COMMISSION Meeting March 4, 1997 CITY OF NEWPORT BEACH • PARKS, BEACHES AND RECREATION COMMISSION REGULAR MEETING TO BE HELD TUESDAY, MARCH 4, 1997 CITY COUNCIL CHAMBERS 7:00 P.M. ORDER AND ROLL CALL II. APPROVAL OF MINUTES - Meeting of February 4, 1997 III. PUBLIC COMMENTS Members of the - public are invited to comment on non agenda items. Speakers are limited to three minutes. IV. CONSENT CALENDAR NOTICE TO THE PUBLIC All matters listed under Consent Calendar (1-4) are considered by • the Commission to be routine and will all be enacted by one motion in the form listed below. The Commission members have received detailed staff reports on each of the items recommending approval. There will be no separate discussion, of these items prior to the time the Commission votes on the motion unless members of the Commission, staff or the public request specific items to be discussed and /or removed from the Consent Calendar for separate action. Members of the public who wish to discuss a Consent Calendar item should come forward to the lectern upon invitation by the Chair, state their name and Consent Calendar Item Number, and complete the sign -in card provided at the podium. Speakers are limited to five minutes on agenda items. Park and Tree Division (Report Attached) Report of Park and Tree Division activities during February and upcoming projects in March. 2. Recreation and Senior Services (Reports Attached) Report of activities during February for these two divisions. 3. Bench Donation (Report Attached) • Accept one 6' bench donation from Kay East that will be installed on the lower observation area at Inspiration Point. 4. ADJOURNMENT Item II • CITY OF NEWPORT BEACH Parks, Beaches and Recreation Commission Special Meeting January 23, 1997 - 7:00 P.M. Call to Order The meeting was called to order at 7:10 P.M. Commissioners Compton, Demmer, Dunn, Glasgow and Schonlau were present. 2. Public Comments - None 3. Discussion of the KPMG Cost of Services Study The Commission reviewed the draft letter to the Mayor and City Council from Chair Schonlau on behalf of the Commission. During discussion it was proposed that the level of revenue recovery be 85% for programs in the Recreation and Senior Services Divisions. The Commission also discussed • implementation of a 10% non - resident fee and proposed raising the fee for Senior Services van transportation to $2.00 per person. Motion was made by Commissioner Glasgow to approve the letter as corrected. The motion carried by the following vote: Ayes: Compton, Demmer, Dunn, Glasgow and Schonlau 4. ORDER AND ROLL CALL The Parks, Beaches and Recreation Commission was called to order at 7:00 P.M. Roll call was taken. Commissioners Beek, Demmer, Dunn, Glasgow and • Schonlau were present. Commissioners Bonner and Compton were absent. II. APPROVAL OF MINUTES Commissioner Demmer moved the minutes of the January 7, 1997 meeting be approved. The motion carried by the following vote: Ayes: Beek, Demmer, Dunn, Glasgow and Schonlau Commissioner Glasgow moved the minutes of the January 23, 1997 Special Meeting be approved. The motion carried by the following vote: Ayes: Beek, Demmer, Dunn, Glasgow and Schonlau III. PUBLIC COMMENTS - None IV. CONSENT CALENDAR Commissioner Glasgow moved that the following items be approved except for • those removed from the Consent Calendar. The motion carried by the following vote: 3 Parks, Beaches and Recreation Commission February 4, 1997 Page 2 • Ayes: Beek, Demmer, Dunn, Glasgow and Schonlau Item #1 - Communication Accept and file letter to Mayor and City Council from Chair Schonlau regarding the KPMG Cost of Services Study. Item #2 - Removed from Consent Calendar Item #3 - Removed from Consent Calendar Item #4 - Street Tree Redesignation on Crystal Avenue Approve changing the designated street tree species from Lemon Bottlebrush to Hong Kong Orchid Tree on Crystal Avenue. ITEMS REMOVED FROM CONSENT CALENDAR Item #2 , Park and Tree Division • Referring to Item #9 in the staff report, Commissioner Demmer stated she is very familiar with Dr. Vandersloot's dedication in leading the community's effort in refurbishing Cliff Drive Park. She recommended he receive community recognition for all his efforts and service. Chair Schonlau advised" this matter will be addressed by the Community Service Awards Committee. Item #3 - Recreation and Senior Services Commissioner Dunn pointed out the Senior Services Division's Monthly Activities/Utilization Report is very valuable, however, he recommends that the Case Management Service be renamed and the numeric information be clarified in terms of units, volunteer and staff hours. Commissioner Demmer