PROCEDURAL MATTERS Item #1 - Call to Order i The meeting of the Parks, Beaches and Recreation Commission was called to order at 7:02 P.M. Item #2 - Roll Call Roll call was taken. Commissioners Herberts, Konwiser, Springer, Taft and Vandervort were present. Commissioners • Brenner and Grant were absent. Item #3 - Approval of Minutes - Meeting of February 7, 1989 Motion x I Commissioner Taft moved the minutes of the February 7, Ayes x x x x x 1989 meeting be approved. Unanimous. Item #4 - Adoption of Agenda The agenda was adopted as presented. II. ACTION ITEMS Item #5 - Animal Control Ordinance Chair Konwiser turned the meeting over to Director Whitley who referred to the proposed draft of the Ordinance which is being presented for further review since other Depart- ments are involved and are providing input. Director Whitley reported the Police Department was present to answer any questions and provide input to the Commis= sion's recommendations, particularly leash length and those sections the Commission recommended be retained. • Bill Lyons, Senior Animal Control officer, addressed the Commission. He stated the leash length of 6' is the state -wide acceptable length to keep an animal under control and, therefore, the Police Department recommends 3 this length remain-in the Ordinance. :all to lyder toll Call 1pproval of lihutes kdoption of lgenda Inimal .ontrol )rdinance CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission Page 2 City Council Chambers 7 p.m. INDEX Commissioner Taft referred to the two paragraphs the Commission recommended be retained, and Officer Lyons reported that since the Police Department feels the para- graphs are not clear and could be misinterpreted, they were deleted. He said the paragraphs sound like an officer would have to order someone out of the park before citing. With the paragraphs deleted, an officer has the option of giving a warning or issuing a citation. He added that the Ordinance does not prohibit dogs in parks, but they must be under control on the access areas. Commissioner Springer referred to the 'bops Scoop" machines used in Laguna Beach which were discussed at the last meeting and stated she felt this would be the least restrictive procedure to follow. Commissioner Herberts pointed out the Commission agreed not to restrict citizens with dogs from the parks and • that no City in Orange County does so. She also brought up the suggestion of raising fines and posting and ex- plained.the,ba•il schedule, noting that a $25.00 fine, after court costs, etc., results in a $68.50 fine. Greg Armstrong from the Police Department addressed the Commission. He explained the reasoning behind rewriting. the Ordinance and the different City factions involved. He said this City has the strictest animal enforcement policy in the County. He also referred to the paragraphs recommended for deletion and explained that they have become an issde,in court as to reasonable doubt. The paragraphs can be misinter- preted and cause confusion; they want the Ordinance to be specific and clear to the public. He stated that the current City Ordinance regarding dogs in parks is vague and its prohibition unclear. Yet, the Police Department receives a large number of complaints regarding dogs in parks and dog nuisances in parks. The draft Ordinance is a compromise between those who would prohibit dogs from parks completely and those who wish to allow dogs in parks. He referred to the bail schedule by which the Judge makes a final decision and reiterated that a citation for $25.00 pleas costs results in a $68.50 fine. Fines may well be increased and more fines added to the schedule. Enforcement, however, would still be a problem. 4 CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission Page 3 City Council Chambers 7 p.m. INDEX Commissioner Herberts reported she spoke with the City Attorney who advised her that if it could be rewritten as an infraction, the fine could be so specified in the Ordinance and parks could be signed to this effect. Officer Armstrong explained parks can still be signed and that they recommend it be made clear where dogs cannot be in parks and enact a less restrictive policy. He stated this is a control issue, however, they don't dictate attitudes which is always a problem with any law. Mr. J. R. Blakemore, 1509 Harbor View Drive, addressed the Commission. He stated he has seen spring loaded leashes which do not control dogs and suggests this be addressed. Commissioner Taft stated he favors permitting dogs in parks, but restricting them to the walkways. • Commissioner Vandervort voiced her concern over the changes the Commission made at their last meeting which should be addressed. Director Whitley advised that all the recommendations made are in a separate draft and that they will be incorporated into the Ordinance and transmitted to the City Council. Commissioner Herberts recommended the Ordinance be re- written