stated that it was possible to do but that Ms. Megonigal would have to get a license
from the Health Department, insurance and would need to pay the utility charges.
Commissioner Beek asked if the fees could be waived.
Manager McGuire stated that she did not have the ability to waive the fees or the
requirements. Since she would be using a City building to provide food, rules would
need to be followed per the City Risk Manager.
Commissioner Beek asked staff to contact Ms. Megonigal to discuss the parameters of
the project.
2. Park and Tree Division - Commissioner Macfarland asked if the tree removal report in
their total of removals to date included emergency tree removals. Director
Niederhaus stated yes.
Commissioner Macfarland asked for clarification from the report re: monitoring
Fletcher Jones and the Arches.
Director Niederhaus stated that staff is monitoring the native vegetation that has
been used in the parkway adjacent to Fletcher Jones. Further, he clarified the
is projects in Upper Back Bay that was constructed with a loss of wetlands that
occurred during the Arches Bridge project.
Chair Skoro asked for a status of the CdM reforestation project on Coast Highway. He
noted that Rich Edmonston from the Public Works Department is working on a water
pollution control plan and that an archeological plan was needed.
Director Niederhaus stated that a permit was needed to move forward as the State
does not allow any work done on the highway between Memorial Day and Labor Day.
Commissioner Macfarland questioned the emergency removal of three trees by the
Risk Manager.
Director Niederhaus noted that a consultant and the insurer stated that the trees
needed to be removed to avoid liability.
Director Niederhaus also noted that illegal tree removals are on the rise, as they are
occurring about once a month. He stated that the City is discussing hefty fines for
those illegal tree removals.
Commissioner Allen asked if staff is working with the Board of Realtors and other
organizations regarding City tree policies when new residents buy their homes.
• Director Niederhaus stated that City brochures have been prepared to send out to
new residents and other organizations.

Commissioner Pfaff stated that possibly when new homeowners sign their loan
documents that knowledge of the rules regarding the City trees should be signed and
put in their hand at that time.
Commissioner Beek stated that the Commission should be involved in the renovation
of Balboa Village and noted that there would be a meeting on May 10. Chair Skoro
and Commissioners Allen and Beek will try to attend.
Discussion ensued regarding the landmark trees on Main Street in Balboa. Director
Niederhaus stated that the redesignation of street trees would be sent to the
Commission in July.
Commissioner Beek questioned the status of the Castaways Grant.
Director Niederhaus stated that they should know next month; but feel confident
that they will be successful.
3. Community Services - Manager McGuire stated that staff has posted signs in English
and Spanish stressing the importance of looking over the play equipment for razors
or glass before allowing the children to use it. She noted that they are working with
• the Police and General Services Departments on monitoring the parks.
4. Energy Cutbacks - Manager McGuire reiterated the steps that staff have taked to cut back
on the use of energy with the Commission.
5. Bench Donations - Commissioner Beek asked staff if there is a point when there are too
many benches. She stated that she had visited the following three locations where
benches could be installed:
• Sapphire at North Bayfront
• Topaz at South Bayfront
• Garnet at South Bayfront
She asked staff to come back next month with a report on the number of benches and their
locations.
Motion by Commissioner Beek to table the request by Balboa Island Improvement
Association to donate three benches to be installed at:
• Sapphire at North Bayfront
• Topaz at South Bayfront
• Garnet at South Bayfront
And request staff to return next month with a report to include the number of benches
and their locations. Motion carried by the following vote:

DISCUSSION ITEMS
8. Flagpole Installation at Eastbluff Park - Manager McGuire stated that Corona del Mar
Pony Baseball has requested to install a flagpole at Eastbluff Park. She noted that the
plaque that they had installed has been removed and that it will be changed to conform
to Council policy.
Discussion ensued regarding responsibility for the raising and lowering of the flag.
Motion by Commissioner Beek to approve the request by Corona del Mar Pony Baseball
to install a flagpole at Eastbluff Park. Motion carried by acclamation.
9. Park Development Committee - Chair Skoro stated that Mike Sinacori, Public Works
Department had made a presentation to the committee on Upper Bayview. He also
noted that City Council will discuss the Newport Village site and the possible next steps
for planning a park.
Discussion ensued regarding requesting from the City $35,000 to hire a firm to do a
concept plan on the site.
Motion by Commissioner Tobin that a letter be forwarded to City Council requesting
• $35,000 be provided in FY 2001/02 budget for the preparation of a master conceptual
plan for development of the Newport Village property into a passive park. Motion
carried by acclamation.
10. Committee Reports
• Budget - Budget hearing with Council will be May 22.
• Castaways Park - Director Niederhaus again stated that staff should hear results of
the grant by next month.
• Park Development - Meeting will be set to discuss park bond money available and the
steps need to take to request those funds.
• Recreation ft Open Space Element - Meeting will be set.