concurred and explained that a number of years ago each Commissioner was assigned to various recreation projects and that she represented Oasis for four years. Commissioner Demmer clarified the report and pointed out that these figures show a very active and dynamic senior center. Steve Hunt advised that staff will implement Commissioner Dunn's suggestions. • Commissioner Dunn moved that Items 2 and 3 be approved. DISCUSSION ITEMS Item #5 - Statement of Economic Interest Robin Clauson, Assistant City Attorney, addressed the Commission and reported that the City's Conflict of Interest Code has been postponed from the City Council's February 10 agenda to its February 24 agenda. She presented the Appendix of Disclosure Categories, of which Items 2 and 3 pertaining to purchasing and regulatory powers apply to this Commission. Ms. Clauson stated that it is her legal opinion that the Parks, Beaches and Recreation Commission should be included in the City's Conflict of Interest Code in accordance with the provisions of the Political Reform Act adopted by the state in 1974. Commissioner Glasgow disagreed with the opinion, pointing out that this Commission only makes recommendations to the City Council and does not make any final decisions. He also expressed his dissatisfaction with the disclosure • statements which are open to different interpretations. Commissioner Demmer stated that should the City Council approve the City's Conflict of Interest Code, she feels this Commission would be legally responsible to comply with the disclosure provisions. Robin Clauson advised the Commission contact the City Clerk or the Fair Political Practices Commission for further clarification and questions. Following discussion, Commissioner Glasgow moved that it be recommended this Commission not be subject to the disclosure provisions because they do not make any final governmental decisions. Commissioner Demmer disagreed, pointing out that the Commission holds public hearings and contributes to negotiations and policy. Vote was taken on Commissioner Glasgow's motion which carried by the following vote: Ayes: Beek, Glasgow, Schonlau • Nays: Demmer, Dunn I Parks, Beaches and Recreation Commission February 4, 1997 Page 4 • Item #6 - Tree Removal at 439 Irvine Avenue Director Niederhaus presented photos of the subject tree and reviewed Mr. and Mrs. Turner's request to remove the Monterey Pine located in front of Mr. and Mrs. Bubb's residence. The Urban Forester, Marcy Lomeli and he have discussed the matter with both parties. Staff recommends the tree be retained because it is healthy and not causing any public or private damage. The tree is scheduled to be trimmed this year and there are no limbs less than 14' above the height of the right -of -way. The root system of the tree is in the Bubb's front yard. Although there is no evidence of roots on the Turner's property, they have recently put in new landscaping and are concerned the roots will damage their property. Chair Schonlau opened the meeting to public hearing. Nancy Turner, 435 Irvine Avenue, addressed the Commission. She presented pictures of the site and reported that for years no one took responsibility for the tree, however, it has been determined that the tree is on City property. She reviewed her concerns that the roots invade their walkway, patio and pipes. In addition, the pine needles are a dangerous fire hazard; the tree looks diseased; and • trucks hit the large branches that fall into the street. Director Niederhaus explained that the previous root cutting was privately done and the large branches are located by the bike lane and mail boxes which prevent vehicles from encountering the branches. There is no apparent disease and he will contact the Fire Chief concerning potential fire hazard as a result of the pine needles. Director Niederhaus advised that one tree has already been removed, however, the stump remains. A compromise of removing the tree and both stumps was not acceptable to the Turners and Bubbs. In response to a question from Commissioner Demmer who explained the City's reforestation program, Mrs. Turner stated she would not want any replacement trees. John Bubb, 439 Irvine Avenue, addressed the Commission. Reading from a prepared statement, Mr. Bubb stated that they would suffer financial hardship as a result of landscaping if the tree is removed. The tree adds value to their land and he agrees with staff that the tree is healthy and not causing public or private • property damage. 