NOTICE TO THE PUBLIC
All matters listed under Consent Calendar (1 -3) are considered by the Commission to be routine and will all be enacted by one motion in the form listed below.
The Commission Members have received detailed staff reports on each of the items recommending approval. There will be no separate discussion of these items
prior to the time the Commission votes on the motion unless members of the Commission, staff, or the public request a specific item to be discussed and /or
removed from the Consent Calendar for separate action.
The City provides a yellow sign -in card for those wishing to address the Commission to assist in the preparation of the minutes. Speakers are not required to submit
a card as a condition to addressing the Commission. If you do fill out the card please place it in the box at the podium. As a courtesy, please turn cellphones and
pagers off or set them in the silent mode.

Commissioner Allen announced that Director Niederhaus was retiring and that tonight was his last
meeting.
Chair Tobin also noted his thanks to Director Niederhaus and then announced that there was a second
presentation to Park it Tree Superintendent Marcelino Lomeli who would be retiring after 39 years of
public service. He went on to say that Marcy was known throughout the entire parks and recreation
community and that many seek counsel from him. He handed him a plaque and a gift from the City
Council and the Commission for his many years of excellent services.
Superintendent Lomeli thanked the Commission and the City Council for their gift noting that he had
worked for the City for 11.5 years and that this had been the best job he had ever had.
Commissioner Skoro stated that Superintendent Lomeli has always gone that extra step and that he has
always appreciated his willingness to work and talk and to get the best possible product no matter what
and again thanked him for his many years of service not only to the City but to the community.

Director Knight stated that from a staff perspective that these two gentlemen retiring from the City will
leave a huge hole not only of knowledge but expertise, help and partnership and that Recreation is in a
state of mourning and wish them well. She thanked Chair Tobin and Commissioner Brown for braving the
elements and coming to the first Flashlight Egg Hunt in the rain, but still had over 500 people attend and
appreciated their support. She went on to say that the Department also had that same weekend a very
successful Special Olympics basketball tournament. Director Knight said that in your mail you will be
receiving a special foldout brochure that lists all the upcoming summer activities and camps in addition to
the Newport Navigator that will come out towards the end of April. She stated that the department had
increased programs and revenue last year in the summer with a lot of surf classes and special camps.
Director Niederhaus thanked the Commission for the recognition noting how appropriate it was as he
enjoys trees and looks forward to picking the right species. He invited the Commission to attend the April
26 Council Meeting where the City will again accept the 15`h consecutive award of Tree City USA and the
10th consecutive growth award and will receive the Silver Growth Award which has only been given to
three other cities in the US and noted that the Arbor Day event that will be held at Buffalo Hills Park on
April 29 at 10am.
PUBLIC COMMENTS
Tod Roth stated that he lives across the street from Cliff Drive Park and that he is concerned about the
size of the trees in the park that obstruct the view. He stated that most of the neighbors feel that this is a
negative aspect of the park as they impact the view significantly and the property values of the homes
around the park. He went on to say that that at the park at the 2401 block has one tree in the middle but
is nicely done and that it is very cohesive and some structure to it but the park on the 2900 block has no
structure and that it is very confusing and not particularly pretty especially from the street and not very
attractive or designed well. Mr. Roth stated that his main problem is that the fact that the trees are so
large all across the park with the bushes and it obstructs the view and the two parks are so difference in
appearance.
Don Williams 2937 Cliff Drive, stated that there are actually two Cliff Drive Parks; one that is situated in
front of his house and resembles a jungle and the other which looks like Central Park, NYC. He stated that
if you go down to the park area that looks like NYC and you have cement, sidewalks, steps, grass, flower
beds, rock formations and looks safe from top to bottom for the police to patrol. He stated that if you go
the park in front of his house has wooden steps that are still together only because the termites are
holding hands and some grass, flowers but are not seen because they are buried in the jungle of weeds,
bushes and hedges. He stated that he did not know who the gardener is doing the work on that part of the
park but stated that he should be fired because all he is doing is watering the weeds. He stated that the
place is not safe and would not want any women walking in there as there are at least a half dozen hiding
places and that when these winos or dope addicts go to that park in the summertime. He recommended
that part of the park be made to look more like the rest of the Cliff Drive Park.
Jan Vandersloot, Newport Heights thanked Dave Niederhaus and Marcy Lomeli for their many years of
good work for the City and stated that he is aware of the disagreements about trees but would like to
commend them for the work on getting more root pruning done by the City and so more trees can be
preserved and for instigating the development of native plants in City parks and with that he distributed
some pictures of Cliff Drive Park that he had taken on April 4. He stated that this a very pretty park and
by the way the plants there are not weeds but are native plants and that the City was required by a
Lawsuit settlement in 1988 to plant native plants on that side of the park and that he personally has spent
literally thousands of hours out there weeding. He stated that what Mr. Williams considers weeds are the

kind of plants that California originally had and are called Coastal Sage and Coastal Bluff Scrub_ Mr.
Vandersloot stated that many people do not appreciate native California plants but he spends many hours
weeding it and that the Fire Department goes by there every year and that one reason so many weeds pop
up is because so much of the intervening ground between the native plants has to be cleared our. He
stated that he was out there last weekend weeding and invited the two previous gentlemen to come out
and educate them and that we owe it to our heritage to preserve some of native California and thanks
Dave and Marcy for their help with native plantings not only at Cliff Drive but at Castaways Park.
Chair Tobin asked Mr. Vandersloot to give those two gentlemen his card so they could contact him for
information.
Karen O'Connell stated that she lives on Larkspur in CdM and wanted to speak out the small trees that are
being planted as replacement trees that she has been noticing in the community.
Chair Tobin stated that this item is on the agenda.
Ms. O'Connell stated that she is speaking in general about replacement trees and not the Larkspur issue
that is listed on the agenda. She stated that the pictures that she had distributed are from Seaview
Avenue and that the last couple of meetings the public has been hearing that Newport Beach is a tree
loving community and that when a mature tree is removed it is replaced with two trees. Ms. O'Connell
stated that the picture actually speaks for itself and that on Seaview; the very old and mature trees are
ISbeing replaced with what can be described as a twig. She wanted to make sure that the Commission is
aware of the size of these trees and their appearance.
Commissioner Englebrecht asked if he could speak on Public Comments. Chair Tobin stated no but could
ask for more information under Future Agenda Items.
Sheryl Ecker of 2940 Cliff Drive Park stated that when they bought their house 9 months ago that they had
been assured by their agent that those trees would be trimmed every two years down to the level of
bushes in the front of the street. She stated that it had been a few years and that the agent had replied
that the City should be doing this at any time. She stated that she called the City Council for information
on trees and never heard back. She stated that she has since heard that it is every three years and feels
like she is in the dark and that they are looking forward to having this home with a view and now are a
little scared and disappointed. She went on to say that the would like to see the trees trimmed way
down, if not taken out but maybe there are other types trees that could be planted that are not quite as
intrusive with the view and it should be enjoyed by everybody.

