Brown, City Clerk APPROVED: � A" TITLE: APPOINTMENT BY MAYOR OF AD HOC APPOINTMENTS COMMITTEE TO REVIEW APPLICATIONS FOR THE CITY'S REPRESENTATIVE TO THE VISIT NEWPORT BEACH EXECUTIVE COMMITTEE AND THE SPECIAL EVENTS ADVISORY COMMITTEE, AND MAKE RECOMMENDATIONS TO THE FULL COUNCIL RELATIVE TO THE APPOINTMENTS ABSTRACT: As part of the agreement between the City of Newport Beach and Visit Newport Beach, Inc. for destination marketing services that was adopted on September 27, 2011, the City will appoint a full voting member to the VNB Executive Committee. In addition, the recent resignation of a member of the Special Events Advisory Committee necessitates that a similar process be followed in appointing a new member to that committee. RECOMMENDATION: Confirm the Mayor's appointment of Mayor Michael Henn, Mayor Pro Tern Nancy Gardner, and Council Member Rush Hill to serve on the Ad Hoc Appointments Committee to review applications for the City's representative to the Visit Newport Beach Executive Committee and the Special Events Advisory Committee, and make recommendations to the full City Council relative to the appointment. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. MAYOR APPOINTMENTS TO AN AD HOC APPOINTMENTS COMMITTEE TO REVIEW APPLICATIONS FOR THE CITY'S REPRESENTATIVE ON THE VISIT NEWPORT BEACH EXECUTIVE COMMITTEE AND THE SPECIAL EVENTS ADVISORY COMMITTEE November 8, 2011 Page 2 DISCUSSION: On September 27, 2011, the City of Newport Beach (City) and Visit Newport Beach, Inc. (VNB) entered into an agreement for destination marketing services. As part of the agreement, the City is appointing a full voting member to the VNB Executive Committee. City Council Policy A -2 establishes procedures for making appointments to the City's various boards and commissions. Although the appointment to the VNB Executive Committee does not fall under the purview of Council Policy A -2, the City desires to use Council Policy A -2 as a guide to assist with the appointment. A Notice of Vacancy for the VNB Executive Committee position was advertised on Saturday, October 1, 2011, and applications were accepted until 4:00 p.m. on Friday, October 21, 2011. The City Clerk's Office received seven applications by the close of the application period. In addition, the Special Events Advisory Committee (SEAC) was formed by Council Resolution 2009 -22. The Resolution directs the Mayor to make appointments to the committee, subject to Council approval. The recent resignation of a committee member necessitates the identification and appointment of a new member. The City desires to follow past practice in filling the vacancy which involved the screening of applications by an Ad Hoc committee of Council members, appointment by the Mayor and confirmation by the City Council. The Notice of Vacancy will be advertised on Saturday, November 5, 2011, to open the application process. Once the final appointment to the VNB Executive Committee and the Special Events Advisory Committee are made by the City Council, this Ad Hoc Appointments Committee will automatically sunset without further action by the City Council. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.