0 Parks, Beaches and Recreation, Commission February 4, 1997 Page 5 • There being no further public testimony, Chair Schonlau closed the meeting to public hearing. Commissioner Demmer voiced her concern over setting a precedent by removing a healthy tree at a neighbor's request unless it is causing public or private damage. Commissioner Glasgow recommended retaining the tree until both parties agree upon its removal or the tree is proven to be, causing substantial damage. Commissioner Dunn moved to retain the tree at 439 Irvine Avenue. The motion carried by the following vote: Ayes: Beek, Demmer, Dunn, Glasgow and Schonlau Item #7 - Proposed Names for the Hoag Linear Park Site Chair Schonlau presented a letter recently received recommending the site be named Tracy Ranae Hays Memorial Park. • Commissioner Glasgow recommended the name chosen be one that easily and quickly identifies the park area. Following a brief discussion, Commissioner Glasgow moved this item be postponed to the March meeting when the Chair of the Park and Open Space Committee can be present. Commissioner Demmer amended the motion to delete Pacific View Park from the list of proposed names. The motion, as amended, carried by the following vote: Ayes: Beek, Demmer, Dunn, Glasgow and Schonlau Item #8 - Balboa Peninsula Planning Advisory Committee Director Kienitz reported that the two documents pertaining to the study were sent to the Commission two weeks ago: The subject was discussed last night and will be addressed at the City Council's Study Session at 4:00 P.M. on February 10. • Commissioner Dunn reported he attended last night's meeting when residents voiced their concerns on the proposed plan. He stated he is concerned about the I Parks, Beaches and Recreation Commission February 4, 1997 Page 6 • recreation facilities, namely the possibility that the Las Arenas tennis courts will be removed and that Peninsula Park will become a parking lot. Upon Commissioner Glasgow's recommendation, Director Kienitz advised staff will prepare a report on usage of the tennis courts, at Las Arenas Park for the Commission's review at their March meeting. Item #9 - Park and Open Space Committee Director Kienitz reported the Park and Open Space Committee meeting was canceled and will be rescheduled. Item #10 - Fee Study for Recreation and Senior Services Programs Director Kienitz explained the report provided is an attachment to the first reading of the Ordinance. The second reading of the Ordinance and the Resolution will be on the City Council's February 10 agenda. Item #11 - Subcommittee Reports • Director Kienitz recommended the Budget Committee meet to review the budget information. Director Niederhaus reported the Tree Policy Committee may need to meet near the end of the month. It is anticipated that the G -1 Policy will be ready for -the Commission's review at their March meeting. The Bob Henry Park Committee will meet February 28. Steve Hunt advised that the irrigation system needs to be completed and tested before the park is seeded. Commissioner Glasgow reported the Community Service Awards Committee will meet to review names for awards which will include Commissioner Demmer's suggestion of Dr. Vandersloot. VI. Staff continued coordinating construction projects regarding MacArthur Boulevard, Bob Henry Park, El Paseo Storm Drain, Castaways Park, Seashore Drive street end improvements from 51st Street to 55th Street, Balboa Boulevard medians between 14th and 16th Streets, the Pacific Coast Highway and Newport Boulevard Bridge/Interchange Project, and Hoag Linear Park with the Public Works Department. 2. The annual turf grass renovation program continued throughout the Parks system. Turf de- thatching continued at several sites by staff. • 3. The replacement of shrubs and ,ground covers was completed at various sites in the Parks system. 0 ►ail 4. Staff continued coordinating the annual control of rodents by contract services at various sites throughout the Parks system. 5. Irrigation renovation and plant replacements were performed by contract in several of the median and roadside areas. 6. Baseball field renovation work was completed Citywide in preparation for the upcoming season. Upcoming Activities for March 1. The turf grass renovation program will continue throughout the City including de- thatching and aerating by staff. 2. The planting of replacement shrubs and ground covers will continue City- wide. 3. Staff and contractors will continue installing recycled wood chips in all planter areas as needed in City medians and roadsides for weed control and water conservation. • Tree Division Activities During the month of February, 5101rees were trimmed, 4 trees were planted, 9 trees were root pruned, 9 trees were removed, 8 emergency calls were responded to regarding trees and 210 tree maintenance requests were received by the Urban Forester. 