1. Minutes of the March 1, 2005 regular meeting. Ms. Singleton asked the Commission to remember
• that she spoke up at the March meeting and discussed comments from the January meeting and that
she since has listened to the tapes and has them right and wanted her correction to be entered.
Commissioner Ruzicka stated that staff would incorporate her written comments into the record,
referring to the information she would present on a later agenda item.

Director Knight stated that Ms. Singleton is actually pulling the minutes from the January 13, 2005
and what cannot be done is correct what was said and what Ms. Singleton is asking is to correct
minutes to two meetings ago.
Ms. Singleton stated that she had originally asked at the last meeting that the minutes be corrected
and then they were reported wrong.
Commissioner Allen asked if her typed comments were from the January meeting and that it is not
the issue before the Commission.
Ms. Singleton stated that she got up at the March meeting and asked that the prior meeting minutes
be corrected and then it was reported that she got up and did it but it was reported wrong. Ms.
Singleton stated that she has listened to the tapes.
Commissioner Allen asked if they were from the March meeting.
Ms. Singleton stated yes and the January meeting as well.
Commissioner Allen stated that you cannot correct minutes from January.
Director Knight asked her to submit those but understanding that minutes are not verbatim and so if
you are listening to tapes and expecting that every single word is reflected that will not happen.
Ms. Singleton stated that the gist of the whole thing was incorrect.
Ms. Singleton stated that when the Larkspur issue comes up and that if the letters that were
distributed from Mary and Bill Singleton could be included into the record then they will not need to
get up a speak.
Motion by Commissioner Allen to approve items 1 -3 of the Consent Calendar). Motion carried by
acclamation.
CONTINUING BUSINESS
4. Reconsideration of Reforestation Request. Director Niederhaus stated that there are three
pieces of correspondence that had been received that were included with your packet: an email
from T. Stefl, letter from the Singletons and a letter from SPON. He stated that no additional
items had been received beyond that except for items that will be distributed tonight from the
public. He stated that staff recommends that the Commission rescind the November 16, 2004
approval of the reforestation request for six trees located at 300, 302, 304, 310, 311 and 312
Larkspur. He stated that staff have reviewed the ballot discrepancies and noted that one ballot
was changed and that no longer does it meet the 60% requirement for reforestation.
Commissioner Allen stated that from what she understands that the Commission has nc
discretion and asked if this were correct since the project does not meet the minimum
• requirements under G -1 and therefore cannot be approved.

Director Niederhaus stated that the City Attorney's opinion on the Commission's authority to
approve/ disapprove reforestation requests is that the Commission can act on a reforestation
request only if the minimum criteria of the G -1 Policy are achieved.
Commissioner Englebrecht stated that in light of all that has gone on with trees, not only on
Larkspur, requested that the Commission have a moratorium on reforestation until either this
Commission or committee meets to address how reforestation requests are handled, voted on,
ballots counted. He stated that maybe a new criteria needs to be put in place and asked for a
moratorium on these issues.
Director Niederhaus stated that staff understands his concern on the procedures and that we
have separately met with some of the Larkspur residents and the City Attorney. He went on to
say that his staff and Deputy City Attorney Dan Ohl will be setting up a SOP and a more precise
checklist for reforestation. He stated that staff plans to bring a legally established reforestation
request from a HOA next month but that for non -HOA requests there will be a better procedure
put in place.
Commissioner Ruzicka asked if there would be a voting protocol in place so that the Commission
is not a part of the fiasco as in this past case.
Director Niederhaus stated that everything will be done by the book before it comes to the
Commission and that staff has learned from the different processes and does not believe that
the Commission will ever see these kinds of difficulties again.
Commissioner Englebrecht asked if the Commission will have a chance to review it.
Director Niederhaus stated that according to the City Attorney and the City Manager that those
procedures will be at the staff level to make sure that the Council Policy is being followed and
that staff provides the Commission with the best reforestation staff reports.
Commissioner Englebrecht stated that as the body that approves or disapproves these types of
requests he was concerned that they would have no say in the procedure so that the fiasco and
the split that has been caused in the City over just the Larkspur incident won't repeat itself
again. He asked why the Commission would have no input as they have to sit month after month
and listen to both sides with no resolution and then when a resolution was decided it was
wrong.
Commissioner Allen stated that everyone would obviously be reviewing what happens because
the Commission will be asked to vote on the information given.
Commissioner Englebrecht stated his frustration.
Commissioner Ruzicka asked if the procedure will direct that the names on the ballots are at
least spelled correctly and people are still alive that voted.
Director Niederhaus stated that it would be more than that and it will make it easier and
clearer for the petitioner to understand exactly what they are responsible for and if anyone
becomes involved in a controversy the other side will understand what staff has done. He stated

