He proposes to replace the tree and assist in developing a plan for the neighborhood. He does not, however, feel he should contribute funds for trees that have been illegally removed on Holly Lane. In response to a question from Commissioner Compton, Director Niederhaus reported that the total cost for removal is '$195 and planting a 15 gallon tree is $95; and that the total cost to plant 5 trees and remove,one tree would be $670. Motion x Commissioner Glasgow moved that the property owner remove and replace both trees. Director Niederhaus pointed out that there is no reason to remove the second ficus tree at this time, however, there is always the possibility it may cause damage in the future. Motion x Commissioner Demmer made a substitute' motion to approve removal of the requested tree and that the home owner bear the cost of removal and planting of a 15 gallon designated street tree. Ayes x x x x x x Unanimous. Item #2 - Park and Tree Division Commissioner Compton complimented Marcy Lomeli on the recent installation of the Petanque Courts at San Joaquin Park in Corona del Mar. Commissioner Glasgow concurred and pointed out that the courts are being used and are a good utilization of space. Commissioner Demmer recommended that the courts be advertised in the Newport Navigator. Staff will comply. Item #3 - Recreation and Senior Services Director Kienitz presented the staff report on Bolsa Park and pointed out that copies of the landscape plans approved in 1992 are available. There has been a slight modification at the request of the homeowners which has resulted in one wall being lowered approximately 30 ". The park should be completed within the month. Referring to the staff report submitted on the use of parks over the past three years, Commissioner Compton pointed out there are 80 1 more participants in Junior All American Football which negates the 50% decrease shown in the report. The reason for the decrease in adult softball teams is due, to the Loral group moving and the loss, of the stockbroker teams that utilized fields in the .afternoons. Commissioner Compton pointed out the need for parks as a result of CITY OF- Parks, Beaches & Recreation September 5, 1995 Page 3 City Council Chambers Commission 7 p.m. the 21 % increase in children's programs in addition to the increase of residents using City parks from the Down Coast area. DISCUSSION ITEMS Item #4 - Surfing Regulations Commissioner Bonner, Chair of the Blackball Revision Subcommittee, reported the committee held two public meetings attended by surfers and non - surfers which resulted in the proposed recommendation. He pointed out that the homeowner associations did not attend the meetings and, therefore, did not participate in the recommendation proposed. Chair Vandervort opened the meeting to public hearing. I The following people spoke in support of the existing blackball regulations. Reasons and comments included that the current situation is fair and has worked well for the past thirty years. Surfers already have access to the ocean 90% of the year and 10 hours daily during the summer. Non - surfing areas are already too small and crowded during the summer months. Existing policy gives surfers access while protecting the swimmers. Boards are dangerous and surfers and swimmers cannot coexist. There would be an increased risk to swimmers and the City. Swimmers and surfers already schedule their day around the current surfing hours when they know they will be safe. To change the rules would be unfair to those living on the beach due to the increase of congestion, traffic and parking problems. Property values would be lowered. Reasons and comments included that it is time for a change. Boards are lighter now and have leashes. Privileges should not be removed for youth CITY OF- Parks, Beaches d & Recreation Commission September 5, 1995 Page 4 City Council Chambers 7 p.m. and recreation. Areas affected are only 8% of the City's coastline. Currently there is 6 miles of coastline where surfers cannot surf from Noon to 4 P.M. Newport Beach is the only coastal city where surfers cannot surf year round. It is not fair that surfers are the only group excluded from the water. The recommendation will raise revenue through tourism and surf contests and will not cost the city any more money. The Newport Surf Council has pledges exceeding $17,000 -- - - - -- -- -- — - --- towards— implementation. -- Property - values — will-- not--be- -affected:-- Parking and traffic will also not be affected since most people will continue to arrive early and stay until late afternoon. Surfers cannot use the unhealthy area near the Santa Ana River Jetty due to pollution and sewer spills. When waves are good', surfers are farther out and there are fewer swimmers, most of them being close to shore. There are more surfers than swimmers in the proposed areas. Exclusive swimming areas are only 100 yards from the surfing areas. Excellent waves are often during blackball hours. Parks need to be shared as well as the beaches. The recommendation supports the community's youth and an important recreation activity. Petitions were presented signed by 475 Newport Beach residents in support of'the proposal. He addressed the safety and liability issues, pointing out that the City Attorney advised there is no increase in liability to the City. In addition, statistics show no injuries in 1994 between a surfer and 1 non - surfer. Leashes also eliminate loose board problems. Commissioner Bonner addressed the enforcement issues which are manageable and cost effective with minimal impact on residents. There is no evidence of declining values in other communities with surfing areas. Motion x Commissioner Bonner moved to approve the recommendation as written to be forwarded to the City Council. Motion x In order to give equal access to swimmers, Commissioner Schonlau — made a substitute motion to-designate 44th -48th Streets and 52nd to 56th Streets as surfing areas; 48th -52nd Streets would be designated for body surfers and swimmers. Commissioner Bonner reminded the Commission that the substitute motion is.not funded. Ayes x Nays x x x x x Vote was taken on the substitute motion. Motion fails. Nay x Item #5 - Lincoln Field Lights I Recreation Manager Steve Hunt gave an overview of the report submitted and stated that AYSO is requesting to use one lighted soccer field during the fall at Lincoln on Friday nights from approximately 6:00 P.M. to 7:30 P.M. Current guidelines are that no lights are utilized Friday, Saturday and Sunday, evenings to ease the concerns of the residents. Key cards are issued to users in order that lights are turned off five minutes after a game is concluded. Motion x Commissioner Glasgow moved that AYSO be permitted to use one lighted soccer field at Lincoln from September 8 to December 1, Ayes x x x x x x 1995 not to exceed 7:45 P.M. Unanimous. Item #6 - Recreation and Open Space Element Commissioner Compton, Chair of the Park and Open Space Committee, reported the committee met with Gail Pickert, consultant, regarding documentation for the General Plan. Commissioner Compton presented a report entitled Development of the Revision of the Recreation and Open Space Element which he reviewed for the Commission. Commissioner Glasgow and he met with the City Manager who told them that there may still be some minor changes in the use of the parcels. He recommended moving forward on conceptual plans for Bay View Landing, Freeway Reservation, Newport Village and; Cal Trans West. Motion x Commissioner Compton moved to approve the proposed Ayes _I x x x x x x development as written. Unanimous. CITY OF NEWPORT , BEACH Parks, Beaches & Recreation Commission September 5, 1995 �G `° X Page 6 � City Council Chambers 7 p.m. Item #7 - Facility Inspections Chair Vandervort reported that each year park inspection assignments are rotated among the Commissioners. Inspection reports are due November 1, 1995. Item #8 - Commission Calendar Commissioner Schonlau reported he called the Chair of the City of Costa Mesa's Park, Recreation Facilities and Parkways Commission. They will be agendizing a joint meeting with this Commission at the end of September. Following a brief discussion, the Commission determined that the best dates for a joint meeting would be either November 13, 14 or 15. In response to Commissioner Schonlau's inquiry regarding the annual Christmas Party, the Commission decided that it will be held Wednesday, November 29, at 7:00 P.M. at the Cannery Restaurant. VI. FUTURE AGENDA ITEMS - None VII. ADJOURNMENT There being no further business, the Parks, Beaches and Recreation Commission adjourned at 10:10 P.M.
