ABSTRACT:
Request that the City Council find that an electronic light- emitting diodes (LED)
changeable copy sign at the Newport Theatre Arts Center located at 2501 Cliff Drive is
exempt from the Sign Standards of Chapter 20.42 of the Newport Beach Municipal
Code (NBMC), pursuant to Section 20.10.040 of the NBMC.
RECOMMENDATION:
Staff recommends the City Council:
1. Conduct a public hearing; and
2. Adopt Resolution No. (Attachment No. CC 1), granting an exemption of
the provisions of Chapter 20.42, and approve retrofitting the existing marquee
sign with a new electronic LED changeable copy sign.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item. The Friends of the Newport Theatre Arts
Center (NTAC) propose to fund the sign retrofit.

and Stan Cohen have been on the NTAC board since the beginning, and continue to
serve the community on a volunteer basis to this day.

DISCUSSION:
Project Overview
The City of Newport Beach owns property, structures, and related improvements that
are commonly known as the NTAC. A Management Agreement between the City and
Friends of the NTAC sets forth the terms by which the property is managed and
maintained. Per the Agreement, the City is obligated to perform routine and recurring
maintenance and repairs to the property, including the on -site signage.
The existing marquee sign is in need of renovation because the internal illuminated
components of the sign are in disrepair. In its current configuration, the sign creates
problems because the individual letters used to create sign copy are often stolen or
manipulated. The Friends of the NTAC contacted the City, requesting that the City
allow the marquee sign structure be retrofitted by removing the existing illuminated
manual changeable copy sign and replacing it with a new electronic LED changeable
copy sign. The retrofitted sign and existing sign are depicted in Attachment C of the
attached Parks, Beaches & Recreation (PB &R) Staff Report (Attachment No. CC2).
Parks, Beaches & Recreation Commission
At the PB &R Commission meeting on April 5, 2011, the PB &R Commission reviewed
the request. The PB &R Commission voted unanimously to recommend that the City
Council adopt a resolution granting an exemption of the Sign Standards of Chapter
20.42, and approve the new sign as proposed.
During staffs report, the PB &R Commission asked why such signs are prohibited. Staff
informed the Commission that electronic changeable copy signs are considered
animated signs' that are prohibited pursuant to Section 20.42.050 of the Zoning Code.
Staff explained one of the reasons animated signs are prohibited is because they can

cause distraction to motorists resulting in unsafe conditions on roadways. Animated
signs can also cause visual blight, especially if these sign types proliferate.
Staff informed the Commission that as proposed, the message on new LED sign would
remain static and the image would not change through out the day. The typical sign
message would include the title, dates, times and brief descriptive information regarding
the productions and events at the theatre.
Exemption Process for City - Implemented Projects
The NTAC is located on property zoned PR (Parks and Recreation), and is subject to
the provisions of the Zoning Code. Section 20.10.040 (Applicability of Zoning Code)
provides that:
"No structure shall be altered, erected, or reconstructed in any manner, nor shall
any structure or land be used for any purpose, other than as allowed by this
Zoning Code. The City Council may exempt specific City - implemented projects
by adopting a resolution at a noticed public hearing upon setting forth the specific
Code provisions that would apply in the absence of the exemption." (emphasis
added)
Staff requests that the City Council consider an exemption of the Sign Standards of
Chapter 20.42, and specifically, Section 20.42.050 which prohibits animated signs.
The purpose of Chapter 20.42 is to provide standards intended to:
• Provide each sign user an opportunity for adequate identification while guarding
against the excessive and confusing proliferation of signs by appropriately regulating
the time, place and manner under which the signs may be displayed.
• Preserve and enhance the community's appearance by regulating the type, size,
location, quality, design, character, scale, color, illumination, and maintenance of
signs.
Encourage signs that are well designed and that attract and invite rather than
demand the public's attention.
Encourage the design of signs that are complementary to the buildings and uses to
which they relate and that are harmonious with the surroundings.
C Enhance the safety of motorists and pedestrians by minimizing the distraction of
intrusive signs, as well as to protect the life, health, property, and general welfare of
City and visitors.

