The Commission members have received detailed staff reports on each of the items recommending approval. There will be no separate discussion of these items prior to the time the Commission votes on the motion unless members of the Commission, staff or the public request specific litems to be discussed and /or removed from the Consent Calendar for separate action. The residents also pointed out that they felt that dogs are not the problem— non - residents are the problem who not only cause extra litter on the beaches but also do not pick up after their dogs. Tim Newman from the City's Police Department reported that all dogs are required to be on a 6' , leash. Although not mandated at this time, it might be effective to require people to carry an implement to pick up dog nuisance. The main problem is that it is difficult to enforce the Ordinance. There are currently four animal control staff in the field between 6:00 A.M. and 9:00 P.M. and problems double during the warmer weather. There are those on the staff who would recommend banning dogs on the beaches year round due to the difficulty of enforcement. Tony Melum, Deputy Chief of the Fire and Marine Department, stated that their concern is the need for additional enforcement which takes away from water safety and the condition of the beach during the summer. Their hours on the beach during the summer are generally from 10:00 A.M. to 5:00 P.M. Motion x Commissioner Compton moved to amend Ordinance 7.04.030 of the Municipal Code that no dogs be allowed on the beach year round between 9:00 A.M. and 5:00 P.M. and that a person be required to carry an )es x x x x x x implement to clean up after their dog. Unanimous. h� Chair Vandervort advised those present that the Commission's recommendation is not a law until it is approved by the City Council. CITY OF NEWPORT BERCH i Parks, Be aches .& Recreation Commission � G ' l O O July 5, 1995 f Page 4 City Council Chambers Item #2 - Request from Wedge Preservation Society Tony Melum, Deputy Chief of the Fire and Marine Department, gave a background of the current Ordinance which is a result of a compromise in 1993 among the interested groups. There have been an equal number of complaints from the users and no rise in injuries at the Wedge. Since there have also been no enforcement problems, staff recommends no change in the Ordinance. In response to a question from Commissioner Compton, Mr. Melum explained that the Ordinance provides for use of flotation devices six months of the year and.for body surfers six months of the year 7 hours a day when the water is warmer with the best swells. Chair Vandervort opened the meeting to public testimony. Terry Wade, P.O. Box 862,.Balboa, addressed the Commission. Mr. Wade, co- founder of the Wedge Preservation Society, explained the history of the Society and their reasons for proposing prohibition of all flotation devices from the Wedge. The main problem over the past ten years has been overcrowding by flotation devices, enforcement by two small signs, and the fact that body surfers cannot compete with them under any circumstances. Mr. Wade presented information packets which included letters requesting a year round preserve for body surfers at the Wedge, rather than the current regulation of May 1 through October 31 from 10:00 A.M. to 5:00 P.M. In response to a question from Commissioner Compton, Mr. Melum explained that extending the hours would create more of an enforcement burden, particularly during the early hours. He pointed out that there is a big demand for this, area from all recreation segments. Recognizing that the Wedge is a dangerous and famous area, Chair Vandervort stated she would support it as a body surfing area only. Commissioner Schonlau pointed out that regardless of the regulations imposed, the City does not have the financial resources to enforce the laws. Motion Chair Vandervort moved there be only body surfing at the Wedge from May 1 to October 31. Commissioner Schonlau amended the motion to extend exclusivity throughout the year to body surfers. �t i on x Commissioner Compton made a substitute motion•to extend the hours for body surfing from 8:00 A.M. to 6:00 P.M. from May 1 to October 31; that the Marine Department and Police Department help enforce the hours; and Ayes x x x x x that there be adequate signage implemented. DISCUSSION ITEMS Item #5 - Tree Removal Director Niederhaus reported staff recommends appro, the two trees provided the homeowner pays for the cos replacement as stated in the report submitted. The proposed recommendation to redesignate tree species represents a joint effort between the Association and staff on the first phase of this project. Discussion Staff and the Association have been working on an agreement to begin a phased program relative to parkway street tree reforestation. One important element of this process is to select replacement trees that can to be maintained within the growth space and also not cause damage to either private or public property. • The species of trees that are being recommended meet this criteria and would be a significant improvement within the Association areas. ._ • A final report with a agreement relative to reforestation(tree removals, planting and funding) between the Association and the City with be presented at the Commission meeting scheduled for September 5, 1995. Vandersloot. • Discussion Dr. Jan D. Vandersloot will provide the City with a donation of one wooden bench. Staff has received correspondence from Dr. Vandersloot for the donation(copy attached). The donor will provide a plaque for the bench with the conforming inscription per City policy. Vandersloot, M.D. n U Agenda Item No. IV -4 August 1, 1995 General Services Department Parks and Tree Divisions July, 1995 Activities Report Park Division Activities 1. One donated bench was installed along Ocean Boulevard in Corona del Mar. 2 Staff continues to work with the City Utilities Department and a consultant for the irrigation renovation and retrofitting for reclaimed water at Bonita Creek Park. The project is out to bid and a contractor will be awarded the project in • August. I Two Petanque courts were installed at San Joaquin Park with the use of staff and contract services. 