5. Tree Donation
Accept donation of one 24" box Purple Orchid tree from Nancy Isbell to be planted at
Mariners Park.
2. Park and Tree Division - Chair Skoro congratulated the Parks Division on receiving yet
another Tree City Award and commended them and the Recreation Division for
another great Arbor Day. He noted that Council Member Ridgeway was there also.
3. Community Services - Commissioner Macfarland asked when the 380h Street Park
is would return to the Commission and thanked the staff for a great CcIM 5K.
Manager McGuire stated that the issued of the removal of the volleyball poles and
the basketball courts at 38th Street Park were with the City Attorney for discussion
with the Coastal Commission.

4. Proclamation — July as Parks it Recreation Month - Commissioner Beek asked that a
revision be made.
Manager McGuire stated that she would take care of it before forwarding to City Council.
Motion by Commissioner Pfaff to accept items 1 through 5 of the Consent Calendar. Motion
carried by acclamation.
6. City Public Information Officer - Chair Skoro stated that Gail McElroy was ill and would
return for a presentation in August.
7. Lighting at Arroyo Park - Manager McGuire stated that the park was constructed by The
Irvine Company as a park and annexed to the City of Newport Beach in 1998. It will be
turned over to the City in late July. She stated that the park will be used actively for
youth and adult sports in the fall of 2001. Manager McGuire also noted that this is only
.the 4`h lighted field in the City and that all the sports groups want and need these lighted
fields.

• Steven Brombal, 21 Regents, stated that he was the president of the Bonita Canyon
Maintenance Association, and noted that he agreed that there had been adequate
disclosure but stated emphatically that when residents signed these disclosures no one
had any idea of what a visual nuisance it would be to them in their homes. He urged
flexibility. Mr. Brombal stated that their position was that they would be best served if
there were not any lights at all, but would appreciate the Commission looking out for
their interest on have some compromise.
Commissioner Beek asked if Mr. Brombal had contacted The Irvine Company to voice his
concerns.
Mr. Brombal stated that his personal residence was not affected.
Commissioner Pfaff asked if Mr. Brombal knew what streets were affected.
Mr. Brombal stated that Lyndhurst, Sherwood, Dartmouth and Victoria were the most
impacted.
Bernard Towers, 1527 Priscilla Lane, representing the Stammer Club, stated that he
believed at the most that 8 or 9 houses were affected. He noted that all youth groups of
various ages have a tremendous need for fields and fields with lights. He stated that if
you move near a park there are positive and negative aspects but you should have to live
• with them, since the choice was theirs.
Greg Currens, 3 Dartmouth, stated that he personally is not affected, but that there is an
equity issue. He stated that yes they had been notified of a lighted park but no one was
notified that the light poles would be 80 feet high. He stated that since these decisions

were made when there were no residents, that it was the Commission's obligation to deal
with them now. They were not there when these decisions were made.
Sheila Walters, 30 Palazzo, suggested that members of the Commission come and visit
these homes. She also noted that there are two paths between the homes and the
apartments and that there is a safety issue because of possible loitering.
Commissioner Beek stated that a demonstration had been held back in February with
Commissioners, Council Members and the City Manager.
Marcelino Almaraz, 1607 Port Charles Place, AYSO President, stated that this park was
laid out so that it'was safe for children to play. He noted that limiting the lighting until
8pm will not allow enough time for children and adults to practice. He urged the
Commission to keep it at the time per the City policy.
Commissioner Beek asked if Bonita Canyon children would be using this park.
Mr. Almaraz stated that children from Bonita Canyon and alt other areas will be involved.
Pete Waiters, 30 Palazzo, stated that there are other problems besides the lights, one of
• them being parking. He also asked if the park would be used for anything other that
sports programs.
Manager McGuire stated that the field is scheduled quite extensively but there are times
when it is not in use and available to the public; however when there are no scheduled
games, no lights will be on.
Mr. Walters asked if any ideas for use by seniors at this park.
Manager McGuire stated that there is a walking path.
Mike Wade, 33 Belcourt Drive, Regional Commissioner, AYSO, stated that soccer
continues to grow and that they will welcome all Bonita Canyon children. He stated that
if lights were not used at this park then more parks would be needed in the City, and
there just is not any more space. He urged the Commission to support the park in its
present plan.
Commissioner Allen asked about the demographics of the children and practice times and
suggested the turn -off time be 9pm.
Mr. Wade stated that with the older teams they generally use the fields from 7:30 -
9:30pm, then clean up the field and done by 10pm. He stated that AYSO has donated a
• lot of money in past years and want to be good neighbors and are willing to work with
Bonita Canyon on possible compromises.
Commissioner Franklin asked if light standards were generally 80 feet high.

Manager McGuire stated that they were usually anywhere between 50 and 80 feet, but
Bonita Creek are 70 feet and at Arroyo one is 70 feet but the rest are 80 feet.
Tim Wada, 16 Sherwood, stated that when he attended the last demonstration he had
been assured that the lights would be turned off by 9pm, but was unsure of who had told
him this.
Resident, 10 Sherwood, stated that he was an engineer and though that by baffling the
lighting and possibly lowering the lights that it could reduce many of the problems
discussed here tonight.
Manager McGuire stated that the lights are shielded.
Rick Letz, Vice President, Bonita Canyon Maintenance Association, stated scheduling of
the lighting is the key and the earlier the turn off time the better.
Chair Skoro reminded the residents that there is a lack of fields and lighted fields in the
City.
• Mr. Letz stated that most resident believe that the lights will reduce their property
values.
Chair Skoro stated that he did not believe that property values would drop and that
recreational activities for youth is needed.
David Carnevale, 26 Palazzo, stated he does not live on the Arroyo, but that there are
multiple issues, he suggested limiting the lighting and that more police patrol the area of
Mesa View. He also noted that as residents they pay $15,000 to the City with taxes to
Mello Roos and that it should count for something.
Melissa Hicks, 27 Marble Sands, noted her concern of the longterm use of the park and
noted that she has driven past Lincoln Park and that no one was using the field and yet
the lights were on.
Manager McGuire stated stated that there have been problems in the past but that all the
lights are on timers.
Discussion ensued regarding the need for the Police Department regularly drive by the
park once it has been turned over to the City.
Manager McGuire stated that for the record she had received 26 phone calls
22 in support of lowering the use and time of the lights

