TITLE: Update Parking Permit fees
ABSTRACT:
The City operates a parking permit system which includes the following permit types:
1. Annual Parking Permit (blue pole) - $100;
2. Master Parking Permit - $675; and
3. Balboa Municipal Parking Lot Overnight Parking Permit ( "Overnight Permit ") -
$150
All above permit fees are prorated quarterly. Seniors are offered "half price" of any
permit fee, although currently that discount is not within the Annual and Overnight
Permit resolutions. Veterans do not receive any discount.
While Master Parking Permit fees are adjusted annually by the Consumer Price Index
( "CPI "), the Annual and Overnight Permit fees have not been studied or updated since
April, 1993. Staff recommends updating the Annual and Overnight Permit fees to reflect
current market rates and changes in the CPI. In order to give customers an additional
option, staff also recommends lowering the Master Parking Permit by $225 to $450.

Staff recommends that City Council:
1. Adopt Resolution No.2011iosupdating the Annual Parking Permit to:
a. adjust the fee to reflect current market rates;

b. allow for an automatic annual adjustment by CPI;
C. limit the proration to once each year, on October 1;
d. provide a fifty percent (50 %) discount to senior citizens; and
e. provide a twenty -five percent (25 %) discount to veterans;
2. Adopt Resolution No.2oll- iloupdating the Overnight Permit to:
a. adjust the fee to reflect CPI changes;
b. allow for an automatic annual adjustment by CPI;
C. limit the proration to once each year, on October 1;
d. provide a fifty percent (50 %) discount to senior citizens; and

FUNDING REQUIREMENTS:
There is no expenditure of funds required with this action.
DISCUSSION:
Background
The City's overall parking permit program has not been reviewed for market
comparisons or CPI adjustments in almost twenty years. Resolutions 95 -133, 95 -134
and 95 -135 established the systems for the Annual Parking Permit, Master Parking
Permit and Overnight Permit respectively. Whereas Resolution 95 -134 allowed the
Master Parking Permit fees to increase by CPI each year, Resolutions 95 -133 and 95-
135 did not provide for such increases.

Resolution 95 -133 provided seniors with a fifty percent (50 %) discount for the Annual
Parking Permit, but there were no similar discounts offered for the Master Parking
Permit or the Overnight Permit.
Annual Parking Permit
Staff recommends that the Annual Parking Permit fee be increased to $150, with an
automatic annual CPI adjuster. The Annual Parking Permit permits its holders to park
at blue painted meters throughout the City, approximately 930 spaces, or 35% of the
total metered spaces in the City. The Annual Parking Permit also allows its holders to
park at the Balboa Municipal Parking Lot, the Corona del Mar parking lot, and the
Superior Avenue Parking Lot.
Almost half (approximately 45 %) of the Annual Parking Permits are purchased by non-
residents. We realized a 20% increase in permits issued between years 2009 & 2010.

calendar years 2008 -2010:

increase would keep our parking program competitive with minimal adverse impact to
our community.
Finance also calculated what the cost of the Annual Parking Permit would be had it, like
the Master Parking Permit, been annually adjusted by CPI from 1994:

The 2010 amount of $150.30 is equivalent to the parking permit costs of the surveyed
neighboring cities and in line with staff recommendations.
Overnight Permit
The Overnight Permit allows its holders to park at the Balboa Municipal Lot for seven (7)
continuous days throughout the year. (The Master Parking Permit also permits
overnight parking, but the Annual Parking Permit does not.) The current fee for the
Overnight Permit is $150. This fee has not changed since 1995. Staff recommends
adjusting the fee by CPI, and increasing the fee to $225.