Staff supports an exemption of the Sign Standards for the following reasons:
G The number and location of signs on the theatre property would not change, and the
existing marquee structure would be retained. The only change would be the
removal of the existing illuminated manual changeable copy sign with a new
electronic LED changeable copy sign.
The retrofitted sign as proposed would be complementary to the existing marquee
structure and theatre building, and would continue to be harmonious with the
surrounding neighborhood.
The proposed new electronic LED changeable copy sign is designed with a black
background and adjustable amber -lit lettering, which could produce less light
spillage and pollution than the existing sign which consists of a backlit white
background with black lettering.
The message on the new electronic LED changeable copy sign would be limited to
the title, dates, times, and a limited description of the production or event at the
theatre, and would be limited to such content. The proposed new sign would be
illuminated between the hours of 7:00 a.m. to 11:00 p.m.
C The safety of motorists and pedestrians would not be jeopardized by the new
electronic LED changeable copy sign because the sign message would remain static
and the image would not change throughout the day.
G The City is obligated to perform maintenance and repairs to the on -site signage as
owner of the NTAC and per the provisions of the Management Agreement between
the City and Friends of the NTAC.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this project exempt from the California
Environmental Quality Act ( "CEQA °) pursuant to Section 15311 (Class 11, Accessory
Structures) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3,
because it has no potential to have a significant effect on the environment. Class 11
exempts construction, or placement of minor structures accessory to (appurtenant to)
existing commercial, industrial, or institutional facilities, including but not limited to on-
premise signs.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
Notice of this hearing was published in the Daily Pilot, mailed to property owners and
occupants within 500 feet of the property and posted at the site a minimum of 10 days in

advance of this hearing consistent with the Municipal Code. The environmental
assessment process was also noticed in a similar manner and all mandatory notices per
the California Envi.onmentai Quality Act were given. Finally, the item appeared upon
the agenda for this meeting, which was posted at City Hall and on the •-ity website.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH GRANTING AN EXEMPTION OF THE SIGN
STANDARDS OF CHAPTER 20.42 OF THE NEWPORT BEACH
MUNICIPAL CODE TO ALLOW AN ELECTRONIC
CHANGEABLE COPY SIGN AT THE NEWPORT THEATRE
ARTS CENTER LOCATED AT 2510 CLIFF DRIVE (PA2011 -063)
THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH HEREBY FINDS AS FOLLOWS:
SECTION 1. STATEMENT OF FACTS.
1. The Friends of the Newport Theatre Arts Center (NTAC) submitted a written request that
the City allow the marquee sign structure located at the NTAC be retrofitted by removing
the existing illuminated manual changeable copy sign and replacing it with a new
electronic light- emitting diodes (LED) changeable copy sign.
2. The subject property is zoned PR (Parks and Recreation) and the General Plan Land
Use Element category is Parks and Recreation (PR).
3. The subject property is located within the coastal zone. The Coastal Land Use Plan
category is Parks and Recreation (PR).
4. The Sign Standards of Chapter 20.42 of the Newport Beach Municipal Code (NBMC)
define electronic LED changeable copy signs as an animated sign, which are specifically
prohibited pursuant to Section 20.42.050.
5. The City Council may exempt specific City- implemented projects by adopting a resolution
at a noticed public hearing upon setting forth the specific Code provisions that would
apply in the absence of the exemption, pursuant to Section 20.10.040 (Applicability of
Zoning Code) of the NBMC. As owner of the NTAC and per the provisions of the
Management Agreement between the City and Friends of the NTAC, the City is
obligated to perform maintenance and repairs to the on -site signage.
6, The Parks, Beaches and Recreation (PB &R) Commission reviewed the request on April
5, 2011, in the City Hall Council Chambers, 3300 Newport Boulevard, Newport Beach,
California. A notice of time, place and purpose of the meeting was given to residents
located within 500 feet of the NTAC property. Both written and oral information was
presented to, and considered by, the PB &R Commission at this meeting.
7. The PB &R Commission voted unanimously to recommend that the City Council approve
the new sign as proposed.
8. A public hearing was held by the City Council on April 26, 2011, in the City Hall Council
Chambers, 3300 Newport Boulevard, Newport Beach, California. A notice of time, place
and purpose of the meeting was given in accordance with the NBMC. Evidence, both
written and oral, was presented to, and considered by, the City Council at this meeting.