Barbara Rappolo, stated that her house is in escrow and has many grave concerns and
stated that the light standards should be lowered; she urged the Commission to have
another demonstration and testing of the lights at the earliest time available.
Chair Skoro closed the public hearinrt
Motion by Commissioner Franklin that the hours for use of Arroyo Park remain the same
as all other parks in the City; and that another tight test be scheduled with Musco, once
the park has been turned over to the City.
Discussion ensued regarding the motion.
Commissioner Allen stated that she would be unable to support the motion because she
believes that the lighting situation can be solved with a little more effort.
Substitute Motion by Commissioner Beek that the hours for use of Arroyo Park remain
the same as all other parks in the City.
Commissioner Franklin withdrew his motion.
• Commissioner Pfaff asked that a light test be scheduled; that staff would notify, Mr.
Brombal, Merit HOA, Youth Groups of the date when scheduled.
Motion carried by the following vote:

8. Balboa Island Bench Report - Director Niederhaus stated that this was a recycled report
from May and had attached maps denoting the locations of the three benches.

• Garnet at South Bayfront
Commissioner Beek commented that she was concerned that those benches had been placed
without the approval of the Commission.
Director Niederhaus stated that one bench had been installed by BIIA because of a
miscommunication, and stated that he would see that the bench was removed promptly. He
stated that BIIA takes the responsibility for the maintenance of these benches because they
are teak, and are informed of where to go to purchase the plaques. He noted that staff is
usually responsible for installation of benches.
• Commissioner Beek stated that she still needs clarification on the number of benches and
asked the question of "when are there too many benches ?"

Motion by Commissioner Beek that staff provide a map with locations of existing approved
benches including the width of the street.
Discussion ensued regarding staff time needed to provide the information requested.
Alternate Motion by Chair Skoro to approve staff's recommendation. Motion failed by the
following vote:
Ayes: Allen, Skoro, Tobin
Nay: Beek, Franklin, Macfarland, Pfaff
Commissioner Macfarland stated that he would like to see a map that shows the actual
physical location of the benches.
Motion by Commissioner Beek to table the request by Balboa Island Improvement
Association to donate three benches to be installed at:
• Sapphire at North Bayfront
• Topaz at South Bayfront
• Garnet at South Bayfront
And request staff to return next month with a report to include the number of benches
and their locations.

And that staff will provide street widths and a map with bench locations; approve bench
donation on Sapphire at North Bayfront.

9. July Commission Meeting - After discussion it was agreed that the Commission would
meet July 3, as scheduled.
10. Committee Reports
• Budget - Budget hearing with Council will be June 12.
• Castaways Park - Nothing new to report.
• Park Development - Chair Skoro stated that letter went to City Council requesting
funds to plan a Central Library at the Newport Village site.
• Recreation £t Open Space Element - Commissioner Beek stated that the committee
needed to meet with General Services to discuss signage within the Element.
• Recreation Services - Nothing new to report.
• Seniors - Commissioner Beek stated that she had attended the OASIS installation and
congratulated staff on a terrific job.

Re: City Ficus Trees
Main Street, Balboa Peninsula
Dear Mayor Adams and City Council Members,
With regard to the upcoming hearings in Newport Beach concerning the ficus trees on Main
Street, Balboa Peninsula, I am attaching a letter from Certified Arborist Alden Kelley. He is
offering his opinion considering the proposed removal and replacement of these ficus trees. He
has reviewed the trees on site and also reviewed the independent report commissioned by the City
entitled City Ficus Landmark Trees, Arboricultural Services, prepared by Integrated Urban
Forestry, dated April 23, 2001.
According to Dr. Kelley, it appears feasible to correct the structural problems caused by these
trees, and minimize or prevent recurrences, while still retaining these trees. In addition, the
• replacement trees proposed for this area, the red - flowering gum, can cause hardscape damage and
structural damage and be as inconvenient and costly as the existing ficus trees. Moreover, the
foliage from these trees can cause view blockage of signage while the trees are maturing, and
their fruits may cause a slip - and -fall hazard.
The Main Street Ficus Trees are on the Preservation of Special Trees List in the City's G -1
Policy, the Retention or Removal of City Trees. According to this Policy, "Special trees shall be
retained, unless there are overriding problems, such as death, disease, or the creation of a
hazardous situation, which require their removal." None of these criteria are present in the current
situation, and these trees shall be retained, according to the policy.
These trees are gorgeous and provide a canopy that flames the view of the Pacific Ocean down
Main Street, while creating a cooling and comfortable effect for pedestrians. The trees have
survived and thrived under difficult conditions, and it is not clear at all that the replacement trees
will do so well and will not cause similar problems in the future. Meanwhile, the replacement
trees will never create the beautiful canopy now provided by the existing trees.
If the Special City Trees Section of the G -1 Policy has any meaning, now is the time to respect it.

