(All Ayes) Item No.2 Discussion of land use and development issues with the City of Newport Beach Harbor Commission The Planning Commission held a joint hearing with the Harbor Commission. The Harbor Commission made two presentations: the first was a review of mixed -use development on the waterfront and the second related to development vis -a -vis the bulkhead, pierhead, and project lines established for the harbor. Both commissions agreed continue the dialogue after the holidays. This item was continued to a future date to be determined. (All Ayes) Item No.3 Chipotle Mexican Grill- (PA2010 -096) 3101 Newport Boulevard Summary: A use permit and accessory outdoor dining permit to allow a take -out service eating and drinking establishment with a Type 41 (On Sale Beer and Wine, Eating Place) Alcoholic Beverage Control (ABC) license and an outdoor patio. The project is located in the Landing Shopping Center (formerly Albertson's). The applicant requested that the Commission continue this item for an additional 30 days. This item was continued to December 9, 2010. (All Ayes) Item No.4 Newport Animal Hospital - (PA2010 -125) 21157 Newport Coast Drive Summary: A use permit to allow a 1,766- square -foot animal clinic in an existing tenant space within the Newport Coast Shopping Center. Discussion by the Commission focused on conditions intended to minimize potential noise and waste impacts. Planning Commission Agenda Report November 23, 2010 Page 2 This item was approved (All Ayes) Item No. 5 Solar Energy System Installations Summary: The Planning Commission requested to review options for solar energy systems installations that were discussed at the City Council Study Session on October 26, 2010. The Commission discussed the pros and cons of approaches outlined in the report. The Commission will take up the issue again when the code amendment is brought before them. CEQA COMPLIANCE: The project is categorically exempt under Section 15303, of the California Environmental Quality Act (CEQA) Guidelines - Class 3 (New Construction or Conversion of Small Structures). ACTION: The applicant is requesting that the Planning Commission continue this item for an additional 30 days. Staff recommends continuing this item to December 9, 2010. ITEM NO.4 Newport Animal Hospital - (PA2010 -125) 21157 Newport Coast Drive SUMMARY: A use permit to allow a 1,766- square -foot animal clinic in an existing tenant space within the Newport Coast Shopping Center. CEQA COMPLIANCE: The project is categorically exempt under Section 15301, of the California Environmental Quality Act (CEQA) Guidelines - Class 1 (Existing Facilities). ACTION: 1) Conduct public hearing; and 2) Adopt Resolution No. approving Use Permit No. UP2010 -026 with the attached findings and conditions. J. NEW BUSINESS ITEM NO. 5 Solar Energy System Installations SUMMARY: The Planning Commission requested to review options for solar energy systems installations that were discussed at the City Council Study Session on October 26, 2010. At the City Council Study Session, Staff was directed to draft an ordinance to implement the Solar Rights Act. Additionally, the Council directed Staff to prepare voluntary guidelines, to evaluate and make recommendations regarding incentives, to evaluate glare as it relates to health and safety impacts, to consider how the Coastal Act would apply with the Coastal Commission, and to bring back the ordinance and information to Council in January 2011. ACTION: Discuss the Solar Rights Act and the installation of solar energy systems. K. STAFF AND COMMISSIONER ITEMS ITEM NO. 6 Planning Director's report. ITEM NO. 7 Planning Commission reports.