4. Staff coordinated the installation of landscaping and irrigation at the new Palm Street parking lot with contractor and the Public Works Department. The 60 day landscape maintenance period has commenced with take over of the maintenance by City in early September. 5. Cliff Drive park has been the site of two tree houses that were constructed by area teenagers. Staff removed the tree houses to eliminate any liability issues resulting from these structures. 6. A sprinkler system replacement program was completed by Park Staff at Peninsula Park. The conversion will improve irrigation coverage and also result in water conservation. 7. Marty Colver, Groundsworker II was selected for the General Services Department's Employee of the Quarter Award for exceptional work performance. Mayor John Hedges presented this award at a recent staff meeting. t�' • Upcoming Activities for August 1. Staff will continue to aerify the turfgrass on a Citywide basis as part of an ongoing improvement program. , 2. Staff will continue to establish the newly sodded areas of the football field at Bonita Creek Park for the upcoming season. 3. Staff will continue to coordinate the construction of Bolsa Park with the Public Works and Community Service Departments. Tree Division Activities This fiscal year 1995 -1996 all tree services with be performed by West Coast Arborist. The work will be coordinated by the Urban Forester and Park and Tree Superintendent. During the month of July, 676 trees were trimmed, 18 trees were root pruned, 4 trees were planted, 11 trees were removed,, 8 emergency calls were responded to regarding trees, and 353 tree maintenance requests were received by the Urban Forester. • 1. The Urban Forester and tree contractor worked with the General Services Department concrete crew on root pruning trees for sidewalk, curb, and gutter replacement throughout the City. 2. The City's tree trimming contractor completed scheduled work within the Eastbluff, Cameo Shores, Cameo Highlands, Westcliff and Corona del Mar areas. 3. Lomeli Park and Tree Maintenance Superintendent 0 COMMUNITY SERVICES DEPARTMENT DATE: July 25, 1995 TO: Parks, Beaches and Recreation Commission FROM: LaDonna Kienitz, Community Services Director SUBJECT: Monthly Commission'Report Special Events Item IV -5 The 22nd Annual Mariners Independence Day Parade and Picnic, which was held on July 4, was a huge success. The Grand Marshals were former Mayor Clarence Turner and his wife, Celia. There were approximately 1,500 participants for the traditional festivities which also included 30 ,teams competing in an amateur volleyball tournament that was sponsored by the department. • Plans are underway for the 1995 Balboa Music and Arts Festival on September 9 -10. To date, thirty applications have been accepted. Posters and banners will be hung the second week in August; a flyer is being included in the water bill. Contract Classes Seven hundred participants registered between July 3 -24, resulting in $20,000 in revenue. The more popular classes this summer include surfing, tennis, sailing camp, beach camp and My Little Pony, a horseback riding course. Tennis classes are going very well and have brought in $1,250 in revenue. Surfing classes are full with waiting-lists and have brought in over $3,000 in revenue. Aquatics The City aquatics program suffered in the early weeks of the summer season because of the reduction in water temperature at each of the District pools. Staff, negotiated a one time payment of $1,500 to increase the temperature of the pools to September 1. The aquatics `b revenue is $16,800 to date. Lincoln, School Lease Agreement • A brief amendment to the City of Newport Beach - Newport =Mesa Unified School District lease for the Lincoln School site directing that the property and fields be designated and posted tobacco -free, effective July 1, 1995, will be forwarded to the City Council, August 14, 1995, for approval. A copy is attached. Open Space On June 26, 1995, the City Council approved the Consultant Agreement with Purkiss•Rose RSI for conceptual planning for the remaining CIOSA parcels. Purkiss•Rose is ready to begin their work. It would be helpful to reinstate the 1994 task force or appoint a new Open Space Task Force to meet with the architect for the preliminary planning. Update on Bolsa Park Construction has begun on'Bolsa Park located at the west end of Bolsa Avenue adjacent to North Newport Boulevard. Storm drains • and the initial grading have been completed'. The completion date for this park is estimated to be the end of September. This project will include a tot lot on the east side of the park. This Expo gave seniors and their families an opportunity to learn about different services that are available. Vendors included financial planners, HMO's, health products, banks, social service agencies and much more. The event had approximately 500 people in attendance. Legal assistance continues to be a popular service at OASIS. Twice a month, • different attorneys from Newport Beach volunteer to provide four hours of free legal advice. Each client receives only a half hour of assistance. ` _l The OASIS manager has been meeting with Hoag Hospital to discuss possible joint ventures between the two organizations. The current Resolution, as explained in more detail in the attached exhibit titled "Surfing Regulations ", requires a mandatory, prohibition of surfing June 15th through September 10th (87 days) between the hours of 12 noon and 4 p.m., a four (4) hour period. The balance of the daylight hours, surfing is permitted at the discretion of the Marine Division. The practical results of this regulation is that during the daylight hours of summer (87 days) the surfers have access to essentially all of Newport Beach 71 percent of the time. During the winter (278 days) the surfers have access to all of Newport Beach 100 percent of the time. 23 . Discussion: Should the current regulation be revised so that blackball is not mandatory and beaches can be opened to surfing at the the discretion of the Marine Division? We would recommend against this for the following reasons: 1) Although some flexibility seems logical (rainy /foggy days, etc.) it would require additional manpower at all levels and therefore additional expense at a time when municipal budgets are shrinking not growing. 