Dear Dr. Vandersloot:
• I am writing to offer my observations regarding the ficus trees on Main Street. Will you
be so kind as to provide copies of this letter to the various parties considering removal
and replacement of the ficus trees?
The ficus trees clearly add character, esthetics and significant environmental enhancement
to the area. They constitute a noteworthy addition to the local attraction to tourists and
residents alike.
There is no denying that the ficus roots have generated serious structural problems.
However, it appears feasible to correct those conditions and minimize or prevent
recurrences, while still retaining the trees. I have been involved with comparable
situations in various locations in Los Angeles, in which the problems were resolved
without recourse to removing ficus trees.

Any consideration of procedures and costs to retain the Main Street ficus trees should
include a careful, detailed assessment of the full effect of the proposed replacements
(reported to be red - flowering gum, Eucalyptus fcifolia).
For starters, the red - flowering gums would generate foliar blockage of signs and store
fronts for many years to come. Any removal of lower branches, adequate to provide
effective sign clearance over the first 5 - 10 years or more, would force abnormal crown
height extension, yielding diminished tree vitality; attenuated, weak trunks; and increased
vulnerability to trunk breakage under wet and windy weather conditions.
Red - flowering gums normally form thick trunks and broad root flares. If the bases are
confined to cutouts less than 5 or 6 feet in diameter, the root flares can grow over the
• edges of surrounding hardscape. (I am presently involved in a lawsuit in which a red -
flowering gum outgrew it cutout limitations and subsequently fell onto a car, critically
and permanently disabling the person in the car.)
Red - flowering gums produce dramatically beautiful flowers, but the resulting fruits are
large (about I inch in diameter), hard, rounded fruits. If not cleared frequently from
sidewalks, the fallen fruits present a slip -and -fall hazard.
Eventually red - flowering gum roots can lead to hardscape damage and other structural
problems such as those associated with the Main Street ficus trees.
On balance, the short- and long -term problems to be expected from red - flowering gums,
while different in some respects, could prove to be as inconvenient and costly as those
attributed to the existing ficus trees.

I urge all interested parties to critically review all available information and studies
regarding the ficus trees, to arrive at a clear view of the full picture. It is important to
evaluate the contents of each of the various reports, with a view to recognizing and
assessing the validity and objectivity therein: some of the available information is slanted,
encouraging uncritical acceptance of imprecise generalities and biased cost projections.
Such presentations should be analyzed, and the sources thereof required to fully define
their inputs and calculations, to yield accountable, objectively derived conclusions and
predictions.

SUBJECT: Parks and Trees Divisions Activities Report
Park Division Activities
1. Staff continued coordinating the construction of the Bonita Canyon Sports Park and
monitoring the maintenance period of Arroyo Park with the Public Works Department.
2. Staff coordinated with Community Services, Public Works and an installation
contractor regarding the renovation of the sand play areas at Spyglass Hill and West
Newport Parks. The work has been completed and provides upgrades at these two
parks.
3. The annual weed abatement of Castaways Park was completed. The project was
coordinated between the Fire Marshal, staff, and a weed abatement contractor. The
work ensures a safe environment before the summer fire hazard. Additionally, a portion
of Cliff Drive Park and several undeveloped park sites in the City were included in this
project.
5. The Fletcher Jones Motor Cars mitigation requirements in the Mouth of Big Canyon
have been approved by the State and deemed mitigated. This multi -year project entailed
the removal of all non - native plants in a portion of the Canyon and the planting of
natives, along with selective removal of non - natives in three phases within a wetland
area. This work provided for important animal habitat restoration.
Upcoming Activities for July
1. The planting of replacement shrubs and ground covers will continue Citywide.
2. Staff will continue to monitor the Arches Mitigation Sites in the Big Canyon area.
3. Staff will continue coordinating the annual control of rodents with contract services.

Tree Division Activities
During the month of June, 132 trees were trimmed, 127 trees were planted and 4
emergency calls were responded to regarding trees. The Urban Forester received 76 tree
maintenance requests.
1. The City tree - trimming contractor, West Coast Arborists, continues tree trimming
throughout the Corona del Mar and Irvine Terrace areas which is scheduled for
completion this summer, thereafter the Buffalo Hills area is scheduled.
2. The Urban Forester coordinated the Citywide Sidewalk Replacement Program with the
Concrete Maintenance Supervisor and the Public Works Inspector. This work involved
the Urban Forester inspecting City street trees as related to sidewalk repairs.
3. The attached Tree Activity Report summarizes work that was performed during the past
several months.
4. At the June 12 City Council meeting Chairman Val Skoro presented Mayor Gary
Adams and the City Council with the National Arbor Day Foundation's Tree City USA
Award and the Tree City USA Growth Award for an outstanding Urban Forestry
Program.
• 5. Staff completed the Corona del Mar street tree planting on East Coast Highway which
included planting 85 King Palms and Hong Kong Orchid boxed trees. The project
included removal of hardscape for tree wells, installation of irrigation to each tree,
planting trees, concrete replacement, and mulching. Staff received many compliments
from the business community for an expedient and well done job. The project was a
very successful partnership program between the Corona del Mar Business
Improvement District (BID) and the City.