SECTION 2. CALIFORNIA ENVIRONMENTAL QUALITY ACT DETERMINATION.
This action is covered by the general rule that the California Environmental Quality Act
(CEQA) applies only to projects that have the potential for causing a significant effect on the
environment (Section 15061.b.3 of the CEQA Guidelines). It can be seen with certainty that
there is no possibility that this activity will have a significant effect on the environment.
Therefore, this activity is not subject to CEQA.
1. This project has been determined to be categorically exempt under the requirements
of the California Environmental Quality Act pursuant to Section 15311 (Class 11,
Accessory Structures) of the CEQA Guidelines, California Code of Regulations, Title
14, Chapter 3, because it has no potential to have a significant effect on the
environment.
2. Class 11 exempts construction, or placement of minor structures accessory to
(appurtenant to) existing commercial, industrial, or institutional facilities, including but
not limited to on- premise signs.
SECTION 3, FACTS IN SUPPORT OF EXEMPTION.
In accordance with Section 20.10.040 of the NBMC, the City Council may exempt specific
City - implemented projects by adopting a resolution at a noticed public hearing upon setting
forth the specific Code provisions that would apply in the absence of the exemption.
Electronic LED changeable copy signs are considered animated signs that are prohibited
pursuant to Section 20.42.050 of the NBMC.
The purpose of Chapter 20.42 (Sign Standards) of the NBMC is to provide standards
intended to:

SECTION 4. DECISION.
NOW, THEREFORE, BE IT RESOLVED:
1. The City Council of the City of Newport Beach does hereby grant an exemption of the
Sign Standards of Chapter 20.42 of the NBMC, and specifically, Section 20.42.050 that
prohibits animated signs.
2. The City Council of the City of Newport Beach does hereby approve the retrofitting of the
marquee sign structure with the new electronic LED changeable copy sign at the NTAC,
subject to the conditions set forth in Exhibit "A ".

EXHIBIT "A"
CONDITIONS OF APPROVAL
1. This approval was based on the particulars of the individual case and does not in and
of itself or in combination with other approvals in the vicinity or Citywide constitute a
precedent for future approvals or decisions.
2. The electronic LED changeable copy sign message shall remain static and shall not
change throughout the day.
3. The conveyance of changing copy or images with the electronic LED changeable copy
sign is strictly prohibited.
4. The sign copy message shall be limited to titles, times, dates, telephone numbers and
brief descriptive information regarding productions and /or'events held at the theatre
only.
5. The sign may be illuminated between the hours of 7:00 a.m. to 11:00 p.m. when in
use, and in no case shall the sign be illuminated after 11:00 p.m. or before 7:00 a.m.
6. The light emitting from the sign shall not be excessively illuminated based on the
luminance recommendations of the Illuminating Engineering Society of North America.
If in the opinion of the Community Development Director, the illumination creates an
unacceptable negative impact on surrounding land uses or environmental resources,
the Community Development Director may order the dimming of the light sources or
other remediation upon finding that the sign is excessively illuminated.
7. The Friends of the NTAC is required to obtain all applicable permits from the City's
Building Division. The construction plans must comply with the most recent, City - adopted
version of the California Building Code.
8. All fees associated with the retrofit of the NTAC signage are to be funded by the Friends
of the NTAC.
9. The terms and conditions of the Management Agreement between the City of Newport
Beach and Friends of the NTAC shall remain in full force and effect.

TITLE: Newport Theatre Arts Center Digital Sign Request
ABSTRACT:
Consider recommending an exemption of the
Newport Beach Municipal Code (NBMC), and
prohibits animated electronic changeable copy
marquee sign with an illuminated manual
changeable copy sign that is changed by

Recommend that the PB &R Commission forward to City Council a request (Attachment

marquee sign to an amber LED sign.
FUNDING REQUIREMENTS:
The Friends of the Newport Theatre Arts Center to fully fund the conversion of the
existing illuminated section of marquee to digital. No impact to the general fund.
DISCUSSION:
The current manual changeable copy marquee sign at the Newport Theatre Arts Center
is in need of renovation with the internal illuminated component breaking down. The
sign in its present configuration also creates problems as the individual letters used to
create the sign copy are often stolen or manipulated.
The Friends of the Newport Theatre Arts Center is proposing to retrofit the existing
illuminated section of the marquee sign changing it from a backlit sign to an LED sign
(Attachment C). The project would utilize the existing marquee sign structure replacing
the internal illuminated component only. The proposed LED sign is designed with a