with their changes before voting, particularly sinc two Commission members who were in favor of the changes are absent. Commissioner Vandervort agreed and suggested the item be continued until the full Commission is available-,-to vote. Director Whitley explained that this is a complex issue and there is a lot of inter - departmental review in the process. The City Manager has placed this item on the Study Session agenda for March 13 in order to provide an opportunity for everyone to give input. Those interested should attend the meeting. He also pointed out that those additions and changes recommended by the Commission will be incorporated into the draft which may be reviewed two or three more times by Council. • Commissioner Springer suggested that since the Commission has now received answers and input to their questions from last month, they review their recommendations and decide Swhich ones to delete or retain. CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission, Page 4 City Council Chambers 7 p.m. INDEX Chair Konwiser stated he felt that if there is no time problem, the item be continued so that the Commission can review the revised Ordinance. In the meantime, their changes should be transmitted to the City Council even though this isn't a final decision. Commissioner Vandervort stated she felt Council should not receive the draft with the recommendations since some may be changed, or that Council should be aware that the Commission is no longer unanimous that leash length should be 8' and the two subject paragraphs the Police Department recommends be deleted be retained. Motion x Commissioner Herberts motioned to continue this item and Ayes x x x transmit the revised draft to the City Council with copies Nays x, x to the Commission. Motion passes. Chair Konwiser reported this will be an action item at the • Commission's April 4, 1989 meeting. Director Whitley reported he was just informed that the City Manager will ask Council to continue the item until after the Commission's review on April 4. Commissioner Vandervort asked that Greg Armstrong be invited to attend this meeting. Item #6 - Review.of City Council Policy I -12, Obstruction Review of City Council of Views by Trees Policy I -12 Director Whitley reported that over a year ago this Commission was active in developing Policy =I -12 which was intended to make statements with regard to trees causing view problems. It is a philosophical policy to encourage trimming of trees. Unfortunately, the policy has not resulted in any changes with regard to improving views. Therefore, the policy is being brought before the Commis- sion for review with three recommendations, namely (1) Modify policy to provide stronger enforcement, or (2) Reaffirm existing policy, or (3) Eliminate the policy. Chair Konwiser opened the meeting to Public Testimony and Mr. Jim Wharton, 1033 Goldenrod, addressed the Commission. Representing the Harbor View Hills Association, he stated they had hoped the policy would encourage other association , • specifically Irvine Terrace, to trim their trees. However, the policy has not worked and there is a continued invasion of view space by overgrown trees which also affects the / b CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission Page 5 City Council Chambers 7 p.m. INDEX value of their homes. He reported they have received cooperation frog other associations but not Irvine Terrace and are asking this Commission's help in doing so. Mr. J. R. Blakemore, 1509 Harbor View Drive, addressed the Commission and stated proper trimming is an advantage to both the homeowners and the City since it inhibits root growth, preserves the view value and encourages beautiful growth. He recommended a study be done to see what the City can do to prevent overgrown trees. -Jean Morris, 1032 Sea Lane and member of the Harbor View Hills Homeowners Association, addressed the Commission. She stated she has lost her unobstructed view of the Bay which could still be corrected. She asked that the City study this matter so they can have a tool, such as an Ordinance, to enforce tree trimming policies. Chair Konwiser reported he has lived in Harbor View Hills • and presently lives in Irvine Terrace. 