Re: Recreation Division Monthly Activities Report
ADULT SPORTS
Adult Basketball - The 2001 summer adult basketball leagues began the week of June 19 with
78 teams participating. Games are being played at the West Newport Community Center,
Ensign School, and the Eastbluff Boys and Girls Club.
Adult Softball - The 2001 summer adult softball leagues are continuing with games played at
Bonita Creek Park, CDM High School, Eastbluff Park, Grant Howald Park, Lincoln Athletic
Center and Bob Henry Park. Enthusiasm among the league participants is high and many are
looking forward to the opening of Arroyo Park.
YOUTH PROGRAMS
Youth Council - Twenty members of the City of Newport Beach Youth Council met in early June
to evaluate the projects and programs they pursued over the past year. Active discussion

• Youth Council are looking forward to coordinating a Challenge Day event in 2002 as well as
community -wide special events for teens. The group will begin meeting again in October.
Youth Basketball - Summer Hoops, a recreational basketball program, is in full swing with 24
teams and 202 children participating. Teams are formed at five local elementary schools and
coached by one the finest group of staff coaches the basketball program has ever seen.
Three divisions are offered this summer, CC for second and third graders, C for fourth and
fifth graders and B for children entering grades six and seven.
Youth Sports Camp - Sports Day Camp for children, grades 1 -6 is held at the Community Youth
Center in Corona del Mar. The camp, which occurs through the summer, meets the childcare
needs of many parents in the Newport Beach community. Recreation Leaders and youth
coaches conduct camp activities which offer the opportunity to experience a wide variety of
sports such as Flag Football, Soccer, Ultimate Frisbee, Disk Golf, Court Hockey, Basketball,
Lacrosse, Track and Field and more. A weekly excursion also has campers visiting local
attractions such as Wild Rivers, Universal Studios and Sea World.

Swim Fees - Warm weather and increased pool fees have brought in more people and revenue
. respectively. Drop -in prices increased from $2 to $3; 20 -swim punch pass from $30 to $50
($60 for non- residents); and annual passes from $105 to $160 ($190 for non - residents).
Swim Lessons - Summer swim lessons will only be held at Newport Harbor High School even
though eleventh hour negotiations with the Newport-Mesa Unified School District resulted in
the City agreeing to pay to heat at MBAC for eight weeks. Swim registration opened online
June 6 and the revenue shown reflects the totals for two weeks. Swim lesson fees increased
going from $30 to $43 for group lessons, $65 to $80 for semi - privates and $85 to $105 for
private lessons. Ten dollars of the increase will go towards the energy surcharged placed on
the City through the school district. Non - residents will pay an additional $5 for group lessons
and $10 for semi and private lessons. Costs to heat the two pools are estimated at $33,800.
CONTRACT CLASSESANSTRUCTION
Registration - Summer registration continues to go well with nearly 3000 registered in
activities. Favorites continue to be sailing, surfing, tennis and golf.
Independent Contract Instructor Annual Meeting - On June 11, a meeting was held with
Independent Contractors to review the Guidelines and Procedures Manual, outlining in detail
the services provided by the Community Services Department, requirements that must be
fulfilled by the Contractor and their role and responsibilities as Independent Contractors.
• FACILITIES USE AND MAINTENANCE
Facilities:
During the period of May 15, 2001 through June 14, 2001 there were:
• 28 Park /Picnic Area Rentals
• 12 Room Rentals
• 4 Field Rentals
• 8 Gymnasium Rentals
Fee Schedules - New proposed fee schedules have a slight fee increase for facility use and a
higher increase for gymnasium use (to offset electricial charges). A minimum use fee of $5 to
cover energy costs was proposed for groups such as boy scouts and girt scouts, who have fees
waived for rental.
PARK DEVELOPMENT
Arroyo Park - A punch list was developed at the final walk through and an opening date has
not yet been determined.
Bonita Canyon Sports Park - Work continues on the irrigation with East Park nearly ready for
weed abatement. The roofs on the restroom buildings are in progress.

Spyglass Hilt Playground - This Park is completed and open with just a few final touches to be
added.

Arbor Day - The City of Newport Beach Community
Services Department and General Services: Parks Division
celebrated Arbor Day with Eastbluff Elementary School
students at Eastbluff Park on Monday, May 21. Parks,
Beaches and Recreation Commissioner, Val Skoro,
conducted the ceremony and Council Member Tod
Ridgeway, presented a proclamation. Thom Porter,
California Urban & Community Forester presented the
City with an Arbor Day Flag. Other special quests
included Susan Despenas, Assistant Superintendent of
Elementary Education and School Board President, Dave
Brooks. Forty third grade students preformed skits and
sang songs in celebration of the event. Each student participated in the planting of four trees
in the park and was presented with a tree seedling to plant at home with their parents.
Corona del Mar Scenic 5K - The 20`" Annual Corona Del Mar Scenic 5K drew approximately
2100 participants on a cold and damp June morning. Despite the poor weather conditions, 25
local merchants, 18 restaurants and a blues band were on -site making sure every runner
experienced the feeling of community in Corona del Mar. An estimated $36,000 were raised
from the event, with $18,000 directed to support City coordinated youth programs and
another $18,000 directed at financing Corona del Mar community beautification projects.
• Independence Day Picnic and Parade - Mariners Park becomes a center for fun and laughs as
the Community Services Department and the Mariners Elementary School Foundation host the
Annual Independence Day Parade and Picnic on July 4. Over 2000 kids of all ages are
expected to participate in the day's festivities, which include a bike parade, Bamaby the
clown games and contests and food.
Other
Teen Coalition - Staff attended a meeting in June with over 25 community leaders to discuss
establishment of a teen coalition, which will examine needs and methods of service to the
teen population in Newport Beach. Teen programs are high on the list of priorities for
Recreation Division Staff and are a priority for 2001 -02.
Summer Staff Training - Two separate trainings were held for seasonal staff. The swimming
pool lifeguards and instructors attended a staff orientation and training on Friday, June 22
from 6:00 to 9:00 p.m. at Newport Harbor High School. There are ten new staff working this
summer with half of them staying on year round. Aquatics staff were re- certified in CPR /FPR
on June 15 and all staff will have safety training every two weeks throughout the summer
session.
A training session for the city's youth sports coaches, after - school program workers and
summer camp staff was held June 23 and 24 at CYC. There were 28 staff attending. The
• training was designed to assist staff in understanding their role as a city employee and to
provide them with valuable tools and insight on working with school age children. Two guest
speakers presented, Dr. William Dyment, a clinical psychologist addressed ways to deal with
violence in the workplace, such as angry parents and children. The second speaker was Dave

