The Parks, Beaches and Recreation Commission was called to order at 7:00 P.M. Roll
call,was taken. Commissioners Beek, Dunn, Glasgow, Pfaff, Phillips, Schonlau and Skoro
were present.
II. APPROVAL OF MINUTES
Commissioner Glasgow moved the minutes of the regular September 2, 1997 meeting
and the minutes of the joint meeting with Costa Mesa Parks, Recreation Facilities and
Parkways Commission on September 23, 1997 be approved. The motion carried by the
following vote:

Item #1 - Park and Tree Division
In response to questions from Commissioner Beek, Marcy Lomeli explained that the turf
grass being aerated and fertilized during October are on non - active fields. Field lines are
initially burned and then painted as part of the installation process.
• In response to a question from 'Commissioner Skoro, Director Niederhaus advised that
Eucalyptus trees will be planted in the parkway along the east side �of Dover Drive
adjacent to Bob Henry Park in October.

In response to a question from Commissioner Glasgow, Director Niederhaus advised that
the Public Works Director is pursuing recognition of the Commission at the new
Castaways park site. He will keep the Commission informed on this matter.
Director Niederhaus corrected the report submitted under Tree Division Activities. No tree
will be removed at 1909 Commodore Road and a second Ficus tree will be removed at
2711 Harbor View Drive due to extensive sewer damage.
Item #2 - Recreation and Senior Services
Director Kienitz presented the list and descriptions of the proposed new winter classes.
She also announced that the new Recreation Manager, Andrea McGuire, will be starting
with the Department on October 27.
Item #4 - Revised Bench List
Commissioner Skoro reported that the Liaison Committees of the Arts Commission and
this Commission met: and recommended the Brooks /Quick Crete bench be deleted from
the official bench list.
Director Niederhaus pointed out that the Brooks bench is a design that costs $350 and is
• environmentally friendly as it is constructed of recyclable materials. He commented that
donors should have a choice that is not limited to more expensive benches.
Commissioner Skoro moved to eliminate Design #1, Brooks, for use at Inspiration Point,
but retain it on the official bench list; and that Design 95, Infinity, be the designated bench
used on the lower level of Inspiration Point. The motion carried by the following vote:
Ayes: Beek, Dunn, Glasgow, Pfaff, Phillips, Schonlau, Skoro
Commissioner Pfaff moved to approve Item #1 as corrected, Items #2 and #3. Motion
carried by the following vote:

V. DISCUSSION ITEMS
Item #5 - Renovation of Bayside Park Playground
Marcy Lomeli reported that this is a renovation project listed in the capital improvements
list for this fiscal year. He introduced Bob Pedersen, design architect, who explained the
existing condition of the playground in the park and those areas which are currently
hazardous. The renovation will replace the play equipment which is safety deficient in
addition to providing better landscaping. Included in the project are replacing the railroad
ties with a concrete seat wall; replacing the blacktop walkway with concrete and replacing
• the play equipment.

is Marcy Lomeli added that Steve Hunt is scheduling meetings with the neighborhood
groups before the project is scheduled to commence this spring.
Item #6 - Recreation and Coen Space Element
Larry Lawrence, consultant for the project, addressed the Commission and gave an
overview of the four major chapters. Chapter 3 is the major text portion of the Element
which addresses the goal of the Recreation and Open Space system to meet the
recreational needs of the City's citizens and enhance the recreation and environmental
resources of the City. The Objectives include Recreation Programs, Parks and Play
Fields, Shared Facilities, Marine Recreation, Coastal Access, Scenic Vistas and
Resources, Trails and Bikeways, Facility Signings, Environmental Resources, Operation
and Maintenance, Annexation and Funding. Each of the Objectives is followed by policies
and methods of implementation.
Following a review of Chapter 4, there will be public hearings on the entire Element before
it is adopted by the Commission and forwarded to the City Council.
Item #7 - Harbor View Hills South Homeowners Association Reforestation Request
Director Niederhaus gave a brief history of the reforestation request submitted by the
Association and explained that this is their first request which involves removing 21 trees
• and replanting 16 replacement trees with 15 gallon Little Gem Magnolia trees. Five trees
cannot be planted due to the location of utilities. The cost is estimated to be $7,800,
which will be borne by the Association.
Chair Schonlau opened the meeting to public hearing.
Yvonne Houssels, President of the Harbor View Hills South Homeowners Association,
addressed the Commission and explained this is the first of three phases to reforest their
area due to liability and damage caused by the tall Eucalyptus trees.
Dr. Jan Vandersloot addressed the Commission on behalf of SPON. Referring to Policy
G -1 which addresses replacing tree removals, Dr. Vandersloot questioned losing 5 trees
as a result of the proposed project.
Director Niederhaus explained that the 5 trees cannot be replaced since staff has deemed
the locations unsuitable due to hardscape and utility damage. This is in accordance with
City Council Policy G -6.
Following discussion, Chair Schonlau advised Dr. Vandersloot to contact staff regarding
trees that are not proposed to be replaced.
There being no further public testimony, Chair Schonlau closed the meeting to public
hearing.
• Commissioner Glasgow moved to approve the request from Harbor View Hills South
Homeowners Association initiating the first phase of City street tree reforestation that will
be funded by the requesting property owners and the Association.

Commissioner Dunn stated he would not be supporting the motion since he feels the trees
should be more thoroughly evaluated and he did not observe any view or damage
problems.
Commissioner Glasgow's motion carried by the following vote:

Item #8 - Possible Alternative Uses for Marinapark and Las Arenas Park
Chair Schonlau opened the meeting to public hearing.
Mary Moyer, 2157 Miramar and 'President of the Balboa Peninsula Point Association,
addressed the Commission. She stated it was her understanding. that in 1985 when the
current lease for Marinapark was signed that it was the City Council's intent that the
property would be converted to recreational use when the lease expired in 2000. She
urged the Commission to recommend this area be used for parks or that the current use
be retained. She also noted the City Council's goal to generate revenue and pointed out
the Girl Scouts cannot compete against the dollar.
Pete Anderson, 1610 West Oceanfront, addressed the Commission and reviewed the
• three proposals by the City Council. He stated this is an opportunity to create a situation
wherein the entire City will benefit if the area is converted to a park or recreation facility.
He also reported that he rarely observes anything except parties at the American Legion
which provides no value to the neighborhood or the City. He recommended a multi
purpose building, pool, gym or park be implemented foruse by all citizens.

