HomeMy WebLinkAbout6 - Ordinance to amend 7.04.030 of Title 7 pertaining to Animals (dogs) on the Beachi Item 6 October 5, 2010 Recreation & Senior Services Department To: Parks, Beaches & Recreation Commission From: Laura Detweiler, Recreation & Senior Services Director Matt Lohr, Recreation Manager Re: CONSIDERATION OF AN ORDINANCE CHANGE AMENDING SECTION 7.04.030 OF TITLE 7 OF THE NEWPORT BEACH MUNICIPAL CODE PERTAINING TO ANIMALS ON THE BEACH RECOMMENDATION That the Commission at the direction of City Council reconsiders changes if any, to Section 7.04.030 of Title 7 of the Newport Beach Municipal Code pertaining to the hours animals are not allowed on City beaches. It is recommended that the Commission review the following options: • No change to the ordinance as currently written (prohibits animals on beaches between 9:60am- 5:00pm year round); or • Change hours that animals are not permitted on beaches to 10:00am — 4:30pm on a year round basis; or • Exclude animals on beaches between the hours of 9:00am to 5:00pm from May 15 to September 15 with no restriction from September 16 to May 14; and • Exclude harbor beaches from any changes to the existing ordinance. and • Forward recommendation to City Council for their review /approval and 1St reading. HISTORY Prior to 1996 the City of Newport Beach Municipal Code section 7.04.030 (see Attachment A) prohibited animals on public beaches during the summer months (June 15 through September 15) anytime and non- summer months (September 16 — June 14) from 9:00am — 5:OOpm. In 1996 the ordinance was amended to prohibit animals on public beaches year round during the hours of 9:00am to 5:OOpm. Sufficient confusion on the public's part as to when animals were allowed and not allowed on the beaches prompted staff and the sitting City Council to amend the ordinance as it stands today. DISCUSSION Upon request from a group of dog owners, Recreation met with staff from the Fire Department Beach Lifeguards, Police Department Animal Control and local dog owners to discuss changing the hours that dogs are allowed on the beach. These residents requested additional time for dogs to be allowed on the beach to all day between the months of September and May. Of additional concern to this group were the winter months of November and December where the days are shorter with minimal daylight allowed for dog walking under the current ordinance. r CONSIDERATION OF AN ORDINANCE CHANGE AMENDING SECTION 7.04.030 OF TITLE 7 OF THE NEWPORT BEACH MUNICIPAL CODE PERTAINING TO DOGS ON THE BEACH Page 2 The Police Department Animal Control Officers concurred that the reason this ordinance was amended in 1996 was due to the many citizens that had been ticketed on the beach in violation of this ordinance. The Animal Control Officers stated that most citizens found to be in violation had a misunderstanding about the ordinance that centered around the months that animals were and were not allowed on public beaches. Staff and City Council sought to clarify the ordinance by simplifying it to read: "No animals allowed on public beaches any day of the year between the hours of 9:00am to 5:00pm." The ordinance was revised to reflect this clarification and has stood since 1996. Beach Lifeguards shared concerns about weather conditions that bring warmer temperatures during non summer months causing beach populations to swell. The ordinance allowed animals on the beach during the day in the winter which caused conflicts between the animals and beachgoers. Fights between animals also occurred. Beachgoer complaints of animal urination and defecation were common and more hours had to be spent by officers in patrol of the beaches during winter time when warmer weather occurs. To provide comparison data, several Orange County coastal communities were contacted to ascertain how their ordinances treat this issue. A synopsis of that data follows. Cities prohibiting animals on public beaches year round: • Dana Point • San Clemente • Seal Beach • Huntington Beach Cities allowing dogs on beaches year round under certain conditions: • Laguna Beach - Animals not allowed on beaches between the hours of 8:00am to 6:00pm from June 15 to September 16. Animals must be leashed at all times. Another concern is animal waste that is deposited upon and into the sand of public beaches. A portion of this waste can be monitored in the form of pet owners picking up after their pets. However, as one can imagine, any liquid waste is unrecoverable and resides in the sand until diluted by the environment. The greater concern is irresponsible dog owners who choose not to pick up after their pet. Understanding that the winter months of November and December provide for very little daylight for dog walking on the beach, staff collectively agreed that adding an hour in the morning and a half hour in the afternoon would provide for greater access with daylight and not be cause for great concern with beach crowds gathering at this time. Consistency with the schedule for when dogs are permitted on the beach is and remains of utmost importance for enforcement purposes and was the basis of staffs recommendation to change the prohibited hours on a year round basis to 10:00am- 4:30pm. CONSIDERATION OF