Bacon, a recreation supervisor from the city of Redondo Beach. Dave's presentation focused
• on play leadership, creative ways to organized activities and motivate children to participate.
Sports Commission - The Youth Sports Commission met on June 28. Topics of discussion were
field use for fall of 2001, energy conservation and rising cost of lighting fields, use of
reservation forms and requirements for co- sponsored groups. All groups are required to sign
a contract outlining their responsibilities. Parks Supervisor, Randy Kearns and NMUSD
representative Sandy Bodman were present also.

Polynesian Review - The OASIS Center had fantastic Polynesian Show at the Annual meeting of
the Friends of OASIS on June 1. The groups name was fill ■I
Tekurio and are from Costa Mesa. Two hundred had the
pleasure of watching this very professional group followed by
a prime rib lunch.
Discussion Group - The Foreign Policy Discussion Group call
"Great Decisions" discussed the United States and Iraq in
their monthly meeting on June 21, from 1:00 - 3:OOpm. This
group meets monthly and discusses various policies and decisions that they have read in the
accompanying literature and viewed on a Great Decisions produced video. A dedicated
volunteer takes the leadership for this group of 20 people.
• Travel Group - The travel group from OASIS enjoyed some of the greatest music ever written -
"South Pacific ", at the Lawrence Welk Resort. They enjoyed lunch as well as the play and
were given some time for shopping. The cost for the trip was $56.
Election of the Board of Directors - The annual election for 7 seats on the Board of Directors
for the Friends of OASIS was held on June 1. Four incumbents were re- elected, Sue Caraco,
Gwen Collins, Ray Gootgeld, and Carol Rails. The new members are Connie Boehler, Bill
Shaver and Lou Willey. At the June Board meeting, the Executive offices were voted on and
the results are as follows: Sheila Hatchell for President, Ray Gootgeld for 1" Vice President,
Mary Jacoby for Secretary, and John Krause for Treasurer. The newly elected members will
be installed on July 6 at the General Membership meeting.
Transportation Issues - The Senior Services Manager met with OCTA this month to discuss
possible collaboration. OCTA is offering to pay 80% of the cost of a new transportation
service and estimates based on population statistics. The City of Newport Beach would need
to pay the remaining 20 %. This service would be in addition to the existing program. With
the annexation in the near future, additional transportation would be needed to
accommodate the senior population. OCTA said that the transportation can be structured in
any manner that the city feels is best suited for them. The potential to enter into a
collaboration with OCTA will be under discussion for the next 3 months.

The tree -lined walkway at Oasis Passive Park beginning at 5th Avenue and
Marguerite in Corona del Mar shall be Identified as one area where a tree
with a bronze plaque can be installed. Other trees with plaques can be
donated and installed at locations recommended by the General Services
Director and approved by the Parks, Beaches and Recreation Commission.

It shall be the responsibility of the Parks, Beaches and Recreation Commission
to designate the type, style, design, and placement of City-owned benches on
City property. Areas of placement may be parks, streets, along the
beachfront; within villages, commercial districts, and neighborhoods, on a

type of bench, the Parks, Beaches and Recreation Commission may require
that the designation be changed only by a formal request for a redesignation.
The factors to be addressed in preparing the list of approved benches for the
City as well as the final design for a specific site will include at a minimum:
size, usage, vandalism; traffic, security, view obstructions, location, style
reflective of neighborhood and cost The Arts Commission will provide
design review assistance as required.

Discussion
• Staff received an inquiry from Ms. Clara E. Chadwick regarding a proposed tree donation
for Cliff Drive Park.
Subsequently, Ms. Chadwick submitted a letter dated June 20, 2001 (Attachment B)
requesting the approval of the tree donation. Staff feels that the donation of a 24" box
tree would be an enhancement to the park. Ms. Chadwick confirmed the donor plaque
will conform to the City Council Policy G -5 in size and verbiage.

In addition to review by the Commission, City Departments have been asked to review
the plans and provide comments by August 10, 2001.
City requirements for the site from the recreation point of view is to maintain the
current City youth and adult sports programs, the requirement include:

. Boat storage for City's fleet of sabots and lidos, with specific site for launching
boats.
. Community Center for dance and recreation classes for youth. A second floor
area, above the Legion Hall is a questionable site for youth programs.
A better use to would be a joint Community Center /Girl Scout facility. The
current scout facilities appear to City staff to be vastly underused. The Girl
Scouts currently have no dock space.
. A site for basketball halfcourt; playground; grill and picnic tables.