Master Parking Permit
Because of the recommended increases in the Annual Parking Permit and Overnight
Permit fees, staff decided to review the pricing of the City's Master Parking Permit. The
Master Parking Permit allows parking at all meters and lots throughout the City. The
Annual Parking Permit allows parking at approximately 35% of the metered spaces (and
the lots). Finance staff calculated what the Master Parking Permit fee would be if it
were based upon the recommended pricing of the Annual Parking Permit:
$150 = 35 % of metered parking; so
$450 = 100% of metered parking
Finance staff recommends decreasing the Master Parking Permit fee to $450, a
reduction of $225 to reflect the pricing of the Annual Parking Permit. The Master
Parking Permit would be a value -added option to City visitors, residents and
businesses.
Last calendar year, the City sold 270 Master Parking Permits.

Proration
The City currently prorates the Parking Permits four times a year, a complex and time
consuming program to administer. Most of the surveyed cities do not offer a prorated
amount, and those that do, offer a semi - annual rate. (Santa Barbara offers a monthly
option.)
Finance recommends one annual proration, a 75% discount on all three Permits, which
would occur at the end of our busy summer season on October 1 st.
Senior and Veteran Discount
Staff recommends maintaining the senior discount (50 %) for the Master Parking Permit,
and officially adding a senior discount to the Annual Parking and Overnight Permit.
Finance Committee recommended that staff look into the possibility of offering a
veteran's discount as well. While our comparable cities do not offer a parking permit
veteran's discount, the State of California offers a permit, the "Distinguished Veterans

Pass," to honorably discharged war veterans who are California residents and have a
50% or more service- connected disability, or were prisoners of war. The Veterans Pass
is free and allows the holder to park at the State beach lots for free. Staff understands it
is the interest of our community and council to offer a discount and recommends a 25%
discount for any active and retired military members with a valid military identification
card. This discount would cost a little more to administer but staff does not anticipate
the cost to be significant.
The City collected approximately $400,000 during fiscal year 2010 -11 for all parking
permit fees. Finance estimates that if Council approves the recommendations above,
we could increase this revenue source by almost $200,000 per year. This would be net
of the decrease in the Master Parking Permit fee recommended above.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or
indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH RE- ESTABLISHING AN ANNUAL
PARKING PERMIT SYSTEM FOR USE IN CERTAIN CITY
PARKING LOTS AND OFF - STREET PARKING METER ZONES,
AND RESCINDING RESOLUTION NO. 95 -133.
WHEREAS, Section 12.44.120 of the Newport Beach Municipal Code provides that, in
off - street parking meter zones previously established by Resolution, a vehicle may be parked
and remain parked in a parking space without the deposit of coins if such vehicle has displayed
a current, valid Annual Parking Permit issued by the City of Newport Beach pursuant to
authorization of the City Council; and
WHEREAS, the City of Newport Beach operates parking facilities where a vehicle may
be parked, and remain parked without the payment of fees, if such vehicle has displayed a
current, valid Annual Parking Permit issued by the City of Newport Beach pursuant to
authorization of the City Council.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport
Beach as follows:
1. There is hereby established a parking permit system consisting of a non-
transferable, Annual Parking Permit which, when affixed to the front windshield of a vehicle
within a seven -inch (T') square in the lower corner farthest removed from the driver's position,
shall authorize the parking of such vehicle in designated spaces in Parking Meter Zones 9, 11,
12, 14, 15, 16, 20, 21, 22, 23, 24, 25, 26 and 27, without requiring the deposit of coins in the
parking meter located adjacent to said parking space. The Annual Parking Permit shall be valid
only in spaces designated by having the adjacent parking meter post painted blue. Such Annual
Parking Permit shall also authorize vehicles displaying said permit to use the City parking lot
located at the Corona del Mar State and City Beach Park, the Balboa Municipal Parking Lot,
and the Superior Avenue Parking Lot, without requiring the payment of an additional parking
fee, provided said lots are open for parking and space is available therein. Such Annual Parking
Permit shall not be valid in the Balboa Municipal Parking Lot between the hours of 3:00 a.m. to
6:00 a.m. It shall not, however, establish any priority for parking spaces.
2. The Annual Parking Permit established pursuant to this Resolution shall not be
usable for vehicles 84 inches or more in width AND more than 84 inches in height OR more
than 20 feet in length OR without windshields.
3. The Annual Parking Permit hereinbefore established shall be appropriately
designed and dated to indicate the appropriate year during which said Annual Parking Permit
shall be valid.
4. The adoption of this Resolution shall not be construed to impair the validity of any
existing Annual Parking Permit, and all said Annual Parking Permits shall continue to be
effective for the term issued therefore.