2) Discretion, unless tightly controlled and uniformly applied, could increase the City's liability if someone were injured. 3) The surfers now have essentially all of Newport Beach 71 percent of the time in the summer and 100 percent of the time in the winter and to increase the cost of public safety to give them more time is unresonable at a time of cost reductions and scarce resources. Surfing regulations in Newport Beach date back to 1949, with the current set of "Blackball" laws remaining largely unchanged since 1966. The current laws (Resolution 89 -10) requires that board surfing be prohibited at all locations in the City between noon and 4:00 pm, from June 15 through September 10. Additionally, special areas are set aside from May through October for the exclusive use of bodysurfers at the Wedge and bodyboarders at 40th to 44th street. At no time are bodysurfers or bodyboards ever excluded from any other area in the City of Newport Beach. HISTORICAL BASIS FOR CHANGE Since 1966 the most profound changes in surfing have been in the area of surfboard design. The aver- age surfboard in 1966 was ten feet in length, weighed 30 to 40 Ibs and would tumble freely toward shore if the rider lost control. The typical surfboard in use today is six feet in length and weighs between six and eight pounds. Most importantly, the use of the surf leash, tying surfer to board, is nearly universal. These factors have radically reduced the probability of swimmers being injured by surfboards. STATISTICAL BASIS FOR CHANGE The City of Newport Beach is unique in the State of California in that it does notprovide an all -day surfing area. In an effort to quantify surfing regulations in surrounding areas, the Newport Surf Council conducted a survey of every lifeguard jurisdiction in Orange County (See Attached Chart). The overall average in the entire survey area is in the vicinity of 30 to 40 percent of each beach zone being allocated for all -day surf- ing. It should be noted that the cities with the lowest total area of dedicated surfing areas (Laguna and San Clemente) do manage to carefully include virtually all of the popular surfing reefs or sandbars within those cities. None of the lifeguard representatives surveyed indicated any difficulty in establishing and enforc- ing separate swimming and surfing areas. Nor did any Indicate any liability problems stemming from the operation of all -day surfing areas. The NSC is of the opinion that the Newport Beach Marine Department is one of the finest in the world. With that noted, if every other lifeguard agency in Orange County is capable of successfully oper- ating all -day surfing areas, Newport should be fully capable as well. COSTIMPACTS Other jurisdictions in Orange County administer surfing areas with lifeguard staffing levels far below Newport's, so it is unlikely that the creation of an all -day surfing area would add any discernable manpow- er costs. There may, however, be certain costs associated with the necessary signs, flags or buoys required to delineate areas for various uses. In light of the City's current budget situation, the Newport Surf Council and Its member businesses would cover reasonable costs for these items if necessary. Surfing Regulations Report, Page 2 DISCUSSION OF SPECIFIC BEACH USE BY SURFERS For the sake of educating those unfamiliar with recreational wave - riding in the City of Newport Beach, it should be noted that not all of the City's coastline is considered prime territory by the surfing population. There are certain exceptions, but during typical surf conditions during the summer months when souther- ly swells are dominant, one can make the following generalizations: Cameo Shores to East Jetty Mostly unfavorable reefs and straight beaches not suited to surfing. Wedge to 17th Street Mostly shorebreak with poor shape better suited to swimming than surfing. 17th Street to 19th Street Commonly surfed during typical conditions, but is world - famous for producing huge waves during hurricane swells on perhaps a half -dozen days a summer. 20th Street to 28th Street: Better in winter due to west swell exposure, but still popular most momings with the longboard crowd. Hugely popular swimming beach leads to early blackball many days. 28th Street to 40th Street: with a curving coastline, the surf tends to get stronger as the street numbers get higher. Extremely popular among local residents and beginning surfers. 40th Street to 44th Street: Currently restricted to use by soft bodyboards only 44th Street to Santa Ana River Jetties: The Good Stuff. Due to its exposure to a variety of swell directions, on a day -to -day basis this stretch offers the best waves and is correspondingly the most heavily -surfed region in the City. The jetties at 48th, 52nd, and 56th Streets and the area adjacent to the Santa Ana Rivermouth provide for superb.sandbars. The jetty-free stretch including the Prospect Street and Orange Street areas are also top - quality on most summer swells. Notable Exceptions: On large south swells (six feet or over) the jetty at Corona del Mar (Big Corona) often becomes a very desirable surf break. The Wedge is also surfed, but currently has its own set of laws in effect. RECOMMENDATIONS Based on the above, the Newport Surf Council recommends the following: 1. An all -day surfing area be established within the City of Newport Beach consisting of 25% of the City's total coastline area. Since the total number of street -ends on the beach approach 100, for sim- plicity's sake the NSC recommends at least 20 streets be set aside for surfing. 