DIRECTOR COMMENTS
Director Harmon thanked the Mayor and Chair Brown for their participation at the Arbor Day celebration
at Harbor View Elementary. He noted that the City would be presented with the Tree li Growth Award
at the City Council meeting on May 13.
Chair Brown stated that Item 5 would be discussed after item 8.

DISCUSSION
4. City of Newport Beach Policy regarding Cooking on Beaches — Director Morgan stated that in an
effort to enforce the policy of cooking on the beaches - specific information signs have been posted
stating appropriate use.
Director Harmon stated that Asst. Director Pisani had met with the PD regarding BBQ on the bluffs
and that additional signage will be added there as well.
Discussion ensued regarding signage, containers and enforcement.
ACTION
6. Bench Donation — Superintendent Sereno stated that staff had received a request from Ms. Schuler
to donate a bench at Cliff Drive Park. The donated bench is included on the City's Official Bench
List and will match four previously donated benches at this site. He stated that Attachment C of

the report shows the location of the proposed bench donation with an aerial of the proposed
location at Attachment D. He went on to say that the value of the bench with a concrete pad is
greater than $1,000 and therefore eligible to receive a dedicatory plaque that will "Donated for
Virginia Herberts" but is also asking that upon the passing of her ailing father, Curtis Herberts,
that a replacement plaque be placed with the verbiage "Donated for Curtis and Virginia
Herberts" be approved at this time as well.
Director Harmon stated two calls against the location of the bench - one from a resident directly
across the street and that his understanding is that there is a concern from a few residents that
the bench may impact view and a call from Kathy Schuler. He noted that several pictures had
been left at each seat received from a resident regarding their concerns and a letter from Ms.
Schuler.
Commissioner Allen stated that she certainly knew Virginia Herberts and believes that something
in her honor is appropriate. She questioned whether staff had communicated with Ms. Schuler
about different locations.
Director Harmon stated that he had discussed it with Ms. Schuler and that his understanding was
that the selected location was appropriate for where they lived and that this bench was in close
proximity to that home. He said that he had not had the opportunity to meet with residents
onsite regarding the possibility of relocating the bench.
• Commissioner Allen stated that she believes that this item should be tabled and continued for a
month giving staff the opportunity to work with the residents regarding the location. Staff did
make that offer to the family.
Chair Brown opened the public discussion
Kathy Schuler stated that regarding the issue of a delay is that their concern is that Mr. Herberts
is on dialysis 4 days a week and the family would really like to see the bench in place while he
still has an opportunity to enjoy the bench in tribute to his wife. She noted that she met with
Randy Kearns and that the location that was designated was a bit below the curb level so she
felt that it would not impact views on the opposite side of the street. She then read a letter that
is attached to the report. She ended by stating that she hoped that the Commission would honor
the request for a bench donation in the location specified in tribute to Virginia Herberts.
Commissioner Allen noted that she had not intended to move it to another place other than Cliff
Drive Park.
Brennan Cassidy stated that he lives adjacent to where the photos were taken. He noted that he
respectfully requests that this request be disapproved for several reasons. He stated that he
respects Ms. Schuler's interest in dedicating something for her mother and apparently Ms.
Herberts' already has a bench designated in her name at the pier and that this location is
probably the furthest away from where the family lived and is the highest point in the street
level as the photograph depicts. He stated that the bench would obstruct the public view. He
believes that there really is no reason for another bench in the park because its size. He again
• asked that the request be denied.
Kathe Choate stated that she had recently purchased a house directly opposite of where the
bench would be located if approved. She noted that the main reason was because of the
beautiful view and is currently drawing up plans to remodel. She stated that there are already
three benches in the park and feels that there is really not a need for another bench and

particularly not in that location. She stated that no one should be deprived of the beautiful
view. She stated that after hearing the letter from Ms. Schuler that believes another location
should be selected that does not impact the views.
Curt Herberts stated that he lives in Newport Beach as an adult and walks by this park almost
every day and have good memories of the neighborhood and that it is important to consider that
the park is for the public and that the views should also be for those that use the park. He noted
that his mother was a very passionate person and believes that we can come to some kind of a
compromise for a specific location.
Chair Brown closed the public discussion
Commissioner Allen asked if this donation were approved over the objection of the neighbors
could they appeal to the City Council or a Council Member could call it up for action. She noted
that with the father being on dialysis it is a sad thing but is not sure that making a decision that
would make one side unhappy enough to have a Council Member call it up is the answer and then
it would be delayed possibly even longer. She stated that she is inclined that another location
should be found and has a problem with the City putting items in the citizen's view plane.
Motion by Commissioner Allen to have staff work diligently with the neighbors to see if another
location can be agreed upon.
• Commissioner Trapp asked if there were any criteria regarding the number of trees and or
benches in a park.
Director Harmon stated that there is no set criterion it is more of an opinion. He stated that in
speaking with Superintendent Sereno that it takes about a month to receive a bench and then a
couple of weeks to get it set in place so even if it were approved tonight that it is about 6 weeks
before the bench would be installed. In respect for Ms. Schuler and her time concerns and the
residents opposing the action that possibly another location could be agreed upon. He asked if
the Commission could approve the donation with the stipulation that staff work with the
residents and the donor to find a location agreed upon by all and then the bench could then be
ordered and that about three weeks could be saved. He reiterated that nothing would be
ordered unless everyone agreed to the location.
Discussion ensued regarding the location and specific policies regarding donations.
Substitute motion by Commissioner Garrett to give staff conditional approval to order a bench
if the residents and the donor agree on an alternate location. Motion carried by acclamation.
Reforestation Request - Superintendent Sereno stated that the Cameo Community Association has
requested the reforestation of 31 City parkway trees within the Cameo Shores and Highlands
community. The Association is requesting the tree removals under the City Council Policy G -1,
Reforestation of City Trees guidelines, and has met all requirements. Cameo Community Association
will assume the full costs of the removals and replacements of the trees.
• Commissioner Allen complemented staff on the new check list.
Commissioner Marston asked if there will be view issues with the replacement trees.
Superintendent Sereno stated that they will grow as high as 25 feet and they will be pruned and will
not impact blue water views.