AN ORDINANCE CHANGE AMENDING SECTION 7.04.030 OF TITLE 7 OF THE NEWPORT BEACH MUNICIPAL CODE PERTAINING TO DOGS ON THE BEACH Page 3 The Parks, Beaches & Recreation Commission recommended an ordinance change to the City Council at their June 1, 2010 meeting which prohibited animals from beaches 10:00 - 4:30 pm on a year round basis. Council considered this recommendation at their July 27, 2010 meeting and approved an ordinance change that would prohibit dogs between the hours 9:00am to 5 :00pm from May 15 to September 15 and no restriction from September 16 to May 14. At the second reading of the ordinance change on August 10, 2010 the Council received public feedback that required further review and consideration of the expanded hours and differentiation of ocean or harbor beaches. All written correspondence to this matter is provided in Attachment B. PUBLIC NOTICE An E- Select Alert was sent to residents regarding the Commission's review of Section 7.04.030 of Title 7 of the Newport Beach Municipal Code pertaining to the hours that animals are not allowed on City beaches. No person having the care, custody, charge or control of any animal shall permit or allow that animal to be on any ocean front beach or ocean front sidewalk or on any bay front beach between the hours nine a.m. to five p.m. B. No person having the care, custody, charge or control of any animal shall permit or allow that animal to be on any ocean front beach, ocean front sidewalk, bay front beach or bay front sidewalk unless that person has, in his or her possession, an implement or device capable of removing any feces deposited by the animal. C. The provisions of this section shall not be applicable to: 1. Any animal enrolled and participating in obedience classes offered by the Community Services Department of the City or in any show for which the City has issued a special event permit; 2. Any guide dog while being used by a blind person or any dog being trained to be a guide dog for the blind pursuant to a recognized program of training provided the dog is on a leash and the person in charge has an official identification card issued for such purposes; 3. Any blind person. No person shall permit or allow any dog on any public pier or dock. B. No person shall permit or allow any dog in the Balboa Island Park, which is a public park located on the west side of Agate Avenue between Park and the alley north of South Bayfront on Balboa Island. No person shall permit or allow any dog to enter or remain on the playground, basketball courts, or fenced in grass areas immediately surrounding the basketball courts and playground at the 38th Street Park, which is a public park located at Balboa Blvd. at 38th Street, Newport Beach. Any person violating or failing to comply with any of the provisions of said sections shall be guilty of an Infraction. Any person convicted of violating or failing to comply with any of the provisions of said sections shall be punishable by the fines as is specified in the currently adopted Uniform Infraction Bail Schedule used by the Orange County Municipal Courts. Every person who keeps a dog older than four months for more than thirty (30) days in the City shall obtain a dog license. The duration of this license shall be the greater of six months or the remaining term of the dog's rabies inoculation, up to the maximum of three years. The fee for the dog license shall be established by resolution of the City Council. License fees are delinquent thirty (30) days after the due date and shall be subject to the payment of a late charge established by resolution of the City Council. With each license, the City shall provide a tag with an imprinted number which shall be worn by the dog when in public. This tag number shall reference the file kept by anima) control on each dog which includes: 1. A description of the dog; 2. Owner's name, address, and telephone number; 3. Duration of license; and 4. Duration of rabies inoculation. (Ord. 1188 § 2, 1966) 7.04.070 Vaccinations. A. Defined. The term "vaccination' shall mean the inoculation of a dog with a vaccine approved by the Orange County Health Department. B. Required. Every person who owns or harbors any dog shall have such dog vaccinated against rabies on or prior to the date such dog reaches four months of age and thereafter at intervals of not greater than two years. A dog may not be licensed prior to vaccination. C. Veterinarian's Certificate. Every duly licensed veterinarian after vaccinating any dog shall sign a certificate in triplicate containing the following information: 1. The name and address of the owner or harborer of the vaccinated dog. 2. The kind and serial number of vaccine used and the date of vaccination. 3. The year, number of dog license tag, and name of City where issued; or, in the event that the dog has not previously been licensed, a notation to that effect. 