Tom Hyans, 217 - 19' Street, addressed the Commission. Mr. Hyans, President of the
Central Newport 'Beach Community Association; stated their Association supports the
existing facilities. He doesn't agree with the idea of using the area for the highest and
best use of revenue, and urged the Commission become proactively involved.
Commissioner Beek noted that this Commission fully supports open space and
recreational facilities; and that it, is their role to make recommendations to the City Council.
She urged citizens to participate and contact the City Council with their recommendations.
Grace Dove, 117 - 15' Street, addressed the Commission and reported that the removal
of Las Arenas and Veterans Memorial Parks are contrary to the current Recreation and
Open Space Element since, by state law, they are public parks. Ms. Dove suggested the
Commission move to recommend to the City Council that Veterans Memorial Park and
Las Arenas Park, including the Girl Scout House and the Balboa Community Center, be
removed from the Request for Proposals for development of the City property between
1'51" and 19" Streets; and that no further consideration be given to replacing these. facilities
with non - recreation /non- community uses.

• Diane Lugo, 510 Canal Street, addressed the Commission on behalf of retaining the Girl
Scout House. She stated that during September 1,000 girls, consisting of 65 troops, and
262 adults used the facility.
John McDaniel, 1770 W. Balboa Boulevard, addressed the Commission in support of the
public beach at Marinapark which is used by both the Boy Scouts and Girl Scouts.
Martha Durkee addressed the Commission and stated that when she surveyed the Las
Arenas Tennis Courts, they were being used by nine Newport Beach residents and one
Costa Mesa resident. The tot lot was being used by residents from the Point. She urged
the area be retained as it exists since parks are part of the assets of living in Newport
Beach. Should the Marinapark lease not be extended, she recommended the area be
converted to recreational use.
Dr. Jan Vandersloot addressed the Commission and recommended public access to the
beaches be increased so they are more available to City residents.
There being no further public testimony, Chair . Schonlau closed the meeting to public
hearing.
Commissioner Skoro pointed out that quality of life is more important than revenue; and
that there is a need for more park sites and space for an open window to the exclusion of
• hotels and marinas. He recommended the Commission actively support the area for
recreational use and suggested the Chair or Vice Chair address the City Council at their
October 27 meeting to state the Commission's position.
During discussion the Commissioners concurred their position in support of recreation,and
open space, rather than commercial ventures, and agreed their position should be
clarified at the City Council's October 27 meeting.
Commissioner Skoro moved that the Parks, Beaches and Recreation Commission
recommend to the City Council that the area including Marinapark, exclusive of the
American Legion, be used for recreational purposes at the expiration of its lease. Motion
carried by the following vote:
Ayes: Beek, Glasgow, Pfaff, Phillips, Schonlau, Skoro
Nay: Dunn
Item #9 - Subcommittee Reports
On behalf of the Park and Open Space Committee, Commissioner Beek reported that
Evelyn Hart, representative from the Friends of Harbors, Beaches and Parks, will speak at
the next Commission meeting regarding a proposal to improve aesthetics and connect
trails along the beaches as part of a tri- community project.
Commissioner Phillips, reporting for the Marlin Sculpture Committee, stated the Bluewater
• Grill will be contacting Director Niederhaus to pursue placing the sculpture in the Rhine
Wharf area.

VI. FUTURE AGENDA ITEMS
Future agenda items will address Docking Facility at Rhine Wharf Park, Newport Coast
Parks, Newport Coast Annexation, Bonita Village and FY 1998 -99 Capital Improvement
Projects.

Park and Tree Divisions
October 1997 Activities Report
Park Division Activities
1. Staff continued coordinating construction project's regarding MacArthur
Boulevard, Castaways Park, the Pacific Coast Highway and Newport
Boulevard Interchange Project, and Sunset View Park with the Public Works
Department.
2. Staff is coordinating with the Public Works Department Phase II of the
"Green Acres Reclaimed Water Project". The project will route reclaimed,
water to irrigate Bonita Creek and Eastbluff Parks and several of the
Jamboree Road medians.
3. Irrigation ,renovation and plant replacements were completed by staff at
various sites in the Parks system.
4. Staff continued coordinating the annual control of rodents by contract
• services at various,sites throughout the Parks system.
5. Staff is coordinating with the Community Services and Public Works
Departments for the renovation of the sand play area in Bayside Park.
6. An El Nino Storm preparedness plan has been implemented to ensure storm
response readiness procedures for the City Parks system.
7. The root pruning of several trees was performed at City Parks to eliminate
tripping hazards.
8. Turfgrass dethatehing, aerification and fertilization of all parks, facilities,
median's and roadsides, was completed.
UpcominLr Activities for November
1. The planting of replacement shrubs and ground covers will continue
Citywide.
2. Staff will continue to coordinate the installation of recycled wood chips, in all
City medians and roadsides for weedcontrol, water conservation, and recycling
purposes.
• 3. The I.A. Cellular antennae is scheduled to be installed at Bonita Creek Park.