Chair Brown opened the public discussion
Kevin Klem stated that even though his house is not part of this phase of the requested reforestation
that he is afraid that it will in the future and is concerned that replacing the trees around his house
will take away the sun protection of his mostly glass house. He stated that he had discussed this
with the Board and felt that they had agreed but has not gotten a response from then. He stated
that the Hong Kong Orchid will never provide the canopy that the trees do now.
Chair Brown stated that since Mr. Klem's house is not part of this reforestation that the Commission
is unable to discuss it as it is not on the agenda.

Motion by Commissioner Allen to reforest 31 City parkway street trees within the Cameo Shores
and Highlands Community. Motion by acclamation.
Reforestation Request - Commissioner Allen stated that since she owns a house in the Harbor View
Hills Community that she will recuse herself from this discussion and action.
Commissioner Sereno stated that the Harbor View Hills Community Association (HVHCA) has
requested the reforestation of two City parkway trees adjacent to 1038 White Sails Way and 1006
• Sea Lane. He went on to say that the Association has met all requirements and will assume the full
costs of the removals and replacements of the trees.
Chair Brown opened the public discussion; hearing none, the public discussion was closed
Motion by Commissioner Garrett to reforest 2 City parkway street trees adjacent to 1038 White

5. FY 2008/09 Recreation & Senior Services Department Operating Budget, Program Plan, Expenses
£t Revenue - Director Morgan stated that the Budget Committee had reviewed the Budget in March,
had been presented to the Commission by staff in April and will go to Council for their review and
approval in June. He stated that staff is looking to the Commission for their support of the budget.
Motion by Commissioner Garrett to approve a motion to support the proposed FY 2008/09
Recreation & Senior Services Department Budget. Motion carried by acclamation.
COMMITTEE REPORTS -
Parks - Director Morgan stated that Sunset Ridge Park will be discussed at the Special PB &R Meeting on May 20 at
6:30pm. Commissioner Garrett asked for information regarding Coastal Peak Park. Director Morgan stated that
• there had been delays but that grading had begun and that PB &R had reviewed the concept of the park about a
year ago. Completion date is scheduled for fall 2009. He also noted that work has begun at Back Bay View Park and
asked that the Commissioner visit the park. He also noted that about 75% of the design development for the OASIS
Senior Center has been complete with construction bidding to begin in early 2009.

— Community Services Award - Superintendent Levin stated that the presentation for Hoag is scheduled for
June.

—Santa Ana River Vision Plan- Commissioner Trapp stated that a meeting was held on March 26 but was unable
to attend.
—1 /1 Marine Memorial Committee- Commissioner Garrett stated that a cocktail party will be held on Sunday,
May 25 from 6 -8pm at the American Legion and the dedication of the memorial will be Monday, May 26 at f pm
at Castaways Park
— MarinaPark - Director Morgan stated that operations of the sailing center are becoming a big conversation and
so staff is making some trips to some other sailing centers around Southern California. Superintendent Levin
stated that the EIR is scheduled to be finished by June 2009.