2. The lifeguards be given the authority (and encouragement) to refrain from posting the black- ball flag in any other area of the City if the number of swimmers do not necessitate exclusion of surf- boards. Typically this would apply to situations of poor weather and/or unusually large surf. Additionally, the Newport Surf Council is of the opinion that any all -day surfing areas should be situated at several locations between 36th Street and the Santa Ana River Jetties. Reasons include: a) scarce parking dictates that this stretch is less crowded with casual beachgoers than, say, the Pier areas; b) these areas provide the most consistent quality surf conditions, and; c) the jetties can provide an obvi- ous line of demarcation between a surfing and swimming areas. The NSC view Is that the first priority lies In gaining official acknowledgement of the need for an all -day surfing area somewhere within the City of Newport Beach. Exact location of the surfing areas can be determined at a future date, taking all factors into consideration. I realize that on busy weekends and holidays the black ball is necessary to protect swimmers from some irresponsible surfers. However I strongly agree with the recommendation that the lifeguards should be given more discretion when there are few swimmers in the water. Also that a designated surfing area be created, Lifeguards would still have the ability to caution and cite surfers if they felt that they were acting recklessly and endangering not only swimmers but other surfers. I feel that surfers in the Newport area receive a bad name from the actions of a few irresponsible individuals. I have been surfing since I was nine. Every summer its the same old frustrating thing - go surf in the morning, get out, go eat and right when I'm ready to go back out surfing they put up blackball. Us surfers have basically nothing to do for the four hours during blackball. I know the beaches are sometimes crowded on weekends but on week days they're not. The lower streets such as 40'th street down are always the most crowded. I think you should consider making 40'th street and up No blackball areas. I mostly surf 54'th street and every day this summer when the lifeguards put up blackball it has not even been crowded. Sometimes there's only one or two people in the water and it is pointless to kick us out of the water for that. We believe that this law infringes on the public's rights to recreational use of the ocean. Essentially this law dictates that one type of recreational user is completelybanned from any ocean access, while others are given preferential treatment. _ _ We understand that the primary reason for the Blackball legislation is to promote water safety, but do not think the current law accomplishes this goal in a fair manner. We suggest the following changes be made: 1. A portion of the Newport Beach coastline should be designated an all day surfing area, as is the practice in all.other state and municipal beaches along the California coast. We suggest using the groin fields as demarcations for swimming and surfing areas, which would allow easy walking access from an given point. Additionally, the entire area south of 15th St. could be for swimmers only, while the entire area north of 52nd St. could be designated for surfing. This would provide fair and safe access for everybody based on • their sport of choice in the conditions best suited for their sport, and would also ease the lifeguards' duties by focusing swimmers in specific areas of Newport. 2. Newport Beach lifeguards should be given discretion to extend surfing time in those areas which would still be subjected to Blackball based on beach usage conditions for that day. For instance, on those days when no swimmers are present at the beach, or when lifeguards post Red Flag,conditions advisingswimmers not to enter the water at all (and the conditions tend to be excellent for experienced surfers and actually provide a phenomenal spectator event enjoyed by local beachgoers and visiting tourists) Blackball should not restrict enjoyment of the ocean. The current law is not fair, and we believe that in recent years (we have been Newport Beach residents for nearly 20 years) there has been an increased unnecessary tension at the beach because of it. Every time the Blackball goes up there is confrontation between lifeguards and surfers that causes frustration, ties up lifeguard time and resources that could be used for actually saving lives (by contrast we actually witnessed a lifeguard on the new jet ski water patrol unit taunting and almost runningover a surfer he was trying to expel from the water at 12:05pm when there was not a single swimmer on the beach), and ultimately costs taxpayers money. We have discussed the issue with lifeguards on numerous occasions and the basic consensus appears to be that they do not agree with the law either, but must enforce it as part of their job duties. Newport Beach has a beautiful stretch of coast that produces world class surfing conditions, particularly in the summer months. Surfing is an important form of water recreation that teaches our youth to respect the water and coast surrounding our City, and provides an excellent outlet for physical challenge and pure enjoyment of nature. Surfing attracts all types of people, ranging from young "grommets" who are just learning but have a great excitement and energy, to college students looking for a break from studies, to working professionals such as ourselves who have been surfing all of their lives and continue to find • inspiration in the ocean's beauty. Surfing now spans several generations and it is common to see son, father and grandfather groups in the water together, and many females also enjoy the sport. California has built up -` • L� • N a rich surfing tradition that is admired by people all over the world. We should be proud of this part of our culture and encourage it, not prevent people from enjoying surfing. We are asking for a fair compromise that will facilitate both water safety and ocean recreation for the public. The laws should be modified to create all day surfing areas and to allow for discretionary black ball when the surf is large and the beaches are uncrowded. OUTDATED The black ball law was created when surfboards where much bigger and • heavier then they are today. Also the leash, which tethers the board to, the ankle of the surfer had not been invented. Nearly all surfers today use a leash. Thus, it is much safer for surfers and swimmers to co -exist today than at the time the black ball laws were implemented. • UNFAIR The black ball prevents those that are most appreciative and respectful of the ocean from using itl This is an outrage! The ocean is fickle and the best waves can occur during black ball. Surfers are citizens, taxpayers and voters. Surfers, through organizations such as the Surfrider Foundation, do a great deal to preserve beaches and oceans. Why are