• Seniors - Nothing to report.

The Parks, Beaches and Recreation Commission in the past several months has had
several public hearings on the utilization of the parcel of land behind the Central
Library known as Newport Village, which was dedicated as open space.
As indicated in prior correspondence, the Parks, Beaches and Recreation Commission
by a unanimous vote strongly recommended that this priceless piece of property be
developed into a passive park.
• The Parks, Beaches and Recreation Commission moved unanimously at their May 1,
2001 meeting to request from l ity Council that $35,000 be provided in FY 2001/02 for
the preparation of a master conceptual plan for development of the property into a
passive park. These funds would be used to provide a base map and biological and
cultural (archeological) surveys. Public hearings would be held relative to the site
with consideration given to requirements for additional parking for the library.
The goal of this funded effort is to provide recommended plans for the development
of the property into a passive park to the City Council for their review and comments.
The development of this property into a passive park with its spectacular views in the
middle of a business environment will be something that all Newport Beach citizens
can cherish forever.

SUBJECT: Parks and Trees Divisions Activities Report
Park Division Activities
1. Staff continued coordinating the construction of the Bonita Canyon Sports Park and the
maintenance period of Arroyo Park with the Public Works Department.
2. Three Commission approved bench donations were installed at West Jetty View Park,
the Balboa Pier and adjacent to a bayside beach area on West Bay Ave.
3. Staff continues coordinating with the Castaways Park Committee in regards to the grant
application for plantings, maintenance and temporary irrigation at Castaways Park. A
consultant has prepared a Negative Declaration document on the park that has been
• forwarded to the California Conservancy as required by the grant application process.
4. The Femleaf Avenue Ramp Project that entailed construction of an extensive retaining
wall, landscaping, and irrigation was completed. The City has assumed the landscape
maintenance. The area was hydroseeded with a California native mix that has been very
successful in providing hillside stabilization and seasonal color this spring.
5. Staff coordinated with Community Services, Public Works and an installation
contractor regarding the renovation of the sand play areas at Spyglass Hill and West
Newport Parks.
6. Seasonal weekend trash removal at City parks due to increased usage by the public
started on Saturday May 5 and will continue through Sunday, September 9.
Upcoming Activities for June
1. The planting of replacement shrubs and ground covers will continue Citywide.
2. Staff will continue to monitor the Fletcher Jones and Arches Mitigation Sites in the Big
• Canyon area.
3. Staff will continue coordinating the annual control of rodents with contract services.
• Tree Division Activities
During the month of May, 407 trees were trimmed, 2 trees were removed as directed by the
City Risk Manager and City Manager, 51 trees were planted and 4 emergency calls were
responded to regarding trees. The Urban Forester received 63 tree maintenance requests.
1. The City tree - trimming contractor, West Coast Arborists, continues tree trimming
throughout the Corona del Mar area which is scheduled for completion this summer.
2. The Urban Forester coordinated the Citywide Sidewalk Replacement Program with the
Concrete Maintenance Supervisor and the Public Works Inspector. This work involved
the Urban Forester inspecting City street trees as related to sidewalk repairs.
3. The attached Tree Activity Report summarizes work that was performed during the past
several months.
4. Staff has been coordinating with the Public Works Department for the renovation of
Balboa Village. The project is multi -phased and will cover a span of three years to
completion. A major aspect of the project is the potential removal of the Ficus trees on
Main Street and Eucalyptus trees on Balboa Boulevard. This beautification project
will include selecting a new designated parkway street tree for the two streets. A report
• from staff will be forthcoming to the Commission regarding the status of the street trees
relative to the project.
5. Staff coordinated with the Community Services Department for the annual Arbor Day
event at Eastbluff Park. Parks, Beaches, and Recreation Commission Chairman Val
Skoro was the Master of Ceremonies for the program which included the Third grade
classes from Eastbluff Elementary School. The students participated in planting four
new trees in the park and provided various skits highlighting the importance of trees
and the celebration of Arbor Day. Additionally, Mr. Thomas Porter, State of California
Urban and Community Forester presented Mayor Pro Tern Tod Ridgeway with the
National Arbor Day Foundation's Tree City USA Award and the Tree City USA
Growth Award for an outstanding Urban Forestry Program. Tree City USA awards will
be formally presented to the City Council on June 12, 2001.