. 4. A handrail will be installed at the Inspiration Point walkway for safety.
5. Staff will continue to monitor the mitigation plan in the Big Mouth Canyon
area. The process includes the maintenance of desirable plant material at the
parkland site.
Tree Division Activities
During the month of October, 1289 trees were trimmed, 2 trees were removed,
1 tree was planted, 18 emergency calls were responded to regarding trees and
227 tree maintenance requests were received by the Urban Forester.
1. Tree removals were performed at these various locations during the month:
1733 Candlestick Lane - One tree removed due to significant hardscape
repairs. One replacement, tree planted.
3221 Seaview Drive - One tree removed due to property damage. No
replacement tree planted due to location.
2. The City tree trimming contractor, West Coast Arborists, completed
trimming several locations within the Newport Heights area. Additionally, the
contractor began trimming City palm and coral trees to reduce potential storm
• damage.
3. The Urban Forester coordinated the Citywide Sidewalk Replacement
Program with the General Services Department Concrete Supervisor. This
involved the Urban Forester inspecting City street trees as related to sidewalk
repairs.
4. The new City Council Policy G -1 requires that notification be made to the
Commission prior to any tree removals 30 days in advance. The following tree
is scheduled for removal in December.
a. Eastbluff Park at Boys and Girl's Club - one tree (Allepo Pine)
recommended for removal due to hardscape repairs. Replacement tree to be
planted in park.
The Eucalyptus erythrocorys (Red -Cap Gum) parkway street trees were
inted on the eastside of Dover Drive between Westcliff Drive and 16th Street

SUBJECT: Recreation Division - Monthly Commission Report
SCMAF Board Member - Steve Hunt, Senior Recreation Manager, has been
elected to the 1998 Southern California Municipal Athletic Federation Board of
Directors. Steve will serve as one of four Directors -at -Large along with the
President, President Elect and Vice President. SCMAF has an annual budget of
over $800,000, with a membership, of over 240 agencies and 800 members that
span from Visalia to San Diego and Santa Barbara to Blythe. The purpose of
SCMAF is to provide and promote training, guidelines and competition for youth
and adult sports. SCMAF involvement greatly benefits the Newport Beach youth
and adult sports programs as well as the Recreation staff.
• The Newport Navigator - The Winter edition of the Newport Navigator is in the
formatting process now and will be ready for proofing within the next week. The
Navigator is scheduled to be out to the public by December 5.
Rent -A -Santa - Tis the season! Community Services is getting ready for the
holiday season with our very popular Rent -A -Santa program. This is a great way
for local businesses or private parties to add that extra holiday cheer by renting a
Santa for a half hour or longer. Currently, staff are contacting all, previous Santas
as well as recruiting for additional people who would be interested in being Santa
from December 1 -23.
Sunset View Park Project - The construction portion of Sunset View Park, Phase I,
is scheduled to be completed by the first of November. The turf areas were
hydroseeded' as of October 24 and'there will be a 60 day maintenance period. If
all goes as scheduled the park will be open to the public in January, 1998.
Youth Sports Commission - Staff has scheduled the semi - annual field use meeting
for Wednesday, November 19, 1997 at 6:00 p.m. Representatives from Parks,
Beaches and Recreation Commission, City Staff, Newport-Mesa Unified School
District and each of the co- sponsored youth sports groups are invited. This
meeting will focus on the upcoming Winter and Spring sports. Those in
attendance will take this time to evaluate the past year and discuss future
• considerations regarding athletic fields and their utilization.

• New Recreation Manager - The vacant Recreation Manager position has been
filled. Andrea McGuire started on October 27. Andrea has most recently been
employed as the Recreation Director for the Ocean Hills County Club„ a senior
community in Oceanside. She will assume the general responsibilities of the
Navigator, contract instruction and class registration, as well as overseeing the
aquatics programs. Andrea has a very rich and diverse professional background
in both the public and private sector. She will make a great addition to the
Department and the City.
1997 Youth Flag Football - The 1997 Flag Football Program is coming to an end.
Division C playoffs will begin on Thursday, October 30 and Division B playoffs,
November 13, with the B Division championship game on November 21. The
winner of each division will move on to the Orange County Municipal Athletic
Association (OCMAA) Regional playoffs on Saturday, December 6 in Garden
Grove. League and playoff games are held Thursday evenings at Grant Howald
Parkin Corona del Mar, starting at 4:30 p.m. The flag football teams represent
players from 5 school sites in Newport Beach: Mariners, Lincoln, Harbor View,
Newport Elementary and Newport Heights.
Newport- Balboa Rotary Club Presentation - The Recreation Staff will be making
a presentation at the Newport - Balboa Rotary , Club on October 29. It will highlight
the City's recreation programs with a slide show and will also include a special'
• thank you to the Club for their support of the Halloween Extravaganza.

Halloween Extravaganza - The 8`h Annual Halloween Extravaganza was held on
Friday, October 31 at Grant Howald. Park from 3:00 to 6:00 p.m. The Rotary
Club of Newport - Balboa ,donated $1,000 to sponsor the event. In addition, the
Club will be assisting with the program by volunteering during the event. The
celebration included carnival games, a costume contest, a cake walk, pumpkin
painting, and much, much more.

Senior Services Division - Monthly Commission Report
October is always busy due to the beginning of the Holiday Season and people returning
from summer vacations. Our classes are going well and the rooms are filled to capacity.
As usual, classes that continue to be popular include computer instruction, all exercise
activities, and art classes. This month a new music appreciation ,class attracted seventeen
enthusiastic participants.
Jazz Concert - The Friends of OASIS once again hosted a very successful concert
featuring The Night Blooming Jazzmen. the Concert, which was held October 12 from 2-
4 p.m. was made possible through the Schonek fund. The tickets were $2.00 for
members of OASIS and $4.00 for non - members. Four hundred people were in
attendance.
• Crime Prevention Lecture - Kathy Lowe, the Crime Prevention Specialist from the our
Police Department, spoke to a crowd of 150 seniors. Her talk centered around ways to
stay safe in your neighborhood and methods of preventing crime. Her talk was
overwhelmingly received by the group. She suggested that we have other officers speak
to the group so that they will be better informed on safety issues.

Tutors Return to Schools - Senior tutors have returned to help out at Ensign Intermediate
School and Harbor View Elementary. This a small program with just a few volunteers,
however, the help that is received is invaluable. the tutors help with math, reading and
English. The tutors not only give assistance, but they receive perks as well. Their perks
are the feeling of being needed and being useful to someone. The wonderful thing about
seniors helping in the schools is that they come with loads of experiences to share and
they are faithful to their position till the bitter end.
Halloween Partv - Staff planned a fantastic party to celebrate Halloween. The event that
was held on October 31 at 11 a.m. included a juggler, a costume contest, a special
performance by Staff and lunch. The lunch was provided by South County Senior
Services that provides our daily meals. A senior hospitality group provided the
decorations. One hundred seventy -five people attended.
Flu Shots Free flu shots will be given to approximately five hundred people age 60 and
older on Saturday, November 1, from 9 -12 noon. The serum is provided by the Orange
County Health Care Agency. Nurses volunteer their time to administer the injections and
are insured by the Health Care Agency.

