CALL TO ORDER—The meeting was called to order at 3:30 p.m. Staff Present: Brenda Wisneski, Zoning Administrator Melinda Whelan, Assistant Planner Benjamin Zdeba, Assistant Planner B. MINUTES of May 28, 2015 Action: Approved C. PUBLIC HEARING ITEMS ITEM NO. 1 Hopdoddy Alcohol Sales Minor Use Permit (PA2015-057) 311 Newport Center Drive CD 5 Benjamin Zdeba, Assistant Planner, provided a brief project description stating that the request is to allow the sale and service of alcohol at a restaurant within the Fashion Island Shopping Center. He indicated the restaurant is taking over an existing retail tenant space and will provide seating for approximately one- hundred (100) patrons inside and fifty (50) patrons outside on an outdoor dining patio. It was noted the restaurant was pursuing a Type 47 ABC License and will not be open beyond 11:00 p.m. thereby eliminating the requirement for an operator license. He further added that the Police Department had reviewed the application and provided information relative to crime in the area along with project-specific recommendations. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. Zoning Administrator Wisneski addressed the recommendation from the Police Department to fully enclose the outdoor dining patio area, noting that conditions of approval specific to that matter were not included in the draft resolution. She expressed support for the project plan as submitted, given that the patio area is to be bound by a five-foot-tall glass wall with a planter in front and passing of alcoholic beverages would be deterred, and approved the project. Action: Approved ITEM NO. 2 404 Heliotrope Avenue Tentative Parcel Map (PA2015-081) 404 and 404 '/2 Heliotrope Avenue CD 6 Melinda Whelan, Assistant Planner, provided a brief project description stating that the parcel map request is for condominium purposes and no waivers of Title 19 are proposed. An existing single-family dwelling has been demolished and a new duplex is currently under construction. Ms.Whelan explained that because there is a map proposed with the increase of units, a park fee is required and has been conditioned. Ms. Whelan stated that staff was able to make all of the required findings to recommend approval of the parcel map to the Zoning Administrator Page 1 of 3 NEWPORT BEACH ZONING ADMINISTRATOR MINUTES 06/11/2015 Applicant "Buzz" Person, on behalf of Heliotrope CDM, LLC, stated that he had reviewed the draft resolution and the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. The Zoning Administrator approved the item. Action: Approved ITEM NO. 3 512 Jasmine Avenue Tentative Parcel Map (PA2015-082) 512 and 512 '/2 Jasmine Avenue CD 6 Melinda Whelan, Assistant Planner, provided a brief project description stating that the parcel map request is for condominium purposes and no waivers of Title 19 are proposed. An existing duplex has been demolished and a new duplex being built to condominium specifications is currently under construction. Ms. Whelan explained that staff was able to make all of the required findings to recommend approval of the parcel map to the Zoning Administrator. Action: Approved ITEM NO.4 613 Iris Avenue Tentative Parcel Map (PA2015-083) 613 and 613 '/2 Iris Avenue CD 6 Melinda Whelan, Assistant Planner, provided a brief project description stating that the parcel map request is for condominium purposes and no waivers of Title 19 are proposed. Action: Approved ITEM NO. 5 Dannelley Parking Modification Permit (PA2015-067) 4630 Dorchester Road CD 6 Melinda Whelan, Assistant Planner, provided a brief project description stating that this request is to add square footage to an existing nonconforming single-family house. She explained that the house is Page 2 of 3 NEWPORT BEACH ZONING ADMINISTRATOR MINUTES 06/11/2015 nonconforming because the garage is less than the required garage width by 6 inches. She continued that the Code requires the process of a modification permit to add square footage of more than 10 percent in this situation. The existing house is a one-story house and the proposed addition is single story. Ms. Whelan added that an addition to the garage would require unnecessary structural revisions and an encroachment into the setback. Ms.Whelan explained that staff is able to make all of the required findings and recommends approval to the Zoning Administrator. Applicant Jeffery Riggs, on behalf of the owner, stated that he had reviewed the draft resolution and the required conditions. The Zoning Administrator added that since the scope of the improvements are not close to the garage, an addition to the garage would unduly enlarge the scope of work of the project. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. The Zoning Administrator approved the item. Action: Approved D. PUBLIC COMMENTS ON NON-AGENDA ITEMS None. E.
