Recommendation:
Support the adoption of Resolution No. 2002- Prohibiting Skateboarding on Certain
Streets, Sidewalks, and Parks and the rescission of Resolution No. 2000 -19.
Background:
Skateboarding activity is common in City parks and recreation areas. Some locations such as
walls, benches and stairs have been damaged or marred by skateboard users.
• On February 22, 2000, the City Council determined that there was a need to prohibit
skateboarding on certain streets and sidewalks and adopted Resolution No. 2000 -19 (Municipal
Code Section 12.57.020). The prohibition stems from a need to address concerns regarding
pedestrian safety and public property damage. Resolution 2000 -19 and Ordinance No. 12.57.020
are attached.
The current ordinance and resolution is not specific enough to allow enforcement in the park and
recreation areas.
The recent opening of a new City park and other improvements to the City park system have
raised safety and maintenance issues regarding skateboarding use at various City parks or
recreation areas.
Discussion:
The current resolution does not address park areas specifically and cannot be applied for
enforcement purposes at any City park without the modification of Resolution 2000 -19. Staff is
recommending that Resolution No. 2000 -19 be rescinded and replaced with a resolution that will
prohibit skateboarding at designated areas of City parks and public areas in addition to the streets
and sidewalks currently addressed by Municipal Code Section 12.57.020.
Upon Council approval of the proposed resolution, the General Services Department will post
signs prohibiting skateboarding in certain areas of each of the parks or recreational areas
identified in the resolution. It is anticipated that the prohibition will resolve staff concerns
• regarding pedestrian safety and park vandalism.
• Draft Resolution No. 2002 is attached for your review and comments.
Staff plans to forward the proposed resolution to the City Council for first reading on January 22,
2002.

ISO A RESOLUTION OF CITY COUNCIL OF THE CITY OF NEWPORT BEACH
PROHIBITING SKATEBOARDING ON CERTAIN STREETS AND
SIDEWALKS AND RESCINDING RESOLUTION NO. 97 -34
WHEREAS, Section 12.57.027 of the Newport Beach Municipal Code
provides, among other things, that the City Council may prohibit skateboarding by
resolution on certain public streets and sidewalks when it has been determined
necessary to protect the health, safety and welfare of pedestrians, motorists or persons
operating skateboards; and
WHEREAS, the City Council has determined that there is a need for
prohibiting skateboards on the following streets and sidewalks:
East Balboa Boulevard between Main Street and "G" Street
Main Street
Washington Street between Ocean Front and Edgewater Place
Palm Street between Ocean Front and Edgewater Place
• Edgewater Place between Coronado Street and "A" Street
Bay Avenue between Main Street and Palm Street
Ocean Front between Adams Street and "A" Street
• Marine Avenue between North Bayfront and 90 feet south of centerline
of Park Avenue
City Hall property located at 3300 Newport Boulevant

12.57.020 Skateboarding Restrictions.
Skateboarding shall be prohibited on all public streets, sidewalks, parking lots and other public property
located in the City of Newport Beach having a grade of six percent or more and which are declared by
resolution of the City Council to be hazardous to pedestrians, motorists or persons operating skateboards. The
City Council may by resolution prohibit skateboarding on public streets, sidewalks, parking lots and other
public property having a grade of less than six percent when it is determined to be necessary to protect the
health, safety and welfare of pedestrians, motorists or persons operating skateboards on said streets and

A RESOLUTION OF THE CITY COUNCIL OF
• THE CITY OF NEWPORT BEACH PROHIBITING SKATEBOARDING

WHEREAS, the City Council has determined that there is also a need to
prohibit skateboarding in City parks and certain public areas; and
WHEREAS, Resolution No. 2000 -19 does not prohibit skateboarding in City
parks and certain public areas; and
WHEREAS, the City Council has determined that there is a need for