SUBJECT: May Parks, Trees, and Operations Division Activity
Report
Parks Maintenance Division Activities
1. Parks Maintenance Division staff continues working with the Public Works
Department on numerous projects in planning and construction phases. The
Castaways I" Battalion, I" Marines (1 /1) Memorial Monument, San Joaquin
Median Tree Planting, and the Ensign View Theatre Arts Lobby Enlargement
Projects have been completed.
Projects currently underway include the Buffalo Hills Park Bollard Lighting,
Parking Lot and Walkway Lighting Replacement Project at Bonita Creek and San
Miguel Parks, Centennial Legacy Project in Newport Pier Plaza, Upper Bay View
Park, the Play Area Renovations at West Newport and Newport Island Parks.
Additionally, the long awaited groundbreaking of Coastal Peak Park in Newport
Coast occurred earlier this month, and the construction has started at the facility.
2. The annual fire abatement trimming of City owned, undeveloped or natural sites
was recently turned over to the Parks Division to manage, under Fire Prevention
staff direction. This year's work is underway with a goal of completing all sites
near structures before July 4`h. This program is listed under hazard mitigation, and
is presently budgeted at $97,000.00.
3. Two Parks Division staff received specialized training in the proper use and
operation of a forklift.
4. CPR Training was offered to all employees of the General Services Department, to
allow for proper response if an emergency situation were to arise.
5. Field renovation work was performed as needed at the various sport fields
Citywide. The work included aerification, dethatching, broadleaf weed control,
seeding, sodding and top dressing.
6. Parks Division staff commenced the seasonal weekend trash runs that will be
• performed seven days a week, until mid to late September. Additionally, due to the
rush of crowds hitting the coastal sites early on weekends, staff is scheduled to
commence work at 5:00 a.m., and are generally completed by 9:00 a.m.
7. The annual Kring and Chung Triathlon took place on Sunday, April 20th at the
Newport Dunes. Participants swam at the Dunes, rode their bikes through the Back
Bay and down Eastbluff Drive, and ran through the Dunes and Back Bay View
Park.
Staff from the Parks Maintenance Division provided assistance by setting up the
traffic control equipment for the event. In addition to setting up equipment, Paul
Ramirez, Bob Martinez, Anthony Patrarca, John Gemme, Daniel Tovar and Harold
Link were on site to assist with the equipment throughout the event.
• 8. Parks Maintenance staff completed more planting projects in a continued effort to
improve the aging landscape. Two planters in the Newport Pier Plaza/McFadden
interchange area were replanted with drought - tolerant materials that also
withstand the marine environment.
9. Accent plantings were also recently added at Westcliff Park. They will perform
well on this sloped area while providing seasonal color.
10. On April 27, 2008, Parks staff provided traffic control set up for the March of
• Dimes Walk America. Staff attended the pre -event meeting and worked on the day
of the event. Parks Maintenance Crew Chiefs Paul Ramirez and Bob Martinez,
along with Groundsworkers Daniel Tovar and Harold Link, began their workday at
• 5:00 a.m. and finished at 12:30 p.m.

In a coordinated effort, the Public Works Department
and Parks Division staff have commenced a native
landscape renovation in select areas of Back Bay View
Park. The first phase of the project started in
December, with the spreading of Biologist approved
native seed in bare slope areas. Subsequently, the
planter areas were prepped for planting along Coast
Highway, and a portion of the flat meadow area near the comer of Coast Highway
and Jamboree.
1,650 native shrubs have been planted along Coast Highway. These plants were
• selected with consideration of the Park's original palette, while also introducing a
few new native plant species due their ability to maintain a nice green appearance
throughout the year.
Two small portions of flat "meadow" area will be planted soon with California
Meadow Sedge plugs, which will be protected with a graduated rabbit fence until
the sedge has adequately matured. In the fall, plugs of Needle Grass will be added
to these areas to ensure diversity of this meadow environment. These improved
meadow areas were created with the idea of providing a more open and user
friendly area, where the public can enjoy the spectacular views of the Back Bay.
Additionally, a mulched pathway has been set and the installation of two picnic
tables is also planned.