1. Tree removals, were performed at these various locations during the month: 521 Orchid Avenue - One tree removed due to property damage. No replacement tree planted due to location. 919 Tiller Way - One dead tree was removed. One replacement tree planted. 1500 Anita Lane - One tree removed due to property damage. No replacement tree planted due to location. 1500 Highland Drive - Two trees removed due to property damage. Two replacement trees planted. 2522 and 2526 Irvine Avenue - Two trees removed due to property damage. No replacement trees due to location. 2948 Cliff Drive - One tree removed due to property damage. No replacement tree planted due to location. 1101 Berkshire Lane - One dead tree was removed. One replacement tree planted. 2. The City tree trimming contractor, West Coast Arborists completed scheduled work within the Buffalo Hills and the Westcliff areas. 3. The Urban Forester coordinated the Citywide Sidewalk Replacement Program with The General Services Department Concrete Supervisor and the Public Works Department. This involved the Urban Forester inspecting City street trees as it related to sidewalk repairs. 4. The Leeward Lane sidewalk replacement project will continue on March 31, 1991 and will be coordinated between the General Services Department Concrete Crew and the Urban Forester. The Leeward Lane citizen's committee has been notified of the work schedule which will include trimming of the trees, removing of the hardscape, root pruning, tree stability test, evaluation of potential tree failure, installation of root barrier, and hardscape (in that order). This is the 14th year of the event that draws over 500 children and their parents. Hughes Market and the Eastbluff Village Merchants Association are, once again, sponsoring the event. The first hunt begins at 10:00 A.M.; the final hunt ends at 10:50 A.M. The festivities then continue until 1:00 P.M. across the street at the shopping center. West Newport Community Center to get a Facelift -The department has awarded a contract • to repaint the community center. This much needed project will begin on February 24. Access to the building will be maintained throughout the course of the work. The West Newport Community Center is being repainted in the next few weeks. It is a much needed project and completes other major repairs and general improvements made on the facility in the past months. Access to the building will be maintained throughout the course of the work. The gym continues to be a very busy facility. Monday through Thursday evenings, more than 30 adult league teams play in the gym. Friday evening, volleyball drop -in regularly attracts over 60 participants. On Saturdays, from 9 a.m. to 6 p.m., over 200 players in the youth basketball program utilize the gym. Sunday evenings, the adult volleyball league currently schedules 26 teams. Additional activities include National Junior Basketball's use of the gym every available afternoon for practice and games; seniors fitness classes on Tuesday and Thursday mornings; and rental. activity. Bob Henry Park - The construction of Bob Henry Park continues slowly. The current timeline is for the park to be seeded by March 7. The hardscape is generally complete; the trees and landscaping have been planted. Once the seed gets in the ground, a rough estimate is that the turf will be ready for use in three to four months. The Bob Henry Opening Day Committee has rescheduled its next meeting for March 21 and established a tentative opening day date of July 19, 1997. 15 • Athletic Field Use - The Spring Athletic Field Use Schedule is complete (attached). The result is a very impacted practice and game schedule for youth baseball, girls softball, adult softball and Spring soccer. All youth baseball and softball started practices the week of February 10 with opening days scheduled either March 1 or March 8. Each of these organizations have shown a substantial growth in their registration. This in addition to the establishment of an off - season soccer program have created an incredibly complex scheduling process. Las Arenas. Park - In response to a Commission request staff has attached a report on the general use of the .Las Arenas Park facilities. This includes the four tennis courts and the 16th Street Sailing Base. Lincoln Gymnasium Use - Staff has been informed by the NMUSD that the City's regular use of the Lincoln Gymnasium will be extended until September 1, 1997. The September date will be very helpful for Recreation staff to complete Summer programming. The use of the gym beyond this date is still in question. Pending