5. The fee for the Annual Parking Permit shall be one hundred fifty dollars
($150.00). Thereafter, the fee will be increased each year, based upon any interim increase in
the Consumer Price Index (the Los Angeles, Long Beach and Anaheim Index). This increase
shall be rounded to the nearest whole dollar and shall become effective on January 1 of any
year that the City Council does not otherwise revise the fee.
6. Annual Parking Permits purchased on or after October 1 of any year shall have
the fee reduced seventy -five percent (75 %).
7. Persons 65 years of age or older may purchase a total of one (1) Annual Parking

PARKING PERMIT SYSTEM FOR THE USE OF PARKING
SPACES IN THE BALBOA MUNICIPAL LOT AND RESCINDING
RESOLUTION NO. 95 -135.
WHEREAS, Section 12.12.050 of the Newport Beach Municipal Code provides that, in a
City parking lot, a vehicle may be parked and remain parked in a parking space if such vehicle
has displayed a current, valid overnight parking permit issued by the City of Newport Beach,
pursuant to authorization of the City Council; and
WHEREAS, the City Council of the City of Newport Beach wishes to establish a Balboa
Municipal Lot Overnight Parking Permit and designate the fees and regulations governing the
use of said Permit.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport
Beach as follows:
1. There is hereby established a parking permit system consisting of a non-
transferable, annual Overnight Parking Permit which, when affixed to the front windshield of a
vehicle within a seven -inch (7 ") square in the lower corner farthest removed from the driver's
position, shall authorize the overnight parking of such vehicle in the Balboa Municipal Lot. The
Master Parking Permit shall be valid for overnight parking in the Balboa Municipal Lot. The
Annual Parking Permit shall not be valid for overnight parking in the Balboa Municipal Lot.
Overnight parking is hereby defined for this parking lot to mean between the hours of 3:00 a.m
to 6:00 a.m. It shall not, however, establish any priority for parking spaces.
2. The Overnight Parking Permit established pursuant to this Resolution shall allow
a vehicle to remain in the Balboa Municipal Parking Lot continuously for a period of up to seven
(7) days without the payment of the regular parking fee.
3. The Overnight Parking Permit established pursuant to this Resolution shall not
be used for the parking of buses. For purposes of definition within this Resolution, the term
"bus" shall mean any motor vehicle, other than a motor truck or truck tractor, designed for
carrying more than nine (9) people, including the driver, and used or maintained for the
transportation of passengers.
4. The Overnight Parking Permit established pursuant to this Resolution shall not
be usable for vehicles 84 inches or more in width AND more than 84 inches in height OR more
than 20 feet in length OR without windshields.
5. The Overnight Parking Permit hereinbefore established shall be appropriately
designed and dated to indicate the appropriate year during which said Overnight Parking Permit
shall be valid.
6. The adoption of this Resolution shall not be construed to impair the validity of any
existing Overnight Parking Permit, and all said Overnight Parking Permits shall continue to be
effective for the term issued therefore.
7. The annual fee for the Balboa Municipal Lot Overnight Parking Permit shall be
two hundred twenty -five dollars ($225.00). Thereafter, the fee will be increased each year,
based upon any interim increase in the Consumer Price Index (the Los Angeles, Long Beach
and Anaheim Index). This increase shall be rounded to the nearest whole dollar and shall
become effective on January 1 of any year that the City Council does not otherwise revise the
fee.
