PROCEDURAL MATTERS Item #1 - Call to order Call to Order The meeting of the Parks, Beaches and Recreation Commission was called to order at 7:00 P.M. Item #2 - Roll Call Roll Call Roll call was taken. Commissioners Compton, . Demmer, Grant, Herberts, Konwiser, Taft and Vandervort were present. Item #3 - Anproval of Minutes - Meeting of Approval of October 2, 1990 Minutes X Commissioner Compton moved the minutes of the x x x x x x x October 2, 1990 meeting be approved. Unanimous. Item #4 - Adoption of Agenda A4option of Agenda X Commissioner Herberts moved the agenda be adopted X x x x x x as presented. Unanimous. II. INFORMATIONAL AND COMMITTEE REPORTS Item 45 - Park and Street Tree Division Park and Street Tree In response to a question by Commissioner Taft, Division Jack Brooks explained the location of "M" Street Park, which is a traffic island on the Peninsula between Balboa Boulevard and Ocean Boulevard. Commissioner Demmer inquired about the redesigned garden plots at Oasis and Jack Brooks advised CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission Page 2 City Council Chambers 7 p.m. INDEX that the scope of the project is less, however, the plots will not be affected. Basically, the project has gone from formal bid to informal bid. This has been awarded and the basic grading completed. Commissioner Herberts stated she felt the Palms on Irvine Avenue are not compatible with the surroundings of the Back Bay. She suggested Eucalyptus be planted in this area. Jack Brooks advised the Palms are transplanted and that the Department tried to plant trees which would not block the view of the Bay. He added that Eucalyptus in parkways have caused view problems in the past. • Commissioner Vandervort suggested three Palms be planted in two clumps and Jack Brooks explained the island is too narrow and spacing would be difficult for the mower. Mr. Brooks further advised the Department has had no complaints from those in the area. Commissioner Demmer expressed that the medians in other areas of the City, specifically PCH from Jamboree to MacArthur, are beautifully designed and are receiving outstanding comments from citizens in the community. However, the medians on Irvine Avenue seem to appear inferior in comparison in that they are lacking in floral vegetation; and the quality of the palm trees, which are being discussed, appear inferior. Chair Grant asked that the Commissioners review the medians on Irvine Avenue; that alternatives and cost estimates be pursued; and that this matter be a discussion item at the Commission's next meeting on December 4, 1990. Item 46 - Recreation Division Recreation Division Nancy Beard reported the Arts and Crafts Fair will be held at Mariners Park on'November 10 and • 11 with about 90 vendors. She also reported the second annual Halloween Haunted House was very successful. E • CITY OF NEWPORT BEACH Parks, Beaches & Recreation Commission Page 3 City Council Chambers 7 p.m In response to a question from Commissioner Taft, Ms. Beard reported there will be a review of the new winter classes before the brochure is mailed. Item 47 - Tree Committee Commissioner Herberts reported the committee reviewed and agreed with staff on nine tree requests. Commissioner Herberts asked Mr. Brooks if the termites had been treated in Corona del Mar and Jack Brooks explained a consultant was hired and his report just received. The consultant felt the area can remain a few more years subject to changing irrigation, annual trimming, etc., which is in conflict with the City's maintenance program. As a result, Mr. Brooks felt the trees will probably have to be removed. Item #8 - Recreation Program Committee Commissioner Compton reported the committee met concerning scheduling at the Marian Bergeson Aquatic Center. At the present time there is a lot of use with 350 children swimming on different swim teams which does not include recreation and adult programs. Since there are many people requesting times, he anticipates problems with future scheduling. Item 49 - Parks and open Space Committee Commissioner Vandervort passed out notes from their last meeting on October 25, 1990 which she reviewed with the Commission. The committee felt a wind protection wall is needed at the top of the bleachers at the CYC fields. The committee also requested the "No Fishing" issue be brought back to the Commission for review. Discussion ensued on hours for fishing versus no fishing at Jetty View Park. Director Whitley explained that should the Commission determine there be no fishing between 10:00 P.M. or 11:00 P.M. to 6:00 A.M., no action is required. Commissioner Vandervort recommended this matter be on the Commission's agenda following a public hearing. Motion Commissioner Taft moved to accept no fishing between 10 P.M. and 6:00 A.M. Motion Commissioner Herberts made a substitute motion to pursue no fishing in the park. She also pointed out the preliminary plan has not been approved and must still go to City Council. Director Whitley explained the concept of enhancing the park has been approved which requires an encroachment permit from Public Works; it then goes to City Council. He suggested the Commission wait to see what the City Council does with the Encroachment Permit. Commissioner Compton recommended the matter be tabled until after City Council review. Commissioner Taft withdrew his motion. Commissioner Herberts withdrew her motion. Motion Commissioner Compton motioned to table the issue Ayes x x x x x x until the City Council votes. Unanimous. Commissioner Vandervort referred to Policy I -12, Obstruction of Views by Trees, which the committee reviewed and which will be reviewed by the Tree Committee. Policy I -22, Naming of City Parks, is being reworded and will be on the Commission's December agenda. Item #10 - Beach Committee Beach Committee Item #10 was addressed following Item #17. Commissioner Taft reported their meeting is covered under Item #15. Item 412 - Theatre Arts Center Liaison Theatre Arts Center Liaiso Commissioner Compton reported the last play was outstanding and the next one is Sherlock Holmes. III. ACTION ITEMS Item 413 - Tree Appeal - 1038 Sea Lane Tree Appeal Chair Grant opened the meeting to Public Testimony and Mr. Kenneth Carr, 1038 Sea Lane, addressed the Commission. He reported that both the plumber and gas company have cautioned him about future serious problems resulting from the roots of the large parkway Ficus. In addition, the roots are pushing into the sidewalk; the curb has broken resulting in cut tires on the ragged break; and the tree is above roof height in conflict with their CC &R's. Mr. Carr asked for permission to remove the tree and plant another one at his expense. Commissioner Herberts reported that the Tree Committee had followed the recommendations of stff and voted for retention of the tree. She also observed the curb to be pushed out about one -half inch and that the sidewalk looks fine. She asked Mr. Carr if the root problems he was referring to are present or future problems and he advised they are anticipated problems. There being no further Public Testimony, Public Hearing was closed. Commissioner Vandervort commented that she found the curb to be out an inch and she was impressed with the sidewalk. In addition, she felt the tree to be consistent with the neighboring trees. Commissioner Vandervort motioned to retain the tree at 1038 Sea Lane. Commissioner