are also the arrangements with the Eastbluff Boys and Girls Club and • Coastline Community College at Eastbluff School for shared use of their respective facilities in limbo. Davis Cup Returns to Newport - As part of the special event permitting process, Department staff have scheduled a pre -event meeting with Ken Stuart of the Palisades Tennis Club and the promoters for the Davis Cup to be held April 4 -6. Staff will' address the numerous logistical concerns as soon as possible; the most pressing of these being the need for proper Police deployment and shuttle services to ensure a smooth traffic control plan for the thousands of visitors attending this international event. Contract Classes - Class registration in the short month of February kept very busy. The conclusion of the Winter class registrations brought in 525 participants with revenue totaling $28,560. Staff have received positive feedback from the new instructional reading program for children. Our new class on gardening also had a ,good response with 10 people enrolled. Belly Dancing has done well with over 20 people in the last 2 quarters. Newport Navigator - The Spring edition of the Newport Navigator will be mailed out by the end of February. The arrival of this issue is highly anticipated due to parents scheduling opportunities for their children's spring break. The bulk of the class schedule • is set to start the week of March 24. 1b • Aquatics - Preparations are already beginning for summer. Flyers have gone out requesting applications for Swim Instructors and Lifeguards. Interviews are scheduled for April. The annual Summer pool users meeting is scheduled for Monday, March 24 at 6 p.m. at Marian Bergeson Aquatic Center. Lap swimming continues to be a very popular program. This past month there was $6,000 revenue from lap swimming and swim passes. Corona del Mar Scenic 5K - The committee, which has been meeting regularly, will be distributing "early bird" sign up flyers for the Corona del Mar Scenic 5K at the Spirit Run on Sunday, March 23. Pacific Symphony performed for their enjoyment. This event has steadily increased in its popularity over the years, possibly because of the increasing number of older people in the City. The first round of interviews for.the Recreation Coordinator position were completed by an outside panel of professionals in the field of aging. Ten applicants were invited. The panel ranked the applicants qualifications and finished with four in the top range. These four candidates will be given a second interview by LaDonna Kienitz and Celeste Jardine -Haug. • The Division staff has been incredible in their way of dealing with the added duties. r1 U After a 3 week break, Coastline College classes are back in.session for the spring semester. One of the most well attended classes is "Stocks, Bonds and Beyond." Seventy five people are enrolled in this class which helps people to understand the ins and outs of investments. There is absolutely no selling, marketing„ or recommendations made. The instructors work for Coastline College. Other classes include Aerobic Exercise, World Geography, Ceramics, Explore the World, Landscape Painting, Chair Exercise and Healthy Eating. We are very grateful to Coastline for providing the Center with this diverse array of courses. These classes will end in May. The computer Friends group still is attracting a gathering of 110 people at their monthly meetings. Every second Wednesday the Center is hopping with people eager to gain some computer knowledge. This activity is planned by a small group of volunteers and is coordinated with the help of our staff. Room 1AB has completed a remodeling project funded by CPI. The room, which has an adjoining kitchen, was in bad shape. Tenant Works, a local contractor, completed the work in a timely fashion with much attention to detail. Next month we will be holding our annual Volunteer Recognition Tea which will be held on Monday, March 24. Plans are underway for the annual Health Fair. The time requested is 30 minutes before dark to 8:45 p.m. The request results from the great demand for practice and regular game times. The Commission has taken action on this issue on two previous occasions. On November 1, 1994 a staff report which included the statement "No lights are utilized Friday, Saturday and Sunday evenings as concession to the residents to ease the lighting use concerns" was accepted as department policy. On September 5, 1995, the Commission • granted an exception for AYSO, to permit them to use the field lights at Lincoln on Fridays from September 8 to December 1. • This year staff permitted, on an interim basis, the