Brown, City Clerk APPROVED: A TITLE: APPOINTMENT OF A NEW MEMBER TO THE PLANNING COMMISSION TO SERVE UNTIL JUNE 30, 2012 ABSTRACT: The City Council desires to fill the vacant Planning Commission position created by the resignation of Planning Commissioner Charles Unsworth on November 14, 2011. Mr. Unsworth's term is set to end on June 30, 2012. RECOMMENDATION: Appoint a person from the applicant list provided in this staff report to the Planning Commission to fill the unexpired balance of Planning Commissioner Charles Unsworth's term, which ends June 30, 2012. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: On November 14, 2011, the City Council received a Letter of Resignation from Planning Commissioner Charles Unsworth. Mr. Unsworth was appointed to a four -year term on the Planning Commission effective July 1, 2008 and ending on June 30, 2012. 1 APPOINTMENT OF A NEW MEMBER TO THE PLANNING COMMISSION TO SERVE UNTIL JUNE 30, 2012 December 13, 2011 Page 2 At the November 22, 2011 Regular City Council Meeting, the City Council directed City staff to bring back a staff report to waive Council Policy A -2, which sets the procedure for the appointment of Board and Commission members, and provide for the appointment of a new Planning Commissioner to the fill the unexpired balance of Planning Commissioner Charles Unsworth's remaining term. At the November 29, 2011 Special City Council Meeting, the City Council waived Council Policy A -2, set the deadline for the submission of applications to fill the vacant Planning Commission position for Wednesday, December 7, 2011, and continued the appointment of a new Planning Commissioner to the December 13, 2011 Regular City Council Meeting. On November 23, 2011, the City Clerk posted a Notice of Vacancy for the Planning Commission position on the City's web page, the City Hall bulletin board outside Building B, and the City Clerk's Office. In addition, a Notice of Vacancy was posted at the Central Library, published in The Daily Pilot on Saturday, November 26, 2011, and on November 23, 2011 the Public Information Manager sent out a news email notifying the public of the opportunity to apply for the vacant Planning Commission position. Pursuant to the Maddy Act (California Government Code Section 54974 et seq.) the City Council must wait at least 10 working days from the date the Notice of Vacancy was posted in the City Clerk's Office to make a final appointment to fill the vacant Planning Commission position. The Notice of Vacancy was posted in the City Clerk's Office on Wednesday, November 23, 2011. Due to the Thanksgiving Day holiday, the City Council must wait until at least Friday, December 9, 2011 to make a final appointment to fill Mr. Unsworth's vacant position. I would like to contribute to the ongoing success of Newport Beach where I have lived since High School. The Planning Commission is the most logical starting position for my skills and interests. I have several decades of experience in planning, up to and including thousand acre master plan entitlements for commercial, industrial, golf course and residential projects. I am fully versed in the interaction between city agencies and private developers and property owners, including simple building permits, leasehold interests, CFD's & Mello Roos, HOA's and the interactions with outside agencies such as water districts and coastal commissions. My parents have lived on Balboa Island since 1977, and since enrolling at USC that year, I have either lived in the area or visited frequently to see family and friends. As a local businessman and Realtor, I want to see the high quality of life we enjoy in Newport Beach preserved and maintained and, more specifically, ensure that development in our city is appropriate and consistent with the local planning codes and ordinances. In that spirit, a few years ago I decided that the best way for me to see that happen was to become more involved in the local community. I committed myself to doing just that by identifying ways in which I could be involved. I approached the Newport Beach Association of Realtors ( "NBAOR ") and I am currently serving my second term as Chairman of the Government and Political Affairs Committee for NBAOR. In that role, I have been able to increase awareness within the Newport Beach Realtor Community of issues that may affect our industry, and I believe my efforts have had a positive impact on the process. In addition, I followed in the footsteps of my father by regularly attending the Aviation Committee meetings so that I will be informed of developments with the airport and be in a position to disseminate that information to the local community in general and to the Realtor community in particular. And now, I am applying for appointment to the Newport Beach Planning Commission. Throughout my business career, I have held senior management and C -level positions, and in these roles, I have applied a fair and thoughtful management style and a pragmatic approach to decision - making. Many of my character traits were learned from my father who was an officer in the US Air Force. For instance, he once told me that when you compromise your integrity you can never get it back. And he has always treated people with the utmost respect. I always try to apply these principles in my professional and personal life, and I believe that people deserve respect and that integrity is "doing the right thing when no one is watching ". If selected, I will apply the same approach as a member of the Planning Commission that I have applied in my professional and personal life. I have owned homes on Balboa Island, Belcourt and now in One Ford Road ( "OFR ") and through homeownership, I have developed a deeper, personal interest in the community. I regularly participate in 0FR Board meetings and I served on the Belcourt HOA for two years. I have also invested in residential real estate in San Francisco. In both the Marina District in San Francisco and in Newport Beach, I always tried to preserve the integrity and character of the unique neighborhoods and the original structures where appropriate. I believe that history is an important aspect of any neighborhood and that we can "enhance the present by remembering the past'. My properties required renovations and re- development, and I acted on my behalf as General Contractor, working closely with the local Planning Departments to submit plans for approval. Furthermore, as a Realtor, I must be very familiar with the local planning codes and ordinances so that I can effectively advise my clients. While developing in Nevada for about 7 years I was encouraged to become a planning commissioner in Nye County, It was a regional Planning commission and quite primitive compared to Newport Beach. While serving there, we adopted the first county master plan, established a real building department and the first zoning ordinance. This is and remains a rural area (only about 25% of the roads are even paved. When the State started mandating dust control we then wrote and adopted the counties first dust control ordinance. There was so much objection to the zoning ordinance by many 'old timers'that the sheriffs office needed to to issue me a concealed weapon permit. Can you envision death threats for enacting an ordinance outlawing yard cars and garbage burning in the front yard?
