioner Springer proposed the hours be 11:00 A.M. to 4:00 P.M. year round 'and' enforced by' the-players. Chair Brenner suggested the posting of hours be referred to the Oceanfront and Beach Committee. When the hours are posted, it should-be noted the court is on a trial basis. Commissioner Herberts and Grant concurred. Commissioner Wolfe,, Jr. suggested the Oceanfront and Beach Committee meet with the players and residents to implement a compromise. Commissioner Taft announced he and Commissioner Springer wil meet with the China Cove community and the volleyball players. He asked that those involved leave their name with Mark Deven so they can be contacted when a meeting • date is established. Motion x Commissioner Taft amended his motion to state the volleyball Ayes x x x x x x court at China Cove be retained with the condition that the net be taken down when people are not playing; that the hours, regulations, and location will be referred to the Oceanfront and Beach Committee for a decision which will be made in conjunction with the China Cove Association and the volleyball players using the courts. Unanimous. The Commission will review the Oceanfront and Beach Committee's report at their June 7, 1988 meeting. Chair Brenner pointed out this will be on a trial basis and asked the volleyball players to notify other players. Commissioner Konwiser also asked the players to notify Mark Deven so there can be a proper follow up. Item #6 - Newport Heights Park Needs Newport Heights Director Whitley referred to a letter feceived from Karen Park Smith, 3309 Clay Street, which was presented at the Needs April 5 meeting -add continued to this meeting. Ms. Smith referred in her letter to church property for sale at Clay and Bolsa, and suggested it be purchased for a green belt area since the Heights area is deficient in parks. Chair Brenner opened the meeting to Public Testimony. CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission Page 6 City Council Chambers 7 p.m. INDEX Shari Rooks, 3308 Clay Street, addressed the Commission. She reported that the church property has been purchased, however, there -is property in foreclosure at 3262 Broad Street at the corner of C1'ay, Bolsa and Broad Streets which will be available. Ms. Rooks reported the Heights area is in"need of more parks and-none is accessible with a baby stroller. She presented a petition from the residents in the area supporting the inclusion of a small,.passive City park. She stated the resi'dents would help with landscaping, architecture, etc. to help defray the costs. Mr. Bill Gadero addressed the Commission and presented and explained alternative plans for a small park. Director Whitley questioned if Bolsa Street can be legally abandoned and used for a park. This matter would have to be directed to the Public Works Department. Commissioner Springer'advised that there are "many speeders on Old Newport Blvd. and a park would alleviate these problems and act as a buffer zone between the residential and commercial areas. Chair Brenner suggested the street end issue be referred to Public Works and Commissioner Konwiser agreed that the matter be postponed-until there is an answer on the street closure. Commissioner Grant thanked the*.residents for their input. 'He noted that the first phase priority of the General Plan does-not include open space in Newport Heights. Commissioner Herberts stated she supports a small park in the Heights area and appreciates the residents' work identifying what they would like. Karen Smith, 3309 Clay-Street, addressed the Commission. She said the old area of Newport Heights is very neglected. If a park cannot be put in this area, one should be put in the Heights area. She said tho- rr_esidents wanted their desires called to the Commission's attention and they will be willing to help fund raising and provide other services. Chair Brenner asked Director Whitley to bring back informa- • tion on the street end and the possibility of establishing a small tot lot area. v 0 CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission Page 7 City Council Chambers 7 p.m. INDEX Motion x Commissioner Konwiser moved staff investigate closing Seconded x Bolsa Street and investigate the possibilities of a tot lot Ayes x x x x x x x next to Bolsa. Item #7 - Proposition 70, The California Wildlife, Coastal Proposi- tion 70 and Parkland Conservation Act Director Whitley reviewed Proposition 70 and reported that from a state wide view such measures are all successful, get on the ballot and pass. Commissioner Grant advised that funds for the Lincoln, facility came from one of the bond acts and Director Whitley explained that this was the first time the Depart- ment pursued it competitively. Motion x Commissioner Grant motioned recommendation be made to Ayes x x x x x Y x Council to support Proposition 70 by making it a Resolution and instruct staff to transmit a letter and thi's information • to homeowner groups so they can get their members out to vot . Unanimous. Item #8 - Tree Removal Appeal, 1936 Leeward Tree Removal Director Whitley reported that in compliance with Policy, Appeal the resident is appealing the Street Tree Committee's decision to retain the Thomlinson Ash Tree. The Park and Tree Maintenance Superintendent recommends the tree be removed since it has caused considerable sidewalk damage. Commissioner Wolfe, Jr. advised this is one of the trees designated to be removed during.a Public Works project, however, this may take 1 -2 years. He recommended the tree be retained. Commissioner Konwiser stated he believes the tree, which is beautiful, should remain since it is nearing'maturity and will remain stabilized for 50 years or more once the side- walk is repaired. He felt there was only minor sidewalk damage. Commissioner Herberts stated she feels this street has many beautiful Thomlinson Ash Trees, that the sidewalk should be repaired and the trees be retained. She asked that the Commission request the funds to repair sidewalks more fre- • quently, if needed, in areas where there are exceptionally beautiful and mature trees. CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission City Council Chambers 7 p.m. INDEX Commissioner Springer stated she feels the tree should be removed and replaced. Commissioner Grant suggested there be guidance from Council and, referring to P'olicy,•there is an overwhelming reason not to remove the tree. Director Whitley advised the Commission could ask Council to transmit to Public Works that they put in new sidewalks and save the trees. Motion x Commissioner Konwiser motioned the tree be retained. Ayes x x x x x x x Unanimous. Director Whitley will notify the homeowner that the entire street project may be'reconsidered and that they can appeal this Commission's decision to the City Council. 