Commission, staff or the public request specific items to be

ORDER AND ROLL CALL
The Parks, Beaches and Recreation Commission was called to order at 7:00 P.M.
Roll call was taken. Commissioners Beek, Bonner, Compton, Demmer, Glasgow,
Schonlau and Vandervort were present.
II. APPROVAL OF MINUTES
• Commissioner Bonner moved the minutes of'the June 4, 1996 meeting be approved as
presented. The motion carried by the following vote:
Ayes: Beek, Bonner, Compton, Demmer, Glasgow, Schonlau and Vandbrvort
III. SEATING OF NEW COMMISSIONER
Newly appointed Commissioner Dunn was seated.
IV. ELECTION OF OFFICERS,
Commissioner Glasgow, nominated Commissioner Schonlau for Chair. The nomination
was carried by the following vote:
Ayes: Beek, Bonner, Compton, Demmer, Dunn, Glasgow and Schonlau

Bill Huscroft, 519 36th Street, addressed the Commission regarding Irvine sewer water.
Mr. Huscroft discussed the adverse effects on the waterways which will affect property
values, boating and result in an aesthetic loss to the people of Newport Beach.
Chair Schonlau advised Mr. Huscroft to contact the Chair of the Water Quality
Committee which reviews these types of issues.
Pat Ward, 1010 Sandcastle, addressed the Commission on behalf of Little League
East. He stated they had an excellent season due in part to the facilities made
available to them.
Andy Almquist, Little League East player from District 55 and on the All Star Team,
presented a plaque to the Community Services Director in appreciation for the
department's commitment to providing fields for Newport Beach Little League.
Stephen Ward, Little League East player from District 55 and on the All Star Team,
presented a plaque to the General Services Director in appreciation for the time and
resources spent in helping them maintain their baseball fields, particularly their home
• field at Lincoln which is one of the best in the County.

Commissioner Compton moved that the following items be approved except for those

ITEMS REMOVED FROM CONSENT CALENDAR
Item #1 - .Communications
Elaine Linhoff, 1760 E. Ocean Boulevard, addressed the Commission in reference to
her letter which was transmitted to the Commission concerning Castaways View Park.
She requested the first sentence be disregarded and that the six other items in her
letter be considered in the design of the park.
In response to a question from Commissioner Compton concerning the Balboa Power
• Squadron's lease, Director Kienitz explained that the City Council commissioned a
study of the area for long term use. As a result, no leases, will be signed in the interim
for this area. When the study is finalized, the Commission will be informed. In the
meantime, the Balboa Power Squadron will continue to use the facility at 1714 W.
Balboa Boulevard on a month to month basis.
Referring to the communication from Lido Isle Community Association concerning their
request for a neighborhood park, Commissioner Compton recommended'the request be
reviewed by the Park and Open Space Committee for future development. Director
Kienitz concurred.
Item #4 - Dedication Committee for Bob Henry Park
Jo Vandervort, 1147 Pembroke Lane, addressed the Commission and reported she
was appointed by the City Manager to chair the committee established to plan the
celebration for the opening of Bob Henry Park. She corrected the report to show that
John Desmond will replace Andy Gonis from the Police Department on the committee.
The Commission determined that Commissioners Beek, Glasgow and Schonlau will
also serve on the committee and that Commissioner Dunn will serve as an alternate.
Commissioner Compton moved to accept the communications with their corrections.

VII. DISCUSSION ITEMS
Item #9 - Potential Passive Parks
Jim Thompson, 3804 Sandune Lane, addressed the Commission and gave a
background on the vacant property at Newport Boulevard and Short Street and Via Lido
and Newport Boulevard. He has.been given conceptual approval by the City Council to
generate private funds to acquire the properties for park sites and donate them to the
City. He envisions them as passive parks with a donor wall at the Newport Boulevard
and Short Street site.
Vice Chair Demmer commented that it is unusual for the City Council to approve a park
concept before it is reviewed by this Commission.
Commissioner Compton moved that the Park and Open Space Committee meet with
Mr. Thompson and that their recommendations, which will be transmitted to the City
Council, be reviewed at the Commission's August 6 meeting. The motion carried by the
following votes:

Item #10 - Castaways View Park
Emmet Berkery, project consultant for the City on the Castaways View Park, addressed
the Commission. Mr. Berkery explained the design of the adjacent projects, the Bob
Henry Park and the Taylor Woodrow homes. Three 'hundred thousand dollars was
allocated in FY 1995 -96 and an additional $300,000 was allocated in FY 1996 -97 for .
the project.
Steve Lang, the landscape architect from Purkiss Rose RSI, addressed the
Commission and gave an overview of the circulation walkways. He also clarified the
erosion control seeding improvements, planting, grading, drainage, lighting and
proposed trail.fences. They hope to go to bid, in September.
Ed Benson, 1028 Westwind Way, addressed the Commission and urged the
Commission to avoid approving a plan that would give no opportunity to make
improvements after an initial usage period. He recommended the park be designed
and developed in three stages, the first being access roads, parking and the public
promenade along the top edge of the bluffs. The second stage would result from
changes determined from usage experience. The third stage would implement public
• comfort items, such as benches, shade structures, etc.
Michael Lindsay • addressed the Commission and supported the plan with two minor
exceptions concerning seed mix and plant selection.

Charles Vandervort, 1147 Pembroke Lane, addressed the Commission and
recommended the 2 rail wood fence be used for children and animal safety.
Elaine Linhoff, 1760 E. Ocean Boulevard, addressed the Commission and stated she is
pleased with the overall plan. She prefers a lower fence to retain views and pointed out
the importance of maintenance since it will take a period of time before the native
growth is established. She also questions the necessity of lighting since it would
detract from the feeling of a view park.
Jan Vandersloot, 2221 16th Street, addressed the Commission and recommended the
park be kept natural along the lines of SPON's plan. He requested the plants be native
to the Orange County area and that a maintenance plan be written into the contract.
He also requested that the Olive Trees not be destroyed and that the fence be 3' high.
There being no further public testimony, Chair Schonlau closed the meeting to public
hearing.
• Commissioner Glasgow stated it concerns him that the Commission is just starting to
hear input from other groups. He pointed' out the need to hear from representatives of
the entire City, not just one group. He recommended the park be developed in stages
and that he would support the lighting and the use of more grass areas.
Commissioner Bonner moved to recommend to Purkiss Rose RSI lighting and a fence
design that is inconspicuous, unobtrusive and with the least view blockage subject to
the Risk Manager's evaluation. The motion was carried by the following vote:
Ayes: Beek, Bonner, Compton, Demmer, Dunn, Glasgow and Schonlau
Commissioner Compton moved to recommend adding benches at the park. The motion
carried by the following vote:

Item #11 - Tree Removal at 280 Evening Canyon Road
Ed Jacklin, 280 Evening Canyon Road, addressed the Commission. Mr. Jacklin
requested the Coral Tree be removed due to its destructive root system which has
broken the gas line, meter box and driveway. In addition, two large branches broke,
narrowly missing his house and a car.
• Commissioner Beek moved to approve the removal of the Coral Tree at 280 Evening
Canyon Road and that a 24" box container tree be planted at City expense. The motion
carried by the following vote:

Item #12 - Council Policy G -1. Retention or Removal of Park and Parkway Trees. and
Council Policy G -3. Preservation of Views
Director Niederhaus reported that the proposed revisions to Council Policies G -1 and
G -3 are being revised and that this item will be addressed at the Commission's August
6 meeting.
Virginia Herberts addressed the Commission and stated she feels the public should be
able to provide input on tree policies. She requested'the Commission's Tree
Committee be reinstated.
Item #13 - Application from Balboa Theatre
Commissioner Compton stated he felt the area merchants should be allowed to provide
input on this matter.
• Following a brief discussion, Commissioner Beek moved to accept the application for
the Balboa Theatre to be placed on the City's Register of Historical Property under
Classification #3 unless corrected. The motion was carried by the following vote:
Ayes: Beek, Bonner, Demmer, Dunn, Glasgow and Schonlau
Abstain: Compton
Item #14 - Notice from Newport -Mesa Unified School District
Director Kienitz reported the Newport -Mesa Unified' School District's declaration of
surplus property is a routine requirement. The Recreation ,Division is in need of a
gymnasium, however, there are no funds designated in the Capital Improvement
Projects.
Commissioner Glasgow moved that staff provide more information as to costs, etc., and
report back at the Commission's August 6 meeting. The motion carried by the following
vote:
Ayes: Beek, Bonner, Compton, Demmer, Dunn, Glasgow and Schonlau
• Item #15 - Recreation,and Open Space Element
Commissioner Compton reported the Park and Open Space Committee received three
bids for a recreation survey to be reviewed as part of the revisions to the General Plan.

DLG Marketing Research was the lowest bid and the committee met with Deborah
Goff in.
Commissioner Compton presented the proposed questionnaire which will be done by a
telephone survey to 550 people, approximately 6 minutes each. The 550 replies will
assure a statistically valid consensus.
Following a brief discussion, Commissioner Compton moved to accept and proceed
with the survey as written. The motion carried by the following vote:
Ayes: Beek, Bonner, Compton, Demmer, Dunn, Glasgow and Schonlau
VIII. FUTURE AGENDA ITEMS
Future agenda items will include Review of Subcommittees and Committee Reports.

Re. Castaway Park Development
At your Tuesday Evening Commission meeting
of July 2nd, a disecusion ensued between Commission Members and the Park design team
regarding the Park details after the Public comment period had closed which precluded
any additional Public comments on the points under discussion. Therefore we are taking
this means to forward for your consideration some design ideas we had in mind.
With regard to the Promenade lighting, the lower the lighting fixture the less vulner -
able it would be as far as vandalism. For example 2411 instead of 42 ". The light pattern '
• can be adjusted by the light fixture used.
•
As to the safety barrier along the Public Walk, we would suggest consideration of a
continuous Hedge type planting instead of the stable corral type railing. There are'hedge
type plants that when grown to maturity are practically impenetrable. Such a semi - safety
barrier would no doubt be less costly. It would' provide a more natural Park appearance and
would provide a more pleasant appearance for the Public using the walkway as well as the
Homeowners that would flank the Promenade. There would be some periodic clipping to
maintain a givem heighth* this would only be necessary on the top of the Hedge when it
reaches maturity, certainly not on the sides of the hedge,, especially so on the side facing
the Bay.
We offer the above ideas for your consideration and suggest they be passed on to the
Castaways design people.

Dear Commission Members:
The Board of Directors of the Balboa Peninsula Point Association
(BPPA) wishes to express their thanks for the attention the
Commission paid to our concerns about the replacement bench in
• West Jetty View Park.
We are pleased that a bench similar to the one which was removed
will be installed.
The BPPA is especially appreciative of the new policy adopted by
PB &R which informs neighborhood associations and other parties
potentially impacted by a change being considered by PB &R before
the change is actually made. This policy will save much
misunderstanding in the future.
Please pass our thanks on to the staff members who work with
PB &R. Their attention to our concerns is deeply appreciated.