To accept the donation of two Eldarica Pine trees (Pinus eldarica) and plaques
from Mrs. Frank S. Tallman that will be planted at Mariners Park.

Discussion
• Staff received an inquiry from Mrs. Frank S. Tallman regarding a proposed tree
donation for Mariner's Park.

Subsequently, the donor submitted the attached letter requesting the approval
of two tree donations. Staff feels that the two 24" box pine tree donations will
enhance the Park. The size of the donor plaques will conform to the City
Council Policy G-5 in size, (2" x 6 "), and verbiage.
Mrs. Tallman will receive a copy of this report and a notice of the November 4
Commission meeting.

Recommendation
To accept the donation of two Coconut Palm trees (Cocos nucifera) from Mr.
Ralph J. Velez that will be planted at the Balboa Library. There will be no
donor plaque.
Discussion
Staff received an inquiry from Mr. Ralph J. Velez regarding a proposed tree
donation for the Balboa Library.
Subsequently, the donor submitted the attached letter requesting the approval
of the donation of two trees. Staff feels that the two palm trees are
outstanding specimens and would enhance the facility. The palms would be
planted in an existing planter on the west side of the building. Additionally, the
Chair of the Board of Library Trustees as well as the Director of the
Community Services Department concurs with the donation.
Mr. Velez will receive a copy of this report and a notice of the November 4
Commission meeting.

It has come to my attention, that several years ago, your dept. planted several
coconut palms on the Balboa peninsular. I must tell you that Newport Beach is famous
the world over within the International Palm Society membership. The International
palm Society is an worldwide organization dedicated to the growth of knowledge and
appreciation of palms in the public and private sector. The coconut palm on the 2400
block of Coast Highway is famous for being the oldest most Northerly grown coconut
palm tree in the world. This year, for some reason, it looks truly magnificent; as if it were
growing in Miami or Hawaii.
Because of the fact that this palm has done so well, and that your city has
demonstrated a keen interest in the world of palms, I would like to donate to the city of
Newport Beach two coconut palms, one being approximately 8' high:
Mr. Lomeli, I must say, that in all the years I have tried to get public officials on
the local city and county level interested in planting sub tropical trees, primarily palms, it
has been terribly unrewarding. The main interest has been on the Eastern look with an
emphasis on low maintenance. Sycamores and pines, to me, do not and should not
symbolize California. Newport Beach is on the right track and we encourage you and
hope there is even more expansion of the use of the more unusual palms within the city.

'condition due to the extreme seacoast exposure and is in need of replacement.
The bench style will be the Infinity model which was recently approved by the
Commission as the replacement bench for the site.

requesting the donation of plants for the California native slope at the west
side of Cliff Drive Park. Additionally, SPON will furnish the volunteer labor to
• plant the Poppy seeds and various shrubs in this area.

SPON would like to continue our annual replanting efforts at Cliff Drive Park to fill out the
remaining empty spaces with native plants and to strive to add' more color to the native plant
palette. With this In mind, we would like permission to plant $200 worth of native plants this
winter, as well as to spread poppy seeds along the walkways and also along Avon Street, to
add some color in front of Avon Creek and throughout the park. The $200 contribution has
been approved by the SPON Steering Committee, and volunteers will begin planting after
some rain has softened the ground. The plant palette will be consistent with the plan as laid
out by Ann Chrlctoph. We thank you for your allowing us to continue with this public-private
park endeavor,
We would also like to ask that your staff try to eliminate the giant wild reed (Arundo donax),
that exists along Avon Creek towards the western and. This is the big bamboo plants that
choke off the creek (not the cattails and rushes which are good). The staff did most of it in the
past few weeks, but the remaining plants will quickly grow back.

Subject: Tree Removals Appeal
Recommendations
To deny the unauthorized removal by a resident of three Lemon Gum (Eucalyptus
citriodora) City parkway street trees at 1737 :Antigua Way and require the full
reimbursement of $9,344.88 to the City by Mr. Robert E. Anderson.
To require that Mr. Anderson remove the four Liquidambar trees in the City
parkway that he has planted subsequent to the removal and replace with a single
specimen of the designated street tree at a later date.
Discussion
• Mr. Robert E. Anderson of 1737 Antigua Way requested the removal of three City
parkway street trees per his letters dated July 1 and 9, 1997. (Attachment A and
B) Informationally, one other Eucalyptus tree was removed by the City at this
address in 1996, per City approval, due to significant hardscape damage and
replacement.
The Urban Forester and Park Superintendent reviewed the request on site per the
Tree Inspection Report (Attachment C) and found three healthy tree specimens
and no significant damage to warrant any tree removals. Subsequently, the
Urban Forester sent a letter dated July 21, 1997 (Attachment D) denying the tree
removals. Additionally, the letter stated Mr. Anderson's recourse for appealing the
matter to the Parks, Beaches and Recreation Commission. Mr. Anderson sent a
letter dated July 26, 1997 (Attachment E) acknowledging ,the City's decision to
retain the trees and asking for consideration of the removal of only one tree.
On August 11, 1997 -the Urban Forester received a telephone call from a resident
and neighbor that City trees were being removed at 1737 Antigua Way. The
Urban Forester then contacted the Newport Beach Police Department and
requested that a Police Officer meet him at the address to document the incident
(Attachment F, Police Report 97- 8600). Additionally, the Tree Appraisal Report
(Attachment G) indicates that the value of the three Eucalyptus trees totaled
$9,344.88.
Mr. Anderson subsequently planted four Liquidambar ( Liquidambar styraciflua)
• replacement trees in the five foot parkway without City approval. The
Liquidambar trees are designated for an eight to twelve foot parkway and will
• result in future hardscape damage. (Attachment H) Additionally, three of the
Liquidambar trees do not meet the required dimensions as outlined in City Council
Policy G -6 (Attachment I) relative to street intersections, service walks, utility
meters and driveways. Based on this policy it appears that only one street tree
could be planted at this location. The current designated replacement parkway
tree for Antigua Way is Eucalyptus citriodora. ( Attachment J) Staff requests a
change of the designated street tree prior to any replacement trees being planted
since the Lemon Gum is not appropriate for an eight to twelve foot parkway. A
future change of designated street tree will require a survey by non -staff (such as
Mr. Anderson).