Re: Recreation Division Monthly Activities Report
ADULT SPORTS
Adult Basketball- The adult basketball program in Newport Beach is Orange County's most
popular basketball league. Over the past year, the program has provided service to 285
teams that have played nearly 1500 games. During the summer months, many NBA players can
be found at West Newport Gym playing in the City league to keep their games in tune. The
2001 summer season will begin the week of June 18, and is expected to reach its capacity of
75 teams.
Adult Softball - The summer softball season is unique and a great representation of the
outstanding quality of life in Newport Beach. Where else in the county can one find a twilight
league, stockbroker's league and women's league occurring on the finest ball fields on any
given day? Softball program participants continue to show their satisfaction with the program
• by participating year after year.
YOUTH PROGRAMS
Youth Council -The Youth Council held its annual City Government Day event on May 31, with
approximately 50 students from Corona del Mar and Newport Harbor High Schools in
attendance. While experiencing local government in action, each participant spent several
hours working alongside a City staff member. The day concluded with the students holding a
mock City Council meeting which included mandated electricity cutbacks, acquisition and
development of a teen recreation center, and coordination of surf contests on the agenda.
Youth Track and Field Championships- Approximately- Forty Newport Beach children
participated in the Southern California Track and Field Championships on May 26, at Gahr
High School in Cerritos. Over 1000 boys and girls from San Luis Obispo to San Ysidro qualified
to participate in the event by placing first through fourth in their City and County meets.
Local track and field sensation, Michael Andraszczyk, just 11 years old, continued his record -
breaking streak by shattering two records at the City Meet and following it up with a record -
breaking performance at the County meet. Staff looks forward to seeing Michael at the 2012
Olympics.

• Marian Bergeson Aquatic Center (MBAC) - The Center experienced a broken pump motor that
caused the pool to be closed May 3 -8. Programs were moved over to Newport Harbor High
School Pool on May 7 and 8. MBAC was also closed on April 15 for the Easter holiday.
Swim Lessons - All summer swim lessons have been rescheduled; all will be rescheduled to the
Newport Harbor High School Pool. Registration was scheduled to begin May 1, but was delayed
to June 4 to provide time to finalize discussions with the School District on the costs for
heating the pool. Due to the high cost of electricity for heating the pool, swim lessons will be
held at Newport Harbor High School only to conserve energy. This strategy requires
reconfiguration of the classes to include as many sessions as possible to accommodate the
lessons not being scheduled at MBAC.
Lifeguard Training - The Community Services Department is conducting a Lifeguard Training
Course that began May 15 and continue through May 31. On June 1, the Department will
conduct a Water Safety Instructor Course. Both classes are filling up quickly.
CONTRACT CLASSESANSTRUCTION
Summer Activities - Registrations for summer activities began May 1; over 1,100 participants
are already registered. Internet registration continues to be a big draw with over 1,200
accounts processed for online registration.
• New Classes - New contracts for independent contract class Instructors for the FY 2001/02
were mailed in mid -May. Independent contractors will also receive a Guidelines and
Procedures Manual explaining the services provided by the Community Services Department,
the requirements that must be fulfilled, along with their role and responsibilities.
FACILITIES USE AND MAINTENANCE
During the period April 15, 2001 through May 14, 2001 there were:
• 22 Park /Picnic Area Rentals
• 10 Room Rentals
• 4 Field Rentals
• 10 Gymnasium Rentals
Use - There are currently 6 Scouting Groups using City Facilities at no charge. There are 9
ongoing 12 -step groups, and 3 additional groups meeting on a weekly or more frequent basis.
There is also one private adult group using Lincoln Gym for Basketball, and a similar Adult
group using Bonita Creek Football Field for Soccer practice, both on a weekly basis. Groups
that meet monthly or less frequently are now recorded in the regular rental figures.
Lacrosse - In May and the first Saturday in June, the Peninsula Park Field was used on
weekends in May through June 2 by Commonwealth Lacrosse and LAX Lacrosse.
• Basketball - American Roundball (Basketball) will be using both Lincoln Gym and West
Newport Gym on a regular basis in May and June.

Community Youth Center - New windscreens are being installed on the tennis courts.
West Newport Park - The windscreen will be replaced above the racquetball court.
Other Court Repairs - Over the next month basketball courts will be resurfaced at the
following locations; Carroll Beek Park, Channel Place Park, Grant Howald Park, West Newport
Park, and Cliff Drive Park. Necessary repairs will also be made to Bayview Park and San Miguel
Park
PARK DEVELOPMENT
Arroyo Park - A final walk - through of this park is scheduled for Monday June 4. At that time it
will be determined when the city will take over maintenance of the park. The earliest
possible date is July 9.
Bonita Canyon Sports Park - Work continues on the irrigation and the restroom buildings.
Some of the walkways are complete and parking lots are underway.
38`" Street Park - The new playground equipment has been ordered with installation expected
• by the end of June. Money for completion of the renovation of the basketball courts will be
re- budgeted to 2001/02 for completion after the public hearings.
West Newport Playgrounds - Work is completed at both these playgrounds and the rubberized
surfacing was installed at Peninsula Park playground as well.
Spyglass Hill Playground - Final work should be completed at this park soon after Memorial
Day weekend.
Volleyball Courts - Still awaiting direction from the City Attorney's office.
OTHER INFORMATION
Public Works Open House - The Community Services Department provided activities at the
Public Works Open House on May 19, for children. Eight Recreation Leaders were on hand to
operate carnival -style games, a scavenger hunt, and balloon creations. All had a good time.
Welcome to New Staff - The new Department Assistant, Lisa
Lee, began May 21. Lisa is a Newport Beach resident with a
• variety of experience in administrative positions.

