Dear Chairperson Pat Beek and Commission Members:
I missed your September 1 meeting as I was attending my father's funeral which-washeld
out of town.
I am sorry to hear that the requested reforestation presented to you on September 1 has
been delayed. The individual impacted homeowners, numbering 24 families, requesting
this reforestation have expressed their desire for this reforestation for many year This
specific phase of the reforestation was formally requested under the new G -1 Policy in
September 1997 and was finalized and approved by the association following the
revisions to the new G -1 Policy in May 1998. This reforestation was then additionally
• delayed due to the City's scheduling. Our Board Vice President, George Parker, was
there to represent these 24 homeowners and their desire to finally proceed with the
reforestation that had been approved both by the Association and the City Staff.
In the last two months, a sub - committee of the Landscape Committee came to the Board
requesting that additional City designated trees be considered on specific streets. The
new proposed plan blend in and take into account previously completed and /or
approved reforestation with the Little Gem Magnolia and the City suggested St
Mary's Magnolia replacement already in process They were also specifically asked
not to take any steps to delay this much needed reforestation
The five Board members had'voted unanimously to proceed with the reforestation
request on behalf of our homeowners. We were not informed prior to the September 1
meeting that one Board member, Dr. Fred Birnberg, had changed his vote and intended to
appear requesting a delay. When Dr. Birnberg testified before you on September 1,
he did not inform the PB &R Commission nor the Board of HVHS that he had
closed escrow that same morning and moved out of the Association. Therefore, he
is not a member of our Association nor a member of the Board.

Our homeowners have been kept fully informed over the years concerning our working
with the City Staff through our duly appointed City Parkway Tree Committee. (Please
see the 12 newsletters enclosed) We have had no significant opposition to the
Magnolias in our Association. The petition that was circulated by one of the members of
the present sub - committee, Lizanne Witte, was not authorized by the Board and
contained inaccurate statements, i.e., "The Little Gem Magnolia typically does not thrive
well in coastal regions," which confused our homeowners.and rendered its results
unreliable.
We cannot prevent individuals or self - appointed committee members from appearing at a
public meeting to express their personal grievances. However, as Chairperson Pat Beek
pointed out, this is not the proper forum for internal matters within our association to be
debated and we have requested that those with differing opinions respect this protocol.
Any encouragement of such practices will only serve to bog down the authorized
deliberations making it more difficult and time consuming for all concerned..
The Board has attempted and continues to attempt to work with all interested
homeowners including the Landscape Committee sub - committee. However, we cannot
• just rubber stamp their recommendations in order to speak with "one voice." Our legally
established association is a non - profit corporation. As in any corporation, the Board is
elected by the majority of homeowners and authorized committees are appointed by the
Board and serve at the pleasure of the Board. There will always be those individuals who
have a different or "better" idea. The Board must uphold the will of the majority and
uphold our previous agreements with our homeowners and City Staff.
We will appear before you again on October 6 and request that this reforestation proceed
with the city designated tree /s approved by our duly elected Board and City staff with no
further delays!

BALLOT MEASURE MAILED THE BOARD AND ALL COMMITTEE MEMBERS
SUPPORT THIS AMENDMENT The ballots and the important information concerning
incorporating the Architectural Provisions contained in the Bylaws into the CC &Rs have been
mailed to all our homeowners. Please check your mail. If you did not receive yours, please
contact our Property Manager, Lee Leibenson, at 752 -2225. We are all in agreement that this
step is essential to bring our documents into conformity with our surrounding associations and to
help lower our legal expenses. There will be an informational meeting just prior to our regular
homeowners session on August 5, Wednesday, 7 PM at the Oasis Senior Center. We hope you
will attend. This ballot measure is vital to our neighborhood. We encourage you to vote in
favor of this new amendment.
'CITY PARKWAY TREES Due to the unavailability of the "Little Gem" Magnolias in the 24"
box size, the city will now be replanting with "Saint Mary" Magnolias. The city has also agreed
to replace many of the smaller specimens of "Little Gems" to make our parkways more uniform.
We are also studying other possible city parkway trees for particular streets or cul -de -sacs to
present to the city staff for their consideration.