that most importantly no questions will be left unanswered when the request is approved or
disapproved.
Commissioner Brown stated that the most important thing,_ and noted his trust with the staff, is
that there is legitimate voting because the neighborhood of the street must meet the threshold
and so it must be foolproof to verify that the ballots are accurate by the property owners and
specifically that they are still alive.
Commissioner Ruzicka stated that it appears at this juncture that the Commission has no choice
but to rescind the reforestation request and that the two letters from the Singletons will
become a part of the record.
Chair Tobin stated that then the proceedings are done.
Director Knight reminded them that it must go to a public discussion.
Jim O'Connell from Larskpur Avenue stated that he wanted to follow up with new information
that was not brought up at the last meeting and that was regarding the two forged ballots and
apparently GS staff told the applicants that a certain number of people had not voted and the
applicants went out to those people and brought in some new votes but some were out of the
country or were not available and at least two of them were taken and the signatures were
forged. He stated that a packet of information had been distributed to the Commission with
those forged ballots and that that you can see that the first one is from Mr. Caputi who has
actually been deceased for over 11 years and that the entire first and last name had been
misspelled as well. He stated that he had attached a letter from the real owner Jean Caputi and
that she wanted to save the trees. He stated that the second ballot had been from Mr.
Stockwell who had been out of the country at the time and that he had written on here that the
signature was not his and that his name was Randolph not Raymond as the ballot states. He
stated that his point is that he knows that the City Attorney has been investigating this but
these are real serious matters and that we are talking about $15,000 worth of trees and
believes that if this had been approved last month those trees would have been removed in a
matter of days. He recommended that the Commission work with the City Attorney in making
sure that charges are filed and fines are levied against these people who committed these
forgeries and that these four applicants on the reforestation request are denied the privilege of
requesting another reforestation process again either permanently or for at least 10 years.
Jan Vandersloot, Newport Heights stated that there are a couple of lessons that could be
learned from this exercise and one is that the initial tree that was reforested was done because
of an easement and once that happened then some neighbors are persuaded or not quite
persuaded to reforest the entire block for uniformity. He stated that many of these people
wanted them to be reforested because they wanted them to be uniform and noted that these
trees began uniform because all the trees were She Oak trees. He stated that the Commission
• should understand that when a reforestation is approved for a part of the block that this
dynamic might follow on and on.
Commissioner Ruzicka stated that the Commission is quite cognizant of that specific matter.

Chair Tobin closed the public discussion
Motion by Commissioner Ruzicka to rescind the approval of the November 16, 2004
reforestation request of 6 trees made by Jay Rifkin, Marilyn Clark, Phyllis Joy Speek and George
Broughton property owners of 300, 302, 304, 310 -312 Larkspur Avenue.
Seconded by Commissioner Allen.
Commissioner Englebrecht asked if this means since the Commission has flip - flopped on this
issue for months that these trees on Larkspur will live.
Chair Tobin stated that yes they will live.
Motion carried by unanimous vote by Commissioners Allen, Brown, Englebrecht, Garrett,
Ruzicka, Skoro and Tobin.
NEW BUSINESS
5. Special Tree Report - Director Niederhaus stated that in October 2004, the Commission (PBEtR)
designated a Special Tree Committee (STC), consisting of Allen (who acted as chair), Skoro and
Ruzicka, to provide recommendations for additions and deletions to the Special Tree List a
component of the Council Policy G -1. He stated that the Special Tree List was adopted in 1966
with no significant amendments and includes Landmark, Neighborhood, and Dedicated trees
(those definitions were refined last year). He went on to say that the goal of the STC was to
review the Landmark and Neighborhood List for any additions and /or deletions of City trees and
provide a public outreach program for public nominations. Staff was tasked to do a separate
review and update of the Dedicated Tree list. He noted that the STC held four meetings on
November 3, November 30, 2004, and January 18, and March 15, 2005, He stated that the public
was allowed to submit nominations to the Committee at a SPON presentation, as well as at the
various STC meetings.
Director Niederhaus stated that three additional pieces of correspondence were received and
were attached to the packet from Dan Heinfeld and his attorney John Kendrick.
He stated that as a result of these meetings that the list of Special Trees is not shorter but
almost twice as big. He stated that staff is asking that the Commission approve the amended list
and will forward those recommendations to the Council for their approval.
Commissioner Ruzicka stated that a lot of time was spent and that he did not believe that
everyone needs to go through this list again as the consensus of these trees were fairly uniform.
Chair Tobin opened the public discussion
Mary Singleton stated that they had requested that the She Oaks on Larkspur be added to the
list and that the Committee was going to continue that issue because of the reforestation item
on the agenda had not been settled.
. Commissioner Allen stated that she was not correct and that the motion at the Committee
meeting was to approve the list as it appears tonight and that those trees were not put on the
list. She stated what was said was that after this whole reforestation thing is taken care of that

Ms. Singleton could come back to the City and make a request at some later time and possible
consideration could be given to adding those trees but were not included on this list tonight and
that it was not intended to be a part of this list.
Ms. Singleton stated that she believed that Commission Allen used the word to "continue" it
until after the reforestation issue was completed.
Commissioner Allen stated as a lawyer, she knows exactly what "continues" means and that Ms.
Singleton would have the opportunity to bring it back at some later time and of course is
welcome to do that as is any member of the public.
Ben Jackson appearing for Dan Heinfeld who owns the property at 901 Chestnut stated that he
is here tonight to talk about the Alta Vista tree and was led to believe that Mr. Eaton who had
recommended that it be added to the list has since asked that it be withdrawn from the list and
that he is here tonight to support that recommendation for withdrawal. He stated that this
tree, although a large and possibly a landmark tree, and has large branches that hang over the
yard and has had the experience of two large limbs falling into the yard. He stated that he is
concerned and that he believes it causes a hazardous condition. He went on to say that
apparently there has been a large branch which fell into the parkway and the City has since
removed it. Mr. Jackson stated again that they support Mr. Eaton's recommendation that the
Alta Vista tree be removed from the Special Tree List. He stated that he believes the tree is
Listed twice as number 41 and S.
Commissioner Allen stated that yes it was repeated.
Director Niederhaus stated that he has brought documentation from Mr. Eaton withdrawing his
nomination of the Alta Vista tree being added to the Special Tree List as long as it can be
withdrawn without prejudice. He stated that staff also recommends that this tree be deleted
from the list that will go forward to Council for approval.
Ann Balderston from Begonia Street stated that she was very happy to see that as Commissioner
Allen stated the process of recommending other trees to the list will continue to be open in the
future and wondered what "some point" means and how long she would have to wait to submit
a tree for the list.
Director Niederhaus stated that the public can submit their nominations and a picture which
would be cycled through staff and then forwarded to the Commission.
John Rogers from De Anza and wanted to confirm that tree Q. at 535 De Anza was not added to
the list. Commissioner Allen stated that yes that was correct. Mr. Rogers distributed copies of
his neighborhoods CCEtR's from 1949 which every neighbor signed and is very clear that no tree
shall inhibit their view or be over 16 feet and now he has been told that he has to request a
reforestation when everyone that lives there has signed this and it is not fair that he should be
asked to do this request to have the tree. He stated that he has been fighting in a very passive
way with a neighbor. Commissioner Allen stated that this is not on the agenda but reminded Mr.
• Rogers that he lives in a community that is governed by CCEtRs and the provisions for
reforestation are ones that we ask be dealt with by the HOA and have the board make the
application and it is a neighborhood issue.