Trees Division Activities
• During the month of April, 2,932 trees were trimmed, 44 trees removed, 13 trees were
planted and crews responded to 6 emergency tree calls. The City's tree trimming
contractor, West Coast Arborists, is currently pruning trees within the Westcliff, Airport,
Cameo and the Santa Ana Heights areas, as part of the City's overall grid trimming
schedule.
1. Recently, a Special Tree, Eucalyptus rudis (Desert Gum), located in the parkway at
213 Marine Avenue, rapidly declined and leaned into the sidewalk area. The
stability of the tree became a concern to the local merchant. Therefore, it became
necessary to remove the tree on an emergency manner to mitigate potential
liability. The emergency removal request was reviewed and authorized by the City
Manager, Risk Manager, and the General Services Director. Additionally, Mayor
Edward Selich was notified prior to the removal of the tree (see attached report and
photos).
2. The 2008 Arbor Day Celebration was held at Harbor View
Elementary School on Tuesday, April 29. Staff planned
the event in conjunction with School Principal Charlene
Metoyer. Parks and Trees Superintendent Dan Sereno
emceed the event and provided pictures of the
transformation of Newport Beach during the past 70 years
from an area with no trees to one containing the beautiful
urban forest of today. The day's festivities included:
• Mayor Selich presenting the Arbor Day Proclamation to Principal Metoyer
and students;
• Tim Brown, Chair of the Parks, Beaches, and Recreation Commission
speaking about Arbor Day;
• City Urban Forester John Conway presenting the Tree City USA Flag to the
Mayor and the Principal;
• 3`d graders reading poems composed for the event and showing off their
Arbor Day drawings; and
• John Conway leading the 3`d graders in planting trees at the Oasis Passive
Park next to the school.
• Newport-Mesa Unified School District Board members Karen Yelsey and Walt
Davenport also participated in the tree planting activities.
3. West Coast Arborists (WCA) recently removed four City trees that had caused
extensive damage to the sidewalk, curb and gutter on 32nd Street between Newport
and Balboa Boulevards. The tree removals were in preparation for sidewalk, curb
and gutter repairs performed by the Concrete Crew. Repairs included 2,300 square
feet of sidewalk, 332 linear feet of curb & gutter, 2 handicap access ramps, and 1
catch basin. To soften the streetscape, ten additional tree wells were constructed in
the project, and WCA planted 14 Tristania laurina - Water Gum trees. A total of 58
• yards of concrete were poured and the project was completed with the help of the
Asphalt Crew, patching 900 square feet of street using 26 tons of asphalt.
4. The attached Tree Activity Report summarizes requests and field activities
performed during the past month.
Beach Maintenance Activities
1. Beach Maintenance Division staff has picked up the temporary pumps and hard
line piping, since the rainy season is over. The pumps are used when rains and
high tides occur simultaneously, and are stationed at the usual trouble spots 441'
Street/Channel Park, 38h Street/Lake, and 30d' Street/ Lafayette. Additionally,
• fourteen mobile pumps are shuttled by field crews in the low lying areas of
Balboa Island and Newport Peninsula during rain events in order to help reduce
street flooding. The pumps have been serviced and stored in preparation for next
year.
This winter season resulted in 9.35 inches of rain being captured in the City
Corporation Yard Rain Gauge since July 2007.
2. Beach Maintenance and Storm Drain Divisions staff have been working together
to reinstall over 450 inlet guards in front of area catch basins. The inlet guard has
proven to be one of the best structural improvements that the City has
implemented in its fight to keep street debris from finding its way into area catch
basins, which eventually drain to the harbor. The program was implemented by
the City six years ago and continues to grow, as high pedestrian traffic areas
continue to be targeted.
3. Beach Maintenance Division staff will be working approximately 400 scheduled
overtime shifts during the busy summer season. Staff performs additional clean
up efforts in the following areas: street sweeping, restroom sanitizing, beach
grooming, emptying trash receptacles, litter picking, shoveling fire rings or steam
cleaning piers in the early morning hours or operating and monitoring the City's
extensive tidal valve during the evening hours. Even though these activities are
never seen by the public, they are essential in keeping the City safe, clean, and
aesthetically pleasing for area residents and visitors. The Division becomes a
seven day a week operation in order to meet the demands of the active summer
season.
4. The Beach Maintenance Division's early morning maintenance activities will
• continue on weekends through Labor Day, at which time will be scaled back as
needed. Additionally, high tides series that necessitate tidal valve operation and
monitoring will be switched back to the early morning hours beginning in
October.
5. Supplemental contract cleaning of beach area restrooms began on Memorial Day
weekend and will continue through mid September.
Staff is to be commended for re- arranging their personal schedules in order to meet
the needs of the City during the summer season.

Dear Mayor Selich:
On May 1, 2008, the City's Urban Forester inspected a City Desert Gum tree adjacent
to 213 Marine Avenue, and found the tree has severely declined and poses a potential
liability (see attached photo). The tree is listed as a Special Tree, Neighborhood Tree,
Balboa Island, under Council Policy G -1, Special Trees, Attachment 1.
Based on the City Council Policy G -1, Retention or Removal of City Trees, page 2,
paragraph 3, states, "Prior to any removal of Special Trees(s), the City must comply with the
• noticing protdsions of the Removal of City Trees section set forth this Pohg, unless a Special Tree is
considered hazardous that necessitates an emergency removal. Any such removal must be
recommended by the General Services Director and the Risk Manager and appm ed by the City
Manager. " Therefore, the City Manager, Risk Manager and General Services Director
authorized the removal of the City tree in order to mitigate potential liability and tree
failure.
There will be one 24" box trees (Eucal=tus cittiodora — Lemon Scented Gum)
planted within the next 60 days.
The Parks, Beaches and Recreation Commission will be notified regarding the
removal and replacement of this Special Tree.