LEAF BLOWERS NOISE - NOISE -NOISE The Association requests homeowners to advise
their gardeners to only use leaf blowers between the hours of 8 AM to 5 PM Weekdays, 9 AM to
5 PM Saturdays and never on Sunday in Harbor View Hills South. Please help us to keep our
neighborhood a pleasant quiet place to live.
PET PEEVES Many homeowners enjoy walking their pets in the greenbelt on these lazy
summer afternoons. Please remember to pick up after your pet in consideration of your fellow
homeowners.
UPDATE BY BUD TAYLOR LANDSCAPE IMPROVEMENT PROJECT
The Landscape Improvement Project, that began in April, is a project planned in four phases to
upgrade landscaping in our community on Marguerite, the three entry ways, several interior
slopes and the greenbelt. The progress of the project is as follows:
1. Architectural plans for Marguerite and the three entry ways were finalized on July 20.
2. Architectural plans for the greenbelt an nine interior slopes is scheduled for August
completion.
To improve the quality of the existing landscape, proper use of plant material that adds color as
well as vertical and horizontal character on Marguerite and the entry ways has been planned. In
addition the,block walls on Marguerite will be masked with low growing plants and vines in
• selected locations. You will be kept informed of future progress of the Landscape Improvement
Project.

and a balcony addition. Thus far in 1998, the Architectural Committee has been actively, wor*$,,on
requests, of which 13 were submitted since the first of the year.

ur monthly homeowners meeting has been moved to the second Wednesday of this month in, order to have all
Board members present. The monthly regular homeowners meeting will be held May 13,7:30 p.m., at the Oasis
Senior Center. Homeowners are encouraged to attend.
CITY STREET MAINTENANCE Please see the enclosed letter to Kevin Murphy, City Manager, concerning our
deteriorating streets. Homeowners are encouraged to write to Kevin Murphy and let him know how important this
maintenance is to the property values in our Association!
BUCK GULLY WEED CONTROL Please see the enclosed letter to the Irvine Company requesting this much needed
weed abatement due to the recent El Nino storms.
LANDSCAPE IMPROVEMENT PROJECT by Bud Taylor, Chairman Landscape and Beautification.
This the second report of the Landscape Improvement Project shows that 190(43 %) of homeowners responded to the
survey circulated in March. Also 104 people offered their comments and landscape preferences. THANK YOU! Of the
190 people who responded to the survey 95% believe that landscaping in the community is "very important or moderately
important to property values" The project has entered into the next phase of preliminary design for: I.-Marguerite
Avenue 2. Three entry ways 3. Greenbelt 4. The 24 common area slopes located along several streets in our
community. One of the several guidelines to this project is that "Marguerite frontage, entry ways, common slopes and
greenbelt will be blended to create a harmonious theme which will provide our community with an attractive identity."
When you come to the May 13 (Wednesday) Board Meeting there will be more to report.
DO YOU NEED HELP? by Bud Taylor: Last month Harbor View Hills homeowners were advised about the tree
trimming service offer by Fred Demaria of Tierra Verde Landscape. To repeat - - -he will offer tree trimming services at
duced cost. For further information call Fred Demaria at 379 -1140.

Beautification Committee member, Maxine Propp, who can help you with odd jobs and repairs around your home such
as: garden chores, roofs, painting, appliance repair, plumbing service, garage door service, etc. If you need the name of a
vendor you may call her at 759 -1988. All vendor names have been used and previously recommended by a Harbor View
Hills resident. Also if you have bad work done on your property and were pleased with the results, please give that
vendor name to Maxine to add to the list. Beautifying our neighborhood will increase property values. We can all help
by touching up our property. Let us take advantage of the vendor repair service that has been prepared by Maxine Propp
and call her at 759 -1988.
-* CITY PARKWAY TREE TRIMMING Due to budgetary constraints, the City will only trim the City parkway trees
on a 4.5 year cycle. The city will trim more frequently, based on the City G -1 policy, if individual homeowners and/or
impacted homeowners make a request to the Board of a legally established homeowners association. The City has just
completed the scheduled tree trimming based on the previous requests of our individual homeowners. Due to the fact
that so many homeowners asked the City to also include their trees while the City was on the premises, the City has
agreed to return. In order to make our streets look uniform, the Board encourages homeowners to complete the enclosed
tree trimming request form and send in a check for $39 per tree made out to Harbor View Hills South HOA. The City
requires the association to send in one check for the full amount of the city parkway tree trimming prior to scheduling.
CITY PARKWAY TREE REFORESTATION REQUESTS
Homeowners and/or impacted homeowners have requested reforestation of the city parkway trees at the following