Jan Vandersloot asked for clarification on item 22 "along Avon Avenue" and stated that those
are the Eucalyptus trees in Cliff Drive Park and that there are eight of them and that the
committee's position is to retain and wanted to make sure that the committee is recommending
that those 8 trees be retained. He stated that the purpose of the aerial map with the eight
trees printed in red that was distributed and that the neighbors above are blaming the lower
trees but those are not the special trees and those 8 trees serve to hide the parking lots, the
car dealership, the ugly buildings and do not encroach into the blue water views and noted that
he was standing on the highway and the neighbors are above that and that his point is that the
Commission is fully justified in retaining those 8 trees and that Mr. Niederhaus spoke up a Speak
Up Newport out retaining those trees.
Chair Tobin closed the public discussion
Motion by Commissioner Ruzicka to forward the amended tree list except for tree #41 on Alta
Vista Drive to City Council for their approval. Motion carried by acclamation.
COMMITTEE REPORTS
• Finance - Nothing to report.
• Park Development - Commissioner Skoro stated that the plantings for Back Bay View Park are doing
well and asked if the dedication was set for July 6. Director Knight stated that no date had been set.
Director Knight stated that a committee was formed to assist in the fundraising for the Newport
Village site and requesting that the public submit names for that park as well. She stated that a small
ad had appeared in the Pilot and that the Committee will review those names in May and forward
those to the Commission in June and then to Council. Superintendent Lomeli stated that the City has
submitted an application for a Metropolitan Water grant of $75,000 and hopes that will spur on the
development of that site and should hear within the next few months.
• Rec Et Open Space Element - Nothing to report.
• Senior - Director Knight stated that a cooperative agreement should be going to City Council in May
and will replace City Council Policy B -5 and will stand alone and thanked Commissioners Allen, Skoro
and Chair Tobin for their participation in that process.
• Recreation Activities - Commissioner Englebrecht stated that there will be a meeting on April 26 to

Commission Allen asked for informational report on the area around Cliff Drive Park encompassing
that will discuss tree trimming and just educating the neighborhood and invite the property owners
- June 2005
Commissioner Ruzicka stated that he concurs with Mr. O'Connell and wants to know about those
blatantly forged ballots and that he finds it appalling and wants to know what will happen.
Commissioner Allen stated that she is concerned that we are convicting people without a trial and
that she is aware that there have been some allegations of forgery and requires certain elements of
intent and is not clear who the defendant is.
Commissioner Ruzicka stated that Commissioner Allen's point as a counsel is well taken but the
issue is that there are ballots from allegedly someone that is deceased.
Commissioner Garrett stated that he believes this is more of a City Attorney issue and not the PBBR
Commission.
Director Knight agreed that this is not the role of the Commission and that the City Attorney is
reviewing this issue and will decided if any further action is needed.
Commissioner Skoro asked for an update on the Irvine Terrace encroachment but believes that at
some point the City needs to make a decision and that it has been thrown under the rug but that
some action needs to be taken.
Commissioner Englebrecht agreed that it should be on the agenda.
Director Niederhaus stated that this issue of encroachments in Irvine Terrace as well as other has
been moved to the Council level. He stated that he would convey the Commission's interest to
Public Works Director Steve Badum.
Commissioner Skoro stating that this issue has been going on for over 10 years and it is a detriment
to the City to avoid the issue.
Director Knight stated that the issue is not being avoided but as Director Niederhaus stated it is at a
Council level at this time and would not be appropriate to bring it back to the Commission. She
stated if there is anything to report then certainly staff could convey that.

SUBJECT: April Parks and Trees Maintenance Divisions Activities Report
Parks Maintenance Division Activities
1. The Coast Highway Median Project has been approved by the Council, and the work has
commenced with anticipated completion by this summer. The project will include the
. installation of new medians, extension of existing medians, hardscape installation, and the
installation of new landscape and irrigation. The Public Works Department will be
coordinating this work with the Parks Maintenance Division staff.
2. Parks Maintenance Division staff completed a planting project on the lower slopes of
Westcliff Park; this effort earned the compliments of the Dover Shores Homeowners
Association, Landscape Committee.
3. The Newport Boulevard medians south of Hospital Road and two medians on Park Avenue
were renovated by staff and contract services. Bob Martinez, Parks Crew Chief coordinated
the landscape project using colorful, drought tolerate, low maintenance plant species.
4. Spectrum Care Landscape began April 1 as the City's Median and Roadside landscape
maintenance contractor.
5. The Parks Maintenance Division staff is coordinating with the Recreation and Public
Works Departments regarding the new library and tennis courts at Mainers Park.
6. All Parks and Trees Divisions staff attended an Emergency Response Training program
conducted by the Fire Department.
7. The City's Water Quality Division has a monthly show segment on Local TV, Channel 3,
• discussing water quality, water run off issues, and water savings methods. Randy Kearns,
Park Maintenance Supervisor, was recently interviewed for this show at Castaways Park
regarding water savings achieved by using California native plants, habitat created with
. these plantings, and some discussion of the City's Centralized Computer Irrigation System.
8. Parks Maintenance Division staff is coordinating with the Recreation and Public Works
Departments on the renovation of the play area at Begonia Park.
Upcoming Activities for May
1. The planting of replacement shrubs and ground covers will continue Citywide.
2. Parks Maintenance Division staff will continue coordinating the control of
rodents with contract services.
Trees Division Activities
During the month of March, 1,470 trees were trimmed, 22 trees were removed as a result of a
claim, 4 problem trees were removed by approval of the City Manager, 41 trees were
planted, 7 trees were root pruned, and 8 emergency tree calls were responded to.
The City's tree trimming contractor, West Coast Arborists, continues to grid trim trees
within the Corona Del Mar, Balboa Island, Harbor View Hills South and Irvine
Terrace area.
• 2. Since July 2004, under City Council direction and funding, staff has undertaken an
extensive root pruning effort. Combined efforts of the Field Maintenance and Tree
Maintenance Divisions and West Coast Arborists staff, have resulted in the root
pruning of 508 trees to date. This effort will mitigate any potential property damage
as a result of City tree roots, and also provide for tree longevity in the Urban Forest.
The extensive work included root pruning, root barrier installation, and hardscape
repairs at each tree site.
3. The attached Tree Activity Report summarizes requests and field activities performed
during the past month.