Teen Coalition - Staff is participating in a community -wide effort to establish a teen coalition,
• which will examine needs and methods of service to the teen population in Newport Beach.
Teen programs are high on the list of priorities for Recreation Division Staff.

RECREATION SERVICES
Corona del Mar Scenic 5K - The event committee has been diligently preparing for the 20`"
annual race, scheduled for June 2, 2001. Promotional materials for the June 2 event have
been released. This year's art features the Sherman Library and Gardens. Approximately 3000
participants are expected to meet on Ocean Boulevard for the summer morning's activity,
which includes live music, restaurant row, the run, walk or children's dash.

Re: Seniors Division Monthly Activities Report
Step Out for Senior Centers - The second annual Step Out for
Senior Centers Walk was held on Friday, May 18. The walk
celebrates Senior Center awareness. Participation was open to
older adults, their families, and community members of all ages
who wish to promote a positive image of aging. The event
began with a warm -up at 8:45am and then a 2.5 mile walk down
to the beach and returned to OASIS with a continental
breakfast. Thirty people participated. The cost for the walk
was $4, which included a tee shirt and breakfast.
Medical Lectures - Two medical lectures were held on Wednesday May 23. At 11:15am. The
Pharmacist from preventive Health Care For the Aging Program spoke on medications and
depression. This same program provides the Center with a Public Health Nurse once a month
is to provide screenings and health counseling. The second lecture in the afternoon featured
Dr. Zusana Bic, discussing the latest in alternative medicine. Participants learned about
preventive care and integrated lifestyle management techniques, nutrition, exercise, and
stress management.
Friends of OASIS Annual meeting - The Friends of OASIS held their annual meeting on Friday,
June 1 at 10am. The election for 7 seats on the Board of Directors was held that day as well
as the business meeting. Election results were posted by the end of the day. After the
meeting, a spectacular Polynesian Revue entertained a group of 200 who enjoyed a luncheon
following the show.
Hearing Screening Events - In place of the one -day Health Fair, staff has planned many health
related lectures and screenings throughout the year. This month the Center held a hearing
screening activity on May 11 from 9am to 4pm. Coast Hearing Aid Center and the Hearing
Enhancement Center volunteered their services for the day. These screenings were done by
appointment only and therefore the usual long wait that accompanied the health fair was not
an issue. Dr.Schmitz also provided an informative lecture on May 16. He discussed hearing
related problems, problems associated with hearing aids, and purchasing hearing aids. Both
events were very well attended.
Computer Classes - Computer classes and related lectures still are very popular activities for

Background
The following proclamation, recognizing July as National Parks and Recreation Month
will be on the June 26, 2001 City Council agenda and presented to the Parks, Beaches
and Recreation Commission.
Proclamation - 01
WHEREAS parks preserve and protect our natural resources;
WHEREAS cities throughout the nation are celebrating July as National Parks
and Recreation month;
is WHEREAS Newport Beach had 43 dedicated parklands encompassing over 300
acres, and 13 recreation facilities;
WHEREAS recreation and parks promote wellness, strengthen workforces,
enhance residential and business locations, and stimulate tourism;
WHEREAS over 9,000 youth and 10,000 adults participate annually in City
recreation programs including sports, fitness, art, and lifelong learning;
WHEREAS over 300,000 citizens of all ages benefit from programs and facilities
provided by City of Newport Beach park and recreation services;
Now, therefore, be it resolved that I, Gary Adams, Mayor of the City of
Newport Beach, hereby proclaim July, as:
National Parks and Recreation Month
A time to enjoy benefits derived from the Community Services Department
programs and facilities, which provide something of value for everyone.

Recommendation
To accept the donation of one 24" box Purple Orchid (Bauhinia variegata) tree and
plaque from Ms. Nancy Isbell for planting at Mariners Park. Additionally, that the
verbiage and size of the donor plaque conform to City Council Policy G -5, (Attachment
A).
• Discussion
Staff received an inquiry from Ms. Nancy Isbell regarding a proposed tree donation for
Mariners Park.
Subsequently, Ms. Isbell submitted a letter dated May 3 (Attachment B) requesting the
approval of the tree donation. Staff feels that the donation of a 24" box tree would be an
enhancement to the park. The size of the donor plaque will conform to the City Council
Policy G -5 in size and verbiage.
Ms. Isbell has received a copy of this report and notice of the June 5 Commission
meeting.