Konwiser pointed out he is concerned with retaining street scapes which he observed to be very good in this instance. Although the tree is a nuisance to the property owner, he stated he would support the motion since he felt the root problems won't occur for a long time. X x x x x x x Unanimous. Jack Brooks advised Mr. Carr he will call him concerning trimming his tree. Item 014 - Tree Appeal - 30 Morro Bay Tree Appeal Director Whitley reported he received a note from Ms. Butler that she would be unable to attend tonight's meeting. He also presented a sample bag of white fly eggs infesting the 2 Pear Trees which Ms. Butler supplied, along with an informational report on the white fly. Jack Brooks explained this is a new type of white fly which has had no natural enemies and is harder to control than the med fly. Spraying is not effective and the County has requested we not spray since they have begun biological control by using the parasite wasp. There is a short reproduction cycle and winter months make the white fly dormant. If the trees are kept healthy, they won't die. commissioner Konwiser motioned to retain the X, x x x x x trees and send the homeowner a copy of the white fly report. Unanimous. Item #15 - Volleyball Court Relocation Volleyball Court Commissioner Taft reported the Beach Committee Relocation met and recommended the beach volleyball court at 4105 Ocean Front be relocated to 41st Street end and that the court at 4307 Ocean Front be moved further out about 10 -15 feet. They have no objection to a court at 45th Street. CITY OF NEWPORT BEACH arks,, Beaches & Recreation Commission Page 7 City Council Chambers 7 p.m. INDEX Although the courts were posted, the residents within 200 feet of the proposed court relocations were not properly notified by mail. As a result, Commissioner Taft recommended the courts be reviewed after proper notification. Motion Commissioner Konwiser motioned to table the Ayes x x Y x x x x volleyball court relocations to the December 4, 1990 meeting. Unanimous. Commissioner Taft reported bids are being received on wooden, aluminum treated and metal volleyball poles. After a cost and longevity analysis, a standardized pole for replacement can be determined. Chair Grant suggested first using a sample or • trial test of the proposed poles. Commissioner Taft concurred. Item #16 - Bolsa Avenue Park Proposal, Bolsa Avenue Park Proposal Director Whitley reported the subject request has been modified from the one presented to the Commission two years ago when property on Bolsa Avenue was for sale. At that time it was too expensive and the project was not pursued. Director Whitley reviewed the proposed mini park which staff supports since this area is very park deficient. Public Works has also reversed their opinion from two years ago since closing Bolsa Avenue will have no impact on traffic. Although it is a small area, there would be enough space for playground equipment, a couple of benches, trees and shrubs. In addition, there are many children in the area along with great community support. There has also been a lot of development in the area, thereby generating sufficient money in in -lieu park fees along with no acquisition costs. should the Commission agree to the proposed mini park, it will need to be placed on the capital improvement list. The request will also be on the City Council's • November 13 agenda. In response to a question from Commissioner Konwiser on the cost of removing the present CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission City Council Chambers 7 p.m. INDEX improvements, Director Whitley advised Public Works has reported this is no problem. Chair Grant expressed his concern over setting a precedent and Director Whitley'advised the City would continue to have control since this is a road right of way. Commisioner Demmer commented that this area has been downgraded- and is now becoming a nice residential area. She noted that parkways and parkway trees are not being implemented into the renovation of this area. Young families are moving into permanent family residential dwellings. A play area with grass, trees, benches, etc., would be very appropriate for this area. She;also made note that if Newport Heights • is to acquire open space and park facilities for future growth, it would have to be "pocket a park" as there is no more available land. Commissioner Herberts agreed this is a good opportunity to beautify the area and that it would also be valuable to the nearby children. Motion x Commissioner Herberts moved to accept the mini park idea and recommended to the City Council that it be pursued; and that this motion is made on the premise that a tot lot be incorporated; the parcel is received in a ready to build condition from the Public Works Department; and that the site is accepted due to the unique circumstance that the proposed park is free land. Ayes x x x x x x x Unanimous. Commissioner Vandervort stated she felt pocket parks are a good idea provided they have a purpose, such as a tot lot, etc. Item --#-17--- Develop Agenda for Joint Meeting with Develop Agend• _city Council for Joint Meeting with Director Whitley reported he met with Chair Grant City Council and they agreed that the City Council should be . aware and receive the Commission's Goals and Objectives. Chair Grant recommended the Council also receive CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission Page 9 City Council Chambers . 7 p.m. INDEX facts and figures concerning registration, pool use, tree appeals, parks, diamonds, etc. Director Whitley will pursue. Commissioner Vandervort recommended adding to the report the number of softball and basketball teams that are turned down and the number of children in youth programs. Commissioner Compton recommended adding the growing number of users of the 'Marian Bergeson Aquatic Center. IV. PUBLIC COMMENTS V. DISCUSSION ITEMS • Item #18-- Status of Capital Improvement Protects Status of Capital Commissioner Taft reported Big Corona needs more Improvement vegetation at the far end. Director Whitley Projects advised this was an Art in Public Places project which involved the Public Works Department and a . report to the Arts Commission will be transmitted along with a copy to the Commissioners. Since this is not City property, planting was done in accordance with State specifications. Item 419 - Facility Inspections Facility Chair Grant reminded the Commissioners to walk In their respective parks and that their inspections are due by December 1, 1990. Commissioner Demmer asked that plans for Cliff Drive Park be reviewed by the Park and Open Space Committee. Homeowners are concerned over irrigation, steps, trails, proper hardscape and landscaping. 