ADULT SPORTS

Spring Softball -Adult softball will conclude May 13, with all rained out games squeezed in just in
time for summer that will begin May 16. Sixty -eight teams are competing in 12 different leagues
this spring with all league winners receiving impressive 25 oz. City Champion Sports Beverage
Mugs, to toast their hard earned league championship with their favorite beverage.
Summer Softball- Over 120 teams are expected to register for the summer softball with games
scheduled to begin the week of May 16. Games will be scheduled from May 16 through August 19,
with all the action taking place at Bonita Creek Park, Lincoln Athletic Center, Grant Howald Park
(CYC), and Arroyo Park.
Spring Basketball - Eighty -two teams are currently "running the hardwood" in the adult hoops
league. Teams are enjoying recent improvements to the facilities, including new padding and
carpet at the West Newport Community Center Gym and a new scoreboard at the Eastbluff Boys
and Girls Club. A new floor, backboards, and scoreboard at the Ensign Junior High School Gym will
be installed June 27 through July 31.
Officials Meeting - ALl contracted softball sports officials will meet with staff in May to discuss ways
of improving the quality and safety. Many of the City's officials have been working for over 20
years, and are approaching 10,000 games officiated. That's a lot of balls and strikes!
YOUTH SPORTS
40`" Annual Youth Track and Field Meet - On April 15, over 200 boys and girls age six through fifteen
took part in the 2005 Youth Track and Field Meet at Newport Harbor High School. Co- sponsored by
the Newport - Balboa Rotary Club, this multi -event competition included individual running, throwing
and jumping events. Optional clinics were held at various school/ park sites throughout the month
of March. The top five competitors from each division have been invited to participate in the
Southern California Municipal Athletic Federation Orange County Track and Field Meet on May 1 at
Trabuco Hills High School in Mission Viejo.

TEEN PROGRAMS

• Youth Council - Youth Council will host City Government Day on May 19, 2005. The day will be an
opportunity for local high school students to learn about the various functions of local government,
participate in an internship, run a mock council meeting and enjoy lunch on the City Hall lawn.
The Youth Council has been busy promoting the day at local high schools.
KidScene - KidScene staff participated in Conflict Management training on April 20 at their bi-
monthly staff meeting. Guest Speaker Ingrid Anderson lectured and prepared interactive games
around the topic to prepare staff with new methods for handling difficult adults.
Intergenerational Sailing Program - The OASIS Sailing Club, operating out of the OASIS Senior Center
in Corona del Mar, began teaching ten KidScene children the fundamentals of sailing. During the
first meeting, children were required to take a swim test at Corona del Mar pool and then were off
to the bay where they received their Sailing Activity handbooks and learned water safety and basic
sailing terms. The program will meet every Wednesday for six weeks and culminate with an
individual sail for each of the participants.
Earth Da v- On April 22, the KidScene celebrated Earth Day with themed crafts, games, and snacks!
They constructed and painted paper mache globes, played "Recycle Ball" and International
Kickball, and enjoyed "dirt and worms" (crushed up Oreo cookies and gummy worms!). Activities
about recycling and pollution increased the children's environmental awareness while having fun!
Day Camps - The spring Recess Camp was better than ever this year with the addition of a field trip
to Knott's Berry Farm! The program was full with 50 campers enjoying a variety of crafts, games,
and two walking trips to Corona del Mar State Beach and each received a City of Newport Beach

CONTRACT CLASSES
Training Time - During April, Recreation staff hosted the Annual Contract Instructor Meeting for
instructors who teach recreational and enrichment classes. Over 60 instructors were scheduled to
attend one of the three day workshops that reviewed policies and procedures, ways to market your
class better and to gather input from the instructors on ways the City can improve services to them
and the participants who take City classes.
Winter is Over, On To Spring- The contract class program which includes fee based classes, tennis,
surfing, and sailing recently completed the winter 2005 season. For this season there was an
increase of $35,295 in revenue and 178 participants from last year. This comparison is shown in the
graphs below.

Contract Instructor Highlight - Intro to Decorating With Kelly Edge

A new proposal landed in the office for a "One Day Decorating" class with one of HGTV's very own
designer, Kelly Edge. As a Newport Beach resident herself, she saw the need for residents to learn
how to do what the interior design professionals do for a living. As many homeowners may find it
easier to hire an interior decorator, Kelly's class emphasizes the fun and excitement of putting
those special touches in your home yourself; that is once you know how to "eye the room ". The
redesigning class caters to DIYs, or do- it- yourselfers, who "...yearn to transform a boring, unused
room into a warm, inviting living space." The DIY class focuses on how to take what you already
own and spice it up a bit by rearranging everything from the furniture, floor rugs, pictures, and
wall hangings to the little accents of plants, candles and memorable trinkets. Just as the half hour
show Decorating Cents can show a TV viewer some examples of the "how to ideas," Kelly takes it a
step further by personalizing the class while focusing on each participant and their need for a little
fix up in a specific room of their home.
Redesigning began in the late 1980s and so far, the Intro to Decorating classes have been an
absolute hit in Newport Beach! Participants leave class looking forward to going home to makeover
their rooms for a fresh new look. Kelly loves what she does and with over 30 episodes shown on
HGTV, Kelly finds that teaching in a small classroom setting and working hands -on with her students
in Newport Beach gives her a great sense of happiness. She is a natural when it comes to seeing
the "...perfect place for the perfect thing." With interior designing a major part of her of her
background, she is proud to share her talents with others and hopes that the class will allow others
to go home and find the same sense of peace in their home as she does after a long day at work.
AQUATICS
Interviews... and More Interviews - Department staff is working with Human Resources to make sure
they are able to hire enough staff by the end of May 2005. The Department would like to hire an
additional 5 -7 staff this year that will give staff flexibility in their schedules during the summer,
since many of the staff last year worked 7 -9 hours each day.