SOFTBALL - The cry of 'Batter Up" was heard May 1P with the first games of the summer
season being played. This summer a whooping 134 teams will be playing through August 21. By
season end, close to 700 games will be played, with 2000 players. The leagues feature various
company teams including, stockbroker firms, accounting firms, law firms, action sports firms,
and just groups of friends who enter their team for fun, excitement, and the trill of victory!
Two teams of note are the BONE A's, (in the Tuesday Mens C -3 league) and BLACKIES
FIGHTING PIDGEONS, (in the Monday Men's C -2 league), beginning their 32nd straight summer
season!!!
SOCCER - The 35 adult soccer teams are looking forward to the playoffs! All 3 divisions will
• compete in a single- elimination tournament running through June 23. This is the first season
that the Adult Soccer program has been operated internally and has been a success. After
playoffs, adult soccer will take a break until September 2, giving the soccer fields at Arroyo
Park, Lincoln, and Bonita Creek Park time for rest and renovation.
SOFTBALL - The spring adult hoops season is winding down to make way for the summer
league. The 83 spring teams will finish play June 16, with summer league beginning the next
day with 90 teams! Many "veteran" adult basketball teams are coming back to play in the
summer season, with their young adult children now playing on the same teams as their Dads!
VOLLEYBALL - The "drop -in" volleyball program continues to be popular on Friday evenings at
the West Newport Community Center. The program brings in 20 to 40 people, paying $3 to
play recreational volleyball. Ric Jennings Coed 6's league is at full capacity on Thursday
evenings at the Lincoln Gym! Ric has requested more space for the summer season as more
teams than ever are entering the league!
YOUTH SPORTS / YOUTH PROGRAMS
TRACK lx FIELD - The top 4 winners in all events (50) from the the 43`d annual Frank E.
Anderson- Newport Balboa -Rotary Club Youth Track lit Field Meet competed at the SCMAF
Orange County Meet held at Laguna Hills High School on May 4th. Newport Beach had a very
strong showing, with over 50 participants attending. Participants competed in a variety of
• events, including the high jump, long jump, softball throw, and many running events. The top
4 winners at the Orange County competing on June 1 at the Southern California Municipal
Athletic Federation ( SCMAF) track meet. The SCMAF meet is held at Warren High School in
Downey. Many Newport Beach Athletes will be attending. GO NEWPORT BEACH!

On May 21, the top 20 athletes from the Frank E. Anderson-
Newport Balboa Rotary Club meet were honored at a special
track and field banquet held during the monthly meeting of
the Newport - Balboa Rotary Club. The 20 athletes received
special "friendship" medals donated to the Rotary Club by
Newport Beach's sister City of Okazaki, Japan.
Congratulations!
A special thanks to the Newport Balboa Rotary Club and Staff
for all of their help in making this such a successful 2008 for
Track and Field!
YOUTH COUNCIL
Youth Council is wrapping up the year with a final presentation at the City Council meeting on
Tuesday June 10. The teens are excited to report to the City Council on their
accomplishments over the past year.
CONTRACT CLASSES
SUMMER PROGRAMS - The 2008 Summer Navigator was sent out to
residents the second week of May and registration for all
summer classes began Wednesday, May 21. New instructors and
classes to Newport Beach include:
• Yoga Fit with Laura Schneider
• Belly Dancing with Kristina Hill
• Travel Photography with Ralph Valasco
• Growing up Gourmet by Maren Sutton
• Adult Art by Greta Silva
Meanwhile, registration for summer camps is at an all
time high. It was very apparent that participants took advantage of the
early bird special, as over 2500 participants enrolled in one of the many contractual
summer camps offered in Newport Beach, bringing in over $375,000 in revenue from
March 17 thru May 19.
ANNUAL INSTRUCTOR TRAINING - On May 14`h over 50 contract class instructors
attended the annual instructor training at the OASIS Senior Center. The
training provided new and existing instructors with the opportunity to get
to know City staff and other contractors. This year the training was broken
up into six different sessions, including developmental assets, marketing,
new policies and procedures, new instructor orientation, upcoming projects
in Newport Beach, and Gale Gorke was the keynote speaker.
CAMP NEWPORT Expo - The First Annual Camp Newport Expo was held Saturday, May 17`h at the
Newport Coast Community Center. Rather than learning about the various camps online, over
• 200 parents and children attending the event had the opportunity to meet camp directors,
ask questions and select the perfect camp to meet their children's needs. It was a "one -stop
shop" for summer ideas. Thirty representatives from Southern California displayed their
summer programs, including extreme sport and athletic camps, overnight camps, youth

enrichment programs, and many others. Additionally, nearly half of the participants who
attended the event registered for a camp and $16,000 was generated in revenue on that day.
LAWN BOWLING - On May 10 over 100 members of the community attended the Lawn Bowling
Club's Open House resulting in 40 new members to the club. The open house provided visitors
with the opportunity to ask questions, get to know other members, and learn about the
benefits of lawn bowling.
TEEN Buzz - Teen Buzz was held May 17 at the OASIS Senior Center. Parents and teens joined
together to discuss future programming for teens. Topics included video game clubs, Friday Night
Fun at NCCC, Battle of the Bands, Pre - College Courses, and Stock Market Classes. This was a great
opportunity to receive feedback from the community to ensure the best programming for teens!
AQUATICS
AQUATIC TRAINING ACADEMY UPDATE - The trainees are now halfway through this year's aquatics
academy. Staff has been busy training and testing the academy class on different rescues,
first aid situations, and stroke •'
techniques for swim lessons.

preparing local young adults to be
pool swim instructors and lifeguards.

Mark your calendars - swim lessons begin Monday, June 23. Staff
will be teaching at MBAC and NHHS.
SUMMER SPLASH BASH - Grab the family, neighbors and
friends and head down to the swimming pools this summer
to beat the heat. Lifeguards will be grilling hot dogs and
hamburgers on June 27 from noon - 3:OOpm at Newport
Harbor High School to kick off the summer. The 45 foot
pool inflatable will bring residents hours of climbing,
sliding, and jumping fun! More Splash Bashes will take
place in July and August.