surfers singled out from enjoying this precious resource? ALL DAY SURF ZONES Granted, during crowded summer days, there is a need to separate swimmers and surfers. Thus, the black ball should be continued, but on a reduced basis. All day surf zones should be created. All other beach cities in the county designate an average of 35 to 40 percent of the beach to surfers. Newport Beach should do the same. �1/ • DISCRETIONARY BLACK BALL The black ball law needs to be more, flexible. There is no reason to put up the black ball anywhere when there are no •people at the beachl. A cold, cloudy or rainy day results in low beach crowds. Also, when the surf is large, it is unsafe for the inexperienced to be in the water. On such days, the black ball should be not be put up. CONCLUSION Implementing these changes would make the black ball law fair to everyone. As a surfer and a resident of the city for many years, correction of the present situation is a priority to me. To state very plainly: During the summer months many thousand' visitors come to Newport Beach to take advantage of this areas world renouned surf. And raising the flag at noon everyday, everywhere along the coast at Newport (with the exception of about 200 yards of beach at the river jetty) is foolish. The fact is that there are many days when surfers out number swimmers 4 to 1 just before the blackball goes up. I cannot count the number of days when the flag goes up, the surfers come in and there is nobody in the water. Lets face it: the water temperature in Newport rarely gets above 65 degrees. This summer it has not been that warm at all. Your typical tourist does not swim in water that cold. Their kids might, but they aren't in the water on days when the surf is good for surfing (i.e. big, strong swells). For Newport Beach to continue to ignore this situation is silly. The beach is for everyone, including surfers. You should alot more than 200 yards for a group that .proportionally uses the ocean far more frequently than any other group and supports the scores of surf shops and restaurants in Newport. To sum it up: The blackball is a policy that should be reviewed and changed to, benefit a group who have suffered unjustice for far too long. We, as surfers, are not asking for the entire beach to be opened to surfing like it is in the winter. We just want more space to pursue our pastime in a safe and reasonable environment, instead of the hositile one we face now. I have (2) sons 10 & 19 who both surf as well as myself on an almost daily basis and compete at the ASAP and NSSA events. I also conduct business in this city as the above letterhead indicates. We have lived here for approx. 16 years and will continue to do so. As you are aware,there is a considerable number of young (and old) individuals enjoying the sport of surfing with that number growing. There is clearly a need for designated beaches that offer all day surfing. This is important due in part that from noon to 4:00 these young people have too much time on their hands. And we all know that can lead to the possibility of the kids getting into trouble. I can only speak for both my sons' friends and'that I haven't met a more respectful or nicer group of kid's. There are certain perceptions that "surfers" may have and I'm sure some deserve the moniker; not this group. What the partial,elimination of blackball;(and adding specific,beach designation) woul &do is to indicate to our kid's and their parents that our city cares. A possible idea would be to provide more . programs such as city sponsored contests, feature surfers of the week in the Daily Journal, etc. in other words make them a part of the community. The city could reap benefits - all day passes? charge for a beach scuttle - ski areas and towns utilize busses which would help any traffic problems - even designated spots that would feature professional and well kno«vn local surfers that could do non - contest judging and display scores via a portable score display, so our kids and others could then get feedback on how they are doing. These and other ideas will help create a certain pride amongst our children about where they live and in the governing body that helps them. The added revenue wouldn't be bad either. This can be a "win/win" situation for all those concerned. The city would delight imthe fact that a majority of kids would be on the beach or in the ocean and not doing God only knows what. And the surfing,public would feel as part of our community. This a unique, situation for the city to step up and show an important part of our population how much you care and that you are willing to get involved. There is no reason to put up the black ball anywhere when there are no people at the beach!, A cold, cloudy or rainy day results in low beach crowds. Also, when the surf is large, it is unsafe for the inexperienced to be in the water. On such days, the black ball should be not be put up. CONCLUSION Implementing these changes would make the black ball law fair to everyone. To state very plainly: During the summer months many thousand visitors come to Newport Beach to take advantage of this areas world renouned surf. And raising the flag at noon everyday, everywhere along the coast at Newport (with the exception of about 200 yards of beach at the river jetty) is foolish. The fact is that there are many days when surfers out number swimmers 4 to 1 just before the blackball goes up. 