4. Our Architectural Committee Chairperson, Lloyd,
Krause reports that there are (at this date) seven
major construction projects for 1997, while six were
completed in 1996. This does not include the dozens
of minor approvals granted such as new house paint,
roof repairs, garage doors and landscape
improvements.
5. With the spring season fast approaching, many
of you will be painting to freshen and update your
homes. Please remember to receive approval for any
color you choose.
6. _Please make a special effort to remove cars,
campers, trucks, motorcycles, trailers, cars with car
covers, etc., parked in streets and driveways. Most
importantly, this- 1s a safety issue and also detracts
from the well kept appearance of the neighborhood.
T. As you drive or walk in our community, take time
to notice the many homes that are being remodeled.

effort in upgrading Harbor view Hills South.

COMMUNITY ASSOCIATIONS
AWANCE (CAA) REPORT

The CAA has been actively involved in negotiating
with the City to have the speed limits on Marguerite
and San Joaquin Hills Road lowered to their former
limits, 35 mph on Marguerite and 45 mph on San
Joaquin, Hills Road. So far we have been successful
in having the speeds reduced from 45 mph on
Marguerite to 40 mph and from 55 mph on San
Joaquin HBIs'Road'to 50 mph.
Additionally, a 25 mph speed has now been
established in front of the Oasis Senior Center.
We will continue to attempt to have these speeds
lowered further, back to their original levels.
Homeowners are encouraged to drive at 35
mph on Marguerite and 45 mph on San Joaquin
Hills Road. The City will be continuing to monitor
these streets and this will help us in our
negotiations. a
Additionally, we are attempting to have by -pass
signs for the toll road properly displayed on San
Joaquin Hills Road and Newport Coast Drive so that
motorists know to proceed to the by -pass rather than
using San Joaquin Hills Road if they do not wish to
pay the toll.
CITY STREET MAINTENANCE '
It has been over 11 years since our City
streets have been slurry sealed in Harbor View Hills
Southl Our President, Yvonne Houssels, has met
with the City on numerous occasions requesting this
much needed maintenance.
Despite our efforts to explain to the City that
experts have Informed 'us that 7 years is the
maximum amount of time between slurry sealing in
order to avoid much more costly repaving, our
requests have been ignored. Obviously, this lack of
maintenance also makes the appearance of • our
neighborhood unattractive and impacts -our property
values.
We are pleased that Mike Favreau, who is
knowledgeable about street • maintenance, has
volunteered to become our new City Street
Chairperson and will be addressing this matter with
the City.

CITY PARKWAY TREES
Our Association has joined our surrounding asso-
ciations in attempting to encourage the City to address
our specific concerns and trim more frequently in our
view priented communities.
' Additionally, we are still negotiating with the
City concerning the overwhelming majority of
homeowners on Sandcastle who have requested re-
moval and replacement of their City parkway Lemon
Eucalyptus trees. The homeowners have'requested
this removal due to the self - pruning characteristics of
these very tall trees. Following the high Santa Ana
winds, the homeowners have reported damage to their
properties and large branches falling on their parked
cars sometimes narrowly missing children at play.
Unfortunately, this process has been very
slow and frustrating. 'Hopefully, we will have a resolu-

TOLL ROAD UPDATE.
The City of Irvine reversed Its earlier position
and has now approved the aftemate road which will
form part of the bypass to avoid the toll on. Newport
Coast Drive. ,
However, this bypass was never considered
adequate by our Association as well as our surround-
ing Associations and the Corona del Mar Chamber of
Commerce. �' '
Although any bypass is preferable to none, ft
Is doubtful that this bypass will relieve the heavy traf-
fic burden on San Joaquin Hills Road and Marguerite
once Newport Coast Drive is completed. •
Those homeowners who are concerned about
this Issue may sign the petitions now available through
the Corona del Mar Chamber of Commerce on Pacific
Coast Highway. Please ask for Ellen at the Corona
Del Mar Chamber of Commerce, 2843 East Coast
High, Corona Del Mar, open Monday thru Thursday,