• PARK AND STREET IMPROVEMENT DONATIONS
The City Council recognizes ilia need to provido residents wills 1110
opportunity to donate trees, benches, drinking fountains or related park and
street improvement items. This policy establishes criteria for donations to
assure attractiveness, usefulness and the capability to 'be maintained.
Tree Donations
The tree -lined walkway at Oasis Passive Park beginning at 5th Avenue and
Marguerite in Corona del Mar shall be identified as one area where a tree
with a bronze plaque can be installed. Other trees with plaques can be
donated and installed at locations recommended by the General Services
Director and approved by the Parks, Beaches and Recreation Commission.
Bench Donations
It shall be the responsibility of the Parks, Beaches and Recreation Commission
to designate the type, style, design, and placement of City-owned benches on
City property. Areas of placement may be parks, streets, along the
beachfronb within villages, commercial districts, and neighborhoods, on a
specific island, etc. Once an area has been designated with a certain style or
• type of bench, the 'Parks, Beaches and Recreation Commission may require
that the designation be changed only by a formal request for a redesignation.
The factors to be addressed in preparing the list of approved benches for the
City as well as the final design for a specific site will include at a minimum:
size, usage, vandalism; traffic, security, view obstructions, location, style
reflective of neighborhood and cost. The Arts Commission will provide
design review assistance as required.
Donation requests will be submitted to the General Services Department and
meet the following requirements.
a. Bench donations along a City street or beach front will require the
approval of the General Services Director and the Traffic Engineer.
b. Bench donations within a commercial district will require notification of,
and an endorsement from, the local business association.
c. Bench donations for parks within a residential community will require
notification of residents within 300 feet of placement and an endorsement
• from the homeowners association, when applicable.

Park and Street Amenities •
Items such as benches, drinking fountains, tables, etc., can be donated to be
included in the public park system. Recognition on the item shall be a 2" x 6"
plaque and limited to Donated by (Name) or Donated for (Name) as a means
of identifying the donation.
Donors of major park improvement gifts may elect to provide a dedicatory
plaque not exceeding 5" x 7" with name, date and appropriate text not
exceeding 25 words.
All donations must be approved by the Parks, Reaches and Recreation
Commission. The cost of a donated item, including identification plaque,
shall be borne totally by private funds. The City will assume ownership and
maintenance if accepted and placed in a public park or on a sidewalk unless
other arrangements have been agreed upon. The City will not assume
responsibility for replacement due to vandalism or theft.

Background
Arroyo Park is a 10 -acre park containing a lighted multi - purpose field (combination
soccer or softball), picnic area, playground, walkways, parking, and a trail to Bonita
Canyon Sports Park. The park was constructed by The Irvine Company as part of the
annexation agreement in 1998. It is expected to be completed and turned over to the
City in July.
The planned use of the park is for youth and adult sports groups in Newport Beach;
scheduled use will begin in fall 2001. The multi -use fields will be actively used by
youth sports groups, which include AYSO, Pacific Coast Bobby Sox, Newport Beach
Stammers and the City of Newport Beach youth flag football programs. Adult use of
the facilities will be primarily limited to softball leagues.
• In accordance with Council Policy 1 -27 — Parks, Beaches and Recreation Commission
Decisions, the Commission has the authority to make decisions on :
•
Any proposal to establish new or significantly modify, existing hours of
operation of any recreation facility or the hours during which recreational
activity is permitted on City property.
Council Policy 1 -27 states that hours of operation or recreational usage of lighted
fields is no later than 10pm, Monday through Thursday; no later than 9pm, Friday,
Saturday and Sunday; and no use of the park before lam. The City of Newport Beach
currently operates Lincoln Athletic Center, Grant Howald Park and Bonita Creek Park
under this policy.

programs that require field lighting. Projected revenue from youth ($9,000) and adult
programs ($39,810) that require lighting is expected to be $48,910.

A letter was received from the Bonita Canyon Maintenance Association, dated May 15,

operation limited to 8pm. One petition stated that they believed 8pm was too early
and suggested 9pm.
There were 101 signed petitions in favor of no restrictions
Five - hundred and seventy -five public hearing notices were mailed May 30. They indicated
that an agenda item on limitation of lighting at Arroyo Park would be on the Parks, Beaches
and Recreation Commission for June 5, 2001.