'I cannot count the number of days when the flag goes up, the surfers come in and there is nobody in the water. Lets face it: the water temperature in Newport rarely gets above 65 degrees. This summer it has not been that warm at all. Your typical tourist does not swim in water that cold. Their kids might, but they aren't in the water on days when the surf is good for surfing (i.e. big, strong swells). For Newport Beach to continue to ignore this situation is silly. The beach is for everyone, including surfers. You should alot more than 200 yards for a group that proportionally uses the ocean far more frequently than any other group and supports the scores of surf shops and restaurants in Newport. To sum it up: The blackball is a policy that should be reviewed and changed to benefit a group who have suffered unjustice for far too long. We, as surfers, are not asking for the entire beach to be opened to surfing like it is in the winter. We just want more space to pursue our pastime in a safe and reasonable environment, instead of the hositile one we face now. There is clearly a need for designated beaches that offer all day surfing. This is important due in part that from noon to 4:00 these young people have too much time on their hands. And we all know that can lead to the possibility of the kids getting into trouble. I can only speak for both my sons' friends and that I haven't met a more respectful or nicer group of kid's. There are certain perceptions that "surfers" may have and I'm sure some deserve the moniker; not this group. What the partial elimination of blackball (and adding specific beach designation) would do is to • indicate to our kid's and their parents that our city cares. A possible idea would be to provide more programs such as city sponsored contests, feature surfers of the week in the Daily Journal, etc. in other words make them a part of the community. The city could reap benefits - all day passes? charge for a beach scuttle - ski areas and towns utilize busses which would help any traffic problems - even designated spots that would feature professional and well known local, surfers that could do non - contest judging and display scores via a portable score display, so our kids and others could then get feedback on how they are doing. These and other ideas will help create a certain pride amongst our children about where they live and in the governing body that helps them. The added revenue wouldn't be bad either. This can be a "win/win" situation for all -those concerned. The city would delight in the fact that a majority of kids would be on the beach or in the ocean and not doing God only knows what. And the surfing public would feel as part of our community. This a unique situation for the city to step up.and show an important part of our population how much you care and that you are willing to get involved. Dear Parks, Beaches and Recreation Commission, City Council Members and Mayor John Hedges: Thank you for taking time to explore alternatives to the current unfair city ordinance to surfers and people who enjoy surfing and watching people surf hard boards on natures gift to all the waves. I understand your concern that it may cost the city to enforce new laws regarding surfing within city limits during previously prohibited times and places. In fact, I feel, the city could implement these changes at-no additional cost as far as enforcement goes. The black ball signs could simply be removed from the lifeguard towers. Currently, lifeguards routinely patrol the entire stretch of city beaches. During the course of this duty, they could advise and remove swimmers out of a surfing area, much like they now kick surfers out at noon. Surfing area could enhance the city's image and contribute more to its local economy. There is a substantial amount of money to-be made by the city and businesses off of the sport of surfing. laby is it that Newport Beach has no hard 'board surfing area within the ity limits ?' Yet, all neighboring coastline cities do.' In fact, most coastal cities in California either have a hard board surfing area or absolute no restrictions on surfing. Surfers are free to go surfing whenever and where ever they want as long as they harm no one or nothing while surfing. Which is the case almost 100 percent of the time. In surfing, the only thing that gets harmed is the surfers themselves if they unwittingly get hurt. However, I feel in my 15 years as a surfer, bodysurfer, and former body boarder, that surfers get hurt or need lifeguard assistance less than the average swimmer. Why? Because surfers look out for other surfers and all those in the ocean. If you are in trouble in the ocean and for some reason the outstanding city life guards couldn't reach you in time, a surfer would be your best hope for a rescue. Blackball was legitimately started.in the 19,50's when the number of surfers was extremely small compared to a large number of swimmers. Surfboards were indeed much heavier, bigger and very much more dangerous to the surfer and especially swimmers. Today's surfer has the surfboard leash attached to the bottom of the leg above the foot. Leashes prohibit the board from getting too far away from the surfer and it takes only seconds for a surfer pull on the leash, pulling the -board toward him and grabbing it thus, again gaining control of the• board'almo"st immediately after falling off. I suggest that leashes be required on all surfboards thus, virtually eliminating all completely loose boards from washing in and r1 hitting other people. This was the major reason why Blackball was first brought about. I'm sure that surfers would be willing So do about anything to cooperate with the city and lifeguards o extend surfing hours and locations. There is a progression that most people make on the way to becoming a surfer: 1. Swimming in the ocean; 2. Body surfing, body boarding etc.; and 3. Surfing hardboards. Throughout each stage more, and more time is spent in the ocean. Therefore, surfers spend the most time in the water and take advantage of the areas recreational resources (the waves!) more often. On June 17, 1995, I was surfing between the jetties located at 52nd and 56th Streets respectfully. There was about 100 or more surfers in the water in this four block area. At noon, Blackball went up and all the surfers grudgingly came in as required by law. I waited on the beach for 20 minutes and counted three bodyboarders in the same four block area. Therefore, due to the Blackball ordinance my recreational resources (waves) were wasted as they have been shamefully since the 1950's. The surfing population in the area and outlying areas has exploded since the 1950's. This forces huge and dangerous crowds to surf in the morning until noon and after 4:00 pm. The ocean became clogged and dangerous like freeways during rush hour. n deed, if I were ever injured in such a crowd situation, I ould look into the city being liable for forcing a large number of surfers to crowd the water to avoid Blackball times and locations. The city could defuse these dangerous crowds with more surfing areas and less Blackball