1 Chair Grant suggested Commissioner Demmer consult • with Director Whitley before the plan goes to the subcommittee. CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission Page 10 City Council Chambers 7 p.m. INDEX Item #20 - Bonita Creek Noise Report Bonita Creek Noise Report Director Whitley explained the subject report is for information only. It was transmitted to the City Council in October, however, due to a long agenda it was deferred to their November 13, 1990 meeting. Should anyone have an interest in the matter, he /she is encouraged to attend. Item #21 - Capital Improvement Proposals 1991 -92 Capital Improvement Director Whitley referred to the report submitted Proposals and pointed out that if any significant alternations are proposed for Cliff Drive Park, it should also be added. In addition, Harbor View School /CYC area should be added. Commissioner Taft recommended a mini park on Balboa Island be added. Chair Grant requested Mouth of Big Canyon be added. Director Whitley advised the Theatre Arts Center will also be added to the list. Chair Grant informed the Commission that cost estimates will be included for the Commission's review and prioritization at their next meeting on December 4, 1990. In response to a question by Commissioner Demmer, Chair Grant explained that plans for Newport Shores Park will first be reviewed at the subcommittee level to be followed by Commission review. Commissioner Demmer inquired as to the status of North Star Beach and Director Whitley explained the area is proposed to be a turf and picnic area subject to approval by the homeowners and Newport Aquatic Center. The plan will be available after the project is funded. • In response to a question by Commissioner Konwiser concerning the Cal Trans East Linear View Park, Director Whitley reported the Master Plan has not been approved by City Council. When CITY OF NEWPORT BEACH L J arks, Beaches & Recreation Commission Page 11 City Council Chambers 7 p.m. INDEX approved, Hoag Hospital will be asked to dedicate the land. Commissisoner Konwiser felt it is premature to include the linear park on the capital improvement list at this time since the City does not own the land. Commissioner Herberts disagreed, stating it is part of the General Plan. Director Whitley explained the City does not legally own the land and it may be a long time before it is dedicated. Commissioner Vandervort inquired as to the status of the Lincoln soccer field lights. Nancy Beard advised the capital improvement item is for lighting the third soccer field. In the meantime, the Lincoln lights have been adjusted and a report should be received next week. It appears everyone is satisfied and hopefully the problems are resolved. VI. SPECIAL. I Dottie oF' ohr, Secretary k PARK AND TREE DIVISION Item No. 5 NOVEMBER, 1990 PROGRESS REPORT • Our park crews performed the following tasks in addition to normal maintenance during the month of November. Begonia Park Regraded and seeded new lawn along the new sidewalk which runs the length of 1st Avenue and Carnation Avenue. Buffalo Hills Park Removed turf and graded an area for the construction of a picnic table shelter. Shelter put in by contract. West Newport Park - 59th Street Prepared the area where the basketball court was'removed, for hydroseeding turf there. Imported soil, graded,'installed irrigation, and put i.n a con - crete.edger strip along the new Pacific Coast Highway wall. Oasis Garden Plot, Project .. The area was graded and si.dewalks'poured by contract. A concrete V -ditch for drainage was installed by contract. Our crews installed sleeves under sidewalks, as needed., for installing drainage and water systems which we have now started on. • For Public Works Department Ran two mainline pressure tests on the West Coast Highway project. Corona del' Mar Bluffs Rebuilt two irrigation systems between Fernleaf and Goldenrod where Public Works had sidewalks installed. Spyglass Hill Park, Las Arenas Park Sanded where needed, stained and linseed oiled all wood playground equipment. For the Recreation.Department, Park Crews Performed the Followinq: 1. Installed new beach sand in the playground areas at the following loca- tions: Grant Howald Park, Bonita Creek Park. 2. Delivered 12 (15 gal.) trees and 10 delineators to Oasis Center for Holiday craft event. 3. Installed metal signs above the entry gate at the following locations: Las Arenas Tennis Courts (Court #2 & 3), Irvine Terrace Tennis Courts (Court on left hand side), • 4. Delivered 24 delineators and a roll of yellow caution tape to the Community Youth Center. Iy r • 0 - 2 - 5. Replaced net on Court #2 at Mariners Park Tennis Courts. For the Arts Commission, Park Crews Performed the Following: Set -up 10 banquet tables, 5 large trash cans with liners and 6 chairs at the Newport Community Center Gallery. Our Street Tree Division Performed the Following: Trimmed 1016 trees. Planted 1 tree. Removed 2 trees. Root Pruned 73 trees. Completed 13 work requests. Areas being trimmed thi.s month.: Bayside Park, Palms - Pininsula, Via Lido, Central Newport. Raised trees on the Peninsula as needed. Trees were, removed at the following locations: Miramar at L 2027 Deborah Dead" City Council Trees were planted at the following location: 2027 Deborah r tea .1M 0 /S_'� 1 -Ficus i -Ash 1- ,Tri.stania Item No. 6 RECREATION DIVISION • NOVEMBER, 1990 PROGRESS REPORT Youth Activities The drop in program at the Community Youth Center is going great guns. We are averaging 100 kids each day. Mariners Park is also doing well with 25 to 30 kids per day. The flag football program wrapped up its season this month. Eleven teams comprised of 120 kids participated in the program this season. Each game was attended by parents due to the early evening hours. Each of the three division champs will compete in the Orange County Athletic Association Championships held in Costa Mesa. December 8 is Breakfast with Santa and Winter Wonderland Day. Adult Sports November is the end of the fall season for all 182 basketball and softball teams. Our limited winter league begins in December and January. Senior Citizens, • The Care -A -Van program is progressing in its success as an established service in the community. Last month there were 286 rides which is an averge of 12.43 rides a day. Keeping in mind that the service is provided to the most frail and whieelchair patients, this is definitely a good average. oasis has also been assisting chemotherapy patients, dialysis, and physical therapy patients to Hoag as well as taking people to doctor appointments. The program has been given rave reviews by its participants and definitely is fulfilling an unmet need in Newport Beach. The Senior Nutrition Program fed 200 seniors on Wednesday, November 21, for Thanksgiving dinner. Turkey and all the trimmings were included for the low donation of $1.75. Miles Running played the organ for our entertainment. The annual Flu Shot Clinic was held at the Oasis Center on November 17 and, as usual, it ran very smoothly. 696 people were served in an extremely timely fashion due to the cooperation and organization of the staff and volunteers. Next month will be the Oasis annual Christmas Party on December 9; Opera Pacific performance on December 12 at 1:00 P.M.; and Sunshine Magic performance on December 19 at 1:00 P.M. • The senior program at West Newport is winding up a search for a new part -time coordinator. Meantime, the Coastline exercise class and lb and a new ARRP driving class are both doing well. • Hopefully, with the hiring of a new coordinator, a wealth of new ideas and enthusiasm will boost our west side program. Contract Classes Fall contract classes are winding up this month. The fall quarter is traditionally a good quarter for us and this quarter was no exception. Gymnastics saw an increase in enrollment. 450 children participated in the classes held both at the Lincoln gym and the West Newport Community Center. Tennis classes also jumped in enrollment this fall. 457 children and adults took part in our lesson program. Rent -A -Santa visits begin December 1 and will continue until the 23rd. We average 50 to 60 rentals each season. The Arts n' Crafts Fair held at Mariners Park this month was very successful. 