CALL MEETING TO ORDER II. APPROVAL OF MINUTES MINUTES OF JUNE 25, 2015 III. PUBLIC HEARING ITEM(S) ITEM NO. 1. 1114 East Balboa Boulevard Lot Merger(PA2015-098) 1114 E. Balboa Boulevard Summary: A lot merger and waiver of a parcel map for the following property currently addressed as 1114 E. Balboa Boulevard, under common ownership: Lots 8 and 9 in Block K, Lots 8 and 9 in Block 17, a portion of the vacated 6-foot-wide strip of Balboa Boulevard and a portion of the vacated 30-foot-wide Bay Avenue. An existing 4,038 square-foot single-family-dwelling that spans the existing lots is proposed to be remodeled subject to the approval of the Lot Merger. Recommended Action: 1) Conduct a public hearing; and 2) Adopt Draft Zoning Administrator Resolution No. _ approving Lot Merger No. LM2015- 002. CEQA Compliance: The project is categorically exempt under Section 15315 , of the State CEQA (California Environmental Quality Act) Guidelines - Class 15 (Minor Land Divisions). ITEM NO. 2. Choco Fruit Minor Use Permit (PA2015-103) 2233 W. Balboa Boulevard, Suite 110 Summary: A minor use permit to allow the operation of a new take-out service limited, eating and drinking establishment containing a maximum of six seats within an existing mixed-use building. No late hours (after 11:00 p.m.) or alcohol service are proposed as part of this application. Recommended Action: 1) Conduct a public hearing; and 2) Adopt Draft Zoning Administrator Resolution No. _ approving Minor Use Permit No. UP2015-027. Zoning Administrator - July 16, 2015 CEQA Compliance: The project is categorically exempt under Section 15301, of the State CEQA (California Environmental Quality Act) Guidelines - Class 1 (Existing Facilities). ITEM NO. 3. Breakers Lot Line Adjustment (PA2015-105) 3150 and 3200 Breakers Drive Summary: An application for a lot line adjustment for the interior boundary between two contiguous parcels. Land taken from 3150 Breakers Drive will be added to the adjacent parcel at 3200 Breakers Drive. There will be no change in the number of parcels. Recommended Action: 1) Conduct a public hearing; and 2) Adopt Draft Zoning Administrator Resolution No. ZA2015- approving Lot Line Adjustment No. LA2015-003. CEQA Compliance: The project is categorically exempt under Section 15305, of the State CEQA (California Environmental Quality Act) Guidelines - Class 5 (Minor Alterations in Land Use Limitations). ITEM NO. 4. Annie Ko Acupuncture Minor Use Permit (PA2015-051) 200 Newport Center Drive, Suite 203 Summary: A minor use permit to establish an acupuncture and natural healing office (Personal Services, Restricted use). The tenant space (approximately 600 square feet) is located on the second floor of an existing two-story office building and will include three treatment rooms, a consultation office, and a reception/waiting area. No tenant improvements are proposed as part of the project. Recommended Action: 1) Conduct a public hearing; and 2) Adopt Draft Zoning Administrator Resolution No. ZA2015- approving Minor Use Permit No. UP2015-014. CEQA Compliance: The project is categorically exempt under Section 15301, of the State CEQA (California Environmental Quality Act) Guidelines - Class 1 (Existing Facilities). ITEM NO. 5. Smallcakes Cupcakery Minor Use Permit (PA2015-099) 208 Marine Avenue Summary: A minor use permit for a take-out service, limited eating and drinking establishment. The operation will be split between two buildings with the front building serving as a retail storefront for the baked goods and the first floor of the rear building serving as a commercial kitchen to prepare the baked goods for sale. The front retail storefront will maintain a maximum of six seats. Late hours (after 11:00 p.m.) are not proposed as part of this application. Zoning Administrator - July 16, 2015 Recommended Action: 1) Conduct a public hearing; and 2) Adopt Draft Zoning Administrator Resolution No. ZA2015- approving Minor Use Permit No. UP2015-026. CEQA Compliance: The project is categorically exempt under Section 15301, of the State CEQA (California Environmental Quality Act) Guidelines - Class 1 (Existing Facilities). IV. PUBLIC COMMENTS ON NON-AGENDA ITEMS Public comments are invited on non-agenda items generally considered to be within the subject matter jurisdiction of the Committee. Speakers must limit comments to three (3) minutes. Before speaking, we invite, but do not require, you to state your name for the record. The Committee has the discretion to extend or shorten the speakers'time limit on non-agenda items, provided the time limit adjustment is applied equally to all speakers. As a courtesy, please turn cell phones off or set them in the silent mode. V. ADJOURNMENT This hearing is subject to the Ralph M.Brown Act.Among other things,the Brown Act requires that the Zoning Administrator agenda be posted at least seventy-two(72)hours in advance of each regular hearing and that the public be allowed to comment on agenda items before the Zoning Administrator and items not on the agenda but are within the subject matter jurisdiction of the Zoning Administrator.The Zoning Administrator may limit public comments to a reasonable amount of time,generally three(3)minutes per person. It is the intention of the City of Newport Beach to comply with the Americans with Disabilities Act("ADA")in all respects. If,as an attendee or a participant at this hearing,you will need special assistance beyond what is normally provided,the City of Newport Beach will attempt to accommodate you in every reasonable manner.If requested,this agenda will be made available in appropriate alternative formats to persons with a disability,as required by Section 202 of the Americans with Disabilities Act of 1990(42 U.S.C.Sec. 12132),and the federal rules and regulations adopted in implementation thereof.