SPECIAL EVENTS
• Pepsi Pitch. Hit and Run - The City and the Newport Harbor Baseball Association is sponsoring the
Pepsi Pitch, Hit and Run event at Bob Henry Park on May 8. This event provides boys and girls, ages
7- 14, the opportunity to participate in an exciting baseball skills competition. In this competition,
youngsters have a chance to showcase their pitching, hitting and running abilities. After this local
event, several young athletes will earn the right to advance to the Sectional Championship, to be
held May 21 at Central Park in La Palma.
FACILITIES USE AND REPAIRS
Bonita Creek Shade Cover - Staff is securing bids to place a shade cover at Bonita Creek Park
next to the center by mid -June, just in time for the summer picnics.
Begonia Park Playground - The contractor began work March 14 and had to stop for a
redesign. Public Works engineering worked on revising the plans to allow for the slope
issues and work began again in mid April. With the delay and extra costs, it should open in
mid May.
West Newport Community Center - The classrooms at West Newport Community Center were
repainted and new carpet will be laid to complete the facelift for West Newport Community
Center. One last piece will be repairing the playground rubber surfacing, which was installed
• incorrectly and should be completed in May.

During March, our Park Patrol program was featured on the "City Scenes" cable show, the
episode focused on the creation and implementation of the Park Patrol program as well as its
goals and objectives. We had several Department events that Park Patrol assisted with this
month including the Egg Hunt, Special Olympics, and Track and Field events. Park Patrol has
continued to monitor skateboarders at Ensign View Park and educate the youth regarding the
rules and regulations for skateboarding in parks. Both Park Patrol officers assisted the Police
Department with handling the Persian New Year Celebration on March 15`" at CDM Beach. This
event draws very large crowds to the beach. Our Park Patrol officers were able to assist and
• help ensure this event took place with the least possible impact to the residents and community
in that area.

Volunteer Recognition - The OASIS Senior Center honored the hard work and dedication of the
many volunteers at a special luncheon held Wednesday, April 6. Councilmember Webb joined in the
celebration with approximately 130 volunteers from the Travel Office, the Administrative Office,
Meals -On- Wheels, and the gift shop. Because of their hard work and dedication, the Center is able
to offer more services and provide better customer service.
Workshop - OASIS offered a fun workshop entitled "Humor, Health and Healing" presented by
Geoff Lang on how humor expands awareness and creates an uplifting attitude for life.
Online Library Catalog - June Pilsitz from the library held an online catalog computer training on
April 12 reviewing basic training session in the use of library resources.
OASIS Employee News - Stephen Zeni has joined the OASIS staff as a van driver. He has worked for
the Newport-Mesa School District for 10 years, lives in the area, and is expecting a second child in
June.
• Also, Van Driver Blanca Parra delivered a 9 lbs 11 oz baby boy on Aprill3 and will be out for six
weeks. When she returns there will be four drivers to accommodate more people than ever.
UCI Lecture - New Concepts in Preventing Heart Disease was present by Dr. Nathan Wong, Director
of UCI Heart Disease Prevention Program on April 27.
OCHCA - The County Health Care Agency offered a brown bag day on April 27. A pharmacist joined
the nurse practitioner and was available to answer questions about medications.

SUBJECT: Passive Park located at the corner of Mesa Drive and Birch Streets in
the Santa Ana Heights Redevelopment area
ISSUE
The Parks, Beaches & Recreation Commission has been asked to provide input on a
concept plan for a passive view park located in Santa Ana Heights. The Santa Ana
Heights redevelopment area's Project Advisory Committee (PAC) planned the park with
the help of architect Dave Pederson.
BACKGROUND
As you may be aware, the City annexed the eastern Santa Ana Heights area in July of
2003. Much of the Santa Ana Heights region is within a redevelopment area, which
means that property taxes generated above a certain "base year" are allocated
• according to a "redevelopment plan" to both remove blight within the Santa Ana Heights
neighborhood and to provide low and moderate - income housing in the region. The
County of Orange administers the redevelopment area via its Orange County
Development Agency (OCDA). Since the annexation, the Council and staff have been
working with the Santa Ana Heights PAC on many issues involving specific projects in
the redevelopment area.
In July 2004, based on a request from the PAC, the City asked County Supervisor Jim
Silva to preserve two parcels at the comer of Mesa Drive and Birch Street as open
space so that this 0.7 acres of land could later become a small passive park (see
Attachment A - letter from then Mayor Tod Ridgeway). In this letter, since
redevelopment funds cannot be used for maintenance, the City offered to maintain the
park once constructed, and to assist in the planning of the park, to ensure that the park
can be maintained in a cost- efficient manner. The City would not however take over
ownership of the park until construction was set to begin. Based on the letter from the
City, the County, who was originally planning to sell the parcels to a developer for
parking, decided to retain the area for a passive park.
DISCUSSION
Staff from the General Services Department and the City Manager's Office have been
working with the County and the PAC on the conceptual development of the park
• (Attachment B). At this time the concept plan is being submitted to the Commission for
information purposes only. The Commission is not being asked to approve the park, as
it is not a City park at this time. The City Council will also be given the opportunity for
input at a future meeting.

Approve the reforestation request of Harbor View Hills South Homeowners Association.
Discussion
The Harbor View Hills South Homeowners Association has submitted the attached Tree
Reforestation Request form, requesting the reforestation of 19 City parkway trees in their
• community (Attachment A).
Staff has completed and attached the Tree Inspection Reports, Tree Appraisals, an area map
and photographs related to each reforestation site (Attachments B, C & D).
The applicant requested the tree removals under the reforestation guidelines delineated in the
G -I Policy. This is the fourth phase of reforestation in Harbor View Hills South; the first
phase was completed in 1997, the second reforestation occurred in 1998, and the third phase
was completed in 2004.
As outlined in the attached letters dated January 22 and April 16, 2005, the applicant has met
all requirements of the G -1 Policy (Attachment E). The Association will fund the total cost
of $6,292 for the removal and replacement of the trees. The applicant has been prepared to
undertake reforestation for several months, but it has been delayed at the request of staff due
to other pending issues under consideration by the Commission. Those issues have been
resolved, and staff feels it is appropriate for the Commission to consider this request at the
present time.
Yvonne Houssels, President of the Association has advised residents of the proposed
reforestation request in the Association newsletters distributed in November 2004 and March
• 2005 (Attachment F).
• Additionally, she has received a copy of this report and a notice of the May 3 Commission
meeting.

the petitioning sponsor (Individual private property owner(s) or group) to pay 100% of the costs of the removal and
replacement of the public tree(s) in advance of any removal activity. The actual removal and replanting will be coordinated
by the General Services Department using the City tree maintenance contractor.
*There shall be a minimum of a one - for -one replacement of all trees removed in reforestation projects. Replacement trees
shall be a minimum size of 24" boxed trees and cost $195 per tree, unless the parkway space will not accommodate a 24"
boxed tree or a tree cannot be planted due to planting restrictions contained in City Council Policy G -6.
This form does not replace the requirements of any of the City tree policies. Its use is intended to expedite the tree
removal or reforestation requests and to ensure compliance with all City requirements. Please refer to individual
City Council Policy G -1 for additional information.