'He explained that Irvine Terrace is much older and the area was,developed before the CC &R's were written, which do not allow the Board members to come on private property as do modern CC &R's. They have tried to change them but to no avail. He suggested the most effective way to attack the problem might be to. address each homeowner on a one to one basis to achieve the necessary cooperation. Commissioner Springer stated she had originally voted against I -12 since she didn't think it would be effective. She would vote for I -12 if the City Attorney could provide an effective method of enforcement', but this is extremely doubtful since private property is involved. The only other option would be in the form of a lawsuit. Chair Konwiser stated he agrees with the policy but feels it is worthy to ask the City Attorney if there is anything that can be done with regards to enforcement. Commissioner Vandervort concurred. - Motion x Commissioner Taft moved to retain the policy and refer it t Ayes x x x x x the City Attorney for ideas on enforcement. Commissioner Vandervort amended the motion to include researching other coastal communities. Unanimous. CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission Page 6 City Council Chambers 7 p.m. INDEX Item #7 - Appeal on Street Tree Decision, 2137 Aralia Appeal on Street Tree Director Whitley reported a letter was received from the Decision owners appealing the Street Tree Committee's decision to retain the tree. Mrs. Karen Drumwright, 2137 Aralia, addressed the Commis- sion. She stated her sewers have backed up twice due to the tree roots and there will probably be another back up. She feels the tree is not only an eyesore, but is also breaking up the sidewalk and the falling blossoms stick on their car in the summer. Commissioner Vandervort said she did not see any damage to the sidewalk, curb or gutter. In addition, the sewer lines are in the center of the lot, 8' from the tree, and the problems may be caused by the Ficus instead. For these reasons, she favors retaining:the. tree. • Commissioner7aft felt the tree is pretty, however, if it is causing sewer damage he would recommend removal. Mrs. Drumwright, 2137 Aralia, addressed the Commission. She indicated that she could just as well have taken the . tree out and said - nothing like other people do. Commission r Springer advised her that she was mistaken, and that the City Attorney addresses unauthorized removal of trees for which the owners are responsible for their dollar value. Motion x Commissioner Vandervort moved to reaffirm the Street.Tree Ayes x x x x Committee's decision that the tree be retained. Motion Abstain x passes. Chair Konwiser advised Mrs. Drumwright that she has the right to appeal the Commission's decision to the City Council. Item #8 - Arbor Day Program Arbor Day Program Director Whitley referred to the proposed Proclamation and briefly reviewed the Arbor Day concept and advised that April 28 is National Arbor Day. The Street Tree Committee has been working towards making this City an official Tree City USA, and one of the requirements is that the City have • an Arbor Day program. The other requirements have been satisfied. Staff recommends a subcommittee be formed to implement an Arbor Day program. Unanimous. Item #9 - Park Bond Park Bond Director Whitley reported the City Council reviewed the report submitted. Since two Councilmembers were absent, Council asked that the same report be on their Study Session agenda for March 13 to which the Commission is welcome to attend. The two recommendations for the Commission's review are (1) Request the City Council to implement a bond issue for Park and Open Space purposes, or (2) Request the City Council to pursue park and open space agreements with developers for selected locations. Director Whitley reported he received a letter from • Commissioner Grant suggesting Council pursue a comprehensive plan to- develop agreements with developers for selected locations and that dedications for public land be made prior to the development of projects. Discussion ensued on the probability of a bond issue being passed. In the past, this has been very hard, however, Commissioner Herberts pointed out the latest Wildlife and Park Bond received 63% affirmative votes by the City in 1988 as opposed to 31% negative. Commissioners Vandervort and Taft both felt that since some parks are not heavily used, a study should be done to set goals and identify specific types of parks, their usage and need in certain areas. Director Whitley advised the Recreation and Open Space Element addresses this issue as to deficient areas. Motion x Following discussion, Commissioner Taft moved to continue Ayes x x x x x this item to the April 4, 1989 Commission meeting.. Unanimous. Item #10 was addressed following Item #7. Item #10 - Volleyball Application Volleyball Application • Commissioner Taft, Chair of the Oceanfront and Beach Committee, read the report submitted concerning pending installation of a volleyball court at 31st Street. Chair I CITY OF NEWPORT BEACH arks, Beaches .