'Item #9 - Facility Fees Facility • Fees Mark Deven reported staff recommends approval of the pro- posed facility fee schedule. He reviewed the report submitted and pointed out that fees have not been reviewed since 1983. It is timely to increase them due to finalizing Bonita Creek Park, the Grant Howald Community Center, re- furbishment of fields, etd.. Mr. Deven explained that all facility fees are deposited into the self- supporting revenue fund. Motion x Commissioner Wolfe, Jr. moved to accept the fee schedule Ayes x x x x x x x as proposed by staff. Unanimous. Item #10 - Proposed New Recreation Activities, 1988 Proposed New Rec- Summer Program reation Mark Deven reported there are 37 new activities summarized Activities and presented in rough form which have been approved by the Recreation Program Committee. Upon Commission approval, they will be transmitted to Council for approval so they can be included in the summer brochure. Commissioner Wolfe, Jr. questioned the difference between introductory sculling /kayaking and beginning sculling/ kayaking. Mark Deven explained that the introductory clinic . is on -going at no charge offered by the Newport Aquatic Center. Commissioner Wolfe, Jr. asked that this be in- cluded in the description to clarify the two programs. I� CITY OF NEWPORT BEACH arks, Beaches .& Recreation Commission Page 9 City Council Chambers 7 p.m. INDEX Commissioner Taft said he appreciated getting the programs in advance which should also generate new interests. Commissioner Grant suggested a one page summary outlining new programs be distributed to schools, organizations, etc. and-Mark Deven advised they are provided at Mariners Park and CYC. Motion x Commissioner Wolfe, Jr. motioned to accept the proposed Ayes x x x Y x x x recreation program activities. Seconded by Grant. Unanimous. III. PUBLIC COMMENTS Commissioner Herberts passed out communications from Dr. Jan Vandersloot, 2221-16th Street, and Robert House of Newport -Mesa Unified School District's Science Department regarding Avon Street Wetlands. This area directly-ad- joins Cliff Drive Park and should excavation occur and a retaining wall put in, it would severely impact the park. Chair Brenner opened the meeting to Public Testimony and Dr. Vandersloot, 2221 16th Street, addressed the Commission. Dr. Vandersloot reported the Wetlands area is used by Newport,Harbor,H -igh School to gather specimens for their science class. He commissioned a biologist to analyze the nature of the water and'flora /fauna on the hillside. The results showed a flow of fresh Water which supports fish, plants and other aquatic forms. Dr. Vandersloot stated that Cliff Drive Park by definition is a view park. If a parking lot is bui'l't, usable park space will be lost and impact biological, educational and historical aspects of•the hillside and wetland. Dr. Vandersloot is also concerned about the homes being planned which would result in removing vegetation, con- densing the park and losing the wetlands and habitat. He suggested the definition of Cliff Drive Park be expanded to include the value of,the- wetlands and hillside. He suggested other alternatives to the parking lot be pursued. Director Whitley advised the Avon Street Creek site is outside the boundaries of the actual park and thus out of the purview of this Commission. The entire matter was reviewed at the City Council's last meeting and was con- tinued. Commissioner Herberts referred to the impact this matter II will have on the park and which the Commission should be CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission Page 10 City Council Chambers 7 p.m. INDEX made aware. Preserving natural resources won't reflect on anyone's property. Chair Brenner stated it is the consensus of this Commission to direct Mr. Whitley to ask Council if they want this Commission to-consider the matter. VI. DISCUSSION ITEMS Item #11 - Commission Committee Reports Commission Committee a. Capital Improvements — Director Whi'tley� advised the Reports Commission's recommendations eliminating Items 14 - -and 16 will be presented to the City Council at their next meeting on May 9. Big Canyon - Commissioner Grant requested staff gather information from other Departments reviewing Big Canyon so that the Commission can decide whether to continue a study on the subject.. Director Whitley advised the Public • Works Department has not yet responded to his memo asking for information on Big Canyon. He will ask for a response to hi -s original memo. West Newport - Commissioner'Wolfe, Jr. asked about the status of the restroom and Director Whitley advised Public Works is in the process of responding. Commissioner Wolfe, Jr. asked about the status of the West Newport Community Center. Director Whitley advised the City Council gave approval for the City to apply to HUD for funds to be used for this purpose. Site Plan of CYC and Oasis Passive Park - Commissioner Grant will respond to Councilman Sansone's request that there is not enough room to provide a flat ballfield. .b. Street Tree - ,Commissioner Herberts reported the Committee met April 27 and received many-requests for moval. They agreed with staff on all except one. Commissioner Herberts requested a memo from Commissioner Konwiser regarding the trees on Leeward. She also re- quested Public Works provide more information on the Corona del Mar project and recommended input be solicited • from those directly involved. CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission Page 11 City Council Chambers 7 p.m. INDEX Commissioner Wolfe, Jr. asked that the Committee be pro- vided a list of replacement trees that have been approved by this Commission. Commissioner Herberts asked for a list of addresses where trees have been replaced. Commissioner Grant recommended the dates of removal and-replacement for each address be included'in the Park and Street Tree Division report. Commissioner Wolfe, Jr. questioned the trees encroaching on Ocean Blvd. Chair Brenner and Commissioner Springer will pursue. Commissioner Herberts reported that -2 trees at 509 Begonia referred to-Councilman Sansone will be removed. Chair Brenner asked Director Whitley to relay to the Park and Tree Maintenance-Superintendent that trees not be removed in Corona del Mar until the involved homeowners association has provided input. Commissioner Herberts . concurred. Commissioner Grant said he will contact Mr.'Brooks about asking The Irvine Company for'their study on diseased Palms. c. Recreation Program - Report received and filed. 'Commissioner Wolfe, Jr. asked that a group picture of the Commission be taken at their June meeting. d. Oceanfront and Beach - Commissioner Springer reviewed the report and recommendations submitted on Lifeguard Staffing at Corona del Mar. The committee concurred with the Marine Department's program which is working well with no major problems. Chair Brenner reported Council is raising the parking permit fees and Director"Whi'tley advised these are established by Council and are consistent with other beach cities. Commissioner Taft-complimented Commissioner Springer on her excellent report. Mark Deven reported timely posting of volleyball court removals will take place'.in•,order that the Commission can • consider them as soon as possible. Facility Evaluation - Commissioner Konwiser reported Carnation, Bayside, Begonia and'Old School Parks all look fine. Commissioner Taft stated the park signs look great, however, the slopes at Westcliff Park need attention. f. Budget - Director Whitley reported Council will review the maintenance and operation budget on May`23 at their Study Session. f. Chair Brenner asked Director Whitley to provide a draft of the Commission's orientation manual at-their June meeting. She also asked that-.,the Implementation portion of the General Plan be reviewed at the June meeting. She asked that the Commission think about subjects to be addressed-,at their joint meeting with Council on June 27. Item #12 - Commission Liaison Reports Commission • Liaison a. Friends of Oasis --No report. Reports b. Friends of the Theatre Arts Center - Commissioner Herberts reported the TAG Board was upset that six trees were removed and that they were not consulted. Discussion ensued regarding clarification of the trees removed. Director Whitley'reported'it has not been decided where the replacement trees will be located on- site: Item #13 - Status of Capital Projects Status of Capital Director Whitley reported the West Newport Park dedication Projects date has been changed from May 21 to June,4, 1988. Commissioner Grant stated the red roof on the Bonita Creek building is not compatible with the surrounding development. He asked that an investigation be pursued towards changing the color at no expense. Director Whitley announced the Grant Howald Community Center will be dedicated on June 25. Mark Deven advised the Commission will be reviewing the pre- liminary plans for the Lincoln facility at their next . meeting I` CITY OF NEWPORT BEACH • • arks, Beaches & Recreation Commission Page 13 City Council Chambers 7 p.m. INDEX Director Whitley stated the preliminary plans for Newport Island have been reviewed and construction should begin T1 in a'few weeks. PCH Boat Ramp - Director Whitley will contact the Marine 11 Department for a written report. Item #14 - Recreation Division Recreation Division Report received and filed. Item #15 - Park and Street Tree Division Park and Street Report received and filed. Tree Division Item #16 - Future Agenda Items Mark Deven announced the Friends of Oasis would like to meet jointly with the Commission at their June 7 meeting. Status of construction will be discussed and the new Recreation Supervisor will be introduced. He also advised that the Police Department does not have funds for a crossing guard, however, they would be willing to train a volunteer. VII. SPECIAL, URGENT OR LAST MINUTE ITEMS I VIII. The City is fortunate to receive the enthusiastic support of the Newport - Balboa Rotary Club which supplies, trains and supervises volunteer officials,, timers and scorers. Through a performance /point system, two participants are judged most valuable male and female athletes and awarded commemorative trophies. At the Commission meeting of June 7, Terry Zimmerman, of the Newport - Balboa Rotary Club will present the most valuable female athlete award to Erin Stoval and the most valuable male athlete award to Joey Miller. 'Both athletes turned in outstanding multiple event performances at the Meet to earn •the beautiful trophies which were donated by our Sister City of Okazaki, Japan. Fern Street /West Ocean Front 2. Marinapark (1770 W. Balboa Boulevard) Background: Following the posting of unauthorized volleyball courts at various beachfront locations, applications were received for the recommended locations. Staff received the applications and notified residents living within 200' of each •location of the Commission's consideration for permanent'installation on the June 7 agenda. The applications were also reviewed by the Marine and General Services Departments. 