PARKS BEACHES AND RECREATION COMMISSION DECISIONS
The Commission shall, among other powers and duties, have the authority to make
decisions on the following proposals relating to park and open space facilities and outdoor
recreational activities:
A. Any proposal to install new lighting facilities in any recreational area owned or
controlled by the City of Newport Beach except low level lighting installed solely
for the purposes of safety or security;
B. Any proposal to establish new or significantly modify, existing hours of operation
of any recreation facility or the hours during which recreational activity is
permitted on City property. For purposes of this subsection, any proposal to
establish or extend the hours of operation or recreational usage after 10:00 p.m.
Monday through Thursday, after 9:00 p.m. Friday through Sunday or before 7:00
a.m. on any day shall be subject to approval by the Commission. The provisions of
this subsection shall not require the Commission to confirm or validate hours of
operation in existence as of the effective date of this Council Policy. The time
• frames in this section do not include time allocated to clean recreational areas after
activities are complete or continued lighting to facilitate clean-up;
C. Any proposal to install new recreational equipment or facilities within 100 feet of
the exterior boundary of any property zoned for residential use. The provisions of
this subsection shall not apply to the replacement or repair of existing recreational
equipment or lighting facilities;
D. Any proposal to construct or improve recreational facilities or recreational areas
that could reasonably be expected to significantly increase noise or traffic in any
residential area. The provisions of this subsection shall not apply to the
replacement, repair or enhancement of existing equipment or landscape,
improvements designed and intended to improve public safety, or modifications to
open space or recreational areas that do not significantly increase the area or
facilities available for recreational activities.
NOTICE
The Commission shall, prior to taking any action on any of the proposals described in
Paragraphs A - D, provide written notice of the proposal to all owners of residentially
zoned property within 150 feet of the property that is the subject of the proposal. The

written notice shall specify the substance of the proposal and the date, time and location of
the meeting at which the proposal is to be considered. In determining the ownership of
property the City shall use the latest equalized assessment roll. The exterior boundaries of
each parcel shall be used in calculating the distance between the residential parcel and the
property that is the subject of the proposal.
APPEAL
Any person shall have the right to appeal to the City Council any Commission decision on
any of the proposals described in Paragraphs A - D. The appeal must be in writing and
filed with the City Clerk within fourteen days after the date on which the Commission
took action on the proposal. The appeal shall not be accepted unless accompanied by the
fee established by Resolution of the City Council. The hearing on the appeal shall be
scheduled within thirty (30) days after the appeal is filed with, and accepted by, the City
Clerk. The City Council shall, in ruling on the appeal, consider the information,
documents and testimony presented to the Commission and other relevant information
known to the appellant when the matter was presented to the Commission.
COUNCIL CALL -UP
Any member of the City Council shall have the right to call up for review (call -up) any
action or decision of the Commission on any of the proposals described in Paragraphs A -
D. The hearing on the "call up' shall be conducted in accordance with the procedures for
an appeal as specified in the Appeal section of this policy.

As the elected representatives of the Bonita Canyon Maintenance Association, we are
writing to you to present the opposition of the Bonita Canyon community to the night time ball
field lighting constructed in the neighboring Arroyo Park.
Enclosed please find signatures from approximately 170 members of the Bonita Canyon
community, all of whom are opposed to the night lighting constructed in the Arroyo Park and
feel that the project, if operated as intended, would have a serious detrimental impact upon the
Bonita Canyon community. Specifically, the Association is concerned that the nighttime
operation of the ball field and the extensive operation of night lighting associated with such use
will promote noise, traffic, vandalism and crime in the neighboring area. Most significantly, a
limitation of operating hours for Arroyo Park is necessary because it is located in a ravine and
the noise associated with park usage carries much farther than it might from the City's other
parks that are not so situated.
As the attached petitions suggest, the membership of Bonita Canyon would like to see the

proposed.
Thus, on behalf of the members set forth on the enclosed petitions, we ask that you
consider our community's opposition to the Arroyo Park lighting and act to protect our homes by
facilitating the relatively minor alterations and time limitations proposed herein.

As a resident and/or homeowner in Newport Beach, I am signing below to voice my
support for night lighting at Arroyo Park, located in a ravine just off of Bison Avenue
between MacArthur Boulevard and the 73 Toll Road. The City of Newport Beach
desperately needs parks and play areas for its youth and adult sports leagues and to be

SUBJECT: Balboa Island Bench Report (Recycled)
The attached Agenda Item #6 was tabled by the Commission at the May 1, 2001 meeting.
The Item proposed three bench donations for installation on Balboa Island. The Commission
directed staff to prepare a report listing an inventory of the existing teak benches on both
Balboa and Little Balboa Islands including their location, bench plaque names, and any
difficulty the benches caused to pedestrian or maintenance access.
The attached bench inventory was submitted by Ms. Peggy Marotta, Beautification
Coordinator, Balboa Island Improvement Association (BIIA) and verified by staff. Also
• attached is a staff inventory indicating the total number of benches located on Marine
Avenue.