NEW LANDSCAPING CABLE TV PROBLEMS? .
A new landscaping service, Artistic Mainte-
nance, is now servicing our community. Our previous
landscape contractor had numerous changes with
their personnel which resulted in a decline- of service
in our area. We look forward to improving the appear-
ance of our neighborhood.
Some of the changes include: A daily mom -
ing check of Marguerite to remove any paper or trash,
a reduction in our water bills due to improved 1nspec-
tion and maintenance and a hands on cooperation in
replanting and beautifying our common areas.
We are presently re- landscaping our entries
and replacing the Oleanders which had become dis-
eased along Marguerite. A special thank you to our
new Landscape Chairperson, Dr. Fred Bimberg, who
is 'contributing Magnolia trees for our entry's.

Based on the overwhelming approval of the

has agreed to make this the designated City parkway
replacement tree throughout our neighborhood.. The

The City has completed their trimming in our
neighborhood. We are pleased that this much needed
maintenance has finally been accomplished.
However, both the Urban Forester for the City of
Newport Beach and the City's trimming contractor,
West Coast Arborists, state that a three year trimming
cycle for our mature trees is not adequate. We will
continue to lobby fora minimum eighteen month
trimming cycle in order to preserve as many mature
trees as possible and still protect the property values
by upholding our governing documents.
Homeowners along Outrigger'Drive have re-
ported poor reception on the lower channels and re-
cently all channels following the rains since the first of
the year. Any homeowners who have difficulty with
service should call 720 -2020. Cox Cable has assured
us that they will -give credit for •any service disruption
until the,problem is corrected.
NEW REAL ESTATE AND
GARAGE SALE SIGN POLICY
IS NOW IN EFFECT
In order to preserve the quality look of our
community, we have implemented a, sign policy based
on the policies already implemented in our surround-
ing associations. The new sign policy was mailed to
all homeowners and Realtors who 'frequently work in
our area. It became effective February 2, 1996.
The need for this policy became apparent
over the last six months. During, that time, as many
as five open house signs were placed in epch single
flower bed•in all the entry monuments at one time. As
Jasmine Creek has a sign policy, Realtor-signs were
also placed in our common areas pointing towards
open houses in Jasmine Creeks ' , '>

UPDATE CITY PARKWAY TREES
November 17, 1995
The City informed the Association that reforestation was to
take place in our neighborhood and our surrounding Associations
where serious sidewalk and hardscape damage had occurred.
Due to the City's increased trimming cycle of between 3 -5 years
and the City's reforestation plans, the Association determined
to form a City Parkway Tree Committee so that our interests
were adequately addressed. The City Parkway Tree Committee
was formed of all interested homeowners who were in attendance
at our monthly homeowners meetings and wished to volunteer.
• The Board has requested that the City respect individual
homeowners' desires to maintain their parkway trees if these
homeowners agree to maintain them according to.our governing
documents and pay for any necessary sidewalk repair.
Additionally, we have requested that the Raphiolepsis and Bronze
Loquat tree be re- designated to the "Little Gem" Magnolia tree
which has been well received by the majority of our homeowners.
There is no plan for massive parkway tree removal. At this
time the City only plans to replace 35 of our 624 trees.
The only street under consideration for complete removal and
replacement is Sandcastle. The Association agreed to present
the over - whelming majority of Sandcastle homeowners' concerns
to the City over the damage caused by these trees to their
properties.
It is not reasonable to establish a new committee now and
eradicate months of research and negotiations with the City
when 32 of the 35 affected homeowners have already approved
of the removal and replacement. Such action would not be
received favorably by the City and would cause further delay
of our much needed parkway tree trimming.