11 Volleyball courts are presently existing at each'locatiorr as shown on the attached aerial photos. An alternative location is suggested for Marinapark in the event of opposition to its proposed location; residents of space BA actively used the volleyball court. The General-Services Department requests that the poles be move&l:ayward four feet to facilitate mechanized beach cleaning near the fence at the-Marinapark location. We delayed any action until we had tried every possible way to save these trees without replacing them. Unfortunately, I do not see any possible way these threes can remain without continued damage to the sidewalk and retaining wall that is part of our residence. Always there is a reoccuring theme. The people would like to have the open space preserved but the space in question belongs to a private owner and the underlying theme is that the city should buy it or the property owner preserve it for the 'benefit of the public. Personally, I have no problems with the city buying property for open space providing that we have the financial wherewithal to accomplish that goal. on the other hand, it is'difficult to require private property owners to give up a portion of their property for the public unless there is a major development involved. Quite obviously, there are few major developments left to occur within the City of Newport Beach. Yet, the requests for more open space continue to roll in. Perhaps it is time to place a bond issue on the ballot and determine if the people really want to tax themselves for additional park land within the city. It is my understanding that there was such an issue on the ballot a few years ago, but it failed to pass by a few percentage points. Maybe the climate has turned around and this time such a proposition -could receive the required votes which I believe is two - thirds of, the votes cast. In any event I would like to see this item placed on the next study session so that council can decide whether or'not it wishes to pursue the idea. May I also suggest that you be prepared to ,discuss the timing to determine if there is enough time left to place such an issue on the ballot for the November 88 election, what the costs are, any historical data which might be appropriate and any additional information which you may perceive council would be interested in receiving. 1, There are numerous candidate sites throughout the city which could fulfill this need. Some are well known and I suspect some are not so well known. If the city has such an inventory it might be helpful to bring those along for a cursory review. His memo suggests that information be provided concerning other bond propositions in the city and whether sufficient time exists to place a proposition on the November 88 ballot. First, the last date on which a.proposition can be placed on the November ballot is Monday, AAuugus 8 This gives approximately 10 -11 weeks to organize and prepare the necessary material for the election. Second, the city on June 6, 1972 placed three bond propositions on the ballot. One (Prop F) was for $3,560,000 for Park and Recreational Purposes including the acquisition of sites and provision for open space. This measure received 58.3% "yes" votes and therefore failed since 66 2/3 "yes" vote was required. The second measure (Prop G) was for $2,425,000 for Park and Recreational Facilities and Improve- ments, Furnishings and Equipment. This measure received 56.5% "yes" votes and was defeated. The third measure (Prop H) was.for $3,000,000 for Park and Recreational Purposes and Open Space. This measure received 53.1i "yes" votes and also failed. On March 8, 1977 the city voted upon a bond issue for $7,130,000 for land acquisition and park improvements. This proposition received 61.5% "yes" votes and therefore failed the 66 2/3 requirement of the election's code. In all of the bond issues stated herein the Parks, Beaches & Recreation Commission compiled a list of projects for acquisition and /or improvement. If the council desires to proceed on the bond issue, it will probably be appropriate to request the opinion of the P.B. &R. Commission and request a list of projects for funding by the bond issue. Potential properties include lower Buck Gully, lower Morning Canyon and properties which include environmentally sensitive areas as a part of a development area such as Westbay, Newporter North and Buck Gully and are designated in the Specific Implementation Recommendations. Management guidelines should detail: permitted land uses . buffering of land uses . permitted level of public access impacts from adjacent areas such as drainage and runoff acceptable improvements for physical access or emergency safety repai-rs •- appropriate management responsibility appropriate building setbacks permitted landform modifications Parks are proposed in the plan as residential development occurs. This has been our traditional way of developing ou.r park system over the past 10 -15 years. • Our system has had important additions in the past four years and although we'have deficiencies in older sections of the City, our overall park and recreation opportunity to the public is in good shape. As a result, CALTRANS /Division of Aeronautics has notified all public —use airport operators of the provisions of Section 21646, of the California Public Utilities Code. This law makes it a misdemeanor for any person to release or cause to be released or flown, within five miles of any airport, any moored balloon, kite, • unmanned rocket or unmanned free balloon which might be ingested by an aircraft engine or might obstruct a pilot's vision, or which could be used to suspend an object capable of endangering airborne aircraft. CALTRANS has suggested that park districts may have a particular interest in this matter; and that parks in close proximity to an airport, including heliports, with low overflight of aircraft, post signs as follows: "No Kite Flying, Low Flying Aircraft" CALTRANS has further suggested that public entities may also wish to consider enacting local ordinances to restrict the use of model aircraft in proximity to an airport where they may endanger the flight of aircraft; and has recommended that airport operators coordinate efforts with local park administrators and law enforcement agencies to enforce protection of airport approaches and traffic patterns. Although I am unaware of any past incident here in Orange County similar to the Palo Alto event, it may be prudent for your staff to examine