SUBJECT: BARRETT- JACKSON AUCTION COMPANY, LLC BANNERS —
APPROVAL OF ENCROACHMENT PERMIT N2010 -0150
Recommendations:
Conditionally approve the request of Barrett - Jackson Auction Company, LLC (Barrett -
Jackson) for the installation of 60 private banners on City -owned street light poles, from
June 1, 2010 to June 28, 2010. Installation shall be along Jamboree Road and
MacArthur Boulevard in the Fashion Island area.
Discussion:
Barrett - Jackson has requested that 60 private banners be installed from June 1, 2010
to June 28, 2010, in the Fashion Island area for the Barrett- Jackson Collector Car
Auction. The banners will be mounted on street light poles along Jamboree Road (30
banners) and MacArthur Boulevard (30 banners) within the public right -of -way (see
attached Exhibit A).
On the weekend of June 25 -27, 2010, Barrett - Jackson will host the first Barrett - Jackson
Collector Car Auction in Southern California at the Orange County Fair and Events
Center in City of Costa Mesa. Considered an "automotive lifestyle event', the Barrett -
Jackson event activities include a road rally and cruise -in, as well as, other activities
planned before the three -day collector car auction begins. Adult ticket prices for
attendees range from $10 to $18 for daily admission or $28.50 to $35 for a 3 -day pass.
The event is expected to have a positive impact on our local economy and tourism, as
well as create national visibility for Orange County. The Barrett - Jackson Collector Car
Auction in Scottsdale, Arizona generates substantial visitor spending on shopping,
dining, entertainment and hotel rooms and is the priemer collector car auction event in
the country. Barrett - Jackson has held similar events in Las Vegas and Palm Beach
Florida.

The event does not meet the intent of Council Policy L -16 General Provisions. The
event is not co- sponsored by the City of Newport Beach, not conducted by a non - profit
organization or corporation, not free to the public, and does not exclude advertisement
of the sponsor (Barrett- Jackson). Council Policy L -16 prohibits the use of a commercial
sponsor's name on the banner. However, the event will be community -wide, open to
the public, and may create additional revenue to the City through restaurants,
businesses, and hotel reservations. Visit Newport Beach, Inc. has been working with
Barrett - Jackson and some Newport Beach hotels will have blocks of rooms reserved for
the event. In the past, the following similar requests have been approved by City
Council: "Bowl Championship Series" (approved December 8, 2009), and "Taste of
Newport" (approved August 11, 2009).
The applicant's request to install 60 private banners does not exceed the 100 - banner
limit and observes the single banner per pole concept allowed per City Council Policy L-
16. Should the City Council elect to approve the installation of 60 private banners in the
Fashion Island area for 28 days, staff recommends the following conditions of approval:
1. No banners shall be installed on traffic signal poles or metal street light poles.
2. The applicant must provide on -going maintenance of the banners and brackets.
3. The applicant must sign a "Hold Harmless Statement" requiring maintenance of the
banners /brackets and indemnification and hold harmless for any liability associated
with the banners /brackets.
4. The applicant must maintain a minimum of $1,000,000 in liability insurance from a
company with a Best's Key Rating Guide parameter of "A" or better, and a financial
size category of "VIII" or higher.
5. Issuance of an Encroachment Permit by the Public Works Department.
6. The banners shall conform to City Council Policy L -16 with the exception of the
advertisement of sponsor, non — profit corporation or organization, open to the public
free of charge, and co- sponsor by the City.
7. All banners and brackets shall be removed by the end of the approved time unless
otherwise approved by the conditions stated in the Encroachment Permit.
8. All banners and brackets shall comply with the Encroachment Permit conditions.
9. If needed, the City may require removal of some of the banners to allow other
organizations to install banners at the same location and during the same time
period.
10. A minimum of two 5- inches wide half - circle wind slits per banner are required to
minimize the wind load.

11. Banner size shall be limited to 2.5 feet wide by 7 feet tall.
Environmental Review:
Staff determined that the project is exempt from the California Environmental Quality
Act (CEQA) pursuant to Section 15378 of the Guidelines. This action is not considered
to be a project as defined by CEQA.
Funding Availability
No City funds will be required. Barrett - Jackson will pay all costs associated with permit
fees, installation and removal of the banners.