& Recreation Commission City Council Chambers 7 p.m. INDEX Status of Capital Projects Commission Committee Reports Konwiser opened the meeting to Public Testimony and Mr. Max Morgan, 3004 W. Oceanfront, addressed the Commission. He reported he thought that on December 6, 1988 when the Commission approved installation at this site that they were addressing 3012 West Oceanfront. As a result he feels he was not properly notified and has now submitted the proper application to oppose installation at 31st Street. He stated these are back to back courts and they would only have 9' of beach in front of their house. In addition, there is a bike rack, trash can and lifeguard station at 31st Street, resulting in more crowds and trash. Sally Colome, 106 31st Street, addressed the Commission. She stated the area is too crowded and noisy already and a volleyball court at 31st Street would present further imposition to this location. • Mark Deven advised he received a telephone call from Helen Moore, 3112 West Oceanfront, opposing installation of a court at 31st Street. Motion x Commissioner Taft moved to support the group that is Ayes x x x x against installation so that the Commission's recommendation be to not install a court at 31st Street. Unanimous. III. PUBLIC COMMENTS IV. DISCUSSION ITEMS Item #11 - Status of Capital Projects The capital projects report was briefly reviewed and Chair Konwiser asked that the Legends be more clearly marked. Item #12 - Commi,ssion Committee Reports a. Capital Improvements - No report. b. Street Tree - Chair Herberts reported there is an older Carob Tree on Third Street that has termites and the owner feels they are entering his house. Jack Brooks advised he will get a special permit to spray. • There were three tree requests before the committee, two of which were denied and one approved. c. Recreation Program - Chair Vandervort reported the new �u spring brochure was recently mailed and all the current programs are going well. Oceanfront and Beach - Chair Taft advised his report was addressed under Item #10. e. Budget - Director Whitley reported he was pleased with the preliminary budget session and thanked the Commis- sion for their support. He will present a summary at the Commission's next meeting on April 4. f. Open Space Acquisition - Addressed under Item #9. g. Chair's Report ­No report. Item #13 - Commission Liaison Reports Commission Liaison a. No report on Friends of Oasis due to Commissioner Reports Brenner's absence. b. Commissioner Herberts reported that Mary Slack from the Friends of the Theatre Arts Center has proposed that • one performance at each production be a fundraiser for a charitable organization. Mark Deven advised that since the City supplements the Theatre's operations at no charge, there is a valid, concern that this idea would not be appropriate. Commissioner Vandervort reported "Lil Abner" was excellent and Mark Deven pointed-out that it was sold out during its last three weeks of performance. Item #14 - Recreation Division Recreation Division Mark Deven explained that a Purchase Order was issued to Assured Electrical Contractors, Inc. to re -aim the lights and provide glare shields by April 21 at Bonita Creek Park. Item #15 - Park and Street Tree Division Park and Street Director Whitley reported staff will meet with the President Tree of the Peninsula Point Association along with the Street Division Tree Committee to discuss the Association's tree concerns. Commissioner Vandervort asked how a dollar value is arrived • at for a tree and Director Whitley explained that a formula is used involving species, caliber, location, etc. He also reported the City Attorney has the names of those who have removed trees without City authorization. A letter will be sent advising them that if they don't pay for the value of 1 the tree, the matter will go to Small Claims Court. These teams competed with distinction throughout the season, exhibiting both skill and sportsmanship prior to earning invitations to the County Tournament on March 11 -12. The teams are the "A" Division (7th -8th grades) and "B" Division. (5th -6th grades) teams from Newport Heights School and the "C" Division (3rd -4th grades) combined teams from Andersen and Harbor View Schools. As a means of providing Special Recognition for the achievements of these athletes, family, f'riend's and team members are invited • to the,Parks, Beaches and Recreation Commission meeting of Tuesday, April 4, 1989, to receive Certificates recognizing their achieve- ments. Approve and transmit to the City Council the attached complete draft of the Animal Control Ordinance entitled "Exhibit A" which contains specific language regarding the Prohibiting of Dogs on School Grounds and omits the restriction of dogs to sidewalks and pathways within City parks; or 2. Approve and transmit to the City Council the attached partial draft of the Animal Control Ordinance, entitled "Exhibit B" which contains alternative language regarding the Prohibiting of Dogs on School Grounds and proposes to restrict dogs to sidewalks and pathways within City parks. Background: • The Commission's consideration of the Animal Control Ordinance at the February and March meetings seems to reveal two clear alternatives for action as presented in the recommendation. Should the Commission approve the draft entitled- ,Exhibit "A,',' a_ specific section regulating dogs on City parks would not be necessary since regulations requiring leashes and nuisance