Park Division Activities
1. Staff continued coordinating with th e

Boulevard, Bob Henry Park, El Paseo- Storm Drain, Castaways Park, Seashore
Drive street end improvements from 51st Street to 55th Street, and Manning
Tract Park with the Public Works Department.
3. The annual turfgrass renovation program continued throughout the Parks
system.
4. Field renovations continue at City athletic fields in preparation for the
upcoming soccer and football seasons. Staff has also been coordinating with A. Y.
S. O. for soccer field turfgrass improvements by contract services at Lincoln
Athletic Center. The cost of these improvements is approximately $24,000 and
will be funded by A.Y.S.O..
5. The Capital Improvement Project for the removal of the track at Lincoln
Athletic Center was completed by contract services.
6. Staff performed traffic control for the recent Bastille Day running events that
were held in the airport area.
7. The replacement of shrubs and ground covers was completed at various sites
in the Park system.
8. Staff continued coordinating the annual control of rodents by contract services
at various sites throughout the Park system. The rodent control is necessary for
public safety at City facilities.
9. Staff continued coordinating between the City tree trimming contractor, West
Coast Arborists and the City median and roadside contractor, California
Landscape Maintenance for the installation of recycled wood chips in planter
• areas located in median and roadside locations for weed control and water
conservation.
10. Tom Diaz, Sprinkler Systems Technician, was nominated by his supervisors
and selected as the General Services Department's "Employee of the Quarter"
award recipient for his dedicated work perfomance.
Upcoming Activities for August
1. The turfgrass renovation program will continue throughout the City in
preparation for the 1996 Football and Soccer Seasons.
2. The planting of replacement shrubs and ground covers will continue City-
wide.
3. The installation of recycled wood chips in median and roadside planter areas
will continue throughout the City.
4. Rodent eradication at various sites will continue by contract services.
5. The aerification and application of soil ammendments by contract services will
be completed at Lincoln Athletic Center.
Tree Division Activities
• During the month of July, 1381 trees were trimmed, 9 trees were planted, 24
trees were root pruned, 22 trees were removed, 6 emergency calls were
responded to regarding trees and 302 tree maintenance requests were received
by the Urban Forester.
1. Tree removals were performed at these various locations during the month:
421 Poppy Avenue - 1 tree removed due to property damage. No replacement
tree planted due to location.
1524 Anita Lane - 1 tree removed due to property damage. No replacement tree
planted due to location.
310 Poinsettia Avenue - 2 trees removed due to property damage. No
replacement trees planted due to location.
1600 Kent Lane - 2 trees removed due to property damage. Two replacement
trees planted.
222 Evening Star Lane - 1 tree removed due to property damage. No
replacement tree planted.
• 280 Evening Canyon Road - 1 tree removed due to property damage. One
replacement tree planted.

SUBJECT: Monthly Commission Report
Youth Sports and Field Renovation - To make much needed improvements to existing youth sport
ballfields, the Community Services Department is working with General Services, NMUSD and
AYSO Soccer - Region 57 to accomplish a major field renovation project in preparation for the
upcoming fall soccer season. The project utilized both approved CIP funds, Project No. C3170045,
and AYSO funds and involved both Buffalo Hills (and Andersen School) and Lincoln Athletic
Center. It includes replacement of the Lincoln track with turf, and replacement of the turf on -most
areas of five soccer fields. AYSO's has agreedto contribute approximately $24,000. The results of
this project will be more practice area and higher quality playing fields.
In a related item, starting August 5 Newport Beach Little League will be using their own funds.to
refurbish the baseball infield at San Miguel Park. This project comes as a follow up to similar
• projects at Lincoln and Buffalo Hills completed last February. Little League's total commitment
for these three fields will be approximately $40,000.
New Staff Member - We are pleased to welcome a new member to the front office staff. On July
15,.Kathy Coulter became the Senior Administrative Clerk for the Recreation Division. Kathy will
be processing revenue, class registration and special event ,permits and overseeing the day to day
operation of the Recreation Office. Kathy brings with her an excellent work background and a
superior knowledge of Newport Beach, having grown up here and previously worked for the city
for over 10 years. Even though staff made a great effort to compensate for the staff shortage
during the last three months, office efficiency will improve with full staff complement
Contract Classes - The summer quarter looks as if it will be one of the better summers with 15,000
registrations for the month of July alone. The camps are doing very well, with several phones calls
from parents complimenting the baseball, basketball, soccer and rollerhockey camps conducted by
Skyhawks Sports Academy. My Little Pony class, Surfing, and Beach Camp continue to be some
of the more popular classes, with an average of 30 children per week. Some new interesting classes
include sign language with 10 participants and a landscaping/flower garden class with 12.
Aquatics - The second session of swim lessons has been completed with 230 children registered
and $7,000 in revenue, compared to 209 children and $6,055 in the first session.. The major
summer venue, the Newport Harbor High School pool, is in need of repairs in regard to safety and
• maintenance concerns. Staff will be meeting with school district representatives to discuss and
identify the needs and, hopefully, plan for future repairs.

Corona del Mar Scenic 5k - Final numbers are in on the Corona del Mar Scenic 5k Run. The event
• raised $34,000, with 2,500 participants. The funds raised have historically been revenue both for
the City and the Corona del Mar Chamber of Commerce.
Balboa Music and Arts Festival - Preparations are underway for the department's next major
special event, the Balboa Music and Arts Festival, scheduled for Saturday, September 21. This
event, in its 5th year as part of Seafest, will be held at Peninsula Park. Vendor applications have
been mailed; 65 vendors @ $75 are expected. There will be food booths and entertainment.
4th of July Event - The 23rd Annual Mariners 4th of July Parade and Picnic was a huge success. It
was estimated that 1500 participants were on hand this year for the festivities, which included the
traditional activities and,an amateur volleyball tournament that attracted 30 teams. The Grand
Marshal of the parade this year was Fire and Marine Chief Tim Riley.
Youth Dro -In n Program - The youth drop -in program sites are averaging 25 plus participants daily.
This year the program includes weekly walking excursions throughout the City' visiting the
Lifeguard Headquarters, Fire Stations, Fashion Island, Sherman Gardens, Tidepools at Big Corona
and the Central Library.
Special Event Permits - The department experienced an unusually large number of Special Event
Permit applications in the month of July. In one week this month 25 applications were received, an
average of five per day. Last year (the heaviest year on record), the office processed 421 permits,
• an average of two per day.
LA Cellular Proposal - L.A. Cellular has approached the City with a proposal for installation of a
telecommunications facility at Bonita Creek Park. The current proposal includes a small building
and adjoining flag pole to be constructed in the northeast end of the park next to University Drive.
Other options have also been suggested. Staff from the City Manager's office, Public Works and
Community Services have had initial meetings with the parties involved and have requested
information regarding environmental impact and financial agreements with similar public agencies.
Staff will keep the Commission apprised of the discussions.
NeWort Ridge Park - With the authorization of the City Council, staff met with the officials of
Merit Property Management, Inc., the firm managing the homeowners association and the two
Master Associations in Newport Ridge and Newport Coast.
The County holds an irrevocable offer of dedication of the Newport Ridge Park. The Masters
Homeowners Association has taken over maintenance of the park, now handled by Merit Property
Management, Inc. No programming of the fields has been undertaken. The tennis courts and
restrooms are key padded to assure use by the members of the homeowners association.
The Master Homeowners Association has received one formal request for the use of the park,
which was rejected. If the City wants the ability to jointly program ballfields, the appropriate
action would be-a formal request to the Master Homeowners Association, citing proposed action or
• activities, with background on number of youth currently served, etc.

SUBJECT: Senior Services Division - Monthly Commission Report
Staff organized a very successful' Senior Resource Fair that was attended by 400
participants. The Fair is intended to allow seniors to learn about products and services that
might be of assistance to them in anon threatening environment. The vendors paid a fee of
$70 to show at the fair and many of them donated an item to be raffled. Their services
ranged from financial services to health food products. Sixty vendors attended.
The newly remodeled billiards room and computer lab was opened and dedicated this
month. The billiards room houses three professional tables and is utilized every afternoon
by a regular group of pool players. The computer lab has six computers which can be used
by people who need to practice or require assistance. CompuServe is donating the use of
• the Internet in this lab. Classes have also been organized for computer instruction. This
remodel was paid for by a charitable remainder trust given to the Friends of OASIS by
Robert Ashton.

A severe transportation crisis has been alleviated by a generous donation from Hoag
Hospital's Community Benefits Program. An additional fifteen passenger vehicle and
driver will be provided for by a contract with Western Transit Systems. This new service
will allow this Division increase to,its transportation services by 33 %. Transportation will
still only be available to City of Newport Beach residents.
Exercise classes continue to be active during the summer months. The water aerobics,
naturally, has quadrupled in size, Tai Chi, aerobics, golf and the walking group are all very
well attended.
The membership for Friends of OASIS continues to grow. Currently, the membership is
5,600. Assuredly, the age of homebound seniors continues to increase and therefore
increasing our numbers of homebound frail seniors who require services of which we
offer.

Recommendation
Approve the installation of a i4" x 20" bronze plaque at Lookout Point to
commemorate Newport Harbor as a State historical engineering landmark.
Discussion
Mr. Lloyd Dalton, Professional Vice President of the Los Angeles Section of the
• American Society of Civil Engineers, submitted the attached request for the
installation of a plaque at Lookout. Point in Corona del Mar to commemorate the
historical engineering and design significance of Newport Harbor.

Staff has met on site with Mr. Dalton and recommends that the plaque be
installed on a concrete pedestal at the site. Additionally, staff recommends, and
Mr. Dalton concurs, that a pahn tree does not need to be removed as originally
requested, since it was recently trimmed and will be trimmed routinely as part of
the Citywide palm tree trimming program.
Since an existing concrete bench will be relocated from West Jetty Park as part of
last month's Commission action, the bench and plaque pedestal can be installed
together into a new concrete pad at Lookout Point.

On February 15th, the California State Council of the American Society of Civil Engineers designated Newport
Harbor as a state historical civil engineering landmark. Such designations are typically memorialized with a bronze
plaque that is usually installed at an appropriate & prominent site near the landmark. Recent Installations have
been in the courtyard of Mission San Juan Capistrano; along the Santa Ana River in Featheriy Regional Park; at
Salinas Dam near San Luis Obispo; at County Sanitation Districts of Orange County offices in Fountain Valley; and
on July 18, 1996, at what remains of W WII's Santa Ana Army Air Base in Costa Mesa..
ASCE has in its posession and has paid for a 14" x 20" bronze piaque,to memorialize. Newport Harbor. ASCE's
History & Heritage Committee feels that Lookout Point in Corona del Mar is the most appropriate & prominent site
to locate the plaque. They ask that the City construct a concrete pedestal for the plaque. Will you do so?
By City mail, I am transmitting to you an aerial photo of the proposed Lookout Point site, photos of plaque
installations at other sites, and a copy of ASCE's details for a concrete pedestal. The pedestal should either be
sandblasted or faced with cobblestone to beautify the pedestal and lessen the probability of graffiti. Please return
• the photos to me after you are done with them.
There is a palm tree that is located on the bluff just behind the proposed plaque site. You will observe from the
aerial photo and onsite inspections that this tree is smack dab in the middle of a potentially spectacular, sweeping
vista of the Pacific Ocean, the harbor entrance, Balboa Peninsula, China Cove, lower'Newport Bay, Balboa Island,
and the City beyond. Don't you agree thatthe site would be much improved if the tree was moved or removed?
Will you do so?
ASCE desires to present the plaque in a meeting of the City Council, then dedicate the plaque in an onsite
ceremony after the Corps of Engineers completes it's east jetty repair contract this summer. it appears that the
presentation and dedication ceremonies would then occur in Sept. or Oct. Our H &H Committee will organize the
ceremonies and invite dignitaries and the media. I will keep you posted as to actual dates of the events.

SUBJECT: Bayside Drive 'Trees
Recommendation
Direct staff to prepare a FY 97 -98 Capital Improvement Project budget
proposal to begin a multi-year landscaping plan for the north side of Bayside
Drive.
Background
On April 2, 1996, the Irvine Terrace Community Association requested the
removal of 23 Eucalyptus trees alongside Bayside Drive. A Fire Department
representative subsequently confirmed the proximity of the trees to the
overhead power lines presented a safety hazard on May 3, 1996. Accordingly,
staff recommended the removal of the 23 trees along with four additional
Eucalyptus trees along Bayside Drive, between El Paseo and Carnation.
The matter was considered by the Commission on June 4, 1996 (minutes
attached).
Staff subsequently received the attached memo from the Fire and Marine
Chief on June 5, 1996 rescinding.the necessity to remove the trees.
Discussion
Staff sent the attached letter to Southern California Edison Company on June
7, 1996 requesting SCE assistance. A verbal response on July 15, 1996
indicated that SCE would only assist in the removal of the trees once the trees
were cut down. No other assistance, such as replanting, irrigation, nor under -
grounding of utilities would be possible. An estimate of $40,000 to $45,000 per
power pole was quoted by SCE staff for the estimate of the undergrounding of
the power lines. There are a total of 12 power poles. The above estimate does
not include the undergrounding of telephone nor other cables that are also
suspended from the power poles and must be undergrounded separately. At a
minimum, the undergrounding of all the utilities is estimated to cost in excess
of $500,000.

There has been considerable opposition to the removal of the trees by Bayside
Drive residents. A total of seven written protests have been received objecting
to the tree removals. Staff has responded by providing written notice to the
Bayside Drive residents of the discussion scheduled for August 6 before the
Commission.
Further discussion with Mr. Val Skoro, President of the Irvine Terrace
Community Association, on July 16 confirmed that the Association no longer
advocates the removal of the trees unless, the area is appropriately
landscaped. Mr. Skoro also noted that the Association would be unable to
financially support landscaping replacement alongside Bayside Drive due to
the Association's commitments on other beautification projects.
Undergrounding of power lines and various cables is normally accomplished in
two ways; Rule 20A funding- or private assessment:
• Rule 20A funding is generated by tax collection that is later allocated on a
per capita basis to cities. Rule 20A funding is presently being used to
underground utilities at Dover Drive and Pacific Coast Highway. As of
January 1, 1996, the City had $89,000 in the 20A account. The allotment
of funds for the year is $319,000. The Dover/Pacific Coast Highway project
will cost $158,000 leaving $400,000 in the 20A account. Rule 20A projects
must be selected and approved by the City Council after evaluation by the
Public Works Department.
• The second alternative for the funding of undergrounding utilities is the
formation of an assessment district. This is a self- initiated project in which
the residents or business owners of an area solicit all residents or owners
adjacent or affected by above ground utilities. When at least 60% of the
residents in a specific geographic area agreed to the process and the
property assessments, City staff coordinates the project to completion.
In the case of Bayside Drive, residents of Dolphin Terrace (Irvine Terrace area)
and Bayside Drive would be the most likely combination to initiate the process.
Unless there is heightened interest in undergrounding utilities by local
residents, staff recommends no further action.
The landscaping along Bayside Drive is sparse and in some cases in distress
due to an incurable blight that is attacking the oleander bushes. At present, a
water truck is used to irrigate the area. The Irvine Terrace Association
advocates that the City should fund improved landscaping.
One possibility would be to consider the programmed replacement (over
several years) and the enhancement of the landscaping with drought resistant
plants.
One landscape plan could be the replacement of every other Eucalyptus tree
with a 36' boxed Carrotwood tree with some shrubbery. This would cost

approximately $ 19,849 and could be initiated in the FY 97 -98 budget proposal
for capital improvements.

Simulated field layouts showed that due to the somewhat limited
space, the contour of the land, the presence of a large drainage
system and lack of existing parking, this would be a very costly
project. Staff was directed to research a rough estimate cost and will
report back to the Commission.
Director Kienitz reported the City Council will review the proposed
budget for FY 1996 -97 on June 7. The KPMG Peat Marwick study
will also be presented. It is of concern that there are high indirect
costs for Recreation and Senior Services, some of which are also
related to other non -City programs. Director Kienitz recommended a
committee be formed to review the indirect costs and how they relate
to fees.
The Commission determined that the committee will consist of
Commissioners Bonner, Glasgow and Schonlau who will review the
study.
Steve Hunt reported the Corona del Mar Scenic 5K Run held June 1
was very successful with 2,450 participants. Over 700 people
registered the day of the race.

Item 46 - Irvine Terrace Community Association Tree Removal
Request
Director Niederhaus reported the Irvine Terrace Community
Association requested 23 Eucalyptus trees on Bayside Drive
between Jamboree and El Paseo Drive be removed due to safety
concerns and their unsightly appearance from trimming for high
voltage clearance. In addition, the Urban Forester and the Fire
Department recommend 4 additional Eucalyptus trees from El Paseo
to Carnation be removed due to the same problems. In the past two
days, eight responses have been received in opposition to the
removals. Staff recommends that since there are no immediate fire
hazards, the item be postponed in order that other solutions can be
researched.
Director Niederhaus explained the Edison Company and' City's tree
trimming procedures regarding the Bayside trees. He stated he
spoke with Edison staff and was told they might participate financially
in replacing the trees with Carrot Wood trees, the designated
replacement tree.

Marcy Lomeli reported that the Edison Company trims the trees
annually for power line clearance and safety, which results in flush
lateral growth encroaching into roadways, blocking signs and
creating hazardous conditions. The City trims the 23 trees at an
annual cost of $1,053, which is outside of'the 3 year trim cycle. The
Eucalyptus tree is the wrong tree for this area since it grows to 60
feet. Cost to replace the trees with 15 gallon Carrot Wood trees
would be $2,565 by contract. Annual cost to water on a weekly basis
would be $2,400. The parkway easement is 10 feet and some
Oleander shrubs are also in the parkway.
In response to a question from Commissioner Bonner concerning the
possibility of underground utilities, Director Niederhaus reported that
an approximate cost estimate could be submitted to the City Council
for a capital improvement project.
Chair Vandervort opened the meeting to public hearing.
Mr. Val Skoro, 1601 Bayadere Terrace and President of the Irvine
Terrace Community Association, addressed the Commission. Mr.
Skoro explained the improvements the Association has completed
and stated they want to work with the City to enhance the area.
Homeowners are concerned over the fire hazards created by the
Eucalyptus trees on Bayside and that they are unsightly and
inappropriate for the. area. They would also support the idea of
underground utilities.
In response to a question from Commissioner Glasgow regarding
cost sharing, Mr. Skoro stated he would need to discuss participating
in funding with the Association.
Commissioner Schonlau recommended all groups involved meet to
determine if there is a potential interest in underground utilities.
Marge Kelso Trevisani addressed the Commission and, presented
pictures showing the telephone cable that runs through the trees
which creates a fire hazard.
Director Niederhaus advised that the telephone cable is very low
voltage and presents no immediate danger. The upper lines,
however, do have high voltage.

opposition to removing the trees. He stated the Association did not

Dr. Jan Vandersloot addressed the Commission and stated he called
the Edison Company and they will be trimming the trees in August.
He recommended underground utilities be installed throughout the
City and'that the trees be retained since this is a "perceived" safety
factor. There is no evidence that this has been a past problem.
Virginia Herberts addressed the Commission and stated the 30 year
old trees have an excellent root system which stabilizes the hill. She
stated she talked with 100 people who opposed the tree removals
and were not aware that this item was to be reviewed. She
recommended that the Association pursue underground utilities as
the Balboa Peninsula Point Association did.
Mrs. Johnson, 504 Begonia, addressed the Commission and spoke
in support of retaining the trees. She feels if the trees are
maintained properly there will be no problems.