4. The breed, age, color, and sex of the vaccinated dog. First of all, For this ordinance amendment I urge you to strike out `Bayfront beaches" and for that fact all Newport Harbor beaches ". And for now try just OCEAN Beaches. There is no language in regards to the ASBS areas (Little Corona to Crystal Cove), and the critical EPA TMDLS for bacteria in Newport Bay. There is new scientific evidence that shows how animal bacteria are harmful in sand to human exposure, and that even residue can find "pathways" into the receiving waters. Balboa Island has seven bay water sampling sites for monitoring bacteria harmful to humans of the sever sites, four of them get posted frequently: Sapphire Ave, Grand Canal, Onyx Ave and Cnmet Ave. not to say other beaches on the Island have been posted for standard violations of Total Coliforms, Fecal Colifomts, and Enterococci. The most important issue we're looking at here Is this a benefit for our ongoing hard work trying to clean up o'ir bay for water - contact recreation (REC -1) and shellfish harvesting (SIIEL), or are we going backwards? As you might know there is new scientific evidence of harmful bacteria and parasite transfer from the sand or, beaches from waste from dogs that cannot bejustified when its harmful to babies and young children trying to safely enjoy our bay. Bacterial contamination of the waters of Newport Bay can directly affect two designated beneficial uses: water - contact recreation (REC -1) and shellfish harvesting (SHEL). Coliform has diverse origins, including: manure fertilizers which may be applied to agricultural crops and to commercial and residential landscaping; the fecal wastes of humans, household pets and wildlife; and other sources. Implementation of the Newport Bay bacteria TMDL is expected to address these bacterial quality problems and to assure attainment of water quality standards, that is, compliance with water quality objectives and protection of beneficial uses regarding high priority water contact recreation and shellfish harvesting areas. Compliance dates for these TMDL standards are expressed as "Soon As Possible ". I have talked with many folks all over Newport regarding this and most agree we need to do something to REDUCE any potential pathways for bacteria loads that can enter our bay especially which gets more of a concentration than the ocean, especially from dogs and cats. The Newport Beach police Department has reservations in regards of enforcement for extended Animals on the beach hours. Again, extending dogs, or as written "Animals" hours of use to beaches does not meet a water quality plan or model for achieving lower bacteria source objectives. As a member of the Newport Coastal/Bay water quality advisory Committee I will be addressing new science findings and potential bealth concerns regarding animal waste on our beaches. Again do not change this ordinance for Newport Bay harbor beaches, sidewalks, and bayfronts. Newport Beach has to be one of the most dog friendly coastal city's in Southern California. So try the Ocean Beaches, but leave harbor beaches the same or more restrictive, so we can achieve water quality standards we've been working so hard to get. Would anyone like to walk around Balboa Island ally's, bayfront's and beaches barefoot after dark? 1 didn't think so... As you know the OC has grown significantly and so has the number of dogs. Balboa Island is being strained/wom for the use of dog walking on our bay front's and beaches, and alley areas. After talking with many Islanders recently in regards to the use change, the tensions are climbing and new issues are on the boiler concerning beach health issues and the difference of "concentration" between the ocean and the bay in regards to bacteria loads. I strongly feel a rising "Pandora's Box" effect here on the Island concerning this issue and really don't want to see it go ballistic. I strongly suggest extending the hours for ocean beaches only, Not to the Newport Harbor beaches (most lighted at dusk). I side with Councilman Selich and Webb to just keep thing the way they are. Researching many other beach city "dogs on beach" rules/ordinances from San Diego to Santa Monica, dogs are restricted from most beaches except for designated walkways, trails, and designated dog use areas. The City of Newport Beach restricts dogs from all parks, which makes the beach use confusing. I know its not the dogs, its the owners contributing to this issue. I also request you consider looking at ocean beach designated dog parks as many water quality minded and recreational waterlcoastal cities inconporale. Sorry if that s not the case, but the following are my thoughts... Re: amendment to Section 7.04,030 of Title 7 of the Newport Beach Municipal Code The blanket removal of winter restrictions to dogs on the beach seems a bit hasty and made without the thorough thoughtful review that it deserves. It seems lie it would make more sense to ease into this and let dog owners cam the removal of these restrictions. It would be easier to add then take away. Have you been to or seen Dog Beach in Huntington Beach, is that what you want for Newpon Beach? To say that dog owners have nowhere to go is simply not hue, the River Jetty area which I assume is not under the jurisdiction of Newport Beach is overran with dogs a fair amount of the time and is certainly well used by dog owners and avoided by nondog owners, Dog Beach in Huntington is not adjacent to homes and therefore does not really affect any residents. Newport Beach on the other hand does not have an area of beach that does not