SUBJECT: CITYWIDE SPEED LIMIT ORDINANCE — SECOND READING
ISSUE
The California Vehicle Code requires speed limits to be justified by an Engineering and
Traffic Survey (ET & S) if the posted speed limits are going to be enforced by radar.
Updating the posted speed limits will allow the Police Department to legally use radar
for enforcement. Staff recommends that the City update its current speed limit survey to
comply with State law.
At the January 11, 2011 City Council meeting, Ordinance No. 2011 -1 was introduced
amending Chapter 12.24 (Special Speed Zones) of the Municipal Code regarding
Increasing and Decreasing State Speed Limits.
RECOMMENDATION
a) Conduct Second Reading and adopt Ordinance No. 2011 -1, and b) direct staff to
replace /modify all speed limit signs requiring changes to reflect new speed limits.
DISCUSSION
Modifications to existing speed limits throughout the City are included in Ordinance No.
2011 -1. This proposed Ordinance was previously discussed at the January 11, 2011
City Council meeting, and at two prior City Council Study Sessions, on September 28,
2010 and November 9. 2010.
During the speed limit review process, a total of 99 roadway segments were surveyed.
Ordinance No. 2011 -1 incorporates all 99 roadway segments. The results of the study
indicate that the speed limits for 34 roadway segments should be raised 5 miles per
hour. For 63 roadway segments, the posted speed limits will remain the same. For the
segment of Bayside Drive from Promontory Drive East to Marine Avenue, the speed
limit is recommended to be decreased 5 mph to 35 mph. For the segment of Coast

Highway between Poppy Avenue and Cameo Shores Drive, it is recommended that the
speed limit be increased by 10 miles per hour.
It is appropriate, and more efficient, for the City to update the Speed Survey and the
controlling Ordinance for the entire city at one time. This will establish legally posted
speed limits on all city roadways that will not need to be reviewed again for another 7 to
10 years, depending on the roadway segment. It is important to note that the posted
speed limits can be reviewed periodically should the conditions of the roadway change.
In the near future, staff will review Bayside Drive, Vista del Oro, Irvine Avenue and
Coast Highway for any possible changes to the Ordinance.
ENVIRONMENTAL REVIEW
This action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant
to Sections 15060 (c)(2) (the activity will not result in a direct or reasonably foreseeable
indirect physical change in the environment) and 15060 (c)(3) (the activity is not a
project as defined in Section 15378) of the CEQA Guidelines, California Code of
Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical
change to the environment, directly or indirectly.
PUBLIC NOTICE
This issue has been taken to one regular City Council meeting and two City Council
Study Sessions to date, in addition to being placed on this agenda. All agenda items
have been noticed according to the Brown Act.
FUNDING AVAILABILITY
A preliminary cost estimate for the changing of all of the affected speed limit signs is
$ 20,000. There are sufficient funds available in the following account to accomplish this
task.

ISSUE

RECOMMENDATION
Introduce Ordinance No. 2011 - amending Chapter 12.24 (Special Speed Zones) of
the Municipal Code regarding Increasing and Decreasing State Speed Limits.
Upon final adoption of Ordinance No. 2011, direct staff to replace /modify all speed limit
signs requiring changes to reflect new speed limits.
DISCUSSION
Proposed modification to existing speed limits on specific streets throughout the City as
proposed in Ordinance No. 2011 has been publicly discussed at two prior City Council.
Study Sessions, on September 28, 2010 and November 9, 2010.
The State requires the City to review its speed limits every 5, 7 or 10 years. As part of
this speed survey update, new traffic data was collected for every non - residential street in
the city.
On June 29, 2009, Caltrans approved a Policy Directive outlining new guidelines for
establishing speed limits throughout the State. The basic process is to sample the speed
of traffic on a roadway and identify the "critical speed ", or "85th percentile speed ", which is
that speed at or below which 85% of the traffic is moving. The speed limit is to be
established at the nearest 5 mph increment of the 85th percentile speed. When there is a
high accident rate, or there are other "conditions not readily apparent to the driver ", a
further reduction of 5 mph may be justified when documented. As discussed at the
earlier Study Sessions, these conditions can include sight distance restrictions, high
pedestrian and bicycle usage, etc. Public Works staff has reviewed all roadway

segments to determine if there are speed related accidents or other conditions that would
justify a 5 mph reduction when establishing the posted speed limit.
Section 40802 of the California Vehicle Code provides that radar may not be used as an
enforcement tool if the posted speed limits are not set in accordance with State
requirements. At the most recent Study Session, the Police Department confirmed that
they cannot enforce speeds using radar unless the City's speed limits are established per
State law.
During both Study Sessions, the City Council presented questions and concerns
regarding the process of setting speed limits. In addition, the City Council asked staff to
review the recommendations for changes to the speed limits on specific streets. The City
Council wanted to be certain that all roadway conditions have been reviewed that may
support a 5 mph reduction.
The recommended speed limit changes herein account for those roadway segments
where staff has reduced the required speed limits by 5 mph based on accident records or
other conditions. It is important to note that for 20 roadway segments, the posted speed
limit will remain unchanged because the roadway conditions and /or accident records
justified the 5 mph reduction. Following the most recent Study Session, the
recommended speed limit for Via Lido has been changed to match the existing 25 mph,
and the recommended speed limit for Riverside Drive has been revised to match the
existing 30 mph.
A total of 99 roadway segments were surveyed. The results of the study indicate that the