Lincoln to obtain a permit for any future use.

event at BCSP, removed beer bottles from Arroyo Park. Stopped boys from shooting arrows

• rooms /gyms, checked on weekly meetings at community rooms, checked on Mariners
Library entry and parking lot daily for disruptive juveniles, stopped skateboarders from
damaging City property at NCCC and Bonita Creek CC, assisted with NB Fire /Police event
at NCCC.

enforcement of no bbq /fire outside fire rings at CDM Beach.

PARK Ft CAPITAL IMPROVEMENT PROJECTS
SUNSET RIDGE PARK - A special session of the PBEtR Commission was held May 20 to conduct a
fifth public meeting to gather public input on the modified concept for Sunset Ridge Park.
The modified plan is intended to address the concerns expressed in prior public meetings by
the Crest Residents, AYSO 97 and Newport Harbor Baseball. The modified plan was
unanimously approved by the Commission. The commission recommended that staff address
beach user parking, restroom security and portable fencing as the concept moves forward.
The concept will be heard by the City Council at an upcoming meeting.
Newport Theatre Arts Center - Thanks to the Public Works staff, this project is almost
complete! The lobby expansion project and restroom renovation has resulted in a beautiful
area for the NTAC to conduct performance receptions.
MARINA PARK - Recreation staff is in the process of developing a business model for the use of
the Marina Park Sailing Center and Community Center. The business plan will help in mapping
out the future uses of the building and possible partnerships. Staff will be visiting existing
City operated sailing centers in early May to research and gather information and determine
best management practices.
CYC REMODEL - Staff will meet with Dougherty + Dougherty Architects in June to begin the
working drawings and bid packets for the remodel of the center starting in fall 2008. The
center will be closed for 3 -4 months during the process with a total cost of $1.2 million.
NCCC - Newport Coast Community Center had a busy month in May, which included:
• Staining of concrete walls and painting light poles.
• Carpeting walls in storage rooms
• Design plan for enhancements to the center sound, video and lighting. The City has hired
a consultant to design the system with installation scheduled for this coming fall.
• During the month of May, NCCC staff met with local artist Sean Tiner. His company Epic Arts
LLC will create archival art featuring iconic images of Crystal Cove and Newport Beach.
WEST NEWPORT Et NEWPORT ISLAND PLAYGROUND REPLACEMENT - Staff is working closely with the
• Public Works Department to have the playgrounds installed. Construction began May 21 and is
scheduled to be completed by mid June.
BEGONIA PARK - The pre- construction meeting for the renovation of the arson damage took
place on May 29 with construction beginning and finishing in June.

COASTAL PEAK PARK - Recreation, Public Works and Parks staff met on -site with the contractor
• on May 22 and will continue to meet weekly throughout the project. The first site meeting
included communication protocols, walk of the site and discussion of the grading which is
currently being completed. This project is being funded by the Irvine Company and will
become the property of Newport Beach upon completion.

SENIOR SERVICES

Re: Senior Services Division Monthly Activities Report
Lecture - OASIS began a new lecture series this month entitled Down with Falls. This class
was held in two sessions and covered the following topics: Why people fall, fear of failing,
how to lower your risk for falling, how medical conditions affect falls, which medical
conditions affect falls, and nutrition and falls. This lecture was provided by the Office on
Aging - Down With Falls Coalition.
New Buildine - The building project is moving forward at a rapid pace. Staff and seniors have
been meeting with the architect to provide input into the various rooms throughout the
facility. Architect, Bob Coffee and Manager Jardine -Haug met with the homeowners that live
above the Center to discuss the design and address their concerns regarding height and
facility usage. Mr. Coffee has also arranged to meet at their homes to look at the view from
their backyard.
Fundraisine - The fundraising committee held a wine and cheese event this week with the
sailing club to inform them about the project and encourage them to make a donation. The
committee decided that this was an effective way of meeting with various possible donors.
• Another event is planned with the Terraces Senior Community located directly next to OASIS.
Therapy Does - Therapy Dogs International shared the joy and fun that these dogs deliver on
their visits to Alzheimer's facilities, convalescent homes, children's hospitals and more.
Speakers included Jane Horsfield and her border collie, Roxanne, Lillian Brabander and her
dancing Weimaraner, and Chris Manahan and his Labrador Retriever mix.
Pacific Symphony - On May 21, the Pacific Symphony presented a String Quintet
"Informance" with members from the orchestra. This presentation featured light classical
music and lively information from their string players. This performance was funded by the
Newport Beach Art's Commission grant program.
DMV Lecture - On May 28, DMV lectured on What you Need to Know to Keep Your Drivers
License and Remain Safe. They presented an overview of the Senior Driver Ombudsman
program and society's need for safe senior mobility. Topics discussed included: how to keep
your license with healthy, active life styles and good habits; Cognitive function - mental
exercise and alertness; the DMV re- examination, hearing and interview process; how to pass
the test and what to do if you do not pass.
May is National Better Hearine Month - An all -day hearing screening event was held with
Donna Cody of Coast Hearing and Mark Dobkin of Hearing Enhancement who both volunteered
their time.