affect adjacent residents who most likely would not be all that happy to have the area outside then home designated as Newport's Dog Beach, As someone who Tegulady walks on the beach all year long including the winter it is not uncommon to see unleashed dogs running down the beach and/or occasionally encounter dog feces left by some irresponsible person. To police these issues is really not possible and opening the door to everyone will only make these problems worse. Obviously there are many responsiblc dog owners fit control their dogs and pick up their waste; unfortunately there are also many that do not it seems to me that what we have now works fine for everyone both dog owners and non-dog owners, if it's not broken don't fix )t. At the very least try expanding the hours a linle and see if there are problems and/or if peop'.e are responsible then constdcr additional changes. We speak on behalf of dozens, if not hundreds, of Newport Beach residents and voters. We can mobilize them for signatures and attending a heating if there were time. However, we will be out of town starling tomorrow and can not be at the neat heating, Having just found out about the passage of the first reading and having plans to leave town for a family wedding in Montreal, we do not have time to do the mobilization now but if important to the Council will do so when we get back. We are oceanfront residents and can see first hand the effect dogs have on human's enjoyment, health, and safety on the beach. As city residents, we are also concerned that more dogs mean more liability for the city (including dog bites) and more health and quality issues on the sand and in the water. The non - summer months are equally important to residents and to many resident, more important even than the summer months. For many residents their enjoyment of the beach increases with the clear warm weather of fall and spring We also are dog owners, who love our dogs, and while we would enjoy the extra hours of walking our dogs on the beach, we feel the disadvantages far outweigh the benefits for the entire community and for our visitors (foreign and domestic) during the non - summer months, where Newport beaches are still a first -class destination. Newport Beach already has some of the most liberal politics in Los Angeles, Orange and San Diego counties regarding allowing dogs on the beach. Abolishing any restrictions will make Newport beaches a "doggie destination" for people from all these places. As Newport peninsula residents, we work hard daily, to maintain the safety and beauty of the beach. We keep the boardwalk and sand clean and we see the effect that dogs have on the boardwalk and sand. Reasons to not adopt the proposal: I. The city will have more liability as more dog - people interaction will have dog bite and health issues. 2. Dogs poop and urinate on the boardwalk. This oftea happens, and if it is not cleaned up immediately, bare feet and bicycles spread it along the boardwalk. It's smelly, gross, and unhealthy. Nearby residents keep bleach, bags, and hoses handy, but we cannot always discover it immediately. (Unfommately dog - owners do not always clean -up their dog's mess –see #3 below.) 3. Dogs poop and urinate on the sand. This is harder to notice because sometimes sand covers it partially. People notice it when they step in it, or worse, when kids or adults ram their fingers through the sand. 4. Many dog owners are diligent about cleaning up after their dogs. But not all are (especially if they think no one is looking). If only 1 in 100 neglects to pick up —that dirties our beach quickly. Nearby residents are always asking dog owners to clean up. Very recently, a dog owner did not clean up after his dog--a not uncommon event. My husband politely asked him to clean up and the owner glared at my husband and said, "No ". Not 10 minutes ago, I saw a dog "do its business" on the sand, the owner kick sand over it, look up and see me watching, and literally pull their dog and run away. We are almost always treated with anger when we politely ask someone to clean up after their dog. Sometimes we are afraid to confront a transgressor, and so we wait and clean it up ourselves. 5. Although the law specifies that dogs must be on a leash, in the winter months about a third of them are running fi ce. They arrive at the beach on a leash, but the owners unleash them to let them `run fuze ". This leads to numerous dog fights, and terrified children (and aduhs). 6. Dogs bother people on the beach. It's scary when you buy your child a hamburger or ice cream, and a curious dog (and I have seen pit bulls) comes up to investigate. Children playing in the sand are especially bothered. During the non- summer months, I often hear screams of terrified children, and see parents rushing to protect diem. The dog owner often just smiles and says, "Oh, don't worry, he's friendly", or "Oh that hamburgerjust smells so good to him". 6. Our beautiful Newport beaches are used by humans year - round. Our residents and visitors, walk, ran, relax , and explore everyday, no matter what the weather or season. They deserve a clean, safe beach. What are the solutions? 