CALL TO ORDER—The meeting was called to order at 3:30 p.m. Staff Present: Brenda Wisneski, Zoning Administrator Jim Campbell, Principal Planner Gregg Ramirez, Senior Planner Melinda Whelan, Assistant Planner Benjamin Zdeba, Assistant Planner B. MINUTES of May 14, 2015 Action: Approved C. PUBLIC HEARING ITEMS ITEM NO. 1 Langson Lot Line Adjustment (PA2015-017) 2616 and 2636 Bay Shore Drive Council District 3 Gregg Ramirez, Senior Planner, provided a brief project description stating that the proposed lot line adjustment involves two (2) existing lots that measure 63.35 feet in width. The requested adjustment would shift the lot line east by 18.35 feet resulting in one (1) 81.70-foot-wide parcel and one (1) 45-foot-wide parcel. He concluded by stating that staff believed the findings for approval could be made and therefore recommends approval. Applicant Jack Langson stated that he had nothing to add. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. Action: Approved ITEM NO. 2 Drewry Deck Modification Permit (PA2015-093) 917 W. Bay Avenue Council District 1 Gregg Ramirez, Senior Planner, provided a brief project description stating that the request was to allow a cantilevered portion of a second floor deck to encroach 1 foot into the required 10-foot front yard setback. He explained that several other decks along this portion of West Bay Avenue have similar front yard deck encroachments. He stated that staff has reviewed the required findings for approval and believed they could be made. He concluded by stating that staff recommended approval of the request. Applicant Theresa Drewry stated that she had obtained several other letters in support of approval. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. Action: Approved Page 1 of 3 NEWPORT BEACH ZONING ADMINISTRATOR MINUTES 05/28/2015 ITEM NO. 3 422 Heliotrope Avenue Tentative Parcel Map (PA2015-071) 422 Heliotrope Avenue Council District 6 Benjamin Zdeba, Assistant Planner, provided a brief project description stating that the project was for a tentative parcel map for two-unit condominium purposes on a typical lot in Corona del Mar. He indicated that a single-family home was demolished and is currently being replaced with a two-unit duplex being constructed without any requests for waivers of the Title 19 (Subdivisions) development standards for condominiums. He further added that the project would require payment of an in-lieu park dedication fee for an increase of one(1)residential dwelling unit. The property owner's representative, Apex Land Surveying, Inc., stated that they had reviewed the draft resolution and the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. She expressed agreement with staff's recommendation and approved the project as submitted. Action: Approved ITEM NO.4 Forever Young Day Spa (PA2015-062) 2300 SE Bristol Street, #B Council District 3 Melinda Whelan, Assistant Planner, provided a brief project description stating that the request was for a minor use permit for a day spa within an existing commercial building with various services including ancillary massage and ancillary medical day spa services of laser hair removal and Botox. She explained that the space is already improved to accommodate the day spa use and the location and space meets all of the requirements in the Zoning Code for massage establishments and services. She also explained that the use does not intensify the parking requirement by the Zoning Code as it is the same requirement as general retail and does not require additional spaces. Ms. Whelan continued that staff believes the use is compatible with the surrounding area and was able to make all of the required findings; therefore recommending approval of the request to the Zoning Administrator. Ms. Whelan stated that the applicant reviewed all of the conditions in the draft resolution and was available for questions. Applicant Teresa Young, on behalf of Forever Young Day Spa, introduced herself and stated that she had nothing to add. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. The Zoning Administrator moved to approve the minor use permit. Action: Approved ITEM NO. 5 Annual Review of Development Agreement for North Newport Center (PA2009-023) North Newport Center Council Districts 5 Jim Campbell, Principal Planner, provided a brief status report related to the Development Agreement between Irvine Company and the City for North Newport Center. He noted that the new office tower in Block 500 is completed but not all tenant improvements are completed. He noted that 524 apartments located along San Joaquin Hills Road are under construction and that all required public benefit fees have been paid. Mr. Campbell indicated that staff lists incomplete floor area and units in the remaining entitlement category in Page 2 of 3 NEWPORT BEACH ZONING ADMINISTRATOR MINUTES 05/28/2015 the staff report and Irvine Company lists them as existing in their report. He noted that the figures in the staff report are reflective of development at the end of 2014, and not the present day condition and the most recent transfer of development is not reflected in the table. He also noted that there was a typographical error in the number of theater seats in the staff report and that the correct number is 680 seats. Mr. Campbell concluded his remarks by noting staff's conclusion that Irvine Company is in good faith compliance with the terms and conditions of the Development Agreement. Applicant Shawna Schaffner of CAA Planning, on behalf of Irvine Company, stated that she concurs with staff's assessment and that she was available for questions. The Zoning Administrator opened the public hearing. Jim Mosher commented that it is impossible to reconcile the development numbers between the General Plan, Planned Community Text, past annual reviews, and the transfer tracking tables. He asked whether the City was going to amend the documents to make them consistent and to promote transparency and ease of public use. Staff responded that they were looking to improve the tables in the staff report to promote ease of use. The Zoning Administrator closed the public hearing. Action: The Zoning Administrator indicated that based upon the information presented in the staff report, and the applicant's report and discussion, she finds that the Irvine Company is in good faith compliance with the Development Agreement and the report was received and filed. D. PUBLIC COMMENTS ON NON-AGENDA ITEMS None. E.