98 vendors brought 1.,000 plus shoppers to the park. Aquatics The City Swim Coach selection process began this month. A Swim Team Coach will be chosen by December 7. City staff worked very closely with the community and F.O.P. to create the criteria for • the formation of the team which will use the Marian Bergeson Aquatic Center as a home base. Nano Be d 0 r� Orange Coast Daily Pilot Item No. 9 ���,u 111 1190 • Opinion LJ 0 0 Idil 111 A -cheer fop, sport noise, it could be much worse Two different sets of residents recently complained to the Newport Beach City Council about the level' of noise generated by youth sports — Junior All - America football in one case, water polo in another — played at nearby schools and parks. In, both cases, homeowners complained the noise from referee whistles and crowd cheers was unbearable and asked the city to relocate the activities, limit their hours or make structural changes to lessen the noise. And in both cases, the council wisely refrained from taking any action to halt the activities. The organized games that keep Orange Coast youths off the street and out of trouble should never be jeopardized. The whistles and cheers are the sounds of a healthy family community. The homeowners at Newport North knew Bonita Creek Park, where the football games, are played, was an active park when they bought their homes. Many folks would pay extra to get to live near such a jewel — crowd cheers or not. For Dan Rabun, a Newport North homeowner who threatened to file suit against the city for allowing what he called a public nuisance to continue at Bonita Creek, we suggest he spend his time and money not on lawyers, who will attempt to keep our children from playing organized sports, but on a real estate agent who can help him find a new place to live. At the Marian Bergeson Aquatic Center at Corona del Mar High School, the situation is a bit different. The residents were there first and the configuration of the million- dollar facility creates an "amphitheater" effect that amplifies the noise from the water polo practices and games. But, again the answer isn't to,, limit. thp activities at the ' center. The city, and school district are taking the appropriate steps to help minimize the noise. Meanwhile, they should remember that some Orange County residents -are bothered• by, other kinds of youth - generatedmoise, including•gunshots.at and by gangmembers. Perhaps local- homeowners should be more'thankful,that whistles and cheers are the only noise their youths now, generate,,. -, , Item No. 13 • CITY OF NEWPORT BEACH Parks, Beaches and Recreation Department DATE: November 27, 1990 TO: Parks, Beaches and Recreation Commission FROM: Parks, Beaches and Recreation Director SUBJECT: CITY PROPERTY ADJACENT TO 850 SANDCASTLE DRIVE The attached represents a request to purchase City owned property (Oasis top of slope) by the property owner of 850 Sandcastle Drive. The Department has reviewed the request and, based on the analysis done by the Public Works Department, finds no objection to proceeding with the transaction. Friends of Oasis has been provided all material related to this request and to date has not provided comment on the proposal. If there are questions, please feel free to call. • Ronald A. Mr. Mark R. Poochigian,, owner of 850 Sandcastle Drive, has asked the City to sell him the level portion of the top of slope behind his property. The parcel is 3 to 4 feet wide and approximately 71 feet long with an approximate square footage of 240. This parcel is part of the slope area granted to. the City for park purposes by the Bren Company at the time Tract No. 11949 (The Terraces) was developed. The City owns the property in fee. Mr. Poochigian is interested in expanding his yard area out onto the flat area. This area has no park use other than for landscaping. It is currently landscaped with low shrubs. The Bren Company has indicated that they have no objection to the transfer of this parcel to the adjoining resident in this particular case. Since the City owns the property in fee it could be sold if it is determined that the public has no use for this parcel. The Parks, Beaches and Recreation Commission should review this item and make a recommendation to 0 h City Council on the potential use of this parcel for park purposes. If the City Council determines that the parcel should be sold, the Public Works Department will recommend the following conditions: 1. That the property be sold for 50% of the current assessed land value of parcels on the southerly side of Sandcastle Drive. 2. That the new property corners be placed by a licensed Land Surveyor or Civil Engineer. 3. That nothing requiring a Building Permit be constructed on the parcel, except for a wall with the upper 3 -feet transparent if approved by the Community Association and next door neighbor. 4. That the parcel be kept separate from Lot 86 (Tract No. 6228). The parcel cannot be used as part of the required rear yard setback for Lot 86. 5. Drainage from the parcel shall be directed onto Lot 86 unless otherwise approved by the Public Works Department. Attached is a sketch that shows the parcel that is being considered. On June 14, 1990, I hired Duca - McCoy, Inc—to provide a lot survey for the purpose of building a new wall at my residence (please see enclosure). Mr. Duca observed that near the location marked by an "x' there appeared to'be an area where considerable water pooling had occurred and the water drainage from the city's property had caused damage to my existing wall and concrete patio. He also advised me that, unless this drainage problem was rectified, my new wall and patio would eventually sustain the same damage. • Mr. Duca recommended to me that I approach the city with a possible solution. I would be willing to pay for the necessary corrections to properly n drain the city's land if I could obtain a encroachment permit for the 5'f in which I would extend my back yard. If this solution is not acceptable to the city, I would also be willing, to purchase those same 5't from the city. In case this method is not desirable, I would also be willing to purchase the 5't plus the slope to the base of the Oasis unimproved land. I would provide an easement to the city so the slope could be uniformly maintained. I believe this 5't is virtually unusable open space. The Marine Department be included in the Review /Approval process of volleyball courts on oceanfront beaches. • 2. Establish a Review /Approval process to be conducted and completed prior to Easter week each year. 3. In West Newport, limit the number of courts in the 44th to 40th Street area to a maximum of 2 courts to be located at street ends. 4. In Corona del Mar, a) provide nets locked to the courts, b) add one court to the south end of the beach and set it up to conform to womens' regulations, and c) clearly sign all courts for "Challenge Regulations ". Background: On October 31, 1990, the Marine Safety Staff completed a review of our `Summer Season' operations'. one area of concern was volleyball courts usage and location on the beaches we patrol. The most pronounced problems existed in a 12 block area of West Newport from 36th to 48th Street, and Corona del Mar. In a July 12, 1990, memo to Bob Granger of PB &R, Marine Safety Officer, Eric Bauer, defined the problem. in West Newport and subsequently met and drove through 'West Newport with Bob. On at least 2 additional occasions `post drive thru', Eric talked to Bob _. regarding more of the specifics of the volleyball problems in West Newport. During the summer, the volleyball :problems were not rectified in • West Newport. 