1. If we keep the hours and leash laws the way they are, residents and visitors can use the beach during the daytime hems. 2. If you change the hours SLIGHTLY during the non summer months, theft dog owners will have some daylight hours to walk their dogs on the sand, and people will know they will expect dog -human interaction at those hours. 3. Designate a few sparsely used portions of the beach for all -day dog walking. Many portions of Newport Beaches are used year round by residents and visitors. The primary recreational purpose of the beach is for residents and visitors. Although most southern California beaches do not allow dogs at all, a few have a designated "dog beach" 4. Although it really won't be enforceable without significant patrolling and city expense, let dog owners get a special permit for dog walking, so that cleanup and safety can be enforced. This is similar to Newport peninsula having residents and frequent visitors purchase special parking permits (blue meters). 5. Have heavy, heavy enforcement of leash laws, clean up laws, and safety laws regarding dogs, even though this will be a significant expense to the City. Give lifeguards, police, and even volunteers authority to fine and enforce those laws. Use existing and install new cameras to enforce these fines. Let me reiterate, we are dog owners and we would benefit from these all -day laws. But we feel as residents and voters it is not worth the price we pay in civic liability, cost to the city, lack of cleanliness, safety, and healthiness of our beaches to allow dogs on the beaches all day during the non summer months. There are numerous studies by Universities, health departments and sanitation departments to document the health hazard of feces in sand beaches. Not only is there the health issue, but the reputation of our fine island and the potential economical impact on the vacation/recreational status should our beaches become laden with dog waste. Not an attractive outcome! Therefore, I urge the city council to eliminate animals from Balboa Island beaches altogether, we have lots of sidewalks, alleys, streets and even the animal owners very own property for their animals to use. Over that time I have come to realize that the current restriction on dog during the Fall, Winter and Spring is not only unwarranted, but actually cause a number of serious problems for residents regardless of if they like or dislike dogs. The governments primary responsibility is the safety of it's citizens. The current restriction runs counter to that primary purpose. During the Winter the days become so short that dog owners are required to walk their dogs either in darkness or on the streets. Those who choose to walk on the streets in daylight increase the risks to themselves and to motorists. Most of the streets in West Newport do not have adequate sidewalks for walking and many choose to walk in the middle of the street. In the Summer this is less problematic since cars have to go slow due to congestion and massive numbers of pedestrians, but after Labor day weekend the speeds increase significantly. Combine the higher speeds an increase in people walking dogs on the streets and SUVs lining one side of each street and it can be quite dangerous. The other choice to walk dogs on the beach at night, can be worse for many of our cities older citizens, navigating those rock jetties is not trivial after dusk for me and I'm only 41. If someone, god forbid, were seriously hurt at night, they could wait a long time before anyone found them. Another factor is to keep out streets, sidewalks and parks clean and safe from filth. There is only one place in Newport Beach that I know of where one can completely remove dog feces. The sand. Many people use the small swatches of grass and playground sand boxes and litter places for their dogs in the day. Even if all of them were to make good efforts to remove their dogs droppings they would still leave a bunch stuck to grass and sidewalks. Ask people who live near them, it's horrible. There is no way to clean it up and the dog owners in that area have no choice during much of the year. Allowing them to go on the beach would allow them to completely remove dog feces. On the same subject, occasionally 1 notice someone take their dog a couple feet onto the beach in the day and let them poop and pce. right next to some ones home. Mine included. l have often wondered if-they could bring their dog on Lhc beach legally would they have stopped right next the house or would they have had the dog do their business a« ay from the homes. I've heard arguments about hoards of people who will invade Newport Beach in the winter with their vicious dogs if we pass this. I cannot help but laugh. Very few people take there dog out of their neighborhood for a walk_ In the last 4 years I think I have done it maybe 10 times. If someone is going to travel to another place to play /walk their dog they are always going to be more likely to go to Dog Beach in Huntington, like many of the people in Newport Beach. The number of dogs on the beach in Newport is likely to stay very close to what it is today. Only the time of day that the dogs are out will differ. Contrary to what some may think, dogs don't poop more when the laws change. Responsible dog owners stay responsible. Irresponsible dog owners are more likely to get caught if they are out in the day. The current dog ban simply hurts Newport Beach residents. In particular it hurts responsible law abiding dog owners, and the elderly. The group most at risk of injury walking at night, senior citizens is the same group who could most take advantage of the change. 