• Attached is what you've all been waiting for, the first submittal for development of the
Marinapark site from Sutherland Talla Hospitality. Per their agreement with the City
(also attached), we now have until August 10 to submit written comments to Sutherland
Talla. They will use our comments and those received at a community forum on July 9 to
modify their project description and submit it for Planning Commission and City Council
approval. The project description is intended to be sufficient for the City to initiate
General Plan, Zoning and LCP amendments, and to prepare an Initial Study.
I am asking you or someone in your department to review this submittal. Please let me
know if you assign this to someone, so I can have Shirley or Helen schedule a meeting in
2 -3 weeks for us to go over our comments so they can be presented to Steve Sutherland
in a coherent fashion.

Relocation of Existing Uses.
1.
American Legion. The American legion will be relocated to the
waterfront on the 18' street end of the property. Sutherland Talla
Hospitality will develop a new dock system with 20 slips. In addition, it is
the intention of Sutherland Talla to acquire 20 moorings in the harbor. I
have had discussions with staff and I understand that it is possible to
"trade" moorings with boaters that are located in front of the new
American Legion site. The intent is that all legion members that now have
a slip in the existing marina will located in one of the new slips or on a
mooring in front of the legion. It is the intention of Sutherland Talla to
fast build the new legion post before beginning work on the existing legion
facility.
2.
Girl Scout House. The existing Girl Scout House will be removed from
the site. A new facility for the Girl Scouts will be built by Sutherland
Talla Hospitality on the same site (moved back from the street) and
dedicated to the Scouts. The Girl Scout Council will also be provided
marina access and dock space to operate water based sailing and other
programs for the girls. This will be part of the projects overall

construction.
Community Center. A new Community Center is planed for the second
floor of the American Legion facility. The intent is that Balboa residential
associations and central business associations will have a waterfront -
dedicated place in which to conduct its meetings and events.

TOT Park. The existing TOT Park will be moved from its current
location (next to the Edison Transformer) to a site adjacent to the new
Girl Scout facility. This will be a part of the projects overall construction.
5.
Tennis Courts. The tennis courts will be replaced in the same general area
that they are now located. The courts will run north to south. The new
courts will be a part of the hotel but membership without charge will be
available to all Newport Beach residents.
6.
Marina Park Mobil Home Court. It is my understanding the City
Attorney is investigating the requirements.
7.
Public Park at 15e Street. The existing park will be relocated to an area
along Balboa Blvd between the tennis courts.

Regent Newport Beach
General Program for the Resort and the Community
1.
The Regent Newport Beach will be a 5 Star Resort operated with the Regent
International Brand
2.
The resort will consist of 156 guestrooms and suites. In addition, two vintage
yachts will be restored and utilized as floating suites.

The existing marina will be redesigned to accommodate the two vintage
yachts and have dock space for " yachts in transit ". The marina will also
accommodate a sailing and rowing club and have slips for local boaters to
tie -up and visit the property. The rowing and sailing club will be for guest of
the resort and residents of Newport Beach. Programs will be available for
local children to learn sailing and rowing without charge.
4.
There will be a main restaurant located in the lobby structure. A specialty
restaurant will be located centrally on the property overlooking the pool and
bay. The restaurants are fully open to the public. The lobby will be the

location of the bar and will house the kitchen, administration, limited retail,
meeting rooms and ballroom. The second floor of the lobby will house 31
guestrooms and the resorts spa.
5.
The existing boardwalk along the bay will be redesigned and extended all
the way to 15' Street. This will provide better pedestrian circulation and
access to the bay and the beach.
6.
The grounds of the resort will be extensively landscaped with cobblestone
walkways; water fountains and arbor covered seating areas. The grounds will
be open to the public with entry encouraged through the day.

Discussion
The attached Agenda Item #8 from the Parks, Beaches, and Recreation Commission meeting
of June 5, 2001 proposed three bench donations for installation on Balboa Island. One of the
three, the bench proposed for the Sapphire Avenue street end at North Bayfront, was
approved (Attachment A). Staff was directed to provide additional information for the two
other proposed bench donations, one at Topaz Avenue and South Bayfront, and one at
Garnet Avenue and South Bayfront.
The attached photographs for your review are of the street ends at each of these locations and
show the existing bench including a computer generated photograph with a superimposed
additional bench illustrating the visual effect with the addition of a second bench. A
measurement of the street from curb to curb is noted on each of the photographs of the two
street ends. (Attachment B).
Also requested and attached is a map, with a color -coded inventory of the existing teak
benches on both Balboa and Little Balboa Islands street ends.
Staff does not consider either of the bench additions as obstructive to the street ends.
Ms. Peggy Marotta, Landscape Coordinator, Balboa Island Improvement Association has
received a copy of this report and a request by staff to attend the Commission meeting.

The Item proposed three bench donations for installation on Balboa Island. The Commission
directed staff to prepare a report listing an inventory of the existing teak benches on both
Balboa and Little Balboa Islands including their location, bench plaque names, and any
difficulty the benches caused to pedestrian or maintenance access.
The attached bench inventory was submitted by Ms. Peggy Marotta, Beautification
Coordinator, Balboa Island Improvement Association (BIIA) and verified by staff. Also
. attached is a staff inventory indicating the total number of benches located on Marine
Avenue.

Recommendation

Discussion
A request to accept three bench donations has been proposed by the Balboa Island
Improvement Association (BIIA). The BIIA has been donating teak benches for the
Island for the past several years. Ms. Peggy Marotta, the Association bench coordinator,
submits the bench donation requests to staff for the BIIA. If the Parks, Beaches, and
Recreation Commission approves the bench donations, City staff installs the new
benches, and the BIIA is responsible for the full maintenance of the teak benches
thereafter.
Ms. Marotta has submitted the attached letter dated April 18, 2001 requesting the
approval of three bench donations. (Attachment A).
There is adequate space to place the proposed benches, which will complement the
existing benches at these locations and be a continued enhancement to the Island. The
verbiage and size of the donor plaque will conform to Council Policy G -5 (Attachment
B).
Ms. Marotta has received a copy of this report and notice of the May 1 Commission
meeting.