3300 Newport Boulevard, Newport Beach Page 2 Please see the letter submitted to council by resident Gunter C. Mayer for the November 13, 1990, City Council Meeting for further information. In Corona del Mar, the volleyball problems increased with the extremely large beach crowds, a large number of courts, rental courts, a challenge process, and a reservation process. This made for numerous confrontations,, with our beach patrol jeep playing the role of referee. Conclusion• Adoption of the proposed recommendations would be in the best interest of Public Safety. In West Newport, the crowded haphazard configuration of the volleyball court placement restricts traffic flow of emergency lifeguard beach patrol jeeps as well as police ATV's and jeeps. Street end locations for all courts would help solve most of the problems encountered during peek crowd periods which are experienced during mid -day and on weekends /holidays through the summer and spring /fall season. In Corona del Mar, a site for numerous volleyball tournaments throughout the year, permanent placement of volleyball nets locked to the poles from the weekend before Easter Week until mid •September would relieve most of the challenge and reservation problems experienced during the past season. The lifeguards, parking'attendants, and police are the most likely city officials required to mitigate problems that may occur on the oceanfront beaches during summer weekends and holidays. It is not feasible to expect PB &R to be on scene or respond to such problems. As sugoested, they should be relocated in front of street accesses away from homes. We alono with most permanent resident=_ cherish the pristine nature of quiet ocean front living. • As a matter of fact, the city county and state are spending millions for improvements of infrastructure to enhance the quality of life in West Newport. The trend in housing is now towards expensive single family residences away from duplexes use for Summer/Winter rentals„ I harp lived with the old conflict between Resident's and Non— Residents for 30 years. The Residents which are always directly affected by activities in front of their homes, obviously want to protect their quality of life from deterioration. It must be understood that every home owner considered and accepted the prevailing conditions and amenities the public beach provides at the time of property purchase and has learned to live with these but also will protect them. Nan — residents on the other hand do not have to put "p with the nuisance created by crowds, but never- the less always seem to generate more pressure on the residents to accept less. These same people would never stand for such nuisances in front of their own homes. It is my opinion that the City Council must formulate a permanent policy to accommodate the general public in a manner which does not result in a deterioration of the quality of life of Reach Front Residents and the choices of amenities available for so long. The specific width of the beach should also be considered. 0 • Paqe This deliberation should not only include volley ball courts, but also prohibit; the placement of permanent improvements on narrow stretches of shifting sands, such as additional bicvcle paths and consider General Services access and ease of policing. Surfino and quiet beach enjoyment by the general public in front of residences has not been a problem for us and should be enconraged an future planning. Vollev ball courts and tournaments directly in front of homes, on the other hand, have manv negative attributes for the residents, such as: J. It concentrates. crowds 40 -50 feet from onr patios. 2. It concentrates trash. Peach cleanup equipment has to drive around the nets., leaving trash uncollected. 3. It concentrates noise in front of homes. A. It creates an unbelievable amount of dust, which the off shore winds blow towards and into the homes. One really must be into dust to enjoy a PRO! dinner on the patio when games are in progress. 5. Thev block off beach areas for specific rather than general use and disruut the wonderful natural view. 6. The court=_ are too close to the front property lines and should be placed At least 75 feet out,. 7. Police and Lifequards have problems with the counts. S. The width of the beach should be considered when placing courts. Attached is the old policy for your review and a revised policy that the Street Tree Committee has worked on for a number of meetings. Alternatives for the Commission: 1. No action, thus reaffirming the deletion of I -12. • 2. Recommend to the City Council reinstating of I -12. 3. Recommend to the City Council a revised policy on this subject. Whitley I�J t M 1 -12 OBSTRUCTION OF VIEWS BY TREES The City Council has expectations that individuals, public agencies and homeowner associations will comply with procedures to diminish view obstructions caused by trees and vegetation on their property. The purpose of this policy is to identify the importance of views lost due to tree growth by another private or public property owner. The objectives o� this policy are to: 1. Preserve and promote the aesthetic benefits provided by trees and the preservation of views of the surrounding locale. 2. Preserve, maintain and enhance property values within the City. 3. Encourage the proper maintenance of trees, shrubs, hedges or other vegetation that unduly diminish desirable views. �. Encourage homeowner associations and individuals to vigorously enforce their CC &R's as they pertain to trimming shrubbery in order to maintain views and property values. S. By example, City will endeavor to maintain all City -owned park property in a manner to maximize public and private view planes. Some exceptions can be trees of special value and beauty that in themselves enhance either the overall beauty of the area or are included in Preservation of Special Trees (I -9). Definitions to clarify this policy are: 1. Unreasonable Obstruction of View A tree, shrub, hedge or other vegetation should not be maintained on public or private property in the City in such a manner as to unreasonably obstruct the view from other property. 2. Views "View" means a range of sight including pleasing vistas or prospects or scenes. Views include, but are not limited to, the sight of geologic features, bays, oceans, skylines and bridges. The purpose of this policy is to commend those Homeowner Associations that cooperate with one another in identifying the environmental and aesthetic value of trees combined with views. The objectives of this policy are to: 1. Preserve and promote the aesthetic benefits provided by trees and the preservation of views enhanced by trees. 2. Encourage the proper maintenance of trees, shrubs, hedges and other vegetation. 