1 Some additional benefits of getting dogs off the streets and on the beach. 1) On the streets and sidewalks one can not avoid a dog walker if you don't like dogs. On the beach there is maneuvering room. 2) Dog walkers can avoid other dogs if they see a dog which looks aggressive. 3) Irresponsible dog owners are more likely to be caught if they walk during the day. I suspect many walk at night and thus avoid being caught by law enforcement or affected by peer pressure. 4) Since dogs will be walked during more hours of the day the number of dogs on the beach at any given time will likely be lower. Currently I and many others just wait till 5pm to rush out, creating a spike of dogs on the beach just after 5pm and just before 9am every day. It seems reasonable to us that dog owners should be allowed some expanded hours to exercise their dogs and them selves. During the Summer, the population of beach people does not start building up until after 10:00 am and people are generally leaving by about 4:00 pm. As for the Winter, there is really no one at the beach; I would recommend not restrictive hours at all during the Winter months. We urge you to consider expanding both the Summer and Winter dog hours on the beach. There is a marked difference between the number of beachgoers between the summer and winter months. From mid - September to mid -May the beach is very often completely empty. I would like to see the dogs use the beach all day long during winter, just as they are able to visit the parks and sidewalks at any time all year. Newport Beach City Council should reconsider the ordinance prohibiting dogs on the oceanfront sidewalks, ocean beaches and bay beaches. Dogs are not allowed on the beaches between the hours of 9:00 a.m. and 5:00 p.m., which does not make sense for a year -round law. The 9 -to -5 exclusion discriminates not only against dogs, but against dog- owning senior citizens, school children, surfers, bartenders, musicians, lifeguards, nurses and trustee benefactors. This restriction should only be enforced during the busy summer months of June, July and August. The sun sets before 5:00 p.m. on most days during the months of November, December and January. This means dog walkers are forced to walk their dogs in the dark. Another fact is that Daylight Savings Time has been extended by four weeks since 2007. If there could be a compromise — say, perhaps, changing the restriction to between 10:00 a.m. and 4:00 p.m. — it would improve safety for bike riders and others who may not be able to see the dog walkers on the poorly lit sidewalks. Our home is located right on the sand so the sand is the best place for us to walk our dog. I remember when the beach had no restrictions during the winter and how nice it was to be able to take our dogs out for a walk when they needed to go. I can't remember the specific date that you changed that rule but I remember that I didn't like it and certainly didn't understand it. I always wondered why you closed the beaches to dogs in the winter when hardly anyone uses the beach during the months of September to May. I am writing this in hopes that you will remove the restriction on the beach for dogs from September 15 through May 15 and that you would also consider changing the hours during the summer from 9 -5 to 10 -4. We diligently walk our dog not only for them to do their "duty" but to give them the exercise and fresh air that they need. I walk every morning before 9am and every evening after 5pm and have met many dog owners on the beach. Most that I have met or seen are very good about picking up after their dogs. Those that don't pick up after their dogs aren't following the rules and therefore the change in the rules would make no difference in their behavior. I usually pick up trash along my walks and feel that many other dog owners do the same. We take pride in our community and our selves to do the right thing by leaving something better than it was when we arrived_ Most of the trash I pick up is stuff from non -dog related activities like soda cans, food debris, kids sand toys, etc. It seems that the restrictions for the beaches are being placed on the wrong types of people, dog owners. During the period of September through May, the beach is almost abandoned with a few exceptions of a busy weekend here and there. Most of the time I just shake my head thinking how not a single person is on the beach but I can't walk my dog until after 5pm. Even when there are people around, I have yet to cncormter anyone who has had a problem with me having a dog on the beach. Most people like animals and want to pet my dog. The few people that have issue I have yet to encounter. As far as shortening the hours during the summer months from 9 -5 to 10 -4, 1 think that there is not much uat(ic before 10am and after 4pm. Most people arrive after 10 and arc packing up around 4pm. if the beach