black background and adjustable amber -lit lettering which could produce less light
pollution than the existing white background and black leftering (Attachment D).
The purpose of the sign is to communicate titles, times, dates, phone number and
limited descriptive information relative to productions and events at the theater only and
would be limited to such content. The lighting in the sign currently turns off at 11:00 p.m.
and the proposed LED sign would be scheduled to turn off at 11:00 p.m. as well.
ENVIRONMENTAL REVIEW:
This project has been reviewed, and it has been determined that it is categorically
exempt from the requirements of the California Environmental Quality Act under Class
11 (Accessory Structures). This class exempts construction, or placement of minor
structures accessory to (appurtenant to) existing commercial, industrial, or institutional
facilities, including but not limited to on- premise signs.

20.42.050 Prohibited Signs.
The following signs and sign types shall be prohibited throughout all zoning districts of the
City.
A. Painted Signs. Painted signs on fences or roofs except addresses.
B. Hazardous Location. Signs located in a manner that the sign or a portion of the sign or
sign supports interfere with the free use of a fire escape, exit or standpipe, or obstruct a
required door, stairway, ventilator, window, or public way or are otherwise hazardous.
C. Signs with Off -Site Commercial Messages. Signs shall not advertise a business,
accommodation, service or activity not provided on the premises on which the sign is located.
The off- site /on -site distinction shall only apply to commercial messages.
D. Beams of Light. No person shall erect or maintain any device that directs a beam of light,
including klieg lights and searchlights, in a flashing sequence toward any street or highway,
nor shall any person erect or maintain any illuminated sign or similar device that interferes
with the visibility of any official traffic control device or warning signal.
E. Luminous Tube Lighting (e.g., Neon, Rope Lighting). Luminous tube lighting shall not be
used to outline or frame doors and /or windows.
F. Prohibited sign types:
1. A -frame signs;
2. Animated signs;
3. Changeable copy lions, except as a component of another type sign allowed
through the comprehensive sign program;
4. Commercial mascots;
S. Inflated display signs;
6. Pole signs;
7. Roof signs, unless avariance is granted; and
8. Vehicle signs, subject to the definition of vehicle signs in Secdon 20-42.040

The monument marquee sign in front of Newport Theatre Arts Center, which
was originally built by the City sign shop a number of years ago, is in dire
need of repair. It encases a light box insert which provides vital information
(titles, dates, times, etc.) regarding plays either scheduled or currently in
performance. The superstructure of the sign is intact, but the light box has
deteriorated and must be replaced. We are requesting the City's approval to
do that at NTAC's expense.
The nighttime illumination level of the present light box would be toned
down considerably by the use of an LED insert, and that is what we propose
to utilize. Rather than the entire box being brightly lit, the LED sign would
provide an essentially black background against which only the letters are lit.
The difference is evident in photos which were transmitted to you earlier.
We would like to proceed as quickly as possible, and would appreciate your
assistance in expediting this request.

NOTICE IS HEREBY GIVEN that on April 26, 2011, at 7:00 p.m., a public hearing will be conducted in the City
Council Chambers (Building A) at 3300 Newport Boulevard, Newport Beach. The City Council of the City of
Newport Beach will consider the following application:
Newport Theatre Arts Center Electronic Sign — Request for an exemption of the Sign Standards of Chapter
20.42 of the Newport Beach Municipal Code, to allow an electronic light- emitting diodes (LED) changeable
copy sign at the Newport Theatre Arts Center located at 2501 Cliff Drive.
The project is categorically exempt under Section 15311 (Class 11, Accessory Structures), of the California
Environmental Quality Act (CEQA) Guidelines — Class 11 exempts construction, or placement of minor
structures accessory to (appurtenant to) existing commercial, industrial, or institutional facilities, including
but not limited to on- premise signs.
All interested parties may appear and present testimony in regard to this application. If you challenge this
project in court, you may be limited to raising only those issues you or someone else raised at the public
hearing (described in this notice) or in written correspondence delivered to the City, at, or prior to, the public
hearing. The agenda, staff report, and documents may be reviewed at the City Clerk's Office (Building B),
3300 Newport Boulevard, Newport Beach, California, 92663, or at the City of Newport Beach website
at www.newportbeachca.gov on the Thursday prior to the hearing. For more information please call