removal are addressed in Sections 7.04.020 and 7.02.020, respectively. Members of the Commission have also discussed a maximum leash length of eight (8) feet instead of six (6) feet, although discussion of the Ordinance last month seemed to favor retention of the 6' maximum length. The Commission also discussed incorporation of the bail schedule into the Ordinance and the installation of signs in City parks which inform the public of the fines. The Commission may desire to transmit recommendations regarding those items in addition to the action on the Ordinance. Staff will research and present a short verbal report regarding the costs to produce and install new signs indicating the bail schedule. Due to prior commitments, Officer Greg Armstrong will' be unable to attend the April 4 meeting. Captain Mike Blitch, Commander of the Police Department's Patrol Division, which includes Animal Control officers, will attend the meeting and will answer questions regarding enforcement. v� Mar Deven � 13 ORDINANCE NO. 89 -_ DRAFT AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING SECTIONS 7.04.020, 7.04.025, 7.04.030, 7.04.040, 7.04.055, 7.04.090, 7.06.010, 7.10.010, 7.20.020 AND 7.20.050 OF THE NEWPORT BEACH MUNICIPAL CODE PERTAINING TO REGULATION OF ANIMALS IN THE •CITY OF NEWPORT BEACH. The City Council of the City of Newport Beach does hereby ordain as follows: Section 1: Section 7.04.020 of the Newport Beach Municipal code shall be amended to read as follows: Section 7.04.020. Section 2: Section 7.04.025 of* the Newport Beach Municipal Code shall be added to read as follows: Section 7.04.025. Prohibited on School Grounds. No person having the care, charge or control of any dog shall cause or allow, either wilfully or through failure to exercise due care or control such dog to be present on or in any Public school property other than when specifically invited by the school administration. 1 The Prohib itions contained in this Section shall not be applicable to any guide dog while being used by a blind Person provided that the dog is on leash carries clearly visible identification and the Person in charge has an official Identification card issued for such Purposes. Section 3: Section 7.04.030 of the Newport Beach Municipal code shall be amended to read as follows: section 7.04.030. Prohibited on Public Beaches and Parks. During the period from June 15 to September 15, no person having the care, charge or control of any animal shall permit or allow any such animal to be, under any circumstances or conditions, on or -upon any ocean front beach, ocean front sidewalk, or bay front beach, er- pubi -ic-- parks-- tairitilr -awe- -used prsmar4bp- as- �krielreais- p�aygraxrn'ts- in the city of Newport Beach. The prohibitions contained in this Section shall not be applicable to dogs while they are enrolled and participating in obedience classes sponsored by the Recreation Department of the city, or in City- authorized dog shows; or to any guide dog while being used by a blind person; or to any dog being trained to be a guide dog for the blind under a recognized program for such training, provided that the dog is on leash, carries clearly visible identification, and the person in charge has an official identification card issued for such purposes. Approve the installation of the tennis court lighting with no conditions other than deactivation of the lights at 10:00 P.M.; or 2. Background: The Fiscal Year 1988 -89 Capital Improvement Budget contains an appropriation of $20,000 to install lights on two of the four tennis courts at San Joaquin Hills Park. The project was originally proposed to staff by tennis participants who desire lighted court facilities in Corona del Mar. The San Joaquin Hills site was selected due to the accessibility of an electrical source on the tennis courts. The tennis court construction provided for the installation of surface mount rigid conduit on the fencing, thereby reducing the amount of underground conduit installation. The selection of the two southernmost courts is based on its lessened anticipated impact on adjacent residential units in comparison with the northern courts. The south courts border Jasmine Creek's own tennis facility and a buffer of trees exists between that portion of the park and the units. Although the proposed system utilizes twelve (12) "shoe box" lights mounted at a height of 20', the trees bordering the park are at approximately the same height. The exact location is designated on the attached map. The Department is fully aware of the community's sensitivity to sports lighting • and the concerns of adjacent homeowners with respect to potential nuisances. Therefore, the proposed system will be designed to minimize or eliminate ay -2- ambient lighting as demonstrated by the downward orientation of the fixtures. Tennis players may activate the system on demand by utilizing a "turn key" • feature. The system is proposed to