time. So, it's time for the city to stop being negligent about surfers, their rights, Blackball and give the huge and growing hardboard surfing populace it's own quality surfing areas and /or less strict and /or optional Blackball or less time with Blackball in effect and less wasted recreational resources. The Blackball ordinances are severly outdated (19601s) and the City of Newport Beach needs to open up more time and space for hardboard surfers to diffuse the dangerous crowds during non - Blackball hours and/ or locations. Folks, it's 1995, almost 2000 and a lot has changed. Please put yourself in the place of a surfer, restricted from doing what he loves, on that special day that happens once to a few times a year and the waves are incredibly good for hardboard surfing. Please be fair to surfers who are much more a part of mainstream society than there average 60's counterpart. And it does just that, around noon. I paddle out to the only place which I'm "allowed" to surf. The Santa Ana River Jetties. I spend the next hour, along with a dense and frustrated crowd of fellow surfers, dodging non - surfers. In that hour, seven non- surfers where saved by lifeguards while playing in our little, designated zone. I return to the beach, only to see it once again littered. I throw in my towel and call it a day. Why is it that surfers must play in a "contained area "? Why is it that non - surfers get to, play in our contained area from noon to four o'clock, but we can't play in theirs? And why is it that we have to clean up their mess? We're not the ones who leave it behind. But we are the ones who clean it up. (Twisted logic comes to mind) In return, hundreds of surfers are crammed into an area as small as a football field to express themselves for four hours of the day. Times that you were considering opening the beaches to board surfers during the summer blackball time. It is obvious that mixing swimmers and bodyboarders with board surfers is very dangerous. The consequences can be fatal as demonstrated in the August 23, 1987 death of Javad Heidarali at 51st St. in Newport Beach. This accident occurred after blackball when both the surfer and swimmer Mr. Heidarali) were legally in the same area and the swimmer was struck by a surfboard whose rider had fallen off. Separating board surfers from swimmers is the safest course of action and demonstrates that the city is acting responsibly. My suggested compromise is as follows: • 11 Set aside the area from Orange street north to the river jetties to be designated' as a surfing area only. The area between the river jetties and north to tower 2 at the state beach is currently open to surfers all day. Work with Huntington State Beach so that they will expand their surfing area. 2) Expand the 40th to 44th St. swimmers only area to include 36th to 40th St. during the summer months. This is necessary because the current swimmers only area is too small and has seen a dramatic increase in use in recent years as more people have become aware of its existence. The laws should be modified to create all day surfing areas and to allow for discretionary black ball when the surf is large and the beaches are uncrowded. OUTDATED The black ball law was created when surfboards where much bigger and heavier then, they are today. Also the leash, which tethers the board to the ankle of the surfer had not been invented'. I understand your concern that it may cost the city to enforce new laws regarding surfing within city limits during previously prohibited times and places. In fact, I feel, the city could implement these changes at no additional cost as far as enforcement goes. The black ball signs could simply be removed from the lifeguard towers. Currently, lifeguards routinely patrol the entire stretch of city beaches. During the course of this duty, they could advise and remove swimmers out of a surfing area, much like they now kick surfers out at noon. Surfing area could enhance the city's image and contribute more to its local economy. There is' a substantial amount of money to be made by the city and businesses off of the sport of surfing. shy is it that Newport Beach has no hard board surfing area within the ity limits? Yet, all neighboring coastline cities do. In fact, most coastal cities in California either have a hard board surfing area or absolute no restrictions on surfing.. Surfers are free to go surfing whenever and where ever they want as long as they harm no one or nothing while surfing. Which is the case almost 100 percent of the time. In surfing, the only thing that gets harmed is the surfers themselves if they unwittingly get hurt. However, I feel in my 15 years as a surfer, bodysurfer, and former body boarder, that surfers get hurt or need lifeguard assistance less than the average swimmer. Why? Because surfers look out for other surfers and all those in the ocean. If you are in trouble in the ocean and for some reason the outstanding city life guards couldn't reach you in time, a surfer would be your best hope for a rescue. Blackball was legitimately started in the 1950's when the number of surfers was extremely small compared to a large number of swimmers. Surfboards were indeed much heavier, bigger and very much more dangerous to the surfer and especially swimmers. Today's surfer has the surfboard leash attached to the bottom of the leg above the foot. Leashes prohibit the board from getting too far away from the surfer and it takes only seconds for a surfer pull on.the leash, pulling the board toward him and grabbing it thus, again gaining control of the board almost immediately after falling off. I suggest that leashes be required on all surfboards thus, virtually eliminating all completely loose boards from washing in and r 1 lJ hitting , &'ther people. This was the major reason why Blackball was first brought about. I'm sure that surfers would be willing o do about anything to cooperate with the city and lifeguards o extend surfing hours and locations. There is•a- progression that most people make on the way to becoming a surfer: 1. Swimming in the ocean; 2. Body surfing, body boarding etc.; and 3. Surfing hardboards. Throughout each stage more, and more time is spent in the ocean. Therefore, surfers spend the most time in the water and take