Mr. Daniel Ohl, Deputy City Attorney has met with Mr. Anderson to discuss the
unauthorized tree removal and reimbursement. Mr. Anderson has requested of
Mr. Ohl that he be allowed to present his position as indicated in his letter dated
October 14, 1997 (Attachment K) to the Parks, Beaches and Recreation
Commission, Additionally, Mr. Anderson has submitted photographs that will be
presented at the meeting. Mr. Ohl will attend the Commission meeting to answer
any questions.
Mr. Anderson has received a copy of this report and a notice of the November 4
Commission meeting.

• MAINTENANCE AND PLANTING OF PARKWAY TREES
The City Council is vitally interested.in beautification of City parkways. Public
cooperation in helping to develop and maintain healthy and attractive trees is
encouraged.
MAINTENANCE, OF PARKWAY TREES '
The General Services Department will trim the parkway trees on a rotation
schedule. An effort will be made to trim the parkway trees on less than a three
year cycle. If the rotation trimming is completed in less than three years, more
frequent trimming will beperformed on certain trees and in view areas.
Public safety such as low'branches and heavy foliage will be given priority over
view trimming. An effort will be made to trim parkway trees located in heavy
summer traffic areas during the fall and winter months. The trimming schedule
will be altered to avoid trimming streets with flowering street trees during their
blooming time. This will apply to streets having a large number of flowering
trees, not to one or two trees on a street.
• TREE LIST
The Parks, Beaches and Recreation Commission has adopted an official tree list
which will be used by the General Services Department to determine species ,for
planning purposes in all new subdivisions and replacement in established
parkways. The list will be reviewed on an annual basis'by the General Services
Department staff with any recommendations forwarded to the Parks, Beaches
and Recreation Commission.
STANDARDS AND SPECIFICATIONS FOR PLANTING PARKWAY TREES
General Requirements
A. 72 -hour notification shall be given the General Services Department prior
to the initial installation of parkway trees for approval of species, material
quality and planting supervision 24-hour .notice shall, be given prior to
all subsequent inspections as required.

• B. Relative position of parkway trees is subject to approval by the General
Services Department, and any tree not properly placed will be relocated
at no cost to the City. In the interest of public safety, trees shall be kept
not less than:
(a) 25 feet back of beginning of curb returns at intersections.
(b) 10 feet from lamp standards.
(c) 10 feet from fire hydrants.
(d) 10 feet from service walks or driveways.
(e) 10 feet from meters and sewers.
(f) 25 feet from stop signs.
C. Trees shall be a minimum container size of 15 gallons.
1. Condition : Plants shall be symmetrical, typical for variety and
• species, healthy, vigorous, free from plant disease, insect pests and
shall have healthy, normal root system free from being root bound.
Trees shall not be pruned or topped prior to delivery.
2. Inspection: 'All plant material shall be subject to inspection and
approval by the General Services .Department prior to planting.
The City has the right to reject any item offered.
D. - Soil Analysis Requirement for Land Developers
Developer may be required to have a composite soil analysis made by a
bona fide soil testing laboratory of soil to receive parkway trees at no cost
to the City. The location and number of soil samples shall be determined
by the City. Analysis shall include fertility level and organic content of
the samples take. A copy of the test results shall ' be forwarded directly to
the General Services Department a minimum of .60 days prior to
scheduled planting of parkway trees.
PARKWAY TREE 'PLANTING
A. All pits shall be dug with the bottom level, width equal to two times the
• diameter of the ball, and the depth 11/2 times the height of the container
from which the tree is planted.

• B. Where land developers are required to provide soil analysis, the prepared
soil backfill shall be based on test results.

C When soil analysis is not a requirement, native soil with a commercial
fertilizer approved by the• General Services Department shall be used for
backfill. -
D. . Set plants in center of pit; in vertical position, so that crown of ball will be
level with finish grad and shall
bear the same ielationship to finish grade after allowing for watering and
settling sand shall bear the same relationship to finish grade that it did to
soil surface in its container.
E. Prepare a depressed water basin capable of holding 10 gallons of water.
Water shall be applied in that quantity at time of planting in a fashion that
insures wetting the entire root ball and that all air pockets are removed.
F. If houses are not occupied, trees shall be watered one week later.
Thereafter, watering shall be done at week intervals by the developer for
a period of one year or until homes are occupied.
• G. Each tree must be properly supported by two Lodgepole pine stakes or
'other material approved by the General Services Department Stakes shall

Form - Evergreen. Tall, slender, graceful tree that is very fast growing to 100'
in height. High arching branches and sparsely foliaged crown. Often used to
enhance tall structures.
Trunk - Usually straight. The thin bark flakes off in large irregular, patches
leaving a smooth, chalky white or pinked tinged trunk.
Foliage - Long, 3 - 7 ", narrow, golden green leaves, that contain citronella and
are lemon - scented when crushed. They seem to cluster at branch ends, giving
tree an airy, picturesque silhouette.
Flowers/fruit - Creamy white, 3/4" across when fully opened in August and
September, are usually not conspicuous due to tree's height. The fmits are urn
shaped capsules 3/8 -1/2" long and narrowed at the apex Flowers and fruit
are borne in terminal cluster's.
Significant pest problem is Eucalyptus longhorn borer.
Site suitability:
Sunset zones- 8 - 24.
Clearances - Suitable for 8 -12' parkways or 10 - 20' medians.
Good for streetsides, medians, parks and as accent trees. Does well in group
plantings.
Culture considerations:
Avoid pruning from May to October due to increased attraction to the eucalyp-
tus longhorn borer, but needs to be cut back and thinned often to strengthen the
trunk. Good health markedly reduces susceptibility to beetle attack. Very
drought tolerant once established. Needs staking when young.

I have lived at this address for 34 years.