segments, the posted speed limits will remain the same. For the segment of Bayside
Drive from Promontory Drive East to Marine Avenue, the speed limit is recommended to
be decreased 5 mph to 35 mph. For the segment of Coast Highway between Poppy
Avenue and Cameo Shores Drive, it is recommended that the speed limit be increased
by 10 miles per hour. Exhibits are attached which show the roadways where the speed
limits are recommended to be increased (or decreased) by 5 mph or 10 mph. As the
exhibits show, the majority of the roadway segments are arterial roads as defined on the
City's Master Plan of Streets and Highways.
It is appropriate, and more efficient, for the City to update the Speed Survey and the
controlling Ordinance for the entire city at one time. This will establish legally posted
speed limits on all city roadways that will not need to be reviewed again for another 7 to
10 years, depending on the roadway segment. The updated speed limits will allow the
Police Department to legally use radar for enforcement. It is important to note that the
posted speed limits can be reviewed periodically should the conditions of the roadway
change.
Section 12.24.020 of the Municipal Code "Increasing State Speed Limits ", covers those
streets where the prima facie speed limit of 25 mph is considered less than is necessary
for the safe operation of vehicles. The streets covered in this section are typically
narrow, have regular stop signs on intersecting streets, and are primarily residential or
collector streets in nature.

Section 12.24.050 of the Municipal Code "Decreasing State Speed Limits ", covers those
streets where the prima facie State speed limit of 65 mph is considered greater than is
reasonable or safe for the conditions of the roadway. These streets are typically arterial
roadways outside of business and residence districts.
Staff is recommending that the attached new Ordinance be introduced to amend Section
12.24.030; Section 12.24.040; and Sections 12.24.055 through 12.24.085 of the
Municipal Code.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AMENDING CHAPTER 12.24 OF THE
NEWPORT BEACH MUNICIPAL CODE REGARDING
INCREASING AND DECREASING STATE SPEED LIMITS
THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEREBY ORDAIN
AS FOLLOWS:
SECTION 1: Chapter 12.24 of the Newport Beach Municipal Code is amended in its
entirety to read as follows:
Section 12.24.010 Speed Regulation by Traffic Signal Timing.
The City Traffic Engineer is authorized to regulate the timing of traffic
signals so as to permit the movement of traffic in an orderly and safe
manner at speeds slightly at variance from speeds otherwise
applicable within the district or at intersections, and shall erect
appropriate signs giving notice thereof.
Section 12.24.020 Increasing State Speed Limits.
It is hereby determined upon the basis of engineering and traffic
surveys that the speed permitted by State law upon the streets or
parts thereof described in Sections 12.24.030 through 12.24.045 is
less than is necessary for safe operation of vehicles thereon by
reason of the nature of the streets, the stop signs on intersecting
streets or the wide spacing of intersections, and it is hereby
declared that the prima facie speed limit shall be as hereinafter
designated on those streets or parts thereof when signs are
erected giving notice thereof.
Section 12.24.030 Prima Facie Speed Limit —Thirty Miles Per
Hour.
The prima facie speed limit on the following named streets or parts
thereof shall be thirty (30) miles per hour:
Avocado Avenue from Waterfront Drive to East Coast Highway.
Cliff Drive from Riverside Avenue to Dover Drive.
Dover Drive East from Mariners Drive to Irvine Avenue.
Newport Boulevard from Finley Avenue to 21st Street.
Santiago Drive from Irvine Avenue to Tustin Avenue.

It is hereby determined upon the basis of engineering and traffic
surveys that the speed permitted by State law outside of business
and residence districts as applicable upon the streets or parts
thereof described in Sections 12.24.055 through 12.24.090 is
greater than is reasonable or safe under the conditions found to
exist upon such streets, and it is hereby declared that the prima
facie speed limit shall be as hereinafter designated on those streets
or parts thereof when signs are created giving notice thereof.
Section 12.24.052 Prima Facie Speed Limit —Sixty Miles Per
Hour.
The prima facie speed limit on the following named streets or parts
thereof shall be sixty (60) miles per hour:
Newport Coast Drive from Pacific Coast Highway to Route 73.
Section 12.24.055 Prima Facie Speed Limit — Fifty -five Miles

SECTION 2: If any section, subsection, sentence, clause or phrase of this ordinance is,
for any reason, held to be invalid or unconstitutional, such decision shall not affect the
validity or constitutionality of the remaining portions of this ordinance. The City Council
hereby declares that it would have passed this ordinance, and each section,
subsection, clause or phrase hereof, irrespective of the fact that any one or more
sections, subsections, sentences, clauses and phrases be declared unconstitutional.
SECTION 3: The City Council finds that this ordinance is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or
indirectly.
SECTION 4: The Mayor shall sign and the City Clerk shall attest to the passage of this
ordinance. The City Clerk shall cause the same to be published once in the official
newspaper of the City, and it shall be effective thirty (30) days after its adoption.
SECTION 5: This ordinance was introduced at a regular meeting of the City Council of
the City of Newport Beach, held on the 11th day of January, 2011, and adopted on the
25th day of January, 2011, by the following vote, to wit:

To: Newport Beach City Council
The speeding and increased traffic on our street is a
safety issue for all individuals. We have two young
children ages 5 and 7 and they are not safe while out
front with cars speeding up and down our street. We
live just three houses in from the Tustin and Holiday
stop sign and cars are accelerating so rapidly from
the stop sign that they are already speeding by the
time they reach our house. This is extremely
concerning as parents to young children.
We fully support implementing traffic calming
measures to reduce the speed and traffic on our street
and make it safer for everyone and especially our
most precious children.