this matter, as CALTRANS has asked. Korade, Assistant City Attorney RE: Government Code Section 84308 The Political Reform Act was enacted in 1974. Under the original conflict of interest provisions of the, -'Act, the receipt of campaign contributions is not a basis for disqualification of a public official. However, Government Code Section 84308 has been added to the Act to deal specifically with campaign contributions and government decision making by certain officials. This memorandum will outline who is governed by Section 84308 and what they must do to be in compliance with its provisions. You are within Section 84308 if: a) you are seeking an elected office; OR •b) you are involved in the campaign of another or are soliciting funds on behalf of another; AND C) you are a board member, •commissioner, or department head who makes decisions in proceedings involving licenses, permits, or other entitlements for use. The City Council and anyone who is directly elected by the voters is exempt. However, these members are only exempt when acting as a member of the body to which he or she is elected. If the member of the exempt body is also a voting member of another body, such as a joint powers agency, the member is within Section 84308 only with respect to proceedings before the non - exempt body. There are three basic rules contained in Section 84308: a) the law prohibits solicitation or receipt of campaign contributions by certain officials from parties, participants or their agents while a proceeding involving licenses, permits or other entitlements for use is pending and for three (3) months following the decision; b) the law requires an official's disqualification in such proceedings if the official has received campaign contributions of $250 or more from a party or participant within 12 months preceding the decision; and C) the law requires disclosure of all such campaign • contributions. qb l � r. A "party" within Section 84308 is any person (including a business entity) who files an application for, or is the subject of, a proceeding involving a license, permit or other entitlement for use. A "participant" is any person who is not an actual party to the proceeding, but who (a) actively supports or opposes a particular decision and (b) has a financial interest in the outcome of the decision. If you are within Section 84308 and have received a campaign contribution of $250 or more from any party, participant, or their agents in proceedings involving entitlements for use within twelve (12) months before the decision, asset forth above, you must: a) Disqualify yourself prior to making a decision; AND b) Disclose the fact on the record of the proceeding prior to any decision being made. • If you are within Section 84308 you are prohibited from soliciting or receiving campaign contributions from parties, participants, or their agents while a proceeding involving licenses, permits, or other entitlements for use, is pending and for three (3) months following the decision. No form is required to be filled out by the official to implement the disqualification and disclosure. Authorize the City Clerk to advertise for bids to be opened at 11:00 A.M. on June 9, 1988. DISCUSSION: This contract provides for the removal and replacement or repair of approximately 3,350 square feet of sidewalk, 1,235 linear feet of curb and gutter. The location of work is shown on the attached drawing, "Exhibit A." An additional 315 square feet of parkway concrete will also be removed. The work is necessary due to (1) the relative high exposure to per - sonal injury caused by parkway tree roots uplifting and displacing public improve- ments; and (2) many public complaints of nuisance water ponding in the street as the result of root uplift. The Parks, Beaches and Recreation Department will be root pruning and /or replacing the existing destructive Ficus, Ash and Pine trees after con- sulting with the adjacent property owners. In addition the Parks, Beaches and Recreation Department will be installing root barriers to limit the growth of destructive tree roots. A majority of the uplifted and displaced improvements were previously replaced in 1984 (Highland Drive), 1983 (Leeward Lane) and 1982 (Anita Lane). The reasons for this conclusion are (1) the tidal current under the Pacific Coast Highway bridge has increased three to four miles per hour since the completion of the Upper Bay dredgiig, (2) the prevailing winds are from the weft o southwb'st; these winds blow straight into the ramp and because of the ramp's close proximity to the bridge and the increased current, the sailing of a trailerable sail boat'launched from the ramp would be extremely dangerous, (3) the most used navigational spans under the bridge ,are on the east side of the channel between the Reuben E. Lee Restaurant and the DeAnza Trailer Park; this conflicts very directly with the location of the proposed launching facility, and (4) the parcel's limited size would only allow for approximately 35 boat trailer and car spaces and would there- fore not justify staffing the ramp with an attendant. If a ramp were build at this location it would be mandatory to have a full time attendant''there to advise users of the boating safety problems association with the location. STATUS OF DEANZA BOAT LAUNCHING FACILITY On May 26, 1986 the City requesting the State Department to grant funds luanching ramp on a small • E. Lee Restaurant and the attached as Exhibit "A"). - ouncil adopted Resolution Number of California Boating and Waterways for the construction of a public boat vacant parcel of land between the'Reuben Pacific Coast Highway bridge (Site plan The proposed project site is owned by the Irvine Company and is under a lease to DeAnza Corporation; the lease running through the year 2013 for a remaining term of 24 years. The State Department of Boating and Waterways, during the fiscal year 1987 -88, budgetted $685,000 via a grant to fund an engineering design and the construction of the boat launch facilities on the condition that (1) the City obtain a ground lease for 50 years, (2) the City