Marcy Lomeli presented and gave an overview of a wood product
( Fibar) which is used by 50 private and public agencies in Orange
County. He explained that the product is light weight, does not
decompose or burn readily, and can easily be used in place of sand.
It has a $10 million product liability policy and thus far 'there have
been no claims. The Risk Manager has reviewed the material and
has determined that it warrants further investigation.
Chair Vandervort stated she visited a complex near Harbor and
Adams that uses this product and observed that it gets very hard
after being in the sun, which prohibits going bare foot. Residents
were very unhappy with the product.
Marcy Lomeli explained that some areas need replacement sand
more than others and- the cost for maintaining sand over the years
has increased. The 50 agencies that use the wood product do so for
maintenance purposes.
Steve Hunt pointed out that Fibar is a product which might be
considered in the future for areas with very low use.

Previous written communication between Fire Prevention Captain Steve
Bunting and Park and Tree Superintendent Marcy Lomeli speaks to our belief
that eucalyptus trees have a tendency to be more readily combustible than
other varieties. However, my personal examination of the trees in question
found them well maintained and well clear of any electrical power lines. If
• maintained in this fashion, they will pose no serious threat to accidental
ignition from exposure to arcing power lines.
•
However, uninsulated electrical conductors arcing against dead or dry
vegetation may lead to ignition and cause a fire in the eucalyptus trees. In
strong wind conditions, flying embers from a burning tree could pose a threat
to surrounding buildings, particularly those with combustible roof coverings.
Prudent fire prevention practices, such as proper brush clearance from
electrical conductors, the use of insulated conductors, and /or the relocation of
electrical conductors to the .prevent their contact with the trees, is essential in
reducing this potential.
We do support the replacement of these trees with a less combustible variety.

This letter is in response to our telephone conversation regarding the possible
removal of 23 Eucalyptus trees located in the City right -of -way on Bayside Drive,
between Jamboree Road and El Paseo Drive in Newport Beach (aerial map attached).
The Irvine Terrace Homeowners Association has requested the tree removals due to
their concerns of fire hazard with these trees. However, the attached memo of the
Fire and Marine Chief does not support removal due to fire hazard.
The City has to annually trim the •lateral growth that protrudes into the street due to
the tree topping that Edison routinely performs on these trees. City staff has
• determined the removal cost of the trees to be $4000 (includes stump grinding)
using the City tree contractor. The tree replacement cost including root barriers with
24" box specimens (trees that would only grow to twenty -five feet) would be $4485.
Additionally, the annual cost to water these trees by water truck would be $2400.
The removal and replacement of the existing trees with a smaller variety would
eliminate the annual tree trimming requirements for Edison.
The Park, Beaches and Recreation Commission has directed me to research any
interest by Edison for financial assistance in solving this problem. The long term
benefits would be of mutual concern to both Edison and the City.
Please respond by June 17,1996 so that I may include your response in my report to

Dear Association Member:
As you are aware, your Board of Directors is aggressively pursuing efforts to enhance and beautify Irvine
Terrace. This is reflected by the newly upgraded main entrance for which we have received numerous
compliments. In addition to the main entrance, we are working with the City and requesting that the City:
(1) provide better care and add additional landscaping on the Irvine Terrace side of Pacific Coast
Highway; (2) upgrade the lawn and replace missing Olive trees (with a size comparable to the remaining
trees) on the median strip of El Paseo; and (3) and Implement a landscape plan for the Irvine Terrace side
of Bayside Drive between Jamboree and El Paseo. This stretch along Bayside has been virtually
neglected by the City since the hillside collapsed in the late 1960's.
Enhancement along Bayside Drive could include landscaping additions as well as the removal of the
• unsightly telephone poles and wires by under grounding. Unfortunately, under grounding would either take
a City investment which is improbable at this time due to the status of City finances or establishing a
bonding area which would include adjacent homeowners along Bayside Drive and Dolphin Terrace. This
would entail getting 60% of the,people in the established bonding area, to agree to such an effort. The
cost to each homeowner in the effected area would- as a wild guess, be in the $110,00.00 plus range
which could be paid off (if desired ) by adding it to the property tax bill and with interest be paid off over
time. If residents along Dolphin who are the affected parties are interested in this endeavor please
contact our management company and express your desires. A leader from Dolphin would be needed to
be in charge of such an effort.
As to landscaping along Bayside Drive, the City has been contacted on enhancing the landscaping. They
are due to present a landscaping plan at the August 6, 1996 meeting of the Parks, Beaches and
Recreation Commission which will be held at 7:00 p.m, in the City Hall Council Chambers. Your Board is
advocating a comprehensive overall plan for the landscaping and not advocating going out and chopping
down Eucalyptus trees which would currently leave the area virtually bare of foliage. It is to be,pointed out
that the Eucalyptus trees are currently trimmed under telephone wires and if the wires were, not present
the Eucalyptus trees could grow to 50 -60 feet in height which could have a potential view impact. Your
view points on enhancing Bayside Drive are solicited. 'Please respond to the Association prior to August 6,
1996 so your comments can also be forwarded to the City.

The Mai Kai Community Association is located in the 1200 & 1300 block of Bayside Drive in
Corona Del'Mar.
Reference is made to correspondence (dated July 24, 1996 and signed, by David Niederhaus- General
Services Director) regarding removal of twenty -three eucalyptus trees from the north side of Bayside
Drive.
The thirty -two property owners at Mai Kai are very much interested in improvement of the
landscaping on the Irvine Terrace Association hillside. The Mai Kai Community Association urges
the City of Newport Beach to study and provide the undergrounding of utilities along the parkway,
which have been provided elsewhere on the parkway,
As to the removal of eucalyptus trees, the Association could support this proposal if there is .a
reciprocal agreement by the City and the Irvine Terrace Association for their maintenance of the
hillside landscaping.to lessen risks of fire, soil erosion, water runoff and avoidance of debris. Also,
we would appreciate a review of the existing drainage piping on the slope to ascertain if it is
consistent with code, engineering and safety requirements.