SUBJECT: Bench Donation Request
At your May 6, 2008 meeting, staff brought forward a Bench Donation Request from Ms. Kathy
Schuler (report attached). The bench was to be placed at Cliff Drive Park. During the meeting,
two members of the community spoke against placing the bench at that location citing a blue
water view issue.
Following public comments, the following motion my Commissioner Garrett was approved:
"That the Commission conditionally approve a bench donation by Ms. Schuler to be
located at Cliff Drive Park if General Services staff and the involved parties can all agree
upon an alternate location. If the parties cannot agree upon an alternate location, then the
• donation is not approved. If they do agree, then General Services will order the new
bench."
The motion was unanimously approved.
Several days following the Commission meeting, General Services' staff met with Ms. Schuler at
Cliff Drive Park. Staff showed Ms. Schuler two alternate locations in the Park where a donated
bench could be placed. She did not accept either location. Instead, Ms. Schuler decided that she
would pay any additional costs to have the donated bench placed lower on the bluff (photo
attached) to eliminate any view issues from the surrounding homes. Ms. Schuler asked that this
" altemate" location be brought back to the Commission for approval as she feels the view issue
has been addressed by lowering or recessing the bench.
Staff's understanding is that both parties involved originally, Ms. Cathy Choate and Dr. Cassidy,
are still not in favor of the bench in the "alternate" location. A letter from Ms. Cathy Choate is
attached.

Bench Donation Request
Recommendation
Staff recommends that the Parks, Beaches and Recreation Commission consider the bench
donation request at Cliff Drive Park.
Discussion
. City Council Policy B -17 establishes criteria for parks, facilities, and recreation program
donations within the City. The policy is structured to establish a fair and uniform procedure for
making gifts to the City to make the donation process easier for staff and donors.
The City has received a request from Ms. Schuler (Attachment A) to donate a bench at Cliff
Drive Park. The donated bench (Attachment B) is included on the City's Official Bench List and
will match four previously donated benches at this site. Attachment C shows the location of the
proposed bench donation. Attachment D is an aerial of the proposed location.

Since the value of the bench with a new concrete pad (to place the bench on) is greater than
$1,000.00, the donation is eligible to receive a dedicatory plaque that will be placed on the
bench. The submitted plaque verbiage, which complies with City Council Policy B -17, is
"Donated for Virginia Herberts ". Ms. Schuler is also asking permission upon the passing of her
ailing father, Curtis Herberts, that a replacement plaque with the verbiage "Donated for Curtis
and Virginia Herberts ", be approved at this time as well.
Ms. Schuler, Council Member Steven Rosansky, and the Newport Heights Improvement
Association have received a copy of this report and a notice of the Commission meeting.
Adjacent property owners were also notified of the Commission meeting.

Re: Proposed Memorial Bench in Cliff Drive Park

I am writing to you as my husband and I will be out of town on June 3, and
unable to personally attend the next Commission meeting. From speaking with
Mark Harmon, it is my understanding that this issue will be revisited at that
meeting and we wanted to be sure that our opinion and perspective is
considered before any decision is made.
Subsequent to the conclusion reached by the Commission that the original
placement of the bench would indeed block views of the residents on Cliff Drive,
the family requesting the bench to memorialize their mother met with Mark
Harmon, Dr. Brennan Cassidy and me. After some discussion, Mr. Harmon told
• both Dr. Cassidy and me, that he did not think that the knoll in Cliff Drive Park
was a suitable site for the bench. A couple of days after that, Mr. Harmon
phoned me to say that Ms. Shuler wanted the bench only in this particular spot
and would be willing to pay for the "recessing" of the bench as well as
positioning it down the knoll, closer to the shrubbery.
My husband and I are concerned that this plan to recess the bench poses a
serious safety hazard for the City. A child could fall over it or at night someone
could injure themselves by not seeing it. With the position lower and closer to
the shrubbery, we are also concerned about the undesirable and noisy activities
it might attract as a result of being below the line of sight of patrolling officers.
We empathize with the family's desire to memorialize their mother. On a
personal note, I lost my twin sister last December and in the quest to find a site
for a memorial bench for her, the special location we chose was not acceptable
to some people. We consequently selected another location which was not as
special to her family and friends but rather one that was acceptable to the
people who objected. I personally did not want a memorial for my sister to draw
any negative words or thoughts. It simply seemed to us that those who live with
these memorials on a daily basis should be as pleased with them as those who
request them but only visit occasionally.

In light of the above, we respectfully request that another site be found for the
bench. If it is decided to proceed with the bench at the "recessed" site, I think it
only fair that plans be drawn up so that the neighbors know exactly what they
are dealing with as far as location and height is concerned. We agree with
Commissioner Allen when she said," We dont allow private property owners to
block views, so we shouldnt allow the City to do so." Additionally, there are
already three existing benches in the park, which as you know is relatively small.
We feel three benches in one small park are enough for the public to enjoy the
view and tranquility. We hope that this little knoll remains a small piece of open
space so rare in our City anymore. It strikes us as no small irony that Ms.
Schuler's mother, who apparently was well known for protecting views, would
probably be supporting our position if she were still alive.
Thank you very much for your time and consideration. We will be returning to
town on June 6, and hope that this matter will be resolved to everyone's
satisfaction.