When I moved in, the City informed me they were planting two eucalyptus trees.
• The City said that more trees would be planted if I paid for them. I paid for
two more. There were four parkway trees in front of my home.
The roots from these trees uplifted the sidewalk, uplifted the driveway apron,
and caused numerous cracks in the sidewalk, the driveway apron and the
driveway.
The City replaced 70 feet of sidewalk, the driveway apron and removed one
tree.
The pebbled .concrete walkway in the parkway was formed with Lomita Stone and
matches the front walk and the front porch. It is 34 years old and impossible
to match.
When two cracks appeared in the pebbled concrete, I wrote the City offering to
share in the tree removal expense and share in the expense of planting new
trees. The City refused.
Worried that the tree roots would ruin the pebbled concrete as they ruined the
sidewalk, driveway, and driveway apron, I had them removed.
I replaced them with four liquid amber trees and new lawn.
• I spent $1,500 for removal and the new trees and lawn. I spent $4,000 for a
-new driveway.

On my block (Santiago Drive to Mariners Drive) on Antigua Way, there are 24
other homes. Only eight homes have parkway trees. Two - thirds of the homes in
my block are barren in the parkway.

I was never told not to remove the trees. John Conway's July 21 letter states
in part, "Staff recommends the retention of the trees."
Vandalism is defined as the willful destruction of property. THIS IS AN
INSULT TO ME. For 34 years, "I believe I have displayed a sincere intent to
improve city and private property.

Recommendation
To deny the unauthorized removal by a resident of one City Brazilian Pepper
(Schinus terebinthifolius ).parkway street tree at 2406 Windward Lane and require
the full reimbursement of $1,759.10 to the City by Mr. Charles A. Muto.
Discussion
Mr. Charles A. Muto of 2406 Windward Lane requested the removal of two City
parkway street trees per his letter dated April 24, 1997. (Attachment A)
The Urban Forester and Park Superintendent reviewed the request on site per the
Tree Inspection Report (Attachment B) and'found healthy tree specimens and no
significant damage to warrant any tree removals. Subsequently, the Urban
Forester sent a letter dated May 8, 1997 (Attachment C) denying the tree
removals. Additionally, the letter stated Mr. Muto's recourse for appealing the
matter to the Parks, Beaches and Recreation Commission,
On August 20, 1997 the Urban Forester received a telephone call from a resident
and neighbor of Mr. Muto's advising that a City tree was being, removed at 2406
Windward Lane. (The second Brazilian Pepper remains on site.) The Urban
Forester then contacted the Newport Beach Police Department and requested
that a Police Officer meet him at the address to document the incident
(Attachment D, Police Report 97- 08970). Additionally, the Tree Appraisal Report
(Attachment E) indicates the value of the Brazilian Pepper tree removed to be
$1,759.10.
Mr. Daniel Ohl, Deputy City Attorney, has met with Mr. Muto to discuss the
unauthorized tree removal and reimbursement. Mr. Muto has requested of Mr.
Ohl that he be allowed to present his position and any mitigation proposal, which
is stated in his letter dated October 15, 1997, (Attachment F) to the Parks,
Beaches and Recreation Commission. Mr. Ohl will attend the Commission
meeting to answer any questions.

Dear Mr. Niederhaus:
The following is an explanation of the decision to remove the City's tree from the parkway in front of my house. I will review
the various conversations I had with City officials as well as the factors which led me to this decision.
Firstly, I must make clear the fact that prior to the removal of the tree, I made every effort to gain approval of the appropriate
City officials. The situation I am currently in is exactly what I was hoping to avoid. My fast action was to contact Mr. John F.
Conway, Urban Forester for the City of Newport Beach, to discus my problem. Mr. Conway and I had several discussions in
which I explained the potentially dangerous situation the tree was causing. At some point, we mutually agrced4that the situation
needed to be examined further by Mr. Conway. I was told that we would schedule a time for I& Conway to visit my home and
personally examine the tree and the damage it was causing. After three days had passed and -I had not heard from Mr. Conway,
I made several unsuccessful attempts to contact hum at hhs•officc. Thcn; on May 8, 1997,1 received the enclosed letter stating
that the situation had been reviewed and that it was the decision of the City to retain the tree. At the close of the letterMr.
Conway told me: "Please contact me at 644 -3083 regarding any questions ". I did attempt to contact Mr. Conway four times
between May 10 and 'May 22, each time leaving a voice mail message. Finally, after receiving no return phone calls, I decided
that I would' move forward with my plans to have the tree removed.
One reasons for the tree removal are as follows:
4, The roots of the tree have raised the parkway up to, three inches above the sidewalk (picture enclosed):
• The root system had traveled thirty eight feet into my front lawn.
• The roots were posing a threat to the water meter.
• The peppers from the tree were causing irreparable damage to the paint of cars which parked beneath it
• The peppers gathered onthc sidewalk posing a threat to pedestrians who could easily slip and fall.
• The trees roots caused backup in my property drainage system causing flooding in my house on four separate occasions.
(Bills for air blower and repair materials enclosed)
• The peppers caused damage to my carpet after being tracked in on the shoes of my family and guests.
I took all of the preceding factors into consideration prior to my decision. In addition, I have noticed that approximately 25% of
the homes on Windward Lane no longer have trees in front of them. It is my understanding that the City planted trees in front of
each home when they were built. If in fact the trees have been removed, what process, did my neighbors adhere to? I feel as
though I made every effort to follow the guidelines the City has created to maintain the pride of ownership for the residents of
Newport Beach. I have great satisfaction in the appearance and condition of my home and the property on which it stands, and
would do nothing to mar its appearance in any way. I made a decision based on rational thought and reasonable expectation of
my City's officials. I.hope you will see that my decision is one of merit and was based on many different factors. I.also hope
that your decision will be based on fairness along with the facts that I have presented to you. I do trust your judgment.