Tree Reforestation Resolution
Dear David:
On behalf of the Board of Directors of the Harbor View Hills Association, this resolution shall
serve as a formal request for reforestation in Harbor View Hills South.
Prior to the Board voting on this request, all members of the association have been officially
notified by newsletter and given an opportunity to respond at our Board of Directors Meetings,
the first Wednesday of each month. (November and December Newsletters enclosed)
. We would like to continue using the 24" box trees that we have used for our previous
reforestations. The Board is concerned that the larger 36" box trees are too large for our narrow
parkways and are very likely to result in compacted roots and unhealthy trees. Starting with the
24" box tree, we have been able to shape the trees to be beautiful at a height below the roofline
in our community of mostly one -story houses and preserve the valuable views in our association.
The association will pay 100 % of the cost of removal and replacement of these parkway trees.

Tree Reforestation January 22 Resolution Addendum
Dear John:
On behalf of the Board of Directors of the Harbor View Hills Association, this resolution shall
serve as a formal request for additional trees to be added to the reforestation list in Harbor View
Hills South.
Due to the heavy rains and the Park, Beaches and Recreation (PB &R) schedule, we understand
that our request had to be delayed for 3 months. Prior to his retirement, David Niederhaus
informed me that this list will be presented to the PB &R in May and that I should complete the
application package with you.
During this delay, 4 additional homeowners requested reforestation. These requests were
discussed and approved at our monthly Board of Directors Meetings where all members are
invited. The minutes of these meetings are available to homeowners upon request and updates
are included in our newsletters. (March Newsletter and April minutes enclosed). The additional
request addresses are:3515 Seabreeze Lane, 3508 Seabreeze Lane, 3620 Seabreeze Lane and
1407 Outrigger Drive.
The association will pay 100 % of the cost of removal and replacement of these parkway trees.

NOVEMBER 2004
This edition of our monthly newsletter is sent immediately following the HVHS Annual
Meeting and election of members of the Board of Directors. It is an abbreviated edition
in that there was no regular meeting of the Board this month. Normal coverage of
community events and Board activities will resume in December.
ANNUAL MEETINGINOVEMBER ELECTION
The Annual Meeting of Members of the Harbor View Hills South Homeowners
• Association was held at the Oasis Center on the evening of Wednesday November 3rd,
2004. In attendance were approximately 35 - 40 homeowners including the two Directors
who's terms -of- office continue for another year - Don Brigham and Peter Morin. In
addition, Cynthia Davis and two associates from The Emmons Company were present to
sign -in homeowners, receive ballots and proxies and handle the mechanics of the election
for new Directors. Secretary of the Association Board Don Brigham conducted the
meeting.
This year there were three candidates for three open seats on the Board. Each of the
candidates made a brief statement outlining their background and why they wanted to
serve on the Board.The Emmons Company confirmed that there was a quorum present
represented by those in attendance and proxies that had been submitted in advance. In
that the number of open seats and the number of candidates were the same, the three
candidates were elected by acclamation. The three new Directors are Yvonne Houssels,
Kay Paciorek and Chad Cooper.
Thus, the HVHS Board of Directors for the next year will include Peter Morin, Don
Brigham, Yvonne Houssels, Kay Paciorek and Chad Cooper. The Directors will meet in
Executive Session before the December meeting to choose President, Vice President,
Secretary, Treasurer and Member -at- Large.
HVHS HALLOWEEN PARTY
• The annual HVHS Halloween Party was held on the greenbelt on Sunday, 31 October.
This really neat event, which was attended by some 150 — 200 kids of all ages, was
• organized by Pete and Samantha Morin who have been doing this for six years now.
There were bouncy- houses, food and drink, all kinds of games and some terrific
costumes. Thank you Peter and Samantha and the many volunteer helpers who put on
a wonderful neighborhood party. A great time was had by all!
MARGUERITE LANDSCAPE PROJECT
There have been two recent and important events conducted by our Landscape
Committee that need to be reported on:
1. The public debut of the new design for the re- landscaping of the Marguerite
corridor took place at this year's Halloween Party. Our Landscape Committee
presented a display of charts, photographs and a rendering illustrating our exciting
new design. There is clearly a great deal of interest in the project and enthusiasm
for the prospect of upgrading the look of the landscaping and entryways that
border our community along Marguerite. Many homeowners stopped by to view
the display and the feedback was almost universally positive.
2. This same landscape design road show made an appearance at the Annual
Meeting at the Oasis Center. Following the election formalities, Landscape
Committee Chairman, Paul Siconolfi, made a brief presentation describing the
rationale behind our project, its goals, features and benefits to the community.
Landscape architect, Dale Waldo, and Margee Drews who heads up our
homeowner landscape design team were on hand to field questions and provide
details of the new design. Those in attendance asked many good questions and
exhibited considerable enthusiasm for the project.
The Landscape Committee will now turn its attention to the cost - estimating phase of the
overall effort. Our goal is to obtain competitive bids for the various aspects of the job
and then to work with the new Board to begin presenting the overall cost and schedule
picture to the community early in the new calendar year.
CITY PARKWAY TREE UPDATE
The Association has received requests for reforestation at the following addresses: 1400
Keel; 3606 Seabreeze; 3921 Sandune; 3927 Sandune; 3900 Sandune; 4000 Topside and
4000 Inlet Isle. At the December 1, 2004 Homeowners meeting the new Board will be
voting on these requests and also be considering reforestation of the City Parkway Trees
in the Association's common area parkways, next to the greenbelt where Seabreeze and
Surfview come together. Interested owners are encouraged to attend. Any owner who
would like to reforest a City Parkway tree should contact Board member and City
Parkway Tree Chair, Yvonne Houssels directly at 949 - 640 -0120.