SUBJECT: City Street Tree Designation
Recommendation
Consideration of the request to designate the Magnolia and Queen Palm as the designated
street tree on Bayside Drive, between East Coast Highway and the west entrance into Newport
Dunes (200 block).
Background
• The City Street Tree Designation List was adopted by the City Council in May 2000
(Attachment A) after a thorough review by the Parks, Beaches, and Recreation (PB & R)
Commission. The list designates specific species of trees for future planting in parkways
and/or medians of a City street to promote uniformity of the street treescapes. However, the
200 block of Bayside Drive, between East Coast Highway and the entrance to Newport Dunes
was not included in the Street Tree Designation List. Staff is requesting that this block be
designated at this time.
The Street Tree Designation List is maintained and reviewed on an annual basis by City staff
in accordance with Section 13.08.020 of the Municipal Code (Official Tree List) and City
Council Policy G -6 (Maintenance and Planting of Parkway Trees). Any changes,
recommendations, or resident request for changes are forwarded to the PB & R Commission
for consideration.
Discussion
The 200 block of Bayside Drive, adjacent to Bayside Village Homeowners Association
property, currently has 30 Olive trees located within the parkway. Over the years several of
the trees have died, and recently ten dead trees were removed. Due to the failure of the Olive
trees, Nicole Conner, General Manager of Bayside Village Homeowner's Association
(BVHOA) and Malcolm Read, President of BVHOA, met with staff to determine a tree
species that would enhance the street and entry to the Bayside Village and Marina
• (Attachment B). Staff believes that additional Olive trees in this area may decline, as a result
of verticillium wilt (root disease).
• Staff has determined that the Magnolia and Queen Palm varieties of trees will perform better
in this location, and BVHOA intends to install an automated irrigation system and additional
plant material along the parkway. Once the parkway improvements are completed, the Olive
trees that were removed will be replaced by the City with a combination of Queen Palm and
Magnolia trees. A map and information regarding the Magnolia and Queen Palm trees are
attached (Attachments C & D). The trees will be a welcome enhancement to this community.
BVHOA has received a copy of this report and a notice of the Commission meeting.

Origin: Southern U.S., 1734
Species characteristics:
Forth - Evergreen. Formal, dense, broadly pyramidal tree, slow growing to 60' tall,
spreading to 40' wide.
Trunk - Smooth when young, maturing to dark brownish black platelets.
Foliage - Glossy, stiff and leathery leaves are deep green, rusty brown - backed and
variable by cultivar. They are ovate, 3 -10" long and 24* wide, with edges that ate
entire and occasionally wavy. The reddish young branches and pointed bro%mishw
green buds are both pubescent.
Flowersifruit - Large, showy, scented b - I cup-shaped flowers have fleshy light
yellow to ivory petals. Trees bloom throughout the surnmer. Fall fruits are 3 - 4"
cone shaped pods that split open to reveal shiny bright red seeds. Very showy
during flowering and fruiting.
Cultivars - Numerous cultivars covering a broad range of shapes and sized, Borne
reaching no more than 20, as well as some with variations in leaf, flower and growth
characteristics.
No significant pest problems.
Site suitability:
Sunset zones - 4 - 12 and 14 - 24,
Clearances - Suitable for 19 minimum parkways, medians or cutouts. Smaller
cultivars are suitable under utility lines and in smaller planting sites.
Goad for street sides, medians, parks and lawns.
Culture considerations:
Tolerant of heat and damp soil. Somewltat drought tolerunt. Must have good
drainage. Litter problems.
Comments, notes:
• Use cultivars when uniformity and earlier blooming tithes are needed

Species characteristics:

Form - Feather palm. Gracefully arching, medium sized, moderate to fast
growth, to 50' with a spread of 20'.
Trunk - Smooth and exceptionally straight. Sears are formed on trunk when
frond sheaths drop, resulting in bands of light and dark gray.
Foliage - Many soft, gray- green graceful arching fronds, with blades
attached to a central midrib, are borne in staggered whorls. Fronds, 10 - 15'
long, are sparse and open.
Flowers/fruit - Small cream to yellow flowers turn into showy hanging
clusters of green dates on 3' stalks. Fruits ripen in June and turn orange
before falling.

Significant pest problem is pink bud rot (Ghocladiunr vermoeseni).
Site suitability:
Sunset zones — 12, 13, 15 - 17 and 19 - 24.
Clearances - Suitable for T minimum parkways, medians or cutouts.
Good for street sides, medians, parks and lawns.
Culture considerations:
Drought tolerant, but responds to water and fertilizer in well drained soil.
Tolerant of smog and seacoast exposure. Fronds subject to breakage in high
winds. Fruit litter problems.
