Exhibit B (Legal Description) 1 wil City (council Attachment A Draft Ordinance 3 Fil ORDINANCE NO. 2011 -27 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH CHANGING AND REDEFINING THE BOUNDARIES OF COUNCIL DISTRICTS WHEREAS, Section 1005 of the City Charter provides that following the national census, the City Council shall appoint a committee to study and report to the City Council on the advisability of redistricting the City and WHEREAS, on May 24, 2011, the City Council appointed the City Council Redistricting Committee; and WHEREAS, on June 30, 2011, July 21, 2011, and August 4, 2011, the City Council Redistricting Committee held meetings to consider proposed changes to the Council District boundaries and received public comments; and WHEREAS, on October 11, 2011, October 25, 2011, and November 22, 2011, the City Council of the City of Newport Beach, at duly noticed public hearings, reviewed and considered the recommendation submitted by the Committee and determined that the proposed changes are necessary and desirable in order that the district boundaries be fair and logical should be adopted by ordinance; and WHEREAS, the City Council has also determined that the proposed district boundaries, as nearly as practicable, constitute natural areas of contiguous and compact territory and provide fair representation on the City Council; and WHEREAS, pursuant to California Elections Code Section 21620, the City Council has also determined that the proposed districts are as nearly equal in population as may be according to the latest federal decennial census and comply with the applicable provisions of the federal Voting Rights Act of 1965, Section 1973 of Title 42 of the United States Code, as amended; and WHEREAS, pursuant to California Elections Code Section 21620.1, the City Council of the City of Newport Beach held duly- noticed public hearings on October 11, 2011, October 25, 2011, and November 22, 2011, to consider the proposed changes to the Council Districts. THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: The seven Council Districts of the City of Newport Beach shall be as depicted on a map attached hereto and marked Exhibit "A" and as described in a legal description, attached as Exhibit "B ", both incorporated herein by this reference. SECTION 2: By the enactment of this Ordinance, it is the intention of the City Council that the district numbers and boundaries as set forth herein shall replace and J ORDINANCE NO. _ Page 2 supersede all prior district numbers and boundaries as originally established by the City Charter and as subsequently modified by ordinance. SECTION 3: This project is exempt from the California Environmental Quality Act ( "CEQA ") pursuant to Section 15320 — Class 20 (Changes in Organization of Local Agencies) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3. The proposed changes to the Council Districts are exempt since they do not change the geographical area in which previously existing powers are exercised. SECTION 4: The Mayor shall sign and the City Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the same to be published once in the official newspaper of the City, and it shall be effective thirty (30) days after its adoption. Alford, Planning Manager APPROVED: A TITLE: City Council Redistricting ABSTRACT: An ordinance to approve the City Council Redistricting Committee's proposed changes to the City Council District boundaries. RECOMMENDATION: 1. Conduct a public hearing; and 2. Introduce Ordinance No, 2011 -27 (Attachment A) approving the City Council Redistricting Committee's proposed changes to the City Council District boundaries, and pass to second reading on December 13, 2011. FUNDING REQUIREMENTS: There is no fiscal impact related to this item DISCUSSION: California Elections Code Section 21620.1 requires the City Council to hold two public hearings before adopting any proposed changes to the City Council Districts. The first public hearing was held on October 11, 2011 and the second was held on October 25, 2011. At the October 25, 2011, hearing, the City Council directed staff to include a written description of the proposed City Council Districts boundaries (Attachment A -2). This, in -1 City Council Redistricting November 22, 2011 Page 2 turn, necessitated minor refinements to the proposed City Council District Map (Attachment A -1). The revised map now uses the centerline of Newport Harbor navigation channels and the centerline of the Upper Newport Bay to delineate common boundaries between Districts 1, 3, 4, 5, and /or 6. Otherwise, the proposed City Council District configurations remain the same and there are no changes to the proposed population distribution. Nevertheless, the Office of the City Attorney determined that these revisions could be interpreted as a substantial change to the proposed City Council District boundaries and should be considered at a new public hearing. Further information on the City Council Redistricting Committee's recommendation and consistency with the City Charter and the State Elections Code is contained in the October 11, 2011 City Council Staff Report (Attachment B). ENVIRONMENTAL REVIEW: This project is exempt from the California Environmental Quality Act ( "CEQA ") pursuant to Section 15320 — Class 20 (Changes in Organization of Local Agencies) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3. The proposed changes to the Council Districts are exempt since they do not change the geographical area in which previously existing powers are exercised. NOTICING: Notice of this hearing was published in the Daily Pilot and posted at the site a minimum of 10 days in advance of this hearing consistent with the Municipal Code. Initiate an ordinance to adopt the City Council Redistricting Committee's recommendation and set for a public hearing on October 25, 2011. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: Background Section 1005 of the City Charter provides that following the national census, the City Council shall appoint a committee to study and report to the City Council on the advisability of redistricting. On May 24, 2011, the City Council appointed the City Council Redistricting Committee. 17 City Council Redistricting October 11, 2011 Page 2 On September 27, 2011, the City Council conducted a study session on the City Council Redistricting Committee's recommendation. Committee Review and Recommendation The Committee held three public meetings to consider proposed changes to the Council District boundaries. The Committee determined at the outset that the current districts are unbalanced due to annexations and set forth the goals for the redistricting: • Population balance (approximately 12,000 people per district); • Avoid breaking up neighborhoods; • Recognize commonalities of interests; • Maintain the current geography of the existing districts as much as possible. The Committee considered seven different district boundary configurations, including three offered by members of the public. The Committee's recommendation (Attachment A) was chosen because it best met the Committee's goals and incorporated many of the suggestions offered by members of the public who attended the meetings. Consistency with the City Charter and the State E lections Code Pursuant to City Charter Section 1005, the Committee determined that due to the population imbalance of the current districts, redistricting is "necessary or desirable in order that the district boundaries be fair and logical." The proposed district boundaries are consistent with the Committee's goal of providing balanced populations of approximately 12,000 people in each district. Furthermore, by respecting neighborhoods, commonalities of interests, and the current geography of existing districts, the Committee's recommendation meets the Charter Section 1005 requirement that the boundaries "constitute natural areas of contiguous and compact territory and provide fair representation on the City Council." California Elections Code Section 21620 requires that the City Council determined that the proposed districts are as nearly equal in population as may be according to the latest federal decennial census and comply with the applicable provisions of the federal Voting Rights Act of 1965, Section 1973 of Title 42 of the United States Code, as amended. In establishing the boundaries of the districts, the Council may give consideration to the following factors: (1) topography, (2) geography, (3) cohesiveness, contiguity, integrity, and compactness of territory, and (4) community of interest of the districts. The Committee's recommendation would provide districts with nearly equal populations and gives due consideration to all of these factors. Therefore, the Committee's recommendation complies with the California Elections Code. California Elections Code Section 21620.1 requires the Council to hold two public hearings before adopting any proposed changes to the districts. The first public hearing will be on the October 11, 2011, City Council agenda. Notes 1. The outer edges of all Council Districts except #5 follow the boundary line of the City, often over a long distance. Trying to assign a direction to that line is unnecessary and creates ambiguity as to whether only the portion of the City limit with that characteristic is intended. In any event, this is clearly a typo for "Irvine Avenue." 3. The language involving "the southwesterly prolongation of the centerline of Seagull Lane' and "the most northern line of Tract Map No. 1218" appears to be an effort to trace the outer edge of Newport Harbor High School ( "NHHS," 600 Irvine Avenue /1701 16th Street), which the drafter wishes to place in District 2, and which is marked by property lines, rather than roads, on its southeastern side. Why the prolongation of the centerline of Seagull Lane was chosen is unclear. One corner of NHHS is indeed near the intersection of Seagull Lane and 16th Street, but the lot line from that point is at an angle to Seagull Lane and does not follow its extension. If the intention is to put all of NHHS in District 2 it would have seemed better to refer to Tract Map No. 1125, which depicts NHHS, and its boundary, as "Lot 4 ". Or to use plain English like "from the intersection of Seagull Lane and 16th Street along the southeastern lot line of Newport Harbor High School, and its prolongation, to the centerline of 15th Street." 