PARK AND STREET IMPROVEMENT DONATIONS

The City Council recognizes the need to provide residents with tho
opportunity to donate trees, benches, drinking fountains or related park and
street improvement items. This policy establishes criteria for donations to
assure attractiveness, usefulness and the capability to 'be maintained.
Tree Donations
The tree -lined walkway at Oasis Passive Park beguuwig at 5th Avenue and
Marguerite in Corona del Mar shall be identified as one area where a tree
with a bronze plaque can be installed. Other trees with plaques can be
donated and installed at locations recommended by the General Services
Director and approved by the Parks, Beaches and Recreation Commission.
Benda Donations
It shall be the responsibility of the Parks, Beaches and Recreation Commission
to designate the type, style, design, and placement of City-owned benches on
City properly. Areas of placement may be parks, streets, along the
beachfront, within villages, commercial districts, and neighborhoods, on a
specific island, etc. Once an area has been designated with a certain style or
type of bench, the Parks, Beaches and Recreation Commission may require
that the designation be changed only by a formal request for a redesignation.
The factors to be addressed in preparing the list of approved benches for the
City as well as the final design for a specific site will include at a minimum:
size, usage, vandalism,. traffic, security, view obstructions, location, style
reflective of neighborhood and cost. The Arts Commission will provide
design review assistance as required.
Donation requests will be submitted to the General Services Department and
meet the following requirements.
a. Bench donations along a City street or beach front will require tie
approval of the General Services Director and the Traffic Engineer.
b. Bench donations within a commercial district will require notification of,
and an endorsement from, the local business association.
c. Bench donations for parks within a residential community will require
notification of residents within 300 feet of placement and an endorsement
• from the homeowners association, when applicable.

• Park and Street Amenities
Items such as benches, drinking fountains, tables, etc., can be donated to be
included in the public park system. Recognition on the item shall be a 2" x 6"
plaque and limited to Donated by (Name) or Donated for (Name) as a means
of identifying the donation.
Donors of major park improvement gifts may elect to provide a dedicatory
plaque not exceeding 5" x 7" with name, date and appropriate text not
exceeding 25 words.
All donations must be approved by the Parks, Beaches and Recreation
Commission. The cost of a donated item, including identification plaque,
shall be borne totally by private funds. The City will assume ownership and
maintenance if accepted and placed in a public park or on a sidewalk unless
other arrangements have been agreed upon. The City will not assume
responsibility for replacement due to vandalism or theft.

Recommendation
Approve change of the current street tree designation on Main Street from the
Cryptocarya rubra (no common name) to the Eucalyptus torquata (Coral Gum) and on
Balboa Boulevard from the Metrosideros excelsus (New Zealand Christmas Tree) to the
Eucalyptus nicholii (Willow- Leafed Peppermint).
0 Background
The City Street Tree Designation List is maintained and reviewed on an annual basis by
City staff (Attachment A). The Parks, Beaches, and Recreation Commission reviews any
proposed changes to parkway street tree designation per City Council Policy G -6
(Attachment B). The current designated street tree for Main Street is the Cryptocarya
rubra and for Balboa Boulevard the Metrosideros excelsus (New Zealand Christmas
Tree).
Renovation of the subject streets is part of the current Balboa Village Project which is a
seven million - dollar multi - phased beautification project for the Balboa Village area. The
area targeted for renovation is bound by the Balboa Pier on the south, the Newport Bay
on the north, Adams on the west and A Street on the east. The project encompasses the
reconstruction of streets, sidewalks, curbs, utilities, and new landscaping, irrigation, and
street trees as part of the beautification efforts. The current street trees will be removed
as part of a City beautification project.
Discussion
The Public Works Department has been coordinating the design work and on -going
IDpublic meetings regarding the proposed improvements. The groups that the City staff has
met with include the Promote Revitalization of Our Peninsula (PROP), which has three
appointed City Council members on the Committee, Central Newport Beach Community
rp-7
Association (CNBCA), Balboa Peninsula Point Association (BPPA), and the Balboa
Merchants and Owners Association (BMOA).
At the PROP meeting held May 10, 2001, attendees included representatives from
CNBCA, BPPA, and BMOA who unanimously approved the proposed street tree
designation for Main Street as the Coral Gum. Additionally, at a second PROP meeting
held May 29, 2001, attendees included CNBCA, BPPA and BMOA unanimously
approved the street tree for Balboa Blvd. as the Willow- Leafed Peppermint Eucalyptus
tree. Additionally, attached are letters of support from both the BMOA and BPPA
(Attachment Q.
Informationally, the projected schedule specifically regarding the trees includes the
following phases;
♦ Phase I
A: Beginning September, 2001 the removal of 11 Lemon Gum Eucalyptus trees on
Balboa Boulevard and the planting of 23, 36" box Willow- Leafed Peppermint
Eucalyptus trees by Spring, 2002.
B: 24 Ficus parkway street trees on Main Street would be removed September, 2002
and 32, 36" box Coral Gum Eucalyptus trees would be planted by Spring, 2003.
♦ Phase II
Includes the removal of 3 Lemon Gum Eucalyptus trees and the planting of an
additional 10, 36" box Willow- Leafed Peppermint Eucalyptus trees by Spring, 2003.
The current street tree designations for Washington and Palm Streets and Bay Avenue are
not being considered for a change.
The Presidents of the three associations, Central Newport Beach Community Association,
Balboa Peninsula Point Association, and the Balboa Merchants and Owners Association
have been sent a copy of this report and a notice of the Commission meeting.