is super crowded, most dog owners don't even want to walk their dog anyway and will wait until the crowds have subsided. However, if the crowds aren't great it would be very nice to be able to take the clog out when they need to get out and stretch their legs. I am not sure where the resistance to the change is but I do hope that your voting board sees that dog owners are generally the ones who are more contentious about the cleanliness of our beaches and that you will lift the restrictions during the "winter" months and shorten the restrictions in the summer. I regularly walk our dog on the beach front and not only pick up after him, but spend a lot of my time on my walk picking up miscellaneous pieces of trash that have been left on our beach. I often see many other dog walkers doing the same as most of them are local residents that care very much about our beaches. The negative feedback I have heard from a few people during your earlier hearings was that allowing dogs to be walked more often would increase the trash /pollution on our beaches ... that is simply not true and is actually just the opposite! Regarding the summer hours, I live on the beachfront during the summer and there are very few people (except for the surfers) on the beach before 10am and also very few after 4pm. Therefore, I would like to request that you consider reducing the restricted hours to just the hours when the beaches are more heavily populated (which is usually sometime between 10 & 11 to approx. 3). In addition, the beaches are like a ghost town from September through May, so it makes no sense whatsoever to have hour restrictions for dog walking during these months. I would be glad to discuss this issue and my thoughts on it further if you would like to contact me. This would attract a large number of dog owners who would then not need to use the beaches later in the mornings and afternoons keeping their dogs on leashes. Currently, I have to get up early and head down from Irvine to get our walk in before 09:00 am. Then I get back in the car and leave. If you increased the time, I would have time to stop, get breakfast or lunch then proceed to take the walk. Therefore increasing the revenue in Newport Beach- ] consider myself a responsible dog owner and always clean -up after my dogs. Most people I see and talk to at the beach is the same, so I don't think increasing the time would cause a waster issue. We all love and appreciate the beautiful area that is Newport Beach. I really feel blessed that I am able to live in such a breathtaking area. But for those of us In Newport that actually live near the beach we know all too well the concessions that we are forced to make. First and foremost is parking. You can't simply invite friends over. You have to engage in an elaborate parking roulette to be able to accommodate guests.This may sound trivial but to those of us at the beach every social gathering has a major strategy involved. Next, we put up with people dressing outside our front doors. It's always an eyeopener to stumble out to get the morning paper and meet an undressed surfer. What we now take for granted I was reminded was shocking to my brother -in -law visiting from New York City " He says to me in a dismayed voice, "Margaret, there's a man undressing in front of your house!" If it's not the disrobing its the loud parties that go on endlessly at our many renter friends homes, not to mention the numerous Sober Living homes, etc. The point I want to make is we pay our taxes just like all Newport Beach residents and yes we live on or near the water but we put up with a lot more inconveniences than our co- residents of Newport Beach. I see this new dog ordinance as a nice little perk for those of us who endure the good with the bad. I respectfully disagree with the officer who thought that people would drive into Newport Beach to walk their dogs and that would be a problem. I think if someone actually would put there dog in a car and commute to take their dog on their walk that person is probably more likely to pick up after their dog.. Years ago no animals were allowed on BI beaches and for good reason, I suspect that present rules were meant more for the ocean beaches not island beaches. I have been a dog owner for over fifty years and think that specific dog parks offer fine solutions, but health factors should be your first consideration for our beaches and water by preventing consistent contamination with feces bacteria. Even picking up after animals, there would still contaminate remaining in the sand. No one wants to have their children exposed to that. Sea water /tides do not cleans or disinfect the sand. There are numerous studies by Universities, health departments and sanitation departments to document the health hazard of feces in sand beaches. Not only is there the health issue, but the reputation of our fine island and the potential economical impact on the vacation/recreational status should our beaches become laden with dog waste. Not an attractive outcome! Therefore, I urge the city council to eliminate animals from Balboa Island beaches altogether, we have lots of sidewalks, alleys, streets and even the animal owners very own property for their animals to use.