not activate after 10:00 P.M. Following the conclusion of discussion, the Commission may desire to: 1. Approve the installation of the parking lot lighting with no conditions; or 2. Approve the installation of the parking lot lighting subject to specific conditions, including but not limited to deactivation of the security lights at a specific maximum time; or 3. Continue the item to the meeting of May 2, 1989 in order to provide staff with an opportunity to meet and confer with affected residents; or Deny the project. Background: The Fiscal Year 1988 -89 budget contains an appropriation of $17,000 to install security lighting in the Newport Theatre Arts Center parking lot. Security lighting was scheduled for installation in the parking lot approximately eight years ago; however, a lack of funds and the perceived negative reaction from neighborhood residents resulted in its deletion from an earlier improvement project. The project is proposed again in response to the continued popularity of the Theatre which has resulted in the scheduling of Thursday evening performances in addition to Friday and Saturday evenings and Sunday afternoon. The proposed lighting system will utilize four (4) 70 watt light fixtures, three (3) mounted at 12' and one mounted at 14'. The system will utilize the MWC San Juan' "H" Series, or equivalent, fixtures which are designed to -2- reduce or eliminate ambient light. The system will be engineered to activate • during the evening hours and may be deactivated at a specific time, such as 11:00 P.M. First of all, the philosophy of the PBR department is to maintain fiscal responsibility with respect to its .parks. Park programming is offered on a self supported basis to ensure that citizens are provided the maximum benefit for their tax dollars. The subject proposal fails to take into consideration that the City would be loosing millions of dollars a year in revenue for a property that is incapable of generating a fraction of that amount in park fee revenues. It is my understanding the existing 25 year lease currently provides the City with $500,000 per year of net revenues. •Given the terms of the lease extension, gross revenues from the apartment units would generate 16 and one -half percent revenue to the City and 33 and one -half percent from the operation of the marina. This is projected to provide over $2,000,000 per year in revenue. In short, the proposal to convert all or a portion of the Bay Club to a park would have a detrimental impact from a fiscal perspective. During my four year tenure on the Parks, Beaches and Recreation Commission, I remember a statistic wherein approximately 25 percent of the users Bay Club recreational facilities are local Newport Beach residents. If the existing property is designed to be a regional park, it is possible that the local residents would have less access to the facility. First of all, ingress and egress to the property is already subject to serious limitations. Opening up the facility to a joint use /regional park would only compound the problem. Secondly, the demolition costs involved would be enormous and any revenue generating activities from the property would be incapable of defraying such costs. Finally, converting the facility to a public park on Coast Highway would result in a similar situation to the traffic congestion on the Balboa Peninsula during the summer months except that the situation would probably continue throughout the year. Any confused or mixed signals regarding the lease extension or the use of the facility will clearly result in the owners not expending money on necessary lease improvements. The facilities are in need of repair and it is doubtful to me that funds for the necessary improvements will be expended while impractical suggestions such as the one before you are being considered. Construct North Oasis Parking Lot Carry -over. n U RECREATION DIVISION MARCH, 1989 PROGRESS REPORT ial Interest Activities Item No. 13 Although the winter session is traditionally a slow period for tennis classes, two programs stood out this past quarter. The "Mr. Pee Wee" tennis camp enrolled 50 participants during the spring vacation break at Mariners and Grant Howald Parks. The camp utilizes down -sized racquets and nets and empha- sizes beginning level skills for youngsters. Parents who observed the program were as enthusiastic as the youthful participants. Similar camps are planned for the summer. The winter round robin program registered 55 participants, a strong number even for fall or spring sessions. The round robin program is administered by both Department staff and the participants, who report scores, officiate matches and keep track of the tournament's standings. Other special interest activities fared well during the winter, especially gymnastics and dance fitness programs, which enrolled slightly less than 1,300 participants between them. Youth Activities /Facilities