3. The City will endeavor to continue its tree maintenance program, as identified in Council Policy I -19, with the timely philosophy in mind that trees in themselves greatly benefit • the environment, beautify our surroundings and serve to frame views, thereby enhancing the total view. 40 1� . I -19 MAINTENANCE AND•PLANTIhG OF PARKWAY TREES The City Council is vitally interested in beautification of City parkways. Public cooperation in helping to develop and maintain healthy and attractive trees is encouraged. MAINTENANCE OF PARKWAY TREES The Parks, Beaches and Recreation Department will trim the parkway trees on a rotation schedule. An effort will be made to trim most of -the parkway 'trees on a two year cycle. If the rotation trimming is completed in less than two years, more frequent trimming will be done on certain trees and in view areas. Public safety such as low branches and heavy foliage will be given priority over view trimming. An effort will be made to trim parkway trees on the Peninsula and parts of Corona del Mar during the fall and winter due to heavy traffic during the summer. Trimming schedule will be altered to avoid trimming streets with flowering street trees during their blooming time. This will apply to streets having a large number of flowering trees, not to one or two trees on a street. Tree Donations The tree lined walkway at oasis Passive Park beginning at 5th Avenue and Marguerite in Corona del Mar shall be identified as the only area where a tree with 'a bronze plaque can be installed. Trees without plaques can be donated and installed at locations approved by the Parks, Beaches and Recreation Department. Park Amenities Items such as benches, drinking fountains, tables, 'etc. can be donated to be included in the public park system. Recognition on the donated item shall be a 2" x 6" plaque and limited to Donated • by or Donated for as a means of identifying the donation. All donations must be approved by the Parks, Beaches and Recreation Commission. The cost of a donated item, including identification plaque, shall be borne totally by private funds. The City will assume ownership and maintenance if accepted and placed in a public park. INFORMATIONAL AND COMMITTEE REPORTS Item #5 - Park and Street Tree Division Commissioner Demmer noted the 1,016 trees that were trimmed in one month was a great accomplishment and Jack Brooks explained-, these were mostly Palms. In response to a question by Commissioner Compton concerning a height limit for Palms, Jack Brooks advised that basically there is no limit, however, this sometimes depends upon the variety. Jack Brooks reported the final Cal Trans corrections have been made at Dover and PCH and a permit should be issued in a few weeks. Concerning the Palms on Irvine Avenue, Jack Brooks stated the Department prefers to keep this type of tree since they can be planted consistently without blocking views. He agreed, however, they are leaning over too far. Commissioner Herberts recommended Citriodoras be considered in this area and Mr. Brooks agreed they could be planted, however, only where there are no view problems. Commissioner Compton suggested a hedge or flowers be planted at the base of the Palms to make them more pleasing. Commissioner Demmer agreed there needs to be landscaping at the bases. Commissioner Taft felt the Palms should be removed sincet they do not fit in the area. Jack Brooks and the Commission agreed and determined that staff will remove the Palms and replace them with Eucalyptus where there are no view problems. Chair Grant asked that the Commissioners final facility inspections be turned in. Commissioner Herberts commended the Park and Tree Division on the excellent job they are doing and asked if more staff will be needed. Jack Brooks advised he will be analyzing the Department's needs. Item #6 - Recreation Division Recreation Division Nancy Beard reported there are two big events slated for Saturday, December 8, one being Breakfast with Santa at Oasis and the other being Snow Day at CYC. Commissioner Taft questioned why the Commissioners had not received a copy of the new winter classes. Nancy Beard explained that they were reviewed by the Recreation Program Committee, however, due to time constraints they were not available before publication. Chair Grant suggested that if any of the Commissioners want to review new classes they should contact Ms. Beard. Item #7 - Tree Committee i Tree Committee Commissioner Herberts reported the committee did not meet. Item #8 - Recreation Program Committee Recreation Program Commissioner Compton reported the committee did Committee not meet. Item 49 - Parks and Open Space Committee Parks and Open Space Item #9 was addressed following Item #18. Committee Commissioner Vandervort reported the committee CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission Page 4 City Council Chambers 7 p.m. INDEX met two times and formulated a policy on plaques. They also reviewed five parks. Commissioner Demmer gave a brief summary of The Irvine Company's presentation to the City Council on their proposed build out plan in which they are asking for no changes in the General Plan. She pointed out that 112 acres are designated to the City and the General Plan mandates 84 acres. Ten acres of view park are designated for the Castaways and 4 acres for Newport North. Commissioner Herberts explained that The Irvine Company wants a commitment for total build out now and they are willing to use appraisals based on different land uses. They have also met cooperatively with SPON. The Irvine Company will give $20.6 million for traffic and road improvements provided the City gives them a firm commitment on what they can do. Chair Grant reported he met with their Ad Hoc Committee and he perceives the Parks, Beaches and Recreation Commission playing a major role in the City's future park needs. Director Whitley passed out a report from the Planning Department concerning what The Irvine Company is proposing. He urged the Commissioners to look over the sites and consider topography and sensitive environmental issues. Chair Grant advised directives will come from the City Council and the Commission will be working= within the limitations of the General Plan. He suggested the Commissioners absorb the report; focus on the General Plan and alternatives; and visit the sites so that when directives are received they will be able to discuss them. Commissioner Demmer suggested the Commission be taken on a field trip to these areas. Commissioner Herberts agreed, suggesting SPON also be invited. Director Whitley will contact . The Irvine Company to arrange a field trip. Commissioner Herberts asked that the no fishing issue at West Jetty Park be addressed. Director CITY OF NEWPORT BEACH arks, Beaches ,& Recreation Commission Page 5 City Council Chambers 7 p.m. INDEX Whitley advised the City Council determined the applicant must submit an encroachment permit which has not been done. After the permit is issued, the matter will come back to the City Council. Commissioner Herberts urged that in the interim the Parks Division clean up the area since it has become a health hazard. _Item 410 - Beach Committee Beach Committee Item #10 was addressed following Item #14. Commissioner Taft reported he met with John Blauer of the Marine Safety Division. Both the Marine Department and General Services Department are to be contacted in the review process for proposed volleyball courts. • Mr. Blauer addressed the Commission and asked that any proposed removals or installations be reviewed annually by the Marine Department prior to Easter Week. Commissioner Taft explained that under the present system, volleyball players can apply for • court at any time and the Commission must make • decision in a timely manner. However, he recommended all unauthorized courts be removed prior to Easter Week. Chair Grant directed this be put on the calendar. Mr. Blauer also proposed that nets locked to courts be provided from Easter to mid - September at Corona del Mar State Beach to alleviate the challenge problems experienced in the past. Commissioner Taft suggested, and Mr. Blauer concurred, that a trial basis of 4 courts-.