Mathuny and Paul Siconolfi for their time and energy to the community the past two

you Paul Siconolfi for your interesting and timely newsletters while you served on the.Board. We will
miss you. This issue of the HVHS Newsletter is published as our holiday season approaches. Even the
weather signals the final retreat of summer and autumn. Grab you umbrellas! It's rain time. The annual
election of the Board of Directors was held at the Homeowners meeting in October with results
published in the November Newsletter. Even now we need interested homeowners to volunteer for
various committees to bring their talents to your Association. The Board of Directors and membership
needs your involvement.
MONTHLY BOARD OF DIRECTORS MEETING
On Wednesday December 1st, in Executive Session at the Oasis Center, Yvonne Houssels was elected
President of your Association. Don Brigham was elected as Vice - Present, Kay Paciorek; Secretary,
Chad Cooper; Treasurer, with Peter Morin; Member -at - Large. Our congratulations to each new and
continuing Board Member. During the regular monthly Board of Director meeting, the Board was
represented by Directors Yvonne Houssels, Don Brigham, Kay Paciorek, Chad Cooper and Peter
Morin. Highlights of the meeting were as follows:
Homeowners Forum Eleven homeowner members were present at the meeting. Several homeowners
expressed concern about stakes erected without an application and plan provided to Property
Management and the Architectural Committee. Homeowners are reminded that an application and
•plan must be sent in to Property Management before stakes are erected. Please see the
Architectural Committee report for additional information. One family registered their concern with an
ongoing tree obstruction issue. The Board will be meeting on their property to view the issue first hand
at their first opportunity. Another reported that the slope bordering and belonging to the Terraces of
Corona del Mar has been trimmed to reduce the danger of brush fire. The Newport Beach Fire
Department aided our Association in reaching the agreement with the Terraces and a letter will be sent
thanking the Terraces. Another member suggested that we contact the University of California COOP
Extension Agent to brief the Association on water management and usage, one of our Association's
largest continuing monthly financial obligations. Tony Christopher met with the Newport Beach Police
Department and was briefed that crime in HVHSA was presently 0 %, however, crime is risin in
Newport Beach proper.
Landscape Committee Chairman Paul Siconolfi discussed the plans for the future landscaping
proposal. He further illuminated the costs and the arranging for a future bidding process and the need
to drive down the overall cost in the process. Margee Drew also contributed to the discussion as it
related to design and implementation of the project.
Maintenance The Green belt is in much better condition due to a new watering program and proper
grass height cutting. In that vein, Committee Chairman, Jack Swan is retiring from this position. He
has been a tireless representative for our membership. Many of his innovations are present today
largely due to his dedication and guiding hand. Thank you so very much, Jack; splendid job.
• Tree Committee Chairperson Cheryl Livingston was absent, however, her report was filed and will be
discussed both in the January monthly meeting and the January Newsletter. In the intervening months,
each member family should assess their own property as it relates to tree and hedge heights. It should

again be noted that we have new guidelines and form letters as it pertains to informing those neighbors

Architectural Committee Guy Cazort is acting as interim Committee Chairman. He brings an
engineering background and a special discipline to the post and is a quick study. He knows the
Architectural Guidelines very well and uses the CC &Rs and his committee to back up his decisions.
We hope he will elect to stay on for a few years to aid the Association in dealing with the,issues of the
day. In the meantime, for all long time residents and those new members that have joined our
Association, the Architectural Committee and the Board of Directors is formulating an Architectural
initial summary checklist for those members contemplating a major structural remodel and/or
demolishing for future building. The checklist will be published and put into the hands of all member
families for its addition as an addendum to the current Architectural Guidelines. We hope this checklist
will better inform those members who contemplate changes to their property. No changes are allowed
without this due process.
City Parkway Trees Yvonne Houssels, Chairperson of City Parkway Trees reported that she was
ready to ask the City for the reforestation application forms. After hearing no objections at the meeting
and no written objections to the previously publicized reforestation requests, the Board unanimously
approved reforestation at the following addresses: 3506 Seabreeze Lane, 3921 Sandune, 3927
Sandune, 3900, Sandune, and 4000 Inlet Isle, 3701 Inlet Isle, 3901 Inlet Isle, 1412 Seacrest and 1030
Sandcastle.
WATER DRAINING ONTO MARGUERITE SLOPES
•Another reminder for those families whose property backs up onto the slopes of Marguerite. It is
against both our community CC &Rs and the City Code for them to permit water from their yards to
drain onto the Marguerite slope. The discovery of a number of drain lines pouring water onto these
slopes causes landscape washout and disastrous vegetation over watering. The rainy season is upon so
it is now particularly important that these drain lines be rerouted.

New Board Member
At the March 10 Board of Directors meeting, the Board appointed Art LaCoste to
complete the term of Pete Morin who had to resign due to family and business
obligations. The Board wants to express our appreciation to Pete for continuing to help
make the transition easier and we thank Art for volunteering.
Summary of the Steps required for Major Structural Modifications in the
Architectural Guidelines and Procedures Enclosed.
In our previous newsletter, the Summary of the Steps required by the Applicant using the
Architectural Guidelines and Procedures did not include some of the important
requirements. This was due to improper editing by the Association's Management
Company.
The Emmons Company has apologized for any confusion and/or inconvenience this may
have caused our homeowners and they have paid for mailing this newsletter with the
correct summary enclosed.
• City Parkway Tree Trimming and Reforestation
Rain Rain Go Away!
The City has been so busy with fallen trees and other emergencies due to the rain that our
tree trimming and reforestation has been delayed.
The City Parkway Tree View Chair, Yvonne Houssels, is presently working with the
City's Urban Forester to put us back on schedule.
2 additional homeowner requests for reforestation were approved and added to the
reforestation list at the March 10 Board of Directors meeting: 3515 Seabreeze and 3508
Seabreeze.
Landscape Renovation Project along Marguerite
The Landscape Committee has turned over their finalized suggestions and bids received
for the Landscape Renovation Project to the Board for review. The need to relandscape
and upgrade the monuments along Marguerite was approved by the previous Board and
presented to the homeowners at the Annual Homeowners Meeting and Election in
November.

• Minutes of HVHS April 11 Board of Directors Meeting
City Tree Committee Report
April 11, 2005
The City is presently trimming the parkway trees in HVHS.
They are continuing the policy of trimming the trees to a height of 14' for view
preservation.
They will be shaping the newer Magnolia and Orchid trees to form a canopy effect.
The reforestation is now scheduled with the PB &R in May.
Following the PB &R approval, the homeowners requesting reforestation will have to
send their checks to the association and the association will provide one payment to the
City before the reforestation can be scheduled.
Please approve the additional reforestation for the homeowners at 3620 Seabreeze and
1407 Outrigger Drive so that they can be included on this reforestation list.