secure a right -of -way agreement through the DeAnza site on the north side of the bridge to they proposed launching facility, (3) launching fees be set at a $3 to $3.50 level and used only to offset maintenance and operation costs and (4) the layout and design guidelines meet the State criteria; i.e. 50 auto and trailer spaces for each single lane of launching. The City staff, including the City Attorney's office, Public Works Department, Marine Department and'the'Planning Department have met on numerous ocassions with representatives from DeAnza in an effort to coordinate and review the feasibility of proceeding with the design of a boat launching facility south of the Coast Highway Bridge. In October 1987 the City staff authorized the engineering firm of Daniel, Mann, Johnson and Mendenhall, a planning architectural and engineering firm, to review the initial concept of a launch Page 2 • facility at the subject location. The DMJM Refined Concept plan illustrates that there is only enough parking available for approximately 35 automobiles and boat trailers, and that to gain additional dry land, considerable filling and bulkhead work would have to be done beneath the Coast Highway bridge. In December 1987 the Marine Department, in conjunction with the Public Works Department and the Orange County Harbor Patrol, met for the purpose of reviewing the revised site plan and formulating • recommendation whether or not to proceed with Phase 2, which is • review by the State Boating and Waterways Commission for approval, so that actual engineering and construction of a boat launch facility could begin. The staff concluded that there are too many factors, primarily related to location, which render the project undesireable in regard to boating safety and potential exposure to high risk liability. The reasons for this conclusion are outlined below: 1. Swift currents: The channel at the 101 bridge narrows and acts like a funnel during tidal changes. The current beneath the bridge flows in excess of 4 knots at times when there are major tidal changes between high and low tide. The increase in tidal current is more noticeable since the dredging project in the Upper Bay has been completed. • A swift current affects the maneuverablity of a vessel at low speed. A vessel going 4 or 5 miles per hour with a current that is also going at that speed has very poor steerageway. Because the proposed ramp is immediately adjacent to the bridge, - launch vessels, particularly sailboats, would have a difficu4t 'time coming into or leaving the ramp and attempting to stay clear of other vessels which might be navigating beneath the bridge separating the upper and lower bay. It is anticipated that the effects of the current will increase the-potential for: vessel collisions near or under the bridge, as well as causing sailboats on an incoming tide to be swept under the bridge and either becoming lodged there, demasted or actually capsizing. The bridge height is approximately 20 feet and this is not high enough for a small trailerable sailboat, such as a Lido 14 or a Hobie Cat, to clear the bridge at most tides. 2. Prevailing Winds: The prevailing winds during most of the year are from the west or southwest; these winds would be blowing straight into the ramp. Sailing away from the ramp, because of the position of the Reuben E. Lee restaurant boat, would require tacking a sailboat either toward or parallel to the bridge during a west or southwest wind condition, and thereby crossing the navigational span beneath the bridge at right angles. This would be a "blind" crossing situation, as vessels that are • navigating or leaving the upper bay and coming under the bridge cannot be seen due to the bridge supports. Coupled with this, if the tide is incoming and there is a 2, to 4 knot current pushing a vessel toward the bridge, the most experienced sailor would have a 5 Page 3 • difficult time to keep the vessel from being swept up against the bridge while also avoiding other vessels navigating beneath the bridge. S� 3. Navigational Spans Beneath the Bridge: Currently only two of the four.spans underneath the bridge are navigable. These two are on the east side of the channel between the Reubewn E. Lee restaurant and the DeAnza Trailer Park on the upper bay side of the bridge. The heaviest used span for navigation is the span directly closest to the east shoreline and and closest to -the proposed ramp. - -- Vessels that are launched from the proposed ramp immediately on the lower bay side of the bridge, because of the positioning of the restaurant boat and the orientation of the concrete spans under the bridge, would be in conflict with these navigational lanes and again would increase the risk of vessel collisions. 4. Parcel Size Limitations: The limited size of the parcel would allow for approximately 35 boat trailer and car spaces. It is not cost effective to staff the launch ramp facility with an employee to collect boat launch fees which are set by State policy at $3.50 per day. Because there is very little turnover in a boat launch facility the fees for the launch ramp would not cover the cost to staff the launch ramp, would not cover the cost of maintenance of the facility and would not come close to funding any liability insurance premiums. RECOMMENDATION_ If desired, direct the Staff to prepare a letter to the California Department of Boating and Waterways, indicating to the state that the grant funds for a public boat launching facility at this location are not advisable because of navigational, operational and engineering concerns. Page 4 is NEWPQRT DUNES PUBLIC BOAT_LANNQHINQ RAMP: The existing Newport Dunes Boat Launch ramp with access from Jamboree and Back Bay Drive has six concrete launching lanes with parking for trailers and automobiles in approximately 100 spaces. In addition, there are 325 dry boat storage spaces adjacent to the launch ramp. The proposed Redevelopment Plan for Newport Dunes and Settlement Agreement outline an upgrade of the launching ramp to a total of ten concrete launching lanes, trailer and car parking spaces to