4. The effort to describe the District 213 boundary from the intersection of Cliff Drive with Irvine Avenue to the intersection of Avon Street with Riverside Avenue by reference to Tract Map No. 919 (dated April 26, 1929, see link below) and Tract Map No. 1133 (dated April 4, 1946) is awkward at best. The intention appears to be to include the homes on the south side of Cliff Drive (which are in the Newport Heights Improvement Association) in District 2, but to place the commercial properties below (which are in the Mariners Mile Association) in District 3. This involves describing a boundary which follows rear lot lines rather than roads. The problem is that Tract Map No. 919 covers a large area, much of which had not been subdivided at the time of the map, and includes properties to the west of the present Riverside Avenue. In particular, the current lots on the south side of Cliff Drive are not indicated since they are part of an undivided 31.86 parcel designated as "Lot A ". Moreover, the western part of "Lot A" appears to have been subsequently ceded to and subdivided (including new extensions of Tustin Avenue and Avon Street and a new Ocean View Avenue) in Tract Map No. 1133. Still more of "Lot A" appears to have been lost to the "Park Place" subdivision as shown on Tract Map No. 12873 (dated January, 1987). The reference to "the intersection of the prolongation of [the centerline of Irvine Avenue] with the most northern line of Tract Map No. 919" presumably refers to the intersection with "Lot A" of Tract Map No. 919, which in turn appears to be an awkward way of describing the northeast corner of the residential lot at 2201 Cliff Drive, which is intended to be in District 2, while its neighbor at 2011 Kings Road (sharing the same lot line) is to be in District 3.. Again, the awkward reference to tract maps could probably be avoided by explaining what is intended in plain English, referring to the lots by their modern street addresses. 5. The reference to "150 feet' appears to extend the district boundary to the south (rear) lot line of the residential property at 2201 Cliff Drive, so that the District 2/3 boundary wraps around the residential lot line. 6. The reference to "paralleling the Cliff Drive Public Right of Way in a northwesterly direction 924 feet' appears to say the boundary follows the south (rear) lot lines of the residential properties on the sourth side of Cliff Drive adjoining 2201 Cliff Drive and extending to some point in Ensign View Park ( ?). 7. Since Tract Map No. 919 dated April 26, 1929 includes properties to the west of present day Riverside Avenue (see note 4), it is extremely unclear what the drafter means by following "the most western line of Tract Map No. 919." This may be a reference to "Lot A" of that tract, but even that has changed over time as explained in note 4. Or possibly the drafter was looking at tract maps different from those linked to below. 8. Lots 42, 44, 45, and 46 of Tract Map No. 1133 dated April 4, 1946 share a common northern boundary. Lots 43 and 47 do not. Also note that the line as described appears to place the Mariners Mile Association commercial properties at 206/212 Riverside Avenue and 215 Riverside Avenue in District 2, whereas all other Mariners Mile Association commercial properties are in District 3. It is unclear why at the end of Santa Ana Avenue the District 2/3 boundary jogs north along Old Newport Boulevard to Catalina Drive then west along an imaginary extension of that road to the centerline of Newport Boulevard and then back south to Coast Highway. The area so described is undeveloped (Caltrans ?) right of way. There would be no difference in the private properties included in the districts if the boundary simply went south from Santa Ana Avenue along Old Newport Boulevard to Coast Highway, or alternatively followed an imaginary extension of Santa Ana Avenue to Newport Boulevard and then south from there to Coast Highway. 10. "Newport Channel" is clearly a typo. The centerline of the main Newport Channel does not intersect Newport Boulevard anywhere near the intended point. 11. The description in the ordinance inadvertently omits the connection, along the imaginary line, from Newport Boulevard to Old Newport Boulevard. 12. The description in the ordinance inadvertently omits the specification of how far south the boundary line paralleling Cliff Drive is from "the northern line" of Tract Map No. 919. 13. Back Bay Drive has two intersections with Jamboree. For the remainder of the description to make sense, it is necessary to specify which is intended. 14. At the Redistricting Committee hearings, the exact division point along Bayside Drive below Avocado was never clear, but it appears the intent was to use an imaginary extension of Avocado Avenue to separate District 5 from District 6. This creates problems because Avocado is a discontinuous street, and the boundary lines of the lots below it align neither with an extension of the centerline of the main divided road section of Avocado (from PCH to Waterfront Drive) nor with the centerline of Avocado's narrow southernmost extension (from Waterfront Drive to Pacific Drive). Because the lot lines beyond the south end of Avocado best align with an extension of the western curb of that southern segment of Avocado it was probably the drafter's intent, despite what the text says, to use that curb line rather than the centerline of the road. If the curb line is used, 401 Avocado Avenue and 2137 Bayside Drive are wholly in District 5, while 2200 Bayside Drive and 2209 Bayside Drive are wholly in District 6. 15. The centerline of the Harbor Entrance needs to be continued along the main Newport Channel to define the intersection with the extension of Avocado Avenue. 16. Since "the most southerly boundary line "of the City is generally the Pacific Ocean, it is difficult to visualize where (or how) it intersects the high tide line. Describing the City boundary perpendicular to the coast as "the most southeasterly boundary line" may or may not help. 17. Since the District 7 boundary follows the City limit from the Bonita Canyon /73 junction all the way back to the ocean, it seems unnecessary to call special attention to the point on the boundary where it is crossed by PCH.