Maintenance Regular youth basketball play ended March 4 with three City teams advancing to the County tournament. The "A" Division team from the Newport Heights area reached the finals before losing to Santa Ana's representative. Track and field workouts have begun at elementary school sites with the All -City Track •and Field Meet scheduled April 14 under the lights at Davidson Field. Once again, the Meet is co- sponsored by the Newport- Balboa Rotary Club, and the School District has waived facility fees for the stadium use. Despite our best efforts, staff could not prevent rain from cancelling the annual Easter Egg Hunt on March 25. The candy = provided by the'Eastbluff Merchants Association will be used for other.Department activities, to the delight of children who attend after - school activities at Mariners and Grant Howald Parks. Adult Sports /Aquatics As 49 teams concluded the adult basketball season, 66 teams began the spring season the week of March 27. The winter softball season is continuing without rainouts. The Department has received approximately $59,000 from the registra- tion of 140 teams in basketball and softball. The spring break classes in sailing and surfing were well received, due-in part to the good weather conditions. Department staff is continuing program development in the aquatics area, negotiating with local vendors for the leasing or purchase of sailing and rowing vessels as a means of expanding the aquatics program. Older Adult Services City staff honored Oasis Center volunteers with a tea on March 1.5. A total of 105 volunteers attended a program which featured entertainment, awards, refresh- ments and food. The volunteers were recognized for their outstanding contributions to the Center, especially in the kitchen and information areas. On March 17, a St. Patrick's Day Dance was held with approximately 200 people attending. -2- The Board elections were also held this month. Three new Board members were • elected: Ken Norman, Virginia Cole and Meyer Bloom. The Executive Committee was elected at the Board meeting on March 20. Balboa Pier Parking Lot Assisted the tree crew in planting a palm tree. Spyglass Park Put new sand in the sand play area. Eastbluff Park Planted 4 (four) 48° box trees. Newport Pier Parking Lot Removed old showers, two at each end of the parking lot, and installed new ones. The proposal by Councilwoman Hart to exempt 4.4 acres of the total of 26•.85 acres so that the city will have the option at the time of expiration of the lease in 2411 to reclaim that 4.4 acres located adjacent to the Scout Base is a timely suggestion that merits our review. I think we have a tremendous opportunity to make it possible for some future city council to possibly add to our parks with a view area or a passive park or some other recreational purpose since we have little city acreage in this area for our citizens. A future council might decide to continue the lease, but exempting the 4.4 acres from a proposed 50 year tease would at least allow an option. Councilwoman Hart's proposal is not asking for return of the entire 26.85 acres but is asking for exempting 4.4 acres from the lease agreement. The 145 units sitting on the 4.4 acres will have had a 45 year life at the end of the present lease agreement in 2011. In 1987 -88 the lease income to the city from these units amounted to $123,300. Broken down, that comes to approximately $70 per unit per month. The apartment portion of property taxes amounted to 3'8,914 or approximately $6 per month per unit. This seemingly small amount of money goes directly into the general fund and not into PBR funds even though the property was given for open space. At present, we have a bond committee trying to identify property that could be Purchased by the city for parks. At the same time we appear to be leasing, for a very inexpensive price, 26.85 acres. I'm not sure the community wi -11 understand why we want more money fan park land when we are leasing out 25.85 prime acres of land given to the city for that purpose. The Balboa Bay Club has done many positive things for the community and this proposal would in no way change things for the members, guests, and community members who use the facilities. This proposal would only allow the city to have the opportunity to take back. the 4.4 acreage currently sitting under the 145 units. It is the city council's decision to decide whether, to lease the entire 26.85 acres for 50 years to the Balboa Bay Club or to exempt 4.4 acres from the lease for possible park use. It seems to me that in light of all the planning for future purchase of part: land, we should decide if there is a possibility that we would want to use our own land and offer the commission's recommendation in favor of Councilwoman Hart's proposal. • 1 have added information for Tuesday's meeting but wanted to give you the opportunity to read the Irvine letter before the meeting.