remain at 100 and the dry boat storage to increase by 75 spaces, for a total of 400 dry boat storage spaces. The County of Orange is currently in lease negotiations with the Newport Dunes Company. The Department will begin accepting mail -in registration on June 3. The Mayor's Cup Tenni's Tournament was conducted May 14, 15'and 21 at various City-courts. A total of 106 players participated in the Tournament, and the Department received $150 in cash sponsorships and addi- tional,product sponsors. As of June 1, over 1,000 entries were received for the Corona del May Scenic 5K scheduled for June 11. Im cooperation with the Corona del Mar Chamber of Commerce, preparations for the annual event are continuing at a frantic pace. Youth Activities The Department's second Indoor Soccer season was brought to a successful conclusion during the month as 40 youthful participants used the Lincoln Gymnasium as the site of the fast pated'variation of regulation soccer. Again, the Department'was assisted by local AYSO officials in the areas of promotion and training of Recreation Leaders. On Memorial Day the Department and the Newport Heights Community Association combined resources to stage the annual Memorial Day Picnic at Cliff Drive Park. Parks Division staff provided set up and located equipment; Recreation Division • staff coordinated games., printed flyers and provided insurance. Over 1,000 area residents attended the Holiday event. The Youth Activities Section also printed and distributed summer promotional flyers, prepared a comprehensive training program for Recreation Leaders and is working with the Youth Council to program an end -of -the year dance on June 11. Adusit Sports /Aquatics The Department processed registration for 279 adult athletic teams during the past month. A total of 232 softball teams are divided into 35 leagues in men's, women's and co -rec divisions.for league play which began May 23. After completing spring basketball play with 42 teams, 47 teams registered for summer league play which will begin in June. Spring sailing and surfing classes enjoyed a'successful spring with surfing enrollment-maximum expanded from 20 to 30 to accommodate the increased demand. Seniors The first Oasis Wog (Walk /Jog) attracted 60 participants on May 14 to the Back Bay Bicycle Trail. The event celebrated fitness and health among older adults in what is hoped to be an annual event. On May 9 Celeste Jardine -Haug started at Oasis and began development of an agenda to improve services and programs at the Center. Among Ms. Jardine - Haug's first priorities is development of a master plan for the 1.06 acres north of Oasis and development of a procedural manual for the Center. Both efforts will be in cooperation with designated committees of the Friends of Oasis. The Friends requested that the joint meeting with the Commission originally scheduled for June be delayed until July. The Oasis schedule for, • June is attached. It should be further emphasized that the preliminary plans detailing the above design considerations were presented in a public forum and approved by the Parks, Beaches and Recreation Commission and subsequently by the City Council. The building was sited and oriented to serve as a focal point for the park. The pyramidal roof forms and strong primary color serve to achieve this design intent. In addition the red roof color compliments the sand blasted natural grey of the concrete block walls and exposed aggregate finish in the walkways. One criticism that has been voiced is that the building does not "match" or "blend" with the surrounding housing product. I can only respond that with respect to the building proper, this was never the intent. This is a public park and the public building at its core serves the entire community, not just the immediate neighborhood. It appears as if some homeowners think the height limit for encroachment requirements is chimney level rather than rooftop level. Beginning at the Chin _ trance, 1. Possibility of adding a sid'ewaik on city property from China Cove street to as far along Cliff Drive as possible. (Driveways are problem areas.) 2. Immediately upon start of property at China Cove, city brush could be taken out. S. 2701 OK 4. 2727 Remove bushes along fence (their property or ours ?) 5. 2735 Bushes need to be taken out completely. 6. Last house before Lookout Point still needs work. 7. Before Lookout Point area - -cdty property needs shrubs removed. 8. 2929 Bushes need to be removed - -not thinned. (Could be private property) 9. Entrance to Big Corona - -some city property bushes need to'be removed. 10. 3317 Bushes out to street block view and Inhibit ability to see coming out of next drive Si. 3625 Giant bush above rooftop height 12. $631 Beautiful 13. 3709 Trees (Ficus and Jun'lper ?) above rooftop height We discussed the possibility of proposing an Improvement protect which would add sidewalk to all 'the encroachment areas where possible as an extension of the sidewalk currently being installed along Cliff Drive with the possibility of reclaiming encroachment area and landscaping . to better fit the overall landscape plan., ' MEMORANDUM • TO: PARKS, BEACHES & RECREATION COMMISSION FROM: JOHN KONWISER DATE: JUNE 6, 1988 RE: FACILITIES REPORT I. BEGONIA PARK 1. Curious — w what he o y is on the missing slide. Obviously this is. ain eature f- the main feature of the park. As I'm sure you real a th o slide! 2. As I said about a year ago, what a great view from the bench at the corner of Begonia and Pacific, similar to the bench in Irvine Terrace Park and I know several others. It would be fun to somehow publicize these locations as passive recreation places perhaps as an adjunct to our recreation bookley or the City Manager's newsletter. II. BAYSIDE DRIVE PARK 1. One large branch on coral tree adjacent to play equipment still shows sign of frostbite with no leaves even though outer layer shows green. If it doesn't leaf out soon, branch could be cut with no loss of aesthetics. Other than this little item, this little park looks in great shape. III. SAN JOAQUIN HILLS PARK 1. The Vinca planted in place of the weeds on the right side as you enter the park looks great. It could use a bit of weeding but a massive r improvement. 