use.of these field lights for February 21 and 28 only. Staff recommends that the recent request of Newport Beach Little League be granted for the period of March 7 through June 6, 1997. Field usage is at a premium and Lincoln's lighted fields are a very valuable resource. The key card system that monitors the use of the lights to only those who are authorized has greatly improved the situation with residents. This eliminates the burning of field lights when there is not a scheduled group present. She stated the lights are often on after 10:15 P.M. and she feels 9:00 -9:30 P.M. is a more reasonable hour. In addition, practice sometimes starts at 6:30 A.M. Karen Kopicki, 10 Crest Circle, addressed the,Commission and requested the activities start later in the morning and' end earlier in the evening. She stated more neighbors would have been present had they known about tonight's meeting. Terry Coville, 2481 -A Irvine Avenue, addressed the Commission on behalf of Orange County United Soccer Club which utilizes the fields. Mr. Coville explained their program and stated their coaches are all informed of the rules. He agreed access to the timer is too easy and that unauthorized people use the fields. He asked thavany complaints concerning their program be directed to him. In-response to a question from Commissioner Grant, Mr. Coville stated their group would help contribute towards a better timing device. Pat Beek, 528,S. Bay Front, addressed the Commission. Ms. Beek stated she is President of Newport Beach East Little League and explained their program which starts the end of February. They supply trash receptacles and instruct their managers on the use of the lighting system. The area closest to Pacific View is used'by the younger children whose parents are more energetic and vocal. They hold a mini parade by special event.permit on opening day,.March 11, and use no whistles except on closing day. Russ Hardt, 1943 Port Albans, addressed the Commission '1 on behalf of AYSO. Mr. Hardt explained their schedule, noting that players arrive at 7:30 A.M. for 8:00 A.M. J games. He pointed out their participation has increased to 1,350 and field space is at a premium. Item #11 - Request for Replacement of Palm Trees Marcy Lomeli reported that Larry Schmitz of the Lido Sands Community Association contacted the Department requesting the existing Windmill Palms adjacent to the Sound Barrier Wall at PCH and Balboa Boulevard be replaced with Queen Palms. Soil conditions cause the Windmill Palms to deteriorate more than they would affect the Queen Palms. Larry Schmitz, 4901 Lido Sands Drive, addressed the Commission and stated their second request, which would be at -no cost to the City, involves the area the Association maintains outside the Sound Barrier Wall adjacent to the sidewalk. Request is made for the City to remove the two Windmill Palms and exchange them for two Queen Palms. Item #5 - Lincoln Field Lights Recreation Manager Steve Hunt gave an overview of the report submitted and stated that AYSO is requesting to use one lighted soccer field during the fall at Lincoln on Friday nights from approximately 6:00 P.M. to 7:30 P.M. Current guidelines are that no lights are utilized Friday, Saturday and Sunday evenings to ease the concerns of the residents. Key cards are issued to users in order that lights are turned off five minutes after a game is concluded. Item #6 - Recreation and Open Space Element Commissioner Compton, Chair of the Park and Open Space Committee, reported the committee met with Gail Pickert, consultant, regarding documentation for the General Plan. Commissioner Compton presented a report entitled Development of the Revision of the Recreation and Open Space Element which he reviewed for the Commission. Commissioner Glasgow and he met with the City Manager who told them that there may still be some minor changes in the use of the parcels. He recommended moving forward on conceptual plans for Bay View Landing, Freeway Reservation, Newport Village and Cal 3 Trans West. Lincoln Lights and Activities Reduction Request The Parks, Beaches and Recreation Commission received the following report at their November 1, 1994 meeting: The Lincoln Athletic Center under went refurbishment for six months in 1989 culminating in the facility utilized today. The facility, includes two baseball /softball lighted diamonds, two tee ball fields, three full sized soccer fields (two of which are lighted) and two mini fields and improvements to the gymnasium. . Following the relighting of the field lights, which had been dark during the construction period of six months, staff, commissioners and residents worked