• with nets be implemented at the farthest area from the fire rings. Mr. Blauer also informed the Commission that a request, which the Marine Department approves, will be forthcoming for a women's court to be • located at the south end of Corona del Mar Beach. Commissioner Compton reported the Beach Committee has reviewed standardizin:g,; volleyball poles and CITY OF NEWPORT BEACH • • arks, Beaches & Recreation Commission City Council Chambers 7 p.m. INDEX Oasis Liaison Theatre Arts Center Liaison City Property Adjacent to 850 Sande castle Drive recommends steel poles be installed for the 4 courts which will be relocated in West Newport. Should there be complaints, they can be re- evaluated; if not, the Department can move forth to install more. The poles, if properly installed and painted, should last eight years at a cost of $208 per court. They should be installed at a uniform 50' distance out from the residences and he hopes this can be completed within 60 days. Item #11 - Oasis Liaison Commissioner Demmer reported Mayor Sansone attended their last Board meeting and he indicated there will be a decrease in revenue from State and County funds this year. As a result, Oasis will be expanding their fund raising efforts to support programs now supported by grants and gifts. Item 012 - Theatre Arts Center Liaison Commissioner Compton reported everything is going smoothly. III. ACTION ITEMS Item #13 - City Property Adjacent to 850 Sandcastle Drive Item #13 was addressed following Item #8. Chair Grant opened the meeting to Public Hearing and Mr. Mark Poochigian, 850 Sandcastle Drive, addressed the Commission. Mr. Poochigian reported he has been working with the City to acquire property adjacent to his residence where there is a plateau of approximately 240 square feet of land. The City owns the land, however, the Bren Company had deed restrictions on the land that it must be used for park purposes which it has since offered to waive. In addition, the Public Works Department finds no objection to acquisition based on their five conditions presented in the report submitted. Oasis Liaison Theatre Arts Center Liaison City Property Adjacent to 850 Sande castle Drive CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission Page 7 City Council Chambers 7 p.m. INDEX Mr. Poochigian explained the subject land is useless space on which he wants to extend his patio and rectify his drainage problems. He proposes to build an aesthetic masonry and plate glass wall at this location. Director Whitley pointed out that the Friends of Oasis have reviewed Mr. Poochigian's request and have no objection. The only condition the Department recommends is that proceeds from the sale be used at the Oasis facility. Commissioner Demmer questioned the condition from Public Works that the property be sold for 50% of its current assessed value. Director Whitley explained that this decision was due to the conditions being placed on the property, i.e., it • cannot be built upon; the rear yard setrback cannot be changed, etc. Commis "stoner Herberts stated she is opposed to recommending it be sold since it could set a dangerous precedent to sell open space to a private party. Commissioner Konwiser agreed this is a valid concern, however, this is a unique situation in that nothing can be built on the land and it will be walled off. Motion x Commissioner Konwiser motioned to approve the request to sell the property as presented with the additional condition that the proceeds from the sale be used at the Oasis Center. Commissioner Vandervort amended the motion to state that the wall be no higher than 6 feet. During discussion, Commissioner Konwiser pointed out the City has a 6 foot limitation and Commissioner Compton felt this is under the Public Works jurisdiction. Mr. Poochigian also stated he did not intend to build a wall over 6 • feet. Commissioner Vandervort withdrew her motion. Ayes x x x x x x Motion passes. Nay x CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission •..- City Council Chambers, 7 p.m. INDEX Item 014 - Volleyball Court Locations Volleyball Court Commissioner Taft, Chair of the Beach Committee, Locations briefly reviewed the volleyball court process for approved courts and that the committee agrees with the Marine Department's recommendation that courts be relocated in West Newport from in front of homes to street ends due to limited access and problems encountered during peak crowd periods. There are courts -at the street ends of 40th, 42nd and 43rd, but not at 41st Street. As a result, the action before the Commission is to approve the relocation of the court at 4105 Ocean Front to 41st Street end. Chair Grant opened the meeting to Public Hearing and Mr. Roger Rouse, 4109 -A Seashore, addressed the Commission. Mr. Rouse was confused as to which courts being were removed and /or relocated. Commissioner Taft explained the only one being considered is the court at 4105 Ocean Front, the objective being that there be 4 courts at street . ends in this area and no courts in front of residences. Mr. Rouse felt that if 41st Street was accessible, he had no objections to a court at this location. Commissioner Vandervort questioned the posting of a court at 4307 and Commissioner Taft explained this was in error, however, 4105 was correctly posted. Mr. David Dick, 4109 Seashore, addressed the Commission and questioned why the courts have to be relocated to street ends that have been there for nine months. Commissioner Taft explained there have been complaints from residents and that courts at street ends pose the fewest complaints and cause ` II the fewest problems. Chair Grant advised that should any interested person want to add a court, there is a procedure to follow subject to the Marine Department's CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission Page 9 City Council Chambers 7 p.m. INDEX approval. Mr. John Blauer from the Marine Safety Division addressed the Commission and pointed out that the narrowest portion of beach subject to heavy usage is located between 36th and 48th Streets. As a result, they recommend two volleyball courts per four block area at street ends, however, keeping the four courts between 40 -44th Streets is reasonable now if they are relocated to street ends and are monitored. Motion x Commissioner Compton motioned to relocate the Ayes x x x x x x x volleyball court at 4105 Ocean Front to 41st Street end as recommended by the Beach Committee. Unanimous. • Item #15 - Council Policy I -12 Obstruction Of council Policy I -12, Views by Trees Obstruction Director Whitley reported that Policy I -12 has of Views by helped out in some instances and not in others. Trees Commissioner Konwiser stated he felt the City needs a policy to encourage people to trim to maintain views which enhances the value of their homes and their neighbors' homes. He felt trees are not equivalent to a view of the bay or ocean and that it is a rare case where trees block ocean views. Since these matters arise frequently, he felt a policy should exist and urged the original I -12 policy be reinstated. i Chair Grant agreed such a policy is beneficial to the City and recommended Item #3 of the proposed policy on Views and CC &R's be added to I -12. Commissioner Herberts reported that the Harbor View Hills Community Association was instrumental in the original request in preparing Policy I -12. She then read a letter from Harbor View Hills wherein they state that City Policy I -12 has not helped them with their private homeowner view . problems. Commissioner Herberts passed out a letter from Mrs. Spencer who objects to trees being cut for CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission Page 10 City Council Chambers , 7 p.m. INDEX views. She presented a picture from her balcony of their only view of the ocean and felt if the policy were implemented the City could lose a lot of trees. Commissioner Herberts further stated she thought Policy I -12 was to be for a trial period to see if it worked. Since it did not, she urged it remain deleted. Motion Commissioner Herberts moved to accept the City Council's deletion of Policy I -12 for one year, after which time it should be brought back for further review. Director Whitley advised staff annually reviews policies and all changes are initiated by this Commission. Commissioner Compton questioned if there is an Ordinance on tree trimming for views. Director Whitley advised there is not but there is one for tree maintenance. Commissioner Compton stated that when he voted he was under the impression there was an Ordinance addressing views which superseded Policy I -12. He felt the City needs a guideline on trimming for view purposes. Commissioner Compton suggested a subcommittee be formed to resolve the matter and that this be an action item at the January 8, 1991 meeting. Substi- Commissioner Compton made a substitute motion to tute send Policy I -12 back to the committee level and Motion that the policy be agendized as an action item at their January meeting. It was then determined that the committee to review Policy I -12 consist of Commissioners Herberts, Konwiser and Compton. Commissioner Demmer stated she supports the proposed policy since;:: it clearly defines where plaques and trees can be located in addition to making the community aware that other amenities can be purchased. She did, however, suggest there be an assessment of the needs for benches, fountains, etc. Commissioner Vandervort suggested adding "Specific plaque locations on items to be determined by the Parks, Beaches and Recreation Commission." Commissioner Konwiser agreed with Commissioner Demmer that a needs assessment is important and recommended adding "The Parks, Beaches and Recreation Commission shall decide how the plaque shall be displayed." Commissioner Taft concurred. Chair Grant recommended "(name)" be inserted following Donated by and Donated for. x Commissioner Konwiser motioned to approve the Park Improvement Donations policy as presented and that under Park Amenities the sentence read ....Donated by "(name)" or Donated for "(name) "_..... and that the second and third sentences of the last paragraph read "All donations must be approved by the Parks, Beaches and Recreation Commission, including method of displaying the plaque. The Commission shall also consider the need the City may have for the X x x x x proposed improvement." Motion passes. IV. PUBLIC COMMENTS V. DISCUSSION ITEMS Item #17 - Status of Capital Improvement Protects Status of Capital Director Whitley reported the conceptual plans Improvement \ for Newport Shores Park have been reviewed by the Projects Commission. Since the City does not own all the property, the parcel as proposed is still being CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission Page 12 City Council Chambers 7 p.m. INDEX reviewed by several agencies which has slowed the process. Staff recommends developing that portion which the City owns and which has no constraints and requests the Commission's approval to proceed in phases. After Director Whitley presented and explained the two different concepts for the rest of the park, the Commission determined staff should proceed with the plan for the City owned portion and work with the existing authorities to submit Plan A. Chair Grant asked that the play equipment be reviewed at West Newport and Channel Place Parks since it has deteriorated. Item 018 - Capital Improvement Proposals 1991 -92 Capital Improvement Director Whitley reported staff recommends adding Proposals Athletic Field Refurbishment as Item #13 in order 1991 -92 to pay back user groups when they refurbish fields, purchase back stops and scoreboards, etc. Director Whitley advised it is anticipated there will be a significant decrease in revenue due to the recession and that the,Commission should take this into consideration and only adopt those projects that are absolutely necessary. Costs will be finalized and a report on uses of the Park Facility Improvement Fund will be presented at the January 8 meeting. Commissioner Taft inquired as to the status of i Peoples Park and Director Whitley explained the City Council only wants it cleaned up at this time. It will probably go back on the ballot in the future. Commissioner Demmer stated she felt active recreation areas should have priority over pocket parks. • Commissioner Herberts questioned if there are enough active fields and Commissioner Compton explained that thus far the youth groups are accommodated, however, adult teams have been turned down. Little League is growing fast and CITY OF NEWPORT BEACH arks, Beaches & Recreation Commission Page 13 City Council Chambers 7 p.m. INDEX this should also be taken into consideration. Commissioner Herberts requested a report on projected needs of fields and athletic facilities. Both Commissioners Grant and Compton agreed such a report is necessary. Chair Grant passed out the recent report completed on the Lincoln lights. The difference after adjustments is significantly better, however, eventually the homeowners would like the lights replaced. Commissioner Herberts recommended adding groundcover to landscaping on Newport Boulevard from PCH to 16th Street. Director Whitley advised this is owned by Cal Trans, however, the Department has started planting on the slopes and • the project will take time. Commissioner Vandervort felt the area near the Arches needs landscaping and Director Whitley advised the bridge will be replaced in January before any landscaping can take place. Following discussion and clarification on the proposed projects, the Commission determined that Oasis Expansion, Park Facility Improvement Fund, Playground Equipment Replacement Fund and Theatre Arts Center be included with amounts to be determined later. They postponed for further consideration the Mini Park on Balboa Island, Cal Trans East Linear View Park and Newport Shores i Park. The remainder of the projects, namely, Harbor View School Field Refurbishment, North Star Beach, Bolsa Avenue Mini Park, Lincoln Soccer Field Lights, Cliff Drive Park, Athletic Field Refurbishment and Mouth of Big Canyon, will be reviewed again at their January meeting. Staff will refine costs on these projects. VI. SPECIAL.