2. There is a three yard trashbin sitting by its lonesome at the end of D t parking lot which looks completely out of place. If this is truly �J ,Q is permanent home a block wall enclosure should be built on the sidewal �y^ area with a ramp down to the pavement as the trash bin surely is out of place in the center of this otherwise good looking facility. 3. As you walk towards the steps leading down to the tennis courts there's a planter about half filled with bunch grass and the balance bare dirt. Since there is a lot of activity in the form of waiting for tennis courts around this planter, it would be great to fill in the rest of it perhaps with something more hardy than the grass. 4. As you walk toward San Joaquin Hills Drive along the tennis courts a planter measuring about 5' wide by 12' long should be replanted with junipers. 5. At the opposite end of the park on our side of the wall from the Jasmine Creek Tennis Court are some good size logs, stumps, and concrete blocks to be removed. i • IV. SAN MIGUEL PARK 1. Looks like a long, narrow, unsightly strip of no -man's land between where our turf ends and about 8 or 10' up the hill where the wrought iron fence with the homes behind is set., I'm wondering why the sprinkler main line is above grade. Simply by mowing the grass and throwing some seed where it's primarily weeds this strip in short order could look as attractive as the rest of it. I assume there is some reason why the irrigation line is above grade as obviously it should be buried: 2. The slope in back of the handball court area leading down to the ser- vice road is 100% weeds except for some volunteer Cape Honeysuckle. It should be cleared and honeysuckle, oleanders, or some native type shrubs planted. After initial watering they would require no watering and little maintenance in years to come. On the handball side of the walk there are some weeds around the rocks at the head of the stormdrain that should be pulled out. 3. The weeded slope above the tot lot really needs some attention and again cape honeysuckle, oleander, etc. I believe would be well suited. This slope unlike the others referenced above is adjacent to a high use section of the park and therefore needs attention. 4. Continuing north there is again a strip from the concrete curb up to the wrought iron fence that is primarily Queen Anne's Lace and other weeds to remove and plant. 5. It should be mentioned the main playing fields and grass area of the park look in great shape. 6. The slope leading down to the street to the north needs a bunch of weeds pulled and more junipers or similar plant material-installed. Where traffic has worn down the slope by the stairs I strongly suggest a solid row of pyracantha, at least 5- gallon size preferably 15- gallon, as a per- manent easy way to deter traffic over landscaped areas. x � Eileen J. Cirillo 2201 Aralia Street Newport Beach, CA 92660 is 760 -8313 t City of Newport Beach Parks, Beaches and Recreation Commission Parks, Beaches and Recreation Department June 7, 1988 � v `�A RE: Request to remove Brazilian Pepper tree in parkway at above address The following is a brief recap and explanation of the attached materials; During the months of February and March I was in contact with Mr. Jack Brooks, Park and Street Tree Superintendent, regarding the problems relating to the tree in my parkway. I requested the removal because of the problems and because I was doing a major relandscaping project. After several phone conversations and the referral of this issue to the Tree Committee, I received the attached memo denying my request. I would now like to explain once again the reasons for my request: 1 - I am doing a major renovation of my landscaping, and I have not been able sucessfullly grow anything in the parkway because of the size of the tree and its roots. is 2 - Even though the City has periodically worked on the tree and its roots, the sidewalk is still lifting. In 1984 a section of sidewalk was replaced, in 1986 that same area was patched because the sidewalk was lifting again. Refer to page 1 of the pictures. 3 - I have also called the City to check out the standing water in the gutter alongside the tree because I often have standing water. Is this caused by the slight lifting of the gutter from the tree roots and hampering the natural flow of water? Refer to page 2 of the pictures. 4 - Page 2 also indicates a large crack in the driveway, which could be caused by the tree roots. There is also a crack in the curb in the immediate area of the tree. 5 - Page 3 of the pictures also indicates the standing water and the cracks in the driveway and the curb. 6 - I am only requesting permission to remove the tree and replace the tree with whatever the City would suggest. Several other Brazilian Pepper trees on my block have been removed; some by the City, some just disappeared. Originally each lot had one and sometimes two Brazilian Pepper trees. In looking at the pictures you can see that many lots are without any trees. The City has replaced some with Carrotwoods and my landscape designer sug- gests either a type of camphor or the Carrotwood. 0 111 F —2— • City of Newport Beach I would like to again request that the Brazilian Pepper tree in my parkway be removed. If the City is unable to do this because of Parkway Tree budget allocations, I would ask the City to give me permission to remove the tree at my expense and replace it with a tree recommended by the City. As you can see by the pictures, my landscape project is well under way and so time is of the essence. If I can provide any further information I will gladly do whatever I can. I appreciate your time and tolerance in this matter and I thank you for the opportunity to plead my case and appeal the decision of the Tree Committee. I hope to have a favorable decision from this Commission so that I may carry out my landscape project and do my little bit to beautify the Eastbluff area of the City.