SUBJECT: Application for Listing of the Property at 700 E. Bay Avenue and
701 Edgewater -in the City's Register of Historical Property
Recommendation:
1. Review application for listing of the Balboa Saloon building in the City's Register of
Historical Property; and
• 2. Recommend to the City Council the classification of the property as a Local Historic
Site (Class 3)
Overview:
The owners of the Balboa Saloon at 700 E. Bay Avenue and 701 Edgewater have
submitted a request to have their property placed in the City of Newport Beach Register
of Historical Property. Pursuant to City Council Policy K -2 (attached), this application
must be reviewed by the Parks, Beaches, and Recreation Commission, the Arts
Commission, and the Newport Beach Historical Society for recommendation to the City
Council.
City Council 'Policy K -2 permits that a property may be placed in the Register of
Historical' Property if it is designated as having any one of the criteria for architectural or
historical significance set forth in City Council Policy K -2. The historical designation
also makes the property eligible to use the State Historical Building Code.
The State Historical Building Code supplants the Uniform Building Code and permits the
use of alternative construction techniques and materials to preserve historical structures.
The State Historical Building Code is particularly useful in dealing with requirements for
plumbing, electrical, structural, seismic, fire, safety, energy conservation, and disabled
is access. The State Historical Building Code allows equivalent methods of construction or

repair so as not to destroy any historical features but does not relieve the property owner
• of meeting necessary building requirements.
Analysis:
The subject property currently houses the Balboa Saloon. The application cites that the
brick structure was built in 1926, and its original use was a marine hardware store which
operated the first marine railway in Orange County used to haul boats out of the water for
painting and repair. The railway once ran along Washington Street from the waterfront to
Bay Avenue but does not exist today.
Since the marine hardware store closed in 1934, the property has provided several uses
catering to the waterfront environment in downtown Balboa. The property has served as a
bath house, and during World War II, the premises were donated to the U.S.O. After
World War II, the bay side of the building became a restaurant called "Pizza Pete ", which
still exists today. The inland side of the property has been the "Balboa Saloon" for the
last 20 years. The building looks essentially the same outside as it did when the owner's
father purchased it before World War II.
Historical Significance: The applicant suggests that the Balboa Saloon property is linked
to the nautical industry historic theme of Newport Beach due to its operation of the first
marine railway in Orange County. In addition, the property may also be linked to the
• social history of the City of Newport Beach due to its involvement in bayfront activities
and entertainment within the downtown Balboa Fun Zone/Pavilion, area. Per City Council
Policy K -2, the Balboa Saloon property may potentially qualify for historical designation
under the following standard of historical significance:
Criterion 1 -b -i. Sites and structures connected with events significant in the
economic, cultural, political, social, or civic history of the City of Newport Beach,
the County of Orange, the State of California, or the United States ofAmerica.
Architectural Significance: The applicant suggests that the brick design of the building
is significant to the 1926 time period in which it was built. The walls are unique in that
they are built 3.5 to 4 bricks -thick as opposed to the brick veneer that is typical today. Per
City Council Policy K -2, the Balboa Saloon may potentially qualify for historical
designation under the following standard of architectural significance:
Criterion I -a -i. Structures or areas that embody distinguishing characteristics of
an architectural style, period, or method of construction, or of architectural
development with the City.

Conclusion:
• The historical designation of a property can help to enhance the public image of an area,
which in turn may contribute to its economic revitalization. The recognition of a property
as historically or architecturally significant may also contribute to a sense of
neighborhood pride among local residents.
The analysis suggests that the history of the Balboa Saloon property is connected with the
nautical heritage of Newport Beach as well as social activities significant to the history of
the City of Newport Beach, and the brick structure itself is representative of an
architectural period and method of building significant to the architectural history of the
City of Newport Beach. Staff recommends that the Commission recommend approval of
this request by the City Council.

The City Council may designate as historical property any building or part
thereof, object; structure, monument; or collection thereof having importance to
the history or architecture of the City of Newport Beach in accordance with the
criteria set forth below. The City Clerk shall maintain a register which shall be
known as the City of Newport Beach Register of Historical Property. The City
Council may at any time repeal, revise or modify any such designation upon
reconsideration of the historical or architectural importance of the places therein
described.

(vi) Unique structures or places that act as focal or pivotal points
important as a key to the character or visual quality of an area.
(b) Property may be designated as historical property if it meets any of
the,following standards of historical significance.

economic, cultural, political, social, or civic history of the City of
Newport Beach, the County of Orange, the State of California, or the
United States of America.
(ii) Structures or areas identified with the 'lives of historical
personages of the City of Newport Beach, the County of Orange, the

(iii) Sites and groups of structures representing historical
development patterns, including, but not limited to, urbanization
patterns, railroads, agricultural settlements, and canals.

Historical property shall be categorized in relation to their significance and
condition in the Newport Beach Register of Historical Property under the
following hierarchical classification system:
• Class 1. Major Historic Landmark A building, structure, object, site,
or natural feature of major historical significance. The
property exemplifies historic /architectural themes of local
and statewide importance and serves as a significant part of
the,heritage of Newport Beach.
Class 2. Historic Landmark A building, structure, object; site, or
natural feature of historical significance. The property is
representative of historic /architectural themes of local and
statewide importance and serves as a physical link to the
historical' past.of Newport Beach.
Class 3. Local Historic Site. A building, structure, object site, or
natural feature of local significance only. The property is
representative of historic /architectural themes of local
importance.
Class 4. Structure of Historic Interest. A building, structure, object
site, or natural feature that has been altered to the extent that
the historic /architectural integrity has been substantially
compromised, but is still worthy of recognition.

events or persons, or architecturally significant structures.
3. Application of State Historical Building Code
Any building or structure rated as Class 1, 2, 3 or 4 in the Newport
Beach Register of Historical Property shall be deemed a "qualified historical
building or structure" for purposes of applying the State Historical 'Building Code,
as set forth in Part 2.7 (commencing with section 189050) of Division 13 of the
Health and Safety Code of the State of California and Part 8 of Title 24 of the
California Administrative Code. The Director of the Building Department may
apply the said State Historical Building Code to any such building or structure,
providing, however, that the highest standards of structural and fire safety are
maintained. Class 5 properties shall be listed in the Newport Beach Register of
Historical Property for recognition purposes only.
4. Procedures
The owner of any structure who desires that such structure be
included in the Register shall make application to the City Council in form
prescribed by the City Manager stating the characteristics of such structure in
terms of the criteria outlined above. The City Manager shall submit applications
to the Parks, Beaches, and Recreation Commission, the Arts Commission, and the
Newport Beach Historical Society for review and recommendation before
submitting such ,application to the City Council' for consideration. The City
Council shall consider all recommendations before�making its determination.
5. Incentives for Preservation
The City Council shall consider granting reductions or waivers of
applications fees, permit fees, and /or any liens placed by the City to
properties listed in the Newport Beach Register of Historical Property in
exchange for preservation easements.