together to improve the negative effects of the revitalized lights. The lights were re -aimed and shielded. Hours of use were cut back. New timing clocks were purchased'to better control the light use. Each field was individually.lighted so that if only one field is in use, the whole facility is not lit up. Additionally, another timing mechanism was located outside the main electrical box which may be controlled directly by the field user. It may be both turned off and on. Both field lights are on a master override system which automatically shuts down at the designated'hour. The current schedule is attached. This, of course, does not include the school schedule. As you are aware, Lincoln School is a functioning elementary school on the fields prior to 3:00 P.M. Monday through Friday. Soccer season has just begun. They are practicing or playing games six days each week on the three fields and six days on the two mini fields. The City's adult softball program utilizes field one (the field closest to San Joaquin Hills Road) Monday through Thursday evenings until 1.0 P.M. Field two's lights are utilized by the Orange Coast United Soccer Club Monday through Thursday up to 10 P.M. 3A . No lights are utilized Friday, Saturday and Sunday evenings as a concession to the residents to ease the lighting use concerns. a) Specifically, in response to Mr. and Mrs. Kopicki's proposed controls: 1. Field lights are currently scheduled Monday through Thursday evenings. The lights are out by 10:15 P.M. on Field 1 or sooner on Field 2. 2. Saturday play begins at 8 A.M. and concludes between 2 P.M. and dusk. Currently, teams are not allowed to begin play until 8 A.M. 3. The two fields referred to as make shift fields are designated as mini fields for the very youngest players. During the baseball season these are the tee ball fields. 4. Amplified sound is used rarely during the Little League season and only with the Community Services Department approval. Whistles are utilized by the soccer coaches and referees and are essential to controlling a game situation. A suitable substitute for a whistle has yet to be developed. 5. No events are scheduled for Sundays on an on-going, basis. Traditionally there are two dates in November in which AYSO will utilize the fields on Sundays for playoff games. I appreciate this notification • and am eager to work with the City to finally complete this project. My conversation with Marcy raised a couple of questions on which I would like to get some clarification. At the last Park, Beaches and Recreation Meeting which we attended regarding the Leeward Lane trees (December 3, 1996) we were left with the impression that there would be another public hearing prior to the commencement of any further work relating to these trees. Marcy indicated that currently there are no plans to put the Leeward Lane tree matter on the commission's agenda pxior to the commencement of the work scheduled for Much 31'. Could you please notify me as to whether or not this matter will be on the agenda for the March meeting. As you will recall, our concern at the December meeting was that the City had decided to remove trees in the parkway based on the request of the property owner and not based solely on the structural integrity of that tree (I have enclosed your memo relating to this matter which states this position). Marcy indicated that the scheduled work is for ALL the remaining trees in question, and that the fate of each tree will be based on the pilot program to which both the residents and the City have agreed. That is, after removing the damaged hard scape and pruning the necessary roots, the tree will be tested for its integrity, and if stable, that tree would remain. Is this your understanding? In any event, one of the critical aspects of the program of cbecking each tree was to allow us the opportunity to observe the testing for the stability of each tree_ The last time we didn't have the opportunity to observe the pilot program and I strongly request that prior to the work commencing at the end of March, that we be notified ahead of time of the exact date and approximate time when the work is scheduled so that we can plan to have representatives from the street there to observe the testing. The sequential work on Leeward Lane is to begin with tree trimming the week of March 24, then removal of the hardscape on March 31, root pruning, tree stability tests, root barrier installation, and new hardscape installation. The City will determine the necessity to remove a tree or retain it based on the stability test. No tree removals are anticipated unless otherwise determined by the stability test.
