SUMMARY: Request to initiate amendments to the Newport Beach General Plan as
follows:
A. 129, 131, and 133 Agate Avenue. Balboa Island: A proposal to change the
land use designation from Reuel and Service Commercial to Two - Family
Residential.
B. 1300 Dove Street: A proposal to increase the allowed square footage to
accommodate a 2,349 square foot expansion to an existing building.
C. 700 Newport Center Drive: A proposal to increase the development
allocation for Block 700 of Newport Center by 11,000 square feet to allow
for the semi- permanent installation of an enclosed tent /pavilion.
D. Santiago Drive /22 "d Street: A proposal to amend the arterial roadway
classification of Santiago Drive /22nd Street between Irvine and Santa ,Ana
Avenues from a Secondary Road to a Commuter Road.
ACTION: Sustain the action of the Planning Commission to initiate the amendments;
direct staff to proceed with the preparation of any necessary environmental
documents and set for public hearing before the Planning Commission.
At its October 8, 1998 meeting, the Planning Commission recommended initiation of items A
and B above to the City Council. Subsequent to that meeting, two minor additional items came to
the attention of staff. Initiation of these requests will be considered by the Planning Commission
on October 22, 1998. Staff will prepare and distribute a supplemental report on the
recommendation of the Planning Commission to the City Council on October 23rd

Adopt Resolution No. 147B, changing street name "Bighorn Drive' to
"Maidstone Drive" in the Aeronutronic Ford Planned Community Area (Final
Tract No. 15390).
Planning Director Temple stated there was no additional information.
Public comment was opened.
Public comment was closed.
Commissioner Fuller asked staff if there is any cost to the City and who bears the
cost. Planning Director Temple stated in a case like this there is not a lot to
change because it is a newly recorded map and the applicant is required to
make the changes in the final recordation to the map. Ms. Temple stated there
are some processing costs. She stated in a street name change takes staff time
most particularly in determining that there are no conflicts with other existing
names in the City. Commissioner Fuller asked about costs to map revisions. Ms.
Temple stated if there were substantial revisions. they would request
reimbursementby the applicant.
Motion was made by Commissioner Ridgeway to adopt Resolution No. 1479, to
Revised Street Name for Aeronutronic Ford Planned Community Area (Final
Tract No. 153900).

Commissioner Fuller asked if it was inconsistent to vote to initiate this
amendment and when it is presented not support it. Planning Director
Temple stated that would not be o problem.
Commissioner Ashley asked regarding the length of time incurred. and if this
were initiated, does it obligate the staff to immediately undertake on in-
depth analysis to present the information to the Planning Commission in a two
week period. Planning Director Temple stated that this type of application is
applicant driven and it depends on how quickly the applicant pulls the
particulars of the related zoning applications together. She stated then staff
would process them in a normal manner.

SUBJECT: Discussion of City's provision regarding natural grade.
Planning Director Temple stated this is o presentation requested by
Commissioner Ridgeway. Ms. Temple stated that Associate Planner Marc Myers
has prepared some exhibits using a case in Corona del Mor to explain how staff
goes through the steps to estoblish grade when it has been altered by previous
development.
Mr. Myers stated the explanation provided in the memorandum provided is
what the entitlement section states in the Code.. He stated that typically in a
situation where there is on existing residence. before the project is started. the
applicant's architect would hove a survey of the lot prepared to determine
what the present conditions ore of the site in terms of the grode-elevotions. Mr.
Myers stated that from the pion that is developed by o licensed surveyor. staff
con then make their best determination of what the natural grade of the lot is.

Background
City Council Policy K -1 states that:
"A citizen and/or property owner may request an amendment to the General Plan.
Such request shall be Submitted in writing to the Planning Commission a
minimum of fourteen (14) days prior to the month during which proposed
amendments are to be initiated. The request should clearly set forth the reason for
which the request is made. and should contain information substantiating the
need. It the Planning Commission, after examination, is convinced that the
proposed change is worthy of initiation, it may recommend initiation of
amendments as set forth above. If not, the Commission shall forward the request
to the City Council with its recommendation that initiation of the amendment is
unwarranted. The City Council, after consideration of the request and of the report
from the Planning Commission, may either initiate the proposed amendment and
direct the Planning Commission to set for public hearing, return the request to the
originator without further action, or defer action on the proposed amendment to
future hearing sessions based on Planning Department work loads and project
priorities."
Proposed Amendments
129. 131. and 133 Agate Avenue, Balboa Island: Bruce E. Nott has submitted a request to amend
the General Plan Land Use Element to change the land use designation of the three lots at the
corner of Agate and Park Avenues from Retail and Service Commercial to Two-Family
Residential. The applicant would also request rezoning the property to R -1.5. The intent of the
applicant is to construct four single family residences on the property. This amendment also
requires a change to the Local Coastal Program, Land Use Plan.
1300 Dove Street: Lincoln Property Company has submitted a request to increase the
development allocation in Newport Place Block F (bounded by MacArthur Boulevard, Newport
Place Drive. Dove Street, and Bowsprit Drive) to accommodate a 2,349 square foot expansion of
one building. The increased floor area is requested to accommodate the needs of a prospective
tenant.
Planning Department Workload
Appendix "A" attached to this report lists all current programs and projects in the Planning
Department (Planning and Economic Development). Included is an analysis of the staffing
requirements for the various workload categories of the department.
The workload analysis indicates that the Department is currently operating at full capacity,
including the processing of some major development projects. The proposed General Plan
Amendments are associated with proposed development on individual properties. As such, these
projects will need to be accommodated within the hours allocated for development review.
It should also be noted that the Planning Department will be understaffed by one full time
position in the economic development division until the end of October. This vacancy will
reduce productivity in that division, All other positions in the Department are filled. However.
the extremely high workload in zoning plan check reduces the ability to utilize counter personnel
for occasional case assignment. All these factors, when taken together, could extend the time
needed to prepare complicated cases for Planning Commission consideration and the scheduling
General Plan Amendment 98-3