BEACH REFUSE ISSUE
AT THE PRESENT TIME, NO AUTOMAT-
ED TRASH/LIMITATIONS ARE PLANNED.
The board has been actively involved in com-
municating with the City in keeping our home-
owners informed about this important issue.
Based on the strong opposition by the public
by mail and in person at the City Council
Meetings, the city has determined to retain the
current manual trash removal procedures.
However, starting in the near future, residents
will be limited to six containers (including plastic
bags.) Additionally, all trash will not be allowed
to exceed 2001bs. These restrictions will not
apply during holidays, however.
A recycling program for green waste will be
implemented and a surcharge is also under study
to be presented to the City Council the end of
December.
The city Staff will also be monitoring refuse
'scavenging and reporting back to the City in 30
days.
-' CITY PARKWAY TREE UPDATE
The City has designated new trees for our
streets as the present trees upon maturity have
caused damage to the sidewalks and cannot be
properly maintained on the newly extended City
tree trimming cycle of 3 years. There is concern
that this cycle may be extended in the future to 5
years, as previously considered, depending upon
the budgetary constraints of the City.
Our City Parkway Tree Committee spent a
great deal of time studying the trees the City list-
ed as acceptable replacements and visiting sites to
view them. Two of the newly-designated trees are
also be in used as replacement trees in neighbor-
ing Harbor View Hills North and Spyglass Hill.
The following is a list of the new City desig-
nated trees for each street:
"Little Gem Magnolia"
Sandcastle, Blue Key, Surfview, Seabreeze,
Quiet Cove, Sausalito, and Tiller Way.
"Bronze Loquat"
Topside, Inlet Isle, Sasndune, Park Green,
Key Bay, Key West, and Sand Key.
"Majestic Beauty Ralphiolepis"
Catamaran, Keel, Outrigger, Seacrest, and
Herron Way.
The City Parkway Tree Committee is still
working with the City to determine which trees
should be removed and replaced prior to the
City's trimming. Of primary concern are those
which are causing sidewalk and hardscape dam-
age.
Additionally, the overwhelming majority of
homeowners on Sandcastle have requested
removal and replacement of the City Eucalyptus
trees due to damage caused to their properties.
A special thank you goes to homeowner Fred
Bimberg, a new Landscape Committee Member,
who has offered to donate a large number of more
mature "Little Gem Magnolia" replacement trees
for Sandcastle.
Those homeowners whose trees are being
considered for removal have already been notified
by the Association and the City has received the
list of those who do or do not wish removal
and/or replacement.
NEWPORT COAST DRIVE TOLL
UPDATE
Due to concerns by many of our residents and
our neighboring associations that tolls on
Newport Coast Drive will increase traffic. on San
Joaquin Hills Road and Marguerite, the
Association will try to keep our homeowners
informed about this important issue.
As stated in our last newsletter, it now appears
that an alternate bypass around the to on Newport
Coast Drive will not be built.
The City of Irvine does not want the addition-
al traffic and their residents do not like the loca-
tion of all three of the proposed alternatives.
Additionally, these routes would all form a zig-
zag route which is not an adequate parallel'
bypass.
Residents should not be misled by the new
Ford Road connection. It is only a TEMPO-
RARY BYPASS.
Although our City Council Members have
indicated that they would support removal of the
tolls on Newport Coast Drive if an adequate
bypass is not provided, we do not know of any
formal objections to the tolls made by the City to

* Is there a real need to do anything at this time? Who is going to use this park-?
Residents in Harbor View Homes and the surrounding communities already have a great
green belt and a nature park for walking, Andersen School leas ttvo baseball /soccer fields.
there is another baseball /soccer field, basketball court and tennis backboards at San Miguel
and Spyglass Hill. In addition. Lincoln Elementary School and Easibluff'have nnaiy fields
and courts for sport events and other facilities are available at Bonita Creek. Tennis courts
are rarely used as most people who play tennis belong to a club. The Bonita Village
bonzes will also have a park within their gated oonnnu pity.
* The noise and traffic factor. If over 240 parking spaces are "on site" and additional
• nnoney is allocated for "off site' parking (I'm not stare where this would be.), this means a
lot of additional' noise and traffic in the surrounding comnnunity. This would be a gigantic
parking lot - for what purpose? As you know, nny neighborhood has already been
impacted by the excessive noise from the Transportation Corridor and Bonita Carryon, and
iNill be affected from the additional traffic brought on from the widening of Culver in
Irvine. If the fields are heeded, L would suggest that they be graded below street level and
a benn with landscaping be used to create a buffer for the regular noise corning from tine
park and li•om Bonita Canyon.

* Regarding the Newport-Mesa School District building a school on the "eastern portion"
After writing a letter and speaking to Serene Stokes last October. I was assured that the
district would not build a school at that location, but would accommodate additional
students at a reopened Eastbluff'school or at tine Newport Coast school. However, if this
is a possibilit}-, veiny spend the money now to develop a park?
* Why is tine "annexation agreennent" dictating how the City of Newport Beach uses tine
area and nnonies received 'from Irvine? Please, don't tell me it's an airport issue.

Magnolias on our behalf by our duly elected Board members was not approved on
September 1.
We understand that the overwhelming majority of our Board and the City staff requested
that this much needed reforestation proceed.
We have learned that this matter was delayed due to the desires of a sub - committee of our
Landscape Committee which had ignored the directives of the majority of our duly
elected Board. The sub - committee had been directed to make any proposed plan for
additional City parkway trees blend in with the reforestation using the St. Mary's
Magnolia already approved by the Board and City staff so that this much needed
reforestation was not further delayed.
• We have been attempting to resolve the problems with our city parkway trees for over 6
years! Our Board members, particularly Yvonne Houssels and George Parker, have been
working with the previous City Parkway Tree Committee members and city staff for over
3 years! Now a sub - committee of the Landscape Committee, which has not been elected,
has decided they want a different plan and everything should stop until they decide what
is best! This is not fair! When will it end?
The time has come to quit planning and replanning! We never will satisfy everyone.
That is why we elect Board members to represent the majority of our homeowners and
make these necessary decisions.
Our Board has kept all of our homeowners fully informed through our newsletters and at
our monthly homeowners meetings. Our Vice President, George Parker, represented the
Board and the interests of the majority of our homeowners. He was speaking for us, the
majority at the September 1 meeting.
Please approve the reforestation which will be brought before you again on October 6,
using the designated trees approved by our duly elected Board members and city staff.

I have some questions and some comments:
• 0 When is the chain link fence going to be removed from the Castaways bluff top?
How much did the citizens of Newport Beach pay for the plaque which was recently
installed? I note that a similar plaque has also been placed at Bob Henry Park.
Why is the so- called "park" planted with weeds rather than grass?
CHAIN LINK FENCE: This fence is an eyesore and a safety hazard. It is in a state of disrepair
and it would be easy for someone (human or animal) to be injured. It also serves no purpose and
I have wondered for many many months why in the world it was installed in the first place.
PLAQUES: I am somewhat familiar with the cost of fabricating bronze plaques, and it's not
cheap. To erect plaques to commemorate or to give historical facts makes sense. But ..... what is
the point of including the names of public officials? What does that have to do with anything? I
find it very self - serving on the part of our city politicians, appointed officials and paid'
employees.

The plaque on the bluff should only be historical in nature. On the plaque in question, the
amount of space dedicated to the history of the bluff is probably one - quarter (printed in tiny
letters) while three - quarters consists of a long list of people (in large letters) who just happen to
be elected, appointed and city -paid individuals at this particular moment (Kevin Murphy isn't
even the City Manager any longer) --- they have nothing to do with history and their names, are
of little interest to anyone!
Ditto regarding the Bob Henry Park plaque. That plaque should include "why" the park was
named in Officer Henry's memory and the date of the park was dedicated. Period. Nothing else.
It's hard to ,understand why even the name of the landscape architect appears there. What did he
do other than win the bid to do the work. He was paid for his work. Why do we commemorate
that in bronze?
I really appreciate the fact that the Castaways bluff is now open to the public; and Gee, I spend
an awful lot of time there, so why not include my,name on a plaque someplace)
BLUFF TOP LANDSCAPING: It's a joke to refer to what happened there as landscaping. It's
• plain ugly. That particular piece of property is one of the truly remarkable view spots in this
City. It should be beautifully landscaped with trees, shrubs and grass. It would be a perfect spot
for some picnic tables & benches and possibly a telescope. I have in my mind's eye the beauty
of the grassy bluff tops in Corona del Mar and the wonderful uses so many residents and visitors
have enjoyed over the years.
I realize beauty is in the eye of the beholder, but it's ludicrous to call Castaways a `park' when
it's nothing more than a lot of weeds which will have to be cleared every year because of the fire
hazard.
I will appreciate hearing from you by letter.