advantage of the areas recreational resources (the waves!) more often. On June 17, 1995, I was surfing between the jetties located at 52nd and 56th Streets respectfully. There was about 100 or more surfers in the water in this four block area. At noon, Blackball went up and all the surfers grudgingly came in as required by law. I•waited on the beach for 20 minutes and counted three bodyboarders in the same four block area. Therefore, due to the Blackball ordinance my recreational resources (waves) were wasted as they have been shamefully since the 1950 "s. The surfing population in the area and outlying areas has exploded since the 1950's. This forces huge and dangerous crowds to surf in the morning until noon and after 4:00 pm: The ocean became clogged and dangerous like freeways during rush hour. n deed, if I were ever injured in such a crowd situation, I ould look into the city being, liable for forcing a large number of surfers to crowd the water to avoid Blackball times and locations. The city could defuse these dangerous crowds with more surfing areas and less Blackball time. In the City of Newport Beach, the bodyboarders and rafters have a 24 hour zone between 40th and 44th Street. At the wedge only bodysurfers are allowed after 10 am. Surfers should have their own hardboard surfing area. In fact,, any city beach that has large breakers should be open for surfing as most surfers could handle such conditions, and close to swimmers as most swimmers could not handle swimming in such conditions. I therefore suggest that 52nd Street to 61st Street become a 24 hour surfing area only as it has the•most consistent and best suited for surfing waves. The area south of the Newport Pier from 17th Street to 20th Street; only three blocks would be a great area. I cannot emphasize enough that if any area in the city limits has that rare day, one of the few times a year when good surfing waves are breaking. Blackball should then be applied not to the surfers but to the swimmers for: 1) Lack of swimmers in the area; 2) Dangerous swimming conditions, red or yellow flag; 3) Prime surfing conditions. I feel that this could be achieved with the current staff of lifeguards 'and their equipment. • V One -of t'ke worst feelings I have ever had in my life is being forced out of the water during a rare, high quality, high swell surfing onditions. I get to the beach on a day like this and see some of he best waves of my life go unridden. As a matter of fact, no swimmers want to even swim in these turbulant waters. What does 'this'add --up to one huge waste of recreational resources and the cities taxpayers money. So, it's time for the city to stop being negligent about surfers, their rights, Blackball and give the huge and growing hardboard surfing populace it's own quality surfing areas and /or less strict and /or optional Blackball or less time with Blackball in effect and less wasted recreational resources. The Blackball ordinances are severly outdated (1960's) and the City of Newport Beach needs to open up more time and space for hardboard surfers to diffuse the dangerous crowds during non - Blackball hours and/ or locations. Folks, it's 1995, almost 2000 and a lot has changed. Please put yourself in the place of a surfer, restricted from doing what he loves, on that special day that happens once to a few times a year and the waves are incredibly good for hardboard surfing. Please be fair to surfers who are much more a part of mainstream society than there average 60's counterpart. Thank you for your time and consideration and rest assured the surfers will abide by anything means less Blackball and more hardboard surfing. The city needs ordinates that are fair to the majority not special interest groups like tourists. I feel that tourists will not be effected by this except the number of tourists who are surfers. Times that you were considering opening the 'beaches to board surfers during the summer blackball time. It is obvious that mixing swimmers and bodyboarders with board surfers is very dangerous. The consequences can be fatal as demonstrated in the August 23, 1987 death of Javad Heidarali at 51st St. in Newport Beach. This, accident occurred after blackball when both the surfer and swimmer IMr. Heidarali) were legally in the same area and the swimmer was struck by a surfboard whose rider had fallen off. Separating board surfers from swimmers is the safest course of action and demonstrates that the city is acting responsibly. My suggested compromise is as follows: • 11 Set aside the area from Orange street north to the river jetties to be designated as a surfing area only. The,area between the river jetties and north to tower 2 at the state beach is currently open to surfers all day. Work with Huntington State Beach so that they will expand their surfing area. 2) Expand the 40th to 44th St. swimmers only area to include 36th to 40th St. during the summer months. This is necessary because the current swimmers only area is too small and has seen a dramatic increase in use in recent years as more people have become aware of its existence. I spend my morning cleaning up plastic bottles, empty cans, diapers and styrofoam cups from the littered beach. I don't work for the city or even recycle for a little extras change. I'm a surfer. A human being. And I'm simply picking up some trash while waiting for the tide to change. And it does just that, around noon. I paddle out to the only place which I'm "allowed" to surf. The Santa Ana River Jetties. I spend the next hour, along with a dense and frustrated crowd of fellow surfers, dodging non - surfers. In that hour, seven non- surfers where saved by lifeguards while playing in our little, designated zone. I return to the beach, only to see it once again littered. I throw in my towel and call it a day. Why is it that surfers must play in a "contained area "? Why is it that non - surfers get to play in our contained area from noon to four o'clock, but we can't play in theirs? And why is it that we have to clean up their mess? We're not the ones who leave it behind. But we are the ones who clean it up. (Twisted logic comes to mind) In return, hundreds of surfers are crammed into an area as small as a football field to express themselves for four hours of the day.