public hearings. As a result, there is a need to consider available staff resources when new
projects are assigned to the department.

The Planning Commission considered the initiation of General Plan Amendments at its last
meeting. Since that time, two relatively minor requests have come to the attention of staff. which
may be added to the October amendments. Staff will combine the requests for the consideration of
the City Council on October 26, 1998, reporting the recommendation of the Planning Commission
on these two requests prior to the meeting.
Proposed Amendments
700 Newport Center Drive: Pacific Life Insurance Company has utilized a tent on an occasional
basis over the years to provide shelter for an informal patio eating area. This area has been used
as supplemental cafeteria seating, as well as providing a location for company events such as
employee awards and training sessions. Community events, such as ''the Race for the Cure" have
also been held in the informal tent structure. The type of tent used required only a tent permit
issued by the Fire and Marine Department, and was never reviewed by the Planning Department
for issues such as whether the space was considered floor area.
Pacific Life is now interested in installing a more substantial tent structure on a semi - permanent
basis (used at least 6 months of the year) to support employee dining and events as described
above. Because the tent is an enclosed structure (see attached photo). it is considered floor area as
defined in the General Plan and Municipal Code. Since no additional floor area is allocated to
Block 700 of Newport Center, a General Plan Amendment is required to accommodate the
installation.
Santiago Drive /22nd Street: The Public Works Department has been working with the City of
Costa Mesa and the County of Orange County to resolve the issue of the appropriate arterial
roadway classification of the segment of Santiago Drive between Irvine and Tustin Avenues in
the City of Newport Beach and 22nd Street from Tustin to Santa Ana Avenues in unincorporated
County territory. Based upon traffic analysis of the current and predicted traffic volumes, it has
been determined that the existing classification of Secondary Roadway (four lanes, undivided)
should be changed to Commuter Roadway (two lanes, undivided). The Cities of Newport Beach
and Costa Mesa must agree on the proposed amendment prior to its deletion from the County's
Master Plan of Arterial Highways by the County and OCTA.

Dear lvls. Temple
The design of our corporate office building, located at 700 Newport Center Drive. allows for a
patio /plaza open air seatinia area adjacent to our employee dining room. During last years winter months
and especially the rainy ones, we contracted with a local temporary tent manufacturer and had a tent
installed for several months to allow for the outdoor dining to continue.
This year and in future years, we would !'.te to continue this. However, to help cut down on our costs
and to let us more tightly control the maintenance of the tent, we would like to purchase our own tent
and put it up and down as we like.
Thus, we are submitting this letter as a request for a one time permit to allow us to put up and take
down the tent at our convienece. We have attached a drawin, indicating all of the pertinent information
regarding surrounding areas, exiting, etc.. The tent will be used for outdoor dining as an extension to
our main dining room. The approximate square footage is 10,580 square feet. Pacific Life will have a
maximum of 300 occupants and provide a sign indicating that. These occupants would be employees
from the building. The tent will be completely self supportive and not hang from or be supported by the
existing building. Additionally, there will be exits from the tent at each of the ends to allow for proper
exiting.
We are proposing this to be a temporary tent since it will not be up all of the time. The tent would be up
at any one time anywhere from I month to a maximum of 6 months.

MEMORANDUM

SUBJECT: RECLASSIFICATION OF SANTIAGO DRIVE BETWEEN IRVINE
AND TUSTIN AVENUES
It is proposed to reclassify Santiago Drive between Irvine
Avenue and Tustin Avenue in the City of Newport Beach from a
Secondary Arterial to a Commuter Arterial. Analyses of
current and predicted traffic volumes on this roadway
segment have disclosed that a two lane Commuter Arterial has
sufficient capacity to operate at Level of Service D or
better. The reclassification will address residents'
concerns over possible future widening of the street and
will allow for the installation of traffic calming devices
in conformance with guidelines recently adopted by the
Orange County Transportation Authority (OCTA).
Modifications to the City's Circulation Element of the
General Plan must be approved by OCTA in order for the City
to remain eligible for all highway funding programs. Their
approval process is based upon agreement by adjacent
jurisdictions. Discussions with the City of Costa Mesa,
County of Orange and OCTA have already begun for this
change.
Santiago Drive continues to the west into unincorporated
county area where it is known as 22nd Street. The County
segment extends to Santa Ana Avenue. The County of Orange
has indicated that they are interested in reclassifying this
segment as well. The segment within the City of Costa Mesa
between Santa Ana Avenue and Newport Boulevard will keep its
designation as a Secondary Arterial.