The Balboa Merchants Owners Association represented at the PROP committee

MAINTENANCE AND PLANTING OF PARKWAY TREES
The City Council is vitally interested in beautification of City parkways. Public
cooperation in helping to develop and maintain healthy and attractive trees is
encouraged.
MAINTENANCE OF PARKWAY TREES
The General Services Department will trim the parkway trees on a rotation schedule.
An effort will be made to trim the parkway trees on less than a three -year cycle. If the
rotation trimming is completed in less than three years, more frequent trimming will be
done performed on certain trees and in view areas. Public safety such as low branches
and heavy foliage will be given priority over view trimming. An effort will be made to
trim parkway trees located in heavy summer traffic areas during the fall and winter
months. The trimming schedule will be altered to avoid trimming streets with
flowering street trees during their blooming time. This will apply to streets having a
large number of flowering trees, not to one or two trees on a street.
TREE LIST
• The Parks, Beaches and Recreation Commission has adopted an official tree list which
will be used by the General Services Department to determine species for planning
purposes in all new subdivisions and replacement in established parkways. The list
will be reviewed on an annual basis by the General Services Department staff with any
recommendations forwarded to the Parks, Beaches and Recreation Commission.
STANDARDS AND SPECIFICATIONS FOR PLANTING PARKWAY TREES
A. General Requirements
1. 72 -hour notification shall be given the General Services Department prior
to the initial installation of parkway trees for approval of species, material
quality and planting supervision. 24 -hour notice shall be given prior to all
subsequent inspections as required.
2. Relative position of parkway trees is subject to approval by the General
Services Department, and any tree not properly placed will be relocated at
no cost to the City. In the interest of public safety, trees shall be kept not
less than:

a. 25 feet back of beginning of curb returns at intersections.
b. 10 feet from lamp standards.
C. 10 feet from fire hydrants.
d. 10 feet from service walks or driveways.
e. 10 feet from meters and sewers.
f. 25 feet from stop signs.
1 Trees shall be a minimum container size of 15 gallons.
a. Condition: Plants shall be symmetrical, typical for variety and
species, healthy, vigorous, free from plant disease, insect pests and
shall have healthy, normal root system free from being root bound.
Trees shall not be pruned or topped prior to delivery.
• b. Inspection: All plant material shall be subject to inspection and
approval by the General Services Department prior to planting.
The City has the right to reject any item offered.

4. Soil Analysis Requirement for Land Developers
Developer may be required to have a composite soil analysis made by a
bona fide soil testing laboratory of soil to receive parkway trees at no cost
to the City. The location and number of soil samples shall be determined
by the City. Analysis shall include fertility level and organic content of
the samples take. A copy of the test results shall be forwarded directly to
the General Services Department a minimum of 60 days prior to
scheduled planting of parkway trees.
PARKWAY TREE PLANTING
A. All pits shall be dug with the bottom level, width equal to two times the
diameter of the ball, and the depth 1 1/2 times the height of the container from
which the tree is planted.

B. Where land developers are required to provide soil analysis, the prepared soil
backfill shall be based on test results.
C. When soil analysis is not a requirement, native soil with a commercial fertilizer
approved by the General Services Department shall be used for backfiil.
D. Set plants in center of pit, in vertical position, so that crown of ball will be level
with finish grade after allowing for watering and settling and shall bear the same
relationship to finish grade after allowing for watering and settling and shall
bear the same relationship to finish grade that it did to soil surface in its
container.
E. Prepare a depressed water basin capable of holding 10 gallons of water. Water
shall be applied in that quantity at time of planting in a fashion that insures
wetting the entire root ball and that all air pockets are removed.
F. If houses are not occupied, trees shall be watered one week later. Thereafter,
watering shall be done at week intervals by the developer for a period of one
year or until homes are occupied.
• G. Each tree must be properly supported by two Lodgepole pine stakes or other
material approved by the General Services Department. Stakes shall be a
minimum of eight feet in length. Stake all trees at time of planting by placing
stake in prepared hole and driving stake a minimum of 30 inches to soil.
H. All trees shall be secured to stakes with a cinch tie.
1. Eight -penny duplex nails shall be used to secure the brace to the stakes —
two per side.
I. A root barrier approved by the General Services Department shall be installed.
GUARANTEES
A. 15- gallon tree shall be guaranteed as to growth and health for a period of ninety
(90) days after final acceptance by the General Services Department.
B. Trees that fail to grow or are injured or damaged during planting operations
shall be replaced within 15 days after notification. Replacement material shall be
guaranteed as specified as original guaranteed material.

Applicant must:
A. Applicant must accept responsibility for watering and fertilizing new trees.
B. If an applicant has questions regarding the street tree program they should
contact the Park & Street Tree Superintendent at (714) 644 -3162 or send a written
request for one or more parkway trees to: Attn: Park & Street Tree
Superintendent, P. O. Box 1768, Newport Beach, California 92659 -1768.
City of Newport Beach will:
A. Approve type, location and spacing of tree planting proposed.
B. Furnish, install, stake and initially fertilize new trees.
C. Prune and spray tree as required.

Measure of Success: Replace the existing overhead lighting in City facilities

electrical costs by $30,000 annually; replace one water pump station with a
more energy efficient station, which will reduce electrical costs by $50,000.