The photographs are provided for your review and are of the street ends at Sapphire at North
Bayfront, Topaz at South Bayfront and Garnet at South Bayfront Avenues which show the
location with the existing bench and a computer generated photograph with the
superimposed bench illustrating the effect with the addition of a bench.
Staff supports the donation of the three proposed benches.
A BIIA representative will be present at the Commission meeting to answer any further

Recommendation
To accept three bench donations, one for installation at each of the following sites,
Sapphire at North Bayfront, Topaz at South Bayfront, and Garnet at South Bayfront.
Discussion
A request to accept three bench donations has been proposed by the Balboa Island
Improvement Association (BIIA). The BIIA has been donating teak benches for the
Island for the past several years. Ms. Peggy Marotta, the Association bench coordinator,
submits the bench donation requests to staff for the BIIA. If the Parks, Beaches, and
Recreation Commission approves the bench donations, City staff installs the new
benches, and the BIIA is responsible for the full maintenance of the teak benches
thereafter.
Ms. Marotta has submitted the attached letter dated April 18, 2001 requesting the
approval of three bench donations. (Attachment A).
There is adequate space to place the proposed benches, which will complement the
existing benches at these locations and be a continued enhancement to the Island. The
verbiage and size of the donor plaque will conform to Council Policy G -5 (Attachment
B).
Ms. Marotta has received a copy of this report and notice of the May 1 Commission
meeting.

• PARK AND STREET IMPROVEMENT DONATIONS
The City Council recognizes the need to provide residents with the
opportunity to donate trees, benches, drinking fountains Or related park and
street improvement items. This policy establishes criteria for donations to
assure attractiveness, usefulness and the capability to'be maintained.
Tree Donations
The tree -lined walkway at Oasis Passive Park beguiiiing at 5th Avenue and
Marguerite in Corona del Mar shall be Identified as one area where a tree
with a bronze plaque can be installed. Other trees with plaques can be
donated and installed at locations recommended by the General Services
Director and approved by the Parks, Beaches and Recreation Commission.
Bench Donations
It shall be the responsibility of the Parks, Beaches and Recreation Commission
to designate the type, style, design, and placement of City -owned benches on
City property. Areas of placement may be patk3, streets, along the
beachfront, within villages, commercial districts, and neighborhoods, on a
• specific island, etc. Once an area has been designated with a certain style or
type of bench, the Parks, Beaches and Recreation Commission may require
that the designation be changed only by a formal request for a redesignation.
The factors to be addressed in preparing the list of approved benches for the
City as well as the final design for a specific site will include at a minimum:
size, usage, vandalism; traffic, security, view obstructions, location, style
reflective of neighborhood and cost. The Arts Commission will provide
design review assistance as required.
Donation requests will be submitted to the General Services Department and
meet the following requirements.
a. Bench donations along a City street or beach front will require the
approval of the General Services Director and the Traffic Engineer.
b. Bench donations within a commercial district will require notification of,
and an endorsement from, the local business association.
c. Bench donations for parks within a residential community will require
notification of residents within 300 feet of placement and an endorsement
• from the homeowners association, when applicable.

• Park and Street Amenities
Items such as benches, drinking fountains, tables, etc., can be donated to be
included in the public park system. Recognition on the item shall be a 2" x 6"
plaque and limited to Donated by (Nance) or Donated for (Name) as a means
of identifying the donation.
Donors of major park improvement gifts may elect to provide a dedicatory
plaque not exceeding 5" x 7" with name, date and appropriate text not
exceeding 25 words.
All donations must be approved by the Parks, Beaches and Recreation
Commission. The cost of a donated item, including identification plaque,
shall be borne totklly by private funds. The City will assume ownership and
maintenance if accepted and placed in a public park or on a sidewalk unless
other arrangements have been agreed upon. The City will not assume
responsibility for replacement due to vandalism or theft.

Ladies and Gentlemen:
I recently received notice of the public hearing scheduled for June 5, 2001 at which the
lighting at the new park adjacent to Bonita Canyon will be discussed. Unfortunately, I will not
be able to attend the hearing but wanted to present my views regarding the lighting issue since I
am a resident of Bonita Canyon.
I am sure that there will be a number of people at the hearing presenting arguments that
the height of the lighting that has been installed in the park be significantly lowered and that the
hours of operation for the lighting be significantly restricted. 1 received several copies of the
• petition that was circulated among residents of Bonita Canyon objecting to the lighting at the
park. I declined to sign the petition because I disagree with the positions taken in the petition.
First, each of the residents of Bonita Canyon was fully apprised of the proposed park and
the related lighting prior to purchasing properties in the development. We all signed documents
acknowledging receipt of disclosure documents that described the proposed park and the related
lighting. In fact, one of the reasons that I found Bonita Canyon attractive was the fact that a state
of the art park was going to be constructed adjacent to the development. We have anxiously
been awaiting completion of-'the park and anticipate regularly using the new park.
Second, as everyone who has children involved in sports in Newport Beach athletic
programs knows there is a chronic shortage of parks and athletic facilities in the City of Newport
Beach. The new park is a good first step in solving that shortage of park facilities. It would be
most unfortunate if the hours of operation of the new park were severely limited as some people
are requesting. I have a son who has participated in Newport Beach sports programs for the last
several years, and his teams were forced on a number of occasions to practice in the dark because
of the absence of lighted parks or other facilities. In addition, although I do not personally
participate in night sports programs, I think it is important to provide adequate facilities for
adults participating in evening spurts activities. If the hours of lighting at the new park are
severely restricted it will mean that the park will not be fully utilized, and that either the children
will not have a lighted park in which to practice or the adult sports program will not be able to
use the park. I thin k that either of these is a bad result and is not in the best interest of the City
• of Newport Beach.

