This portion of the minutes was approved unanimously. The remaining portion of the minutes was approved with Chairman McDaniel abstaining. Item No.2 Minutes of March 3, 2011 Commissioners Unsworth, Eaton and Hawkins provided edits to the minutes and the amended minutes were approved (4 ayes, 1 abstain, 2 excused) Item No.3 Discussion Item - Minimum Side Setback Determination Broadmoor Pacific View Planned Community (PA2011 -013) Summary: Determination of appropriate side yard setbacks within the Broadmoor Pacific View Planned Community District. Staff presented its analysis of the provisions of the Broadmoor Pacific View Planned Community District regulations as it relates to side and setback maps. The community has a zero -side setback configuration with a minimum of 10 feet between buildings as well as street and view (rear) setback regulations. The PC regulations do not specify a minimum side setback for the side opposite the zero - side. The ambiguity applies to 22 lots that share a common side yard where larger than minimum setbacks are provided and the houses are flipped to face each other to take advantage of views. Staff recommended the establishment of a minimum 5 -foot yard setback to provide the minimum 10 feet between buildings pursuant to the PC regulations as equitable solution. Planning Commission Agenda for March 17, 2011 March 22, 2011 Page 2 Jamie and Patricia White (2003 Yacht Mischief) presented their interpretation that the original plot plan for the building of the tract should regulate all setbacks and that there should be a review process for any addition outside the original building footprint. Testimony from residents of the community, the homeowner association president, the chairman of the association's architectural review committee supported staff's interpretation such that the original plot plan should not be used to limit future additions and the establishment of a minimum 5 -foot side yard setback. The Planning Commission endorsed staffs interpretation and the establishment of a minimum 5 -foot setback for the 22 lots in question (4 ayes, '1 no, 2 excused): Iterin No,4 Discussion Item Zoning Code Implementation; Review Authority for Alcohol Sales ;In -Lieu Perking Planning Commission Appeals Summary: At the request of the Planning commission; this item has been placed on the agenda to give the Commission the opportunity to discuss the Changes in the updated zoning node related to the alcohol'sales, in -lieu parking fees and appeal Alcohol Sales Planning Commission Agenda for March 17, 2011 March 22, 2011 Page 3 In-Lieu Parking.