Recommendation
To deny the appeal to remove one Grevillea robusta (Silk Oak) tree at 600
Marguerite Avenue.
Discussion
Staff received a letter dated January 16, 1996 (copy attached) from Mr. Joseph
Orsini requesting the removal of one Grevillea robusta tree, located on Third
Avenue side of his residence due to irrigation system damage.
The Urban Forester completed a Tree Inspection Report (copy attached) and the
Park and Tree Maintenance Superintendent concurred with the report that
recommends that the tree should not be removed. The report further
recommends that the surface roots be root pruned to eliminate the irrigation
problems in the parkway. Mr. Conway sent Mr. Orsini the attached letter, dated
April 2,1996 denying the tree removal and an offer to schedule root pruning at
his residence to alleviate the root problems. Mr. Orsini has elected to appeal this
decision per the attached correspondence dated July 2, 1996.
The same tree removal request was presented to the Commission on December
6, 1994 per the attached agenda report. The Commission at this meeting denied
the appeal submitted by Ms. Barbara Rizzo. The condition of the tree and the
irrigation • system has not changed significantly since December, 1994.

Dear Mr. Conway,
As per our conversation conscerning the silk oak tree
at 600 marguerite, C. D. M., the tree in just the past
lz years has distroyed my sprinkler system in that area.
My plumbing in the house in th@ same location I do not
know Rhat has happened to it. Further more the roots
are growing -under my home. I know the city will pay for the
damage to the sprinkler system (invoice enclosed), and also
possible damage to the water lines in that area, but what
happenes tb this tree affects my home.
The tree is on city property but I believe I have the right
to protect my home.
If you agree to pay for all damages done by this tree please
put in writing with a carte blanch bill or lets remove the
tree and plant one in its place, this will satisfy everyone's
needs at no great expense to taxpayers or myself. If you
wish some signatures from taxpayers let me know because this
can be done.
Saving trees is very important, saving wetlands is im-
portant but we keep loosing them. One tree does not make
a difference when it causes damage.

Staff recommends the retention of the tree in accordance with the attached

to the community.

Recomendation:
To retain the City Silk Oak near the corner of Marguerinte and Third Avenue.
Discussion:
Ms. Barbara Rizzo contacted John Conway, Urban Forester regarding the
removal of City parkway tree, located at her residence due to the tree's root
system . The tree is a Silk Oak (Grevilla robusta) and is actually located on the
Third Avenue side of the property.
• A subsequent field inspection conducted by the Urban Forester on October 12,
1994 (field report attached) recommended not removing the tree for the
following reasons:
a. Tree is mature and healthy
b. Very minimal damage to private and public property
c. Tree is a valuable asset to the community
Mr. Conway's field inspection was then submitted to, the Park and Tree
Superintendent who concurred with the recommendation of not removing the
tree. Additionally, the tree has a value of $ 3,126.98 ( assessment report attached)
and was last trimmed in March, 1994.

• Thank you for your prompt response to my request for the removal of a City street tree. I
continue to feel there is a safety issue with this tree and respectfully request you place this issue
on the agenda of the next meeting of the Parks, Beaches and Recreation Commission.
As mentioned in my previous letter, the tree's root system has pushed the curb out of alignment
and has created a high mound on the easement along my property. My concerns are with the
root system invading my sewer and water pipes, pedestrians tripping over the root mound and
damage to cars by the protruding curb and who bears the liability should any of these incidents
occur.
Please notify me in writing of the Commission's decision. I would also appreciate clarification
with regard to liability should this tree cause damage or injury. I look forward to your reply.

Recommendation
Approve the removal of two Eucalyptus ficifolia (Red Flowering Gum) trees
located at 3500 Ocean Boulevard (trees are actually located on Narcissus Avenue)
provided that the property owner, Mr. Robert L. Wells, pay for the cost of the
tree removals. Additionally, that the Commission accept a donation in the
amount of $2500 for the planting of 25 fifteen gallon trees as part of the City's
reforestation plan.
Discussion
The Public Works Department forwarded an Encroachment Permit to the Urban
Forester for review since the permit included City trees. Mr. Conway completed
the attached Tree Inspection Report and recommended to the Public Works
Department that the, trees be retained (copy attached).
Subsequently, Mr. Wells sent the attached letter and photos dated June 12, 1996
requesting that the trees be removed at his expense due to encroachment into
the five foot set back and root damage. Additionally, he would donate $2500
towards the planting of 25 fifteen gallon trees in the City. Staff further concurs
that significant damage would occur to these trees due to construction and the
set back that is required at the site.
Prior to the trees being removed, staff strongly recommends that Mr. Wells
provide funding to West Coast Arborists for $3155, the cost of two tree removals
and the planting of 25 trees.

I am requesting that you reconsider the removal of the two trees on the west
side of my property. I have enclosed photos so that you may see how far one
of the tree's extends over the existing house, far past the five foot set-
back. The branches would have to be severely cut back in order to facilitate
the new house. There has also been some sidewalk damage.
The small tree is lopsided and has been hit by larger vehicles trying to park.
I have spoken to.all my neighbors to see if there would be any objections to '
having these trees removed, there was none.
I would not only expect to pay for the tree removal, but, also for repairs-to
the sidewalk as well. In addition I would like to donate twenty -five trees to
the city.
The couple next door has just completed their home with the garage entrance on
Narcissus. They have done a beautiful job of landscaping and I would like to
continue with the same theme.
I do hope the photographs have helped and that-.you drill- reconsider. I look
forward to hearing from you.

SUBJECT: Newport -Mesa Unified School District Surplus Property
The Newport -Mesa Unified School District has declared the site at 1601
Sixteenth Street,'Newport Beach, surplus property. Pursuant to Education
Code Section 393615, and provisions of the Naylor Act, Education Code
Section 39390, et sec., the District is offering the property for sale.
The staff of the Community Services Department, aware of the critical need
• for a gymnasium for the City, have investigated the possibilities for
purchase and use of this site for a gymnasium.
Factors to be considered include:
The site would be adeauate for avmnasium and oarkina.
• Newport -Mesa Unified School District site, according to the tract
map, is approximately 48,000 square feet. The District notice lists
the site at approximately one acre (one acre is equivalent to
43,560 square feet).
The West Newport Community Center site, with gymnasium,
classrooms and parking, is 36,000 square feet.
• The Boys and Girls Club site in Eastbluff, with gymnasium,
community room, etc., and some parking, is 26,266 square feet
(.603 acre).
2. Current Use and Zoning of Sale
• The site currently houses inadequate, temporary school office
facilities and parking; it is listed as Governmental Educational

• Institutional Facility (GEIF). It is adjacent to Davis Field of the
Newport Harbor High School and a commercial establishment.
A governmental recreational facility use is not inconsistent with
current neighborhood use.
3. Carol Stocker, Executive Director, Business Services and
Auxiliary Operations, reports that the official 60 days are up
in mid - August.
4. Costs
Site Purchase - The District states that the site has been appraised
at less than $1 million.
Cerritos - The City of Cerritos has built a community gymnasium, a
18,684 square foot project, including one full basketball court, one
full volleyball court, six badminton courts, bleachers with 800
capacity and storage, for approximately $2 million of City
Redevelopment Funds. A joint agreement with the School District
provides for prorating utilization, maintenance costs, etc. See
attached press clipping and cost summary.
Downey - The City of Downey has just broken ground on a
Gymnasium /Activity Center, including renovation of existing facilities,
at a total cost of $1,856,412. See attached.

