Re: Proposed G -1 Tree Policy
Dear Ms. Beek,
There was discussion at last night's Commission meeting re item G. in the Reforestation
of City Trees section (Page 5) of the proposed new G -1 Tree Policy. As it is presently
written, I am not sure anyone really knows what it says and how to administer.
I am pretty sure that this new item G came from a letter our Association wrote to the
Mayor with a copy to Homer Bludau advising them of a Motion passed November 3,
1999 by our Board of Directors recommending an addition to the G -1 Policy that gave
more local control to reforestation in CC &R controlled communities, and expedited
reforestation where there was unanimous consent of all parties including the Association.
The motion read as follows. (Slightly edited.)
"HVHCA recommends the following be added to the proposed new G -1 Policy
under the requirements list:
"In legally established community associations with view restrictions empowered
with CC &Rs, an association member (property owner) requesting Reforestation of a City
tree(s) to the designated City street tree at his/her full expense shall have the request
granted by the City General Services Director provided that the applicant has unanimous
written approval by aii association members that can see the tree(s) from their individual
Lots, and provided that the applicant has the written approval of the community
association Board of Directors. Where this unanimous approval is not obtained, the
applicant may request Reforestation under alternate sections of the G -1 Tree Policy."
As you will note, some resemblance to the proposed item G on page 5, but really quite
different in total. I hope this helps our viewpoint in this area. If questions, call

In a letter dated November 19, 1999, you were informed that the Parks, Beaches and Recreation
(PB &R) Commission would consider proposed modifications to the City tree retention and
removal policy on December 7, 1999. The proposed modifications are intended to facilitate tree
action requests, address problem areas, and ensure retention of a healthy urban forest without
undue liability. The letter further stated that, it was anticipated that following PB &R review, the
revised policy would be forwarded to the City Council for review on December 13, 1999.
This letter is to inform you that the PB &R Commission has decided to extend its review of the
proposed changes to the tree policy, and that the City Council review, tentatively scheduled for
December 13, 1999, has been postponed indefinitely.
The Commission will meet again to continue their review of the proposed modifications on
January 4, 2000. Upon completing its review, the Commission will forward its
recommendations to the City Council. Although it is anticipated that the Commission will
complete its review on January 4, a Council review date has not been scheduled at this time.
You are welcomed to attend the January 4, 2000 Commission meeting to state your comments.
Your input will ensure that all tree - related matters are addressed and thoroughly discussed. If

Re: Designated Street Tree List
Dear Mr. Niederhaus,
In response to your letter of December 9, 1999 (postmarked 12/14/99) received December
18, 1999, it is impossible for our Association to give you a response by December 31,
1999. The holidays make it virtually impossible to get our Board of Directors together
before the deadline.
• Our Association published the proposed new street tree list in our November 16, 1999
member Newsletter based on the Designated Street Tree List we had been supplied by the
PB &R Commission during their subcommittee meeting on the proposed list prior to our
Newsletter going out. No one from your office was at this meeting. (This preliminary List
for our Association streets was essentially the same as the November 29, 1999 List you
refer to in your letter).
At that meeting (October 21 st.), a member from our community advised Pat Beek during
the public comment part of the meeting that we had a list of designated street trees
already that were different than the list. Another community group also made the same
comment. Ms. Beek advised everyone at the meeting that the proposed new List was the
list to go by and if an Association wanted to change the designated street tree after it was
published they could do so by making an application to the PB &R.
Evidently, your department and the PB &R have a different policy in this area.
When we published the proposed new Street Tree List in our November Newsletter only
one of our homeowners, Bill Ginter, objected to the Association on the proposed new
street trees. He made the point that we already had designated street trees and told me he
had directly contacted your department on the issue. I advised Mr. Ginter of the
Association's experience at the PB &R subcommittee meeting and the policy response we
• had received from Pat Beek. Mr. Ginter advised he had changed the List back to the
original through contacting John Conway in your department.

We're confused. We've got two different policies from the City. Our homeowners have a
new published List from our Association Newsletter in hand which differs from your
December 9, 1999 letter. Please advise us which list of trees to go by as HVHCA
designated street trees - your December 9, 1999 letter list or the published list?
If your December 9, 1999 list is the definitive list, will your department pay for a
correcting mailing to our homeowners?