the Santa Ana River Ecological Reserve and the
efforts of the "Friends of Harbors, Beaches and
Parks ". I hope the proposed plan will direct
significant attention to the need for sporting
fields (soccer and base /softball). Our need for
the inclusion of youth sport facilities is well
documented and will hopefully play a major role
in the proposal and general plan.
14. Capital Improvement Projects. At this time,
please be advised that I am not in favor of the
restroom project for the West Jetty "Wedge" area.
I believe our financial resources could better
serve our community in other areas of need.

Recommendation
Revisit the current regulations for the use of Marian Bergeson Aquatic Center
and; direct staff if,any changes are to be made.
Background
In response to citizen request, Recreation staff met with representatives of the
,Eastbluff Homeowners Association on September 19, 1,997 to discuss the
Marian Bergeson Aquatic Center usage and the related ,effects on nearby
residents.
• After the meeting, Bob Babbe, President of the Association, submitted a letter to
request future considerations in the policies and procedures of the usage of the
Center. The proposed set of restrictions are mainly focused on water polo
events held during the summer months. The main areas of concern are the
persistent sound of game whistles and participant parking on residential streets.

Thank you for your participation in the recent meeting with representatives of the Eastbluff Homeowners
Association. You may recall we discussed our concerns regarding the current operation of the Marian
Bergeson Aquatic Center and its impact on the numerous homes located in proximity to the Center.
We have reviewed the copies of the POLICY AND PROCEDURES MANUAL you provided, along with
the USE REGULATIONS, and find that several additional restraints are necessary to provide areasonable
balance between the Center's operation and the affected homeowner's rights of" peace and quiet"
enjoyment of their homes.
• WATER POLO,EVENTS
As we discussed,water polo events are the major source of noise pollution and receive the most criticism
from the homeowners: We therefore, are proposing the following set of restrictions to govern such events:

1) A limit of three consecutive days for any event.
2) No event will be scheduled to include both Saturday and Sunday.
3) All events to be limited to the hours between 9AM and 5PM
PARKING
The parking restrictions in the residential areas have not been enforced in the past by the City. We request
therefore, that the City enforce the parking regulations as described in the POLICY AND PROCEDURES
MANUAL for all future events.
We would be pleased to meet with you again, along with members of-the Parks, Beaches and Recreation
Commission in order to arrive at a solution to these matters,Please advise me as to the time and place we

GENERAL REGULATIONS:
1. Reservations offacilities and payment offees or deposit, when applicable, are, due upon approval of reservation. All applications for reservations
shall be reado on
official forms provided by the Community Services Department Special toumaments and/or annual events may be applied for no more than 12
months in advance.
2. Pemrission to use the M.B.AC. is granted subject to observance of all City, School District, County; State and Federal laws, rules and regulations.
Users permit may be
revoked for any violations.
3. Cancellation of activities by were may occur five(5) working days priorto the scheduled on ofthe M.B.AC. withoutforfeiting anyfees collected.
Cancellations
without proper notice will be charged a $25.00 cancellation fee. In the event of cancellation by the City, notice will be given as far in advance of
the scheduled use as is
possible under the circumstances.
4. Groups or persons using a facility are responsible to pay for any damage to or loss of property,. A fee equal to total replacement cost will be

5. The City of Newport Beach is not liable for accidental injury to persons or loss or damage of group or individual property. In the best interest of
the General Public, the
City of Newport Beach requires the group to famish proof of Insurance by way of a commercial general liability policy in the amount of

6. Groups composed ofminors must be supervised by approved adults for minors at all times while they are using the facility. The use pemrit must

7. A City Aquatic Staff parson(s) will be assigned to be present at all programs and/or activities Staff shall be responsible for, and have complete
authority over the
• M.B.AC., all equipment, participants and activities. Staffshall have the authority to request changes in activities or cessation of activities, and the
group(s) using the
M.B.AC, must comply with these requests or instructions.
8. When, in the opinion of Community Services Director, activity conditions warrant the presence ofadditional aquatic personnel, the cost of such
service shall be home by
the group or organization sponsoring the activity.
9. Any signage, decorating or other alterations to the existing facilities will be subject to the approval and conditions ofthe Director.
NOTE: No structure may be erected or assembled on premises, nor may any extraordinary electrical, mechanical or other equipment be brought
thereon unless special
written approval has been obtained forth the Community Services Department Any use offacilities shall comply with all state and local fire,
health and safety laws.
10. No advertising shall be exhibited, no petitions circulated and no solicitation or sales made in public facilities or on public grounds without written
permission from the
Community Services Department
11. All vehicles must obey parking regulations. If estimated attendance warrants, group will be responsible forparking lot signage and enforcement

BUSINESS AT A GROUP EVENT. EACH VENDOR MUST PROVIDE PROOF OF A
CITY OF
NEWPORT BEACH ISSUED BUSINESS LICENSE PRIOR TO THE EVENT DATE.
CONDITION OF FACILITY
UPON ARRIVAL TIME ON THE DAY OF THE EVENT THE PATRON, WHO IS THE
RESPONSIBLE APPLICANT, MUST INITIALLY INSPECT THE PREMISES WITH A
STAFF PERSON AND FILL OUT A CONDITION OF FACILITY REPORT. THIS REPORT
IS' A CHECK LIST TO INSURE THERE IS NO DISAGREEMENT AS TO THE CONDITION
OF THE FACILITY BEFORE AND AFTER THE EVENT.
RESERVATION GROUP IS RESPONSIBLE FOR ALL TRASH PICK UP AND PUT INTO
CONTAINERS. EXTRA TRASH BAGS WILL BE SUPPLIED.