• Third, I do not believe that lowering the height of the light towers will really make
anyone happy. 1 am not a lighting expert, however, common sense tells me that high lighting
towers provides better lighting with fewer lighting towers than would be necessary if the towers
were at a lower height. I believe that the park needs to have adequate lighting for its intended
purposes, and if the height of the light towers was lowered, then additional light towers would
need to be added to provide adequate lighting. The nearby residents would not be well served by
the additional light towers and they may find the lights at a lower height to actually be more
objectionable than the high towers with the light directed down towards the playing fields.

The Commission is to be commended for taking steps to address the shortage of park
facilities in Newport Beach and 1 would urge the Commission to make sure that the new park can
be fully used by all or the constituencies that it was intended to serve. Obviously, I would expect
the Commission to establish rules of use similar to those in place for the lighted park facilities at
Lincoln school and Bonita Creek.

I am writing this on behalf of Slammers Futbol Club, a local non -profit youth soccer
organization, to express our support of the City's original decision to have night lighting
installed and used at Arroyo Park. I represent over 100 Newport/Corona del Mar residents whose
• children have played or are playing on our Club and who fully support the aims of the City to
enhance our community by accommodating youth sports programs.
The City of Newport Beach desperately needs parks and play areas for its sports leagues and for
them to be able to use these facilities in the early evenings for games and practices. The City has
already installed the lighting facilities at Arroyo Park and has approved night lighting at the park.
The night lighting at Arroyo Park will be subject to the same limitations and restrictions placed
on other lighted parks located in the City of Newport Beach, When the neighboring homeowners
in the community of Bonita Canyon purchased their homes, it was fully disclosed to them that
Arroyo Park would have night lighting. I believe that night lighting is necessary for the full
enjoyment of Arroyo Park and I strongly urge the City of Newport Beach to continue to support
the approved plan for night lighting at Arroyo Park.

Dear Commissioners:
The City of Newport Beach is growing at a great rate, with the addition of many new communities, such
as Bonita Canyon. The American Youth Soccer Organization (AYSO) is working with the city to
embrace this growth by expanding available recreational facilities to support the children of the
community. In concert with city development, AYSO in the Corona del Mar I Newport Beach area is
growing at a rate of 100 players per year. Phis year we anticipate that approximately 3,000 children will
register to play AYSO soccer, ranging in age from 4 '/a to 18 years old.
Due to a lack of playing fields available last year, our Under 14, Under 16, and Under 19 teams played
most (in some cases, all) of their games away, that is, outside of Ncwport Beach. This season, with the
opening of Arroyo Park, these teams will have a -home' venue on which to play soccer. This new field
with lights will allow our older players to have practice and games in the evening hours.
• It has come to my attention that the Bonita Canyon Maintenance Association is protesting the opening of
the Arroyo Park lighted field. In their words: "the Association believes that the lighting at the Arroyo
Park may negatively impact the value of homes within our community because of the increased noise,
Traffic and vandalism that may result from the evening and late night use of the park." The Association
would like to lower the lights by 20 feet and limit the use of this facility to before 8.0OPM
I feei the Bonita Canyon Maintenance Association does not have all the information on the planning and
use of the park. AYSO, in conjunction with the City of Newport Beach's parks and recreation activities,
will use this field. In terms of AYSO use, this means that the children of Newport Beach will be on this
field. The lights for the field were designed to ensure the safety of our kids Reducing the height of the
lights on a soccer field may result in a dangerous situation for our children, either by lighting improperly
or by putting lights within kicking range of flying soccer balls. Limiting the use of the fields to 8:00 PM
will inhibit our ability to facilitate team practices in a lighted, safe environment.
One of the best things about living in Newport Beach is the availability of the many parks and activities
the city has planned for our families. l feel that with adequate communication we can work with
associations like the Bonita Canyon Maintenance Association and the city to ensure that organizations
like AYSO are able to best serve and protect die children in our community.