This 18,684 square foot, multi -use gym serves the City and High School
The City of Cerritos and the ABC
Unified School District opened the
expanded Community Gymnasium at
Cerritos High School on May I, 1995. In
1993, the City Council recognized the
need for a community gymnasium and
approached the ABC School District to
explore the possibility of a joint use ven-
ture. The ABC School District was in need
of a new facility, as gymnasium practice
time at Cerritos High School for boys and
girls teams was at a premium, with some
teams practicing at 6 a.m. and others shar-
ing court time after school.
Through the City's Redevelopment
Agency, more than $2 million was made
available for the 18,684 square foot pro-
ject. The Community Gymnasium features
one full basketball court or two regulation
e courts, one full volleyball court or
o full side courts, six badminton courts,
scoreboards, stereo and P.A. systems,
moveable bleachers (800 seating capaci-
ty), a, motorized mesh curtain, and storage

for both the City and the District.
During the school year, on school
days, the school district operates the gym-
nasium from 8 a.m. to 5 p.m., and the City
Ten
operates the gymnasium from 5:15 to 10
p.m. The City has full scheduling privi-
leges during the summer and holiday
vacations. The City's Leisure Services
Division developed a full program at the
gymnasium for summer, including open
play, clinics, and classes and leagues in
volleyball, basketball, badminton and
table tennis for groups and individuals of
all ages.
The joint use agreement outlines
shared responsibility between the City and
District, prorating all utilization and main-
tenance costs and the District's responsi-
bility for actual maintenance of the build-
ing.
The City of Cerritos now has a plan to
offer a variety of indoor programs and is
currently working with the ABC School
District and Whitney High School to build
another gymnasium. If you would like to

At your Tuesday Evening Commission meeting
of July 2nd, a disccusion ensued between Commission Members and the Park design team
regarding the Park details after the Public comment period had closed which precluded
any additional Public comments on the points under discussion. Therefore we are taking
this means to forward for your consideration some design ideas we had in mind.
With regard to the Promenade lighting, the lower the lighting fixture the less vulner —
able it would be as far as vandalism. For example 2411 instead of 421'. The light pattern
can be adjusted by the light fixture used.
As to the safety barrier along the Public Walk, we would suggest consideration of a
continuous Hedge type planting instead of the stable corral type railing. There are hedge
type plants that when grown to maturity are practically impenetrable. Such a semi— safety
barrier would no doubt be less costly. It would provide amore natural Park appearance and
would provide a more pleasant appearance for the Public using the walkway as well as the
Homeowners that would flank the Promenade. There would be some periodic clipping to
maintain a givem heighth. this would only be necessary on the top of the Hedge when it
reaches maturity, certainly not on the sides of the hedge, especially so on the side facing
the Bay.
We offer the above ideas for your consideration and suggest they be passed on to the
Castaways design people.

As per our conversation conscerning the silk oak tree
at 600 marguerite, C. D. M., the tree in just the past
1k years has distroyed my sprinkler system in that area.
My plumbing in the house in th@ same location I do n6t
know ghat has happened to at. Further more the roots
are growing,-Under my home. I know the city will pay for the
damage to the sprinkler system (invoice enclosed), and also
possible damage to the water lines in that area, but what
happenes to this tree affects my. home.
The tree is on city property but I believe I have the right
to protect my home.
If yOu agree to pay for all damages done by this tree please
put in writing with a catte blanch bill or lets remove the
tree and plant one in its place, this will satisfy everyone's
• needs at no great expense to taxpayers or myself. If you
wish some signatures from taxpayers let me know because this
can be done.
Saving trees is very important, saving wetlands is im-
portant but we keep loosing them. One tree does not make

It was recommended that the consultant be commissioned to draft the
questionnaire with the two Commissioners. The Committee will request
that the Parks, Beaches and Recreation Commission request the $30,000
be transferred from the Tennis and Facility Fund for completion of the

The requirements of the committee for the park were reviewed. Pete

The Park and Open Space Committee of the 'Parks, Beaches and
Recreation Commission met last evening and reiterated their requirements
for this park design. They included'the following:
1. Railing extending the entire length of the park at the edge of the park
above the slope.
2. All plantings to be low maintenance; shrubbery is to be close to the
ground; no trees.
3. View portion to include a cement walkway around the circumference of
the park; one or two benches; water fountain; trash can.
4. Linear portion of the park is to have three or four turn -outs from the bike
trail /access road, which are ADA accessible, and each lead to a
destination bench.
When an architect is selected, we have promised the Board of Directors of
Villa Balboa a meeting, with the architect, the Park and Open Space
Committee, and a representative from the Villa Balboa Board.

PROPOSAL TO DESIGN .A QUESTIONNAIRE
TO BE INSERTED INTO THE NEWPORT NAVIGATOR
The goal of this research will be to identify the residents'
involvement in recreational and leisure -time activities.
Some of the issues covered in the telephone study may be
included, and some additional issues may be added.
The questionnaire used for this study will be 2 -4 pages
long. It will be designed to allow the respondent to mail it
back to the City. Upon completion of the time allowed for
questionnaire return (no more than 1 month) the surveys will
be reviewed for completeness, and if requested, the
open -ended questions will be coded. Also, if requested, the
information will be entered into the computer and data
processed against relevant cross -tabs. The researcher (if
requested) then will analyze the data, compile a written
report, and present the study findings to the City